HomeMy WebLinkAbout06-03-74 1505 Hastings, Minnesota June 3, 1974 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, June 3, 1974 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Schnirring, Kramer, Fischer, Driscoll, Novak and Mayor Petersen. r I Members absent: Councilmen Collins, Hallberg and O'Connor. Minutes of the last meeting were read and approved. Councilman Driscoll introduced the following resolution and moved its adoption: BID FOR ONE SQUAD CAR 'J-t # WHEREAS: pursuant to an advertisement for bids for furnishing the City with one (1) Squad Car for the Police Department, the following bid was received complying with the advertisement. Bidder Bid Price Joe O'Brien Chevrolet-Cadillac, Inc. $5,450.00 $1,260.00 $4,190.00 Bid Price Less Trade-in Net Bid WHEREAS: One bid (1) was received from Joe O'Brien Chevrolet- Cadillac, Inc., and no other Bidders appeared, or submitted bids; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: r--- I I I I The Mayor and City Clerk are hereby authorized and directed to enter into a contract with Joe O'Brien olet-Cadillac, Inc., for the purchase of One (1) Police Squad Car, a cordi to the specifications therefore approved by the City Council a d on ile in the office of the City Clerk. The Mayor declared open the Public Hearing on the variance request for Wayne Walk, 1358 W. 18th. St. (Lot 7, Block 3, Town's View Estates) to construct a fireplace chimney, the variance being from Section 9.15, District Lot Regulations of the Zoning Ordinance dated December 7th, 1970. No one appeared in opposition to the Variance, the Mayor declared the Hearing closed. r f Moved by Councilman Schnirring, seconded by Councilman Novak to approve the Variance for the above described property. Ayes, all; Nayes, none. Moved by Councilman Fischer, seconded by Councilman Driscoll to pass the third and final reading of the Ordinance pertaining to the re- moval of overhead electrical wiring in the Downtown Parking Lot Area and the necessity of the benefited customers to convert or adopt their elect- rical facilities to accept service from the new underground facilities to be installed by Northern States Power Company. Ayes, all; Nayes, none. 1506 111 ~ AN ORDINANCE PERTAINING TO THE REMOVAL OF OVERHEAD ELECTRICAL WIRING IN THE DOWNTOWN PARKING LOT AREA AND THE NECESSITY OF THE BENEFITED CUSTOMERS TO CONVERT OR ADOPT THEIR ELECTRICAL FACILITIES TO ACCEPT SERVICE FROM THE NEW UNDERGROUND FACILITIES TO BE INSTALLED BY NORTHERN STATES POWER COMPANY THE CITY COUNCIL OF THE CITY OF HASTINGS DOES ORDAIN: Section 1. Inasmuch as a portion of Block Three (3), Original rl Town of Hastings, according to recorded plat thereof is now being deve1- ! I oped as a Parking Lot in accordance with the plan previously adopted, it ~ is hereby declared that the provision of the plan for the downtown park- ing10t requiring that the landscape be relieved of overhead wiring where feasible, be carried out, in regard to the overhead electrical facilities of Northern States Power Company (hereinafter referred to as the Company) in accordance with the provisions of this ordinance. Section 2. All overhead electrical distribution lines and other electrical lines of the Company over the alley in Block Three (3) Original Town of Hastings, shall be placed underground during the next 90 day period. The Company has full discretion as to relocation of the electrical lines underground except that the Company will inform the City of all under- grounding plans and the City must be reasonable assured that said under- grounding is coordinated with alley and parking lot development and resur- facing and that the progress is sufficient to complete the under grounding in accordance herewith. Existing overhead transmission lines existing through the present alley and the North one-half of Block Three (3), Original Town of Hastings, shall also be placed underground. Section 3. Inasmuch as such undergrounding requires a large out- lay of capital, it is reasonable that the Company receive at least partial contribution for its expenses from the benefited customers; and inasmuch as the customers must convert or adapt their electrical facilities to re- ceive the new underground service, it is necessary to require them to pro- vide, at their own expense, such new facilities before the overhead service is removed. It is hereby declared that the policy of the Company as established in its General Extension Rules - Underground, Downtown Urban Renewal, is a fair and reasonable policy and shall be observed by customers of the Company Before the Company begins construction of any sector of the underground work, the City will by letter inform the customers that, at the request of the City, the overhead electric facilities serving their build- ing will be removed; that if they desire to continue receiving electric service after that date they must execute Company Form No. 0350-15 when contacted by the Company and, at their own expense, engage an electrician to convert or adapt their electrical facilities to accept services from the underground service which will be installed. The above mentioned Company Extension Rules and Form shall be on file with the City Clerk. This ordinance will apply to amendments of said Extemsion Rules and Form when accepted for filing. The customers will provide the Company with such ease- ments as are necessary for the Company to install underground distribution facilities on their property. Section 4. Inasmuch as such underground facilities cannot be easily relocated, the City shall designate and reserve a definite area within the public ways for the installation and location of the Company's