Members present: r- , I I I Members absent: Councilmen Collins, Kramer, Hallberg, O'Connor, Fischer, Driscoll, Novak and Mayor Petersen. Minutes of the last meeting were read and approved. Councilman Schnirring. The first item on the Agenda was the awarding of the Bids on the Ice Arena. After a lengthy discussion Councilman Novak moved, seconded by Councilman Collins to limit the debate on the Ice Arena,Motion lost by the following vote: Ayes, Councilmen Collins, Driscoll and Novak; Nayes, Councilmen Kramer, Hallberg, O'Connor and Fischer. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed. All persons present were given an opportunity to be heard. There was no one who appeared and spoke in opposition to the proposed vacation. The Clerk reported that XNotice of the Public Hearing on the porposed vacation had been duly advertised and mailed as required by law. The Mayor declared closed the public hearing on the vacation when there was no one wishing to be further heard on the matter. 1458 Whereupon, Councilman Kramer offered, and Councilman O'Connor seconded the following resolution: Ayes, Councilmen Kramer, Hallberg, Novak, O'Connor, Fischer, and Driscoll; Nayes, Councilman Collins. ! RESOLUTION VACATING PORTION OF PUBLIC ALLEY A\b Re: The North 4 feet of the public alley in Block 3, 01'iginal Town of Hastings lying adjacent to and immediately South of the Westerly 44 feet of Lot 2, and all of Lots 3 and 4 in said Block 3, Original Town of Hastings. WHEREAS, all of the owners of the property abutting the afore- described alley have heretofore filed with the City Council of the City of Hastings, a verified petition requesting the vacation of the described portion of said alley; and r---\ I I \~ . ! \:__.1 WHEREAS, by Order of the City Council, a notice of a public hearing on said vacation was duly advertised by a notice in the Hastings Gazette, and duly mailed to adjacent property owners, all as required by law; and WHEREAS, a hearing was held on said vacation at a regular meeting of the Hastings City Council April 15, 1974; and WHEREAS, all persons present were given an opportunity to be heard on the question of said vacation, and no one appeared in opposition thereto; and WHEREAS, said petition was duly received and found to be in proper order, and was found to be signed by all abutting property owners; and WHEREAS, the requirements of the City Charter, City Ordinances, and State Statutes are found to have been complied with; and WHEREAS, it is in the best said described portion of said alley NOW, THEREFORE, IT IS HEREBY the City of Hastings that ORDERED : n !. Erickson City Clerk The next item on the agenda was the matter of the Downtown Parking Lot. After a discussion, the following motion was made by Councilman O'Connor, seconded by Councilman Kramer Moved that the City Clerk be authorized and instructed to purchase from the "On-the-Main Development Company", Lots 3 and 4, and the west 44 ft. of the South 90 feet, and the West 41 feet of the North 50 feet of Lot 2, all in Block 3, Original Town of Hastings, paying therefor the sum of $50,000, said funds to be derived from bond sales incident to the Downtown Parking Lot Project. Further, the Mayor and Clerk are authorized to execute appropriate documents to carry out this motion in form as approved by the City Attorney. Upon being put to a vote, the vote was recorded as follows; Ayes, Councilmen Kramer, Hallberg, O'Connor, Fischer, Driscoll and Novak; Nayes, Councilman Collins. n ! , LJ The next item for discussion was the irregular boundary line on the Easterly side of the property to be purchased for Downtown Parking Lot pur- poses from the "On-the-Main Development Corporation". It was reported that there was a three-foot offset between this property and the property immediately to the East. 1458 Whereupon, the motion was duly made by Councilman O'Connor, and seconded by Councilman Fischer, that the City Clerk be authorized to attempt to negotiate with the adjacent property owners immediately to the East of the Downtown Parking Lot Property, a land trade or other similar transaction, so that the East line of the Downtown Parking Lot will be straight. Upon being put to a vote, the foregoing motion received the following vote: Ayes, Councilmen Kramer, Hallberg, O'Connor, Fischer, Driscoll and Novak; Nayes, Councilman Collins. r- I The next item on the Agenda was the awarding of the Bid for an air- conditioning unit for the Council Chambers in City Hall. The City Clerk presented two informal bids as follows: Swanson Plumbing and Heating, Inc. propose to furnish and install in a worklike manner the following: 1 Bryant 5-ton compressor installed on roof 1 "A" coil installed in heating plenum on existing heating plant. Existing duct work to be used for cooling. Installation as per plans laid out jointly by O'Connor-Kranz and Swanson Plumbing & Heating. Wiring by others. Local fees by others. TOTAL SUM OF $4,500.00 O'Connor-Kranz., Inc. propose the following addition and changes in the Council Room cooling. I 1 Lennox 5-ton compressor unit, using present ductwork and supply registers. Change present round diffusers to larger size 14" square diffusers, Replace present 7" round supplies to round diffusers with new fiberglass trunk duct. Install new thermostat. Install a new condensate drain line to the present two air-conditioners as well as the new unit. Clean up and check over present air-conditioners. We submit