HomeMy WebLinkAbout05-06-74 1474 Hastings, Minnesota May 6, 1974 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, May 6, 1974 at 8:00 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Collins, Schnirring, Kramer, Hallberg, O'Connor, Fischer, Driscoll, Novak and Mayor Petersen. Members absent: None. Mr. Bruce Peterson from the Rauenhorst Corporation presented the City Council with plans for the establishment of a Shopping Center on the south side of Highway #55 by Westview Drive. Moved by Council- man Novak, seconded by Councilman Fischer that this Project plan be referred to the Planning Commission. Ayes, all; Nayes, none. Moved by Councilman Novak, seconded by Councilman Driscoll to pass the second reading of the proposed amendment to Section 10.05 of the Zoning Ordinance and in particular the subdivision 6 thereof. Ayes, all; Nayes, none. Subdivision 6, Fences and Walls or Hedges. ~ a) Allowed, but shall not obstruct view. Notwithstanding other provisions of this Chapter, fences, walls and hedges are permitted in any yard, including a required yard, or along the edge of any yard, provided that no fence, wall or hedge along the side or front edge of any front yard shall be over thirty in- ches in height where the fence, wall, or hedge would obstruct the view from a driveway. or street. b) Hazardous fences and walls. Hazardous fences and walls such as barbed wire, electric fences, chain link with barbs exposed, and walls with protruding sharp edges thereof, and other fences and walls designed for, or likely to cause harm to persons are declared hazardous and are prohibited in the city, except as follows: conventional barbed wire fences with barbs exposed are allowed with permission of the City Council by simple resolution in commercially zoned areas, and are allowed without permission of the City Council in Industrial and Agriculturally zoned areas. Every person violates this ordinance when he performs an act thereby probibited or declared unlawful, and upon conviction thereof, shall be punished as for a misdeameanor. Moved by Councilman Novak, seconded by Councilman Collins that the Adjutant General's office be notified that the City of Hastings is not interested in purchasing the old Armory. Ayes, Councilmen Collins, Hallberg, O'Connor, Fischer, Driscoll and Novak; Nayes, Councilmen Schnirring and Kramer. Moved by Councilman EXamer, seconded by Councilman Novak that the Engineer do a feasibility study on samitary sewer and water extensions to serve the Westerly part of Lot 1, Block 4, Vermillion Addition. Ayes, all; Nayes, none. 1475 The Engineer informed the Council that there were several vacant lots abutting on streets in the 1974 construction program that do not currently have water and sewer service stubbed to the property line. The Engineer requested that these Utility services be entended, prior to sur- facing and the costs be charged to the property owners. Moved by Council- man Driscoll that the request of the Engineer be approved. Motion failed for lack of a second. Upon failure of the Motion the Engineer was directed to contact the property owners involved and notify them that this item will be discussed at the next Council meeting and acted thereon. The Engineer brought up the problem of water services that need to be replaced on 6th. street. Moved by Councilman Driscoll, seconded by Councilman Collins that the Engineer approach each property owner to make him aware of this water service and give him the opportunity of having it replaced at his expense so as not to incur street replacement cost in the future. Motion failed for lack of a second. Moved by Councilman Novak, seconded by Councilman Collins to approve the transfer of the On-Sale and Off-Sale Liquor License for the "Viking Bar" at 117 East Second Street, Hastings, Minnesota from Richard D. Hoffman to William House. Ayes, Councilmen Collins, Hallberg, O'Connor, Fischer, Driscoll and Novak. Nayes, Councilmen Schnirring and Kramer. Moved by Councilman O'Connor, seconded by Councilman Hallberg to approve the appointment of Joseph Novak to the eoiice Civil Service Commission for the balance of the unexpired term of Theodore Riches. Ayes, all; Nayes, none. Moved by Councilman Hallberg, seconded by Councilman Fischer that the request received from "Kid Dndz" of Cannon Falls, Minnesota to manufacture children's clothing in the building located at 1512 Vermillion Street be referred to the Planning Commission. Ayes, all; Nayes, none. The City Council received a letter from Mr. Kenneth laCroix, Superintendent of School District #200, requesting that consideration be given to making Prairie and River Streets one way roads from Highway t55 to Second Street for the safety of the school children attending Tilden School. Moved by Councilman Schnirring, seconded by Councilman Driscoll that the letter be r-l. I referred to the Planning