underground facilities. Once the Company facilities have been installed in such designated and reserved areas, if the City requires the Company to remove or relocate such facilities for any reason, the City shall reimburse the Company for the cost of such removal or relocation. Such reimbursement shall not exceed the entire cost incurred by Company attributable to such removal or relocation after deducting therefrom any increase in value of the new facility and any sal- vage value derived from the old facility. Ayes, all; Nayes, none. Moved by Councilman Driscoll, seconded by Councilman Fischer to approve the expenses of the Fire Chief, Clarence Latch to attend the Minnesota State Fire Conference, June 6, 7, 8, & 9, at Hibbing, Minnesota. Ayes, all; Nayes, none. ----- Moved by Councilman Driscoll, seconded by Councilman Fischer to approve a Gas Fitter's License for George Fredrickson, 1031 Zweber Lane, Hastings, Minnesota subject to the posting of a $5,000 bond. Ayes, Councilmen Schnirring, Fischer, Driscoll and Novak; Nayes, Councilman Kramer. Moved by Councilman Schnirring, seconded by Councilman Kramer to approve the partial payments to Robert Moore Construction and Husting & Engstrom Construction for work performed on the 1974 Construction Program as follows: Ayes, all; Nayes, none. Prop. #1 Husting & Engstrom Prop. #2 $11,964.21 $ 9,207.00 Moved by Councilman Kramer, seconded by Councilman Driscoll that the final Plat of Dakota Hills, Fourth Addition be referred to the Planning Commission for review and study. Ayes, all; Nayes, none. r- Several property owners on 15th. street between Westview Drive and Pleasant Drive appeared at the meeting to request that the City allow the United Telephone Company to install their telephone conduit parallel to the curb and in the bituminous roadway adjacent to the south curb of 15th. street. It has been the policy of the City Engineering Department that private Utilities be located in the Boulevard area and the roadway portion of the street be reserved for all Public Utilities. (Private Utilities; Telephone, N.S.P. and Gas; Public Utilities: Water, Sewer and Storm Sewer). Discussion followed after which Councilman Driscoll made the motion that the Telephone Company be authorized to install the conduit as per their request, the motion was duly seconded by Councilman Fischer. The following vote was re- corded. Ayes, Councilmen Schnirring, Fischer, Driscoll and Novak; Nayes, Councilman Kramer. Councilman O'Connor came in at this time. A discussion was held regarding aditional cost of the Ice Arena necessitated by the State Building Code requirements after which Council- man Novak moved, seconded by Councilman Driscoll to approve the following additional charges. (1) Separate front part of arena from remainder of building with a one-hour, non-combustible fire separation; $7,281.00 (2) Remove silty sand and clay, replace with sand fill; $14,708.00 (3) Change size of water main from Highway 316 to the building from a 4" dia- meter to a 6" diameter; $925.00 (4) Revise mechanical system to accom- plish one-hour fire separation; $1,470.00 (5) Provide and install one com- plete Heat Mat system, $8,818.00, total cost $33,202.00. and authorize the Mayor to approve the change orders accordingly. Ayes, Councilmen O'Connor, Driscoll and Novak; Nayes, Councilmen Schnirring, Kramer and Fischer. It being a tie vote, Mayor Petersen cast an affirmative vote, motion carried. ~ Moved by Councilman Kramer, seconded by Councilman Driscoll that the employees of the City be required to wear the safety equipment pro- vided for them by the City and as required by OSHA according to the Depart- ment Head's instructions. Ayes, all; Nayes, none. Mayor Petersen stated that Mr. Joseph Novak has asked that he be removed from the Police Civil Service Commission and that the Council approve the appointment of Mr. Edward Thiel to replace Mr. Novak. Moved by Councilman Driscoll, seconded by Councilman Novak that the appointment of Mr. Thiel be approved. Ayes, Councilmen O'Connor, Fischer, Driscoll and Novak; Nayes, Councilmen Sch~irring and Kramer. Motion carried. 1508 Moved by Councilman Kramer, seconded by Councilman Schnirring that the request of Kid Duds to manufacture children's sleepwear at the Gegen property, 1512 Vermillion Street be denied, the Council accepted the Planning Commission's recommendation that approval of this request would require "spot zoning" which they deemed detrimental to the intent of the Zoning Ordinance. Ayes, all; Nayes, none. Moved by Councilman Kramer, seconded by Councilman Fischer to deny the request of Audley Zeeveld & Gene Gove to rezone the land at 1st and Vermillion streets (Hastings Automative Shop) from C-3 to 1-2, on the basis that it would require "spot zoning". Moved by Councilman Fischer, seconded by Councilman Schnirring to accept the Committee's report as it relates to Mr Dexter Marston and to authorize his employment as of July 1, 1974 at a salary of $14,000 per annum. Ayes, all ; Nayes, none. Moved by Councilman Driscoll, seconded by Councilman Novak to approve the salary of Mrs. Phila Matsch at $600.00 per month, retroactive to January 1, 1974. Ayes, Councilman Schnirring, Kramer, Fischer, Driscoll and Novak; Nayes, Councilman O'Connor. o Moved by Councilman Driscoll, seconded by Councilman Schnirring that the City Clerk be authorized and directed to advertise for bids for Tank Wagon delivery of Regular gasoline and Station Pump delivery of regular and premium gasoline for the City of Hastings. Bids to be opened at 8:00 o'clock P.m. July 1, 1974 Council meeting and awarded at the Council meeting on July 1, 1974. Ayes, all; Nayes, none.