Commission. Ayes, all; Nayes, none. L~ Moved by Councilman Fischer, seconded by Councilman Hallberg to refer to the Planning Commission the request from H. M. Jammes for a variance to the Si~n Ordinance with regard to the installation of a sign at the Hastings weel & Alignment Shop, 116 W. 15th. Street. Ayes, all; Nayes, none. Moved by Councilman Schnirring, seconded by Councilman Hallberg to approve a $25.00 monthly salary increase to Arnold Endres, Water Department Superintendent, for passing the written examination for Water Supply Systems Operator, Class C. Effective date May 1, 1974. Ayes, all; Nayes, none. 1476 Moved by Councilman Driscoll, seconded by Councilman Hallberg to hire Thomas P. Simmons to perform administrative functions, receiving there- fore $3.50 per hour. The number of hours to be directed by the Mayor. Ayes, Councilmen Collins, Schnirring, Kramer, Hallberg, O'Connor, Fischer and Driscoll; Nayes, Councilman Novak. Moved by Councilman Driscoll, seconded by Councilman O'Connor to authorize Mrs. Phila Matsch to cosign all City checks during the absence of Wallace H. Erickson, the Administrator/Clerk. Ayes, all; Nayes, none. ,-- Moved by Councilman Hallberg, seconded by Councilman Driscoll that a Public Hearing be held on Monday, June 3, 1974 at 8:00 o'clock P.M. in the City Council Chambers and. that the following notice be published, mailed and posted as required by the City Zoning Ordinance. NOTICE OF PUBLIC HEARING Notice is hereby given that the City Council of the City of Hastings will meet in a Public Hearing in the Council Chambers of the City Hall on Monday, June 3rd, 1974 at 8:00 o'clock P.M. to consider the following variance request from the City Zoning Ordinance. Variance from Section 9.15 District Lot Regulations. Variance request for Wayne Walk, 1358 W. 18th St. (Lot 7 Blk 3 Town's View Estates) to construct a fireplace chimney. Motion withdrawn. Moved by Councilman Fischer, seconded by Councilman Driscoll to approve the Parade permit request from the March of Dimes Chairman, for the "Walk-A-Thon" Saturday, May 18, 1974. Parade from Kennedy School East on Highway $55 to the City Limits. Ayes, all; Nayes, none. Moved by Councilman Kramer, seconded by Councilman Hallberg to authorize the sale of 2.115 acres of Industrial Park land at $10,000 per acre to Hastings Industrial Development Corporation. The Mayor and City Clerk to execute the necessary documents. Ayes, all; Nayes, none. Moved by Councilman Collins, seconded by Councilman Novak to approve the Change Order to Rumpza Builders, Inc. directing them to replace 30 day strip chart recording free chlorine residual with an Acco-Bristol 24 hour, 12 inch diameter circular chart recorder with low and high alarm for free chlorine residual, at the additional charge of $764.50 to be added to the original contract of $11,261 for a total of $12,025.50. Ayes, Councilmen Collins, Schnirring, Hallberg, O'Connor, Fischer, Driscoll and Novak; Nayes, Councilman Kramer. -- r Moved by Councilman Hallberg, seconded by Councilman Driscoll to authorize the employment of Wold Associates, Inc. and its Consultant, Kirkham Michael and Associates to prepare an airport Master Plan, subject to the approval of the Minnesota Department of Aeronautics and the Federal Aviation Administration, and subject to the Federal and State governments, participating to the extent of 90% of the cost of the plan. Ayes, Councilmen Collins, Schnirring, Hallberg, O'Connor, Driscoll and Novak; Nayes, Councilmen Kramer and Fischer. 1477 Moved by Councilman O'Connor, seconded by Councilman Kramer to pass the first reading of: An Ordinance pertaining to the removal of overhead electrical wiring in the Downtown Parking Lot Area and the necessity of the benefitted customers to convert or adapt their electrical facilities to accept service from underground facilities to be installed by Northern States Power Co. which Ordinance was reviewed and placed on file. Upon being put 1 to a vote the following vote was recorded. Ayes, all; Nayes, none. ~- Moved by Councilman Driscoll, seconded by Councilman Hallberg to: Organize a Bicentennial Planning Committee consisting of the following persons: Michael O'Connor Bert Lund Mrs. Pat Schultz Mrs. Peg Brevik Robert Karow Miss Debbie Peters Mrs. Florence Petersen said Committee to plan, coordinate and carry out an American Bicentennial program for the City of Hastings, to apply for designation of Hastings as a Bicentennial Community, and to accomplish such other steps as may be necessary to involve the City of Hastings in the Bicentennial Celebration pursuant to the program of the Minnesota American Revolution Bicentennial Commission. Motion carried by the following vote: Ayes, all. Moved by Councilman Novak, seconded by Councilman Collins that the bills as audited be approved and the City Clerk be instructed to issue warrants for the same.