the following price of $4,100.00 for the additions and changes. This does not include the electrical wiring which would be about $300.00. We also have a used Lennox five ton condensating unit which is in good condition and is about ten years old. If you would want this in place of a new unit deduct $400.00 from the above price. If a Lennox "Power Saver" system is added (which will save electri- cal energy) add $498.00 to price. TOTAL BID PRICE - new unit, electrical wiring & Power Saver System - $4,898.00 r: I I The two proposals were discussed after which Councilman Novak moved, seconded by Councilman Driscoll that the informal bid submitted by O'Connor-Kranz., Inc. for a new Lennox 5-ton unit (price $4,100.00) also to include the electrical wiring ($300.00), and the Power Saver System ($498.00) which was added to the informal bid, be approved and the Bid be awarded to O'Connor-Kranz" Inc. Ayes, Councilmen Collins, Kramer, Hallberg, Fischer, Driscoll and Novak; Nayes, Councilman O'Connor. Motion carried. Moved by Councilman Novak, seconded by Councilman Collins that Albert Herrmann having completed a satisfactory six month probationary period with the City of Hastings Water and Sewer Department be given a regular employee statis with a monthly salary of $868.00 effective April 1, 1974. Ayes, all; Nayes, none. Moved by Councilman Driscoll, seconded by Councilman Fischer that Marjorie Kelley having completed a satisfactory six month probationary period as Water Clerk for the City of Hastings, be given a regular employee statis with a m~nthly salary of $495.00 effective April 15, 1974. Moved by Councilman Hallberg, seconded by Councilman O'Connor that the Airport Study Committee appointed by the Mayor negotiate a contract be- tween the City of Hastings and the consultant team of Kirkham-Michael and Wold to apply for federal and state grants and perform the study resulting in an Airport Master Plan for the Hastings Area. The proposed contract, after review by the City Attorney as to form, shall be submitted to the City Council for approval. Ayes, Councilmen Collins, Hallberg, O'Connor and Driscoll; Nayes, Councilmen Kramer, Fischer and Novak. Moved by Councilman Kramer seconded by Councilman Driscoll that Northern States Power Company be authorized to install one (1) 175 Watt Mercury Vapor street light at Westview Drive and Pleasant Drive. Moved by Councilman Hallberg, seconded by Councilman Driscoll to approve a contract with the Chicago, Milwaukee Railroad Company, for con- struction of an entrance track to the Industrial Park, a copy of which contract is on file in the City Clerk's office. Ayes, all; Nayes, none. il I . ~/ Moved by Councilman Hallberg, seconded by Councilman Fischer that the building inspector fees for the Chlorine Room Addition to the Swimming Pool be waived and the building inspector fees, sewer charge fees and sidewalk fees be waived for the construction of the Ice Arena. Moved by Councilman Kramer, seconded by Councilman Driscoll that the Mayor, who is the authorized representative, approach the Dakota County Board of Commissioners on the disposition of the old County Courthouse, to gather enough preliminary data so that the City Council of the City of Hastings have enough on-hand information in case they are called upon to make a decision on this matter in the near future. Mr. Wallace Swanson, Cha:t~n of the l'ublic Library Board appeared before the Council and presented a landscape plan for the Hastings Public Library with construction cost estimates received and approved by the Library Board at their April 4, 1974 meeting. Said Parade to be held July 14, 1974. Ayes, all; Nayes, none. Moved by Councilman Kramer, seconded by Councilman O'Connor that the Council authorize the placing of a B~cycle Rack, streetside, next to the Curb in front of 106 E. Ayes, all; Nayes none. THE CITY OF HASTINGS DOES ORDAIN: as follows; Subdivision 6, Fences and Walls or Hedges. ~ a) Allowed, but shall not obstruct view. Notwithstanding other provisions of this Chapter, fences, walls and hedges are permitted in any yard, i~cluding a required yard, or along the edge of any yard; provided that no fence, wall or hedge along the side or front edge of any front yard shall be over thirty in- ches in height where the fence, wall, or hedge would obstruct the view from a driveway or street. r-- b) Hazardous fences and walls. Hazardous fences and walls such as barbed wire, electric fences, chain link with barbs exposed, and walls with protruding sharp edges thereof, and other fences and walls designed for, or likely to ca~se harm to persons are declared hazardous and are prohibited in the city, except as follows: conventional barbed wire fences with barbs exposed are allowed with permission of the City Council by simple resolution in commercially zoned areas, and are allowed without permission of the City Council in Industrial and Agriculturally zoned areas. Every person violates this ordinance when he performs an act thereby prohibited or declared unlawful, and upon conviction thereof, shall be punished as for a misdeameanor. NOTICE OF PUBLIC HEARING -- Notice is hereby given that the City Council of the City of Hastings, Minnesota will meet in a Public Hearing on Monday, May 20, 1974 at 8:00 o'clock P.M. in the Council Chambers of the City Hall to consider the following proposed amendment to Section 10.05 of the City Zoning Ordin- ance and in particular the Subdivision 6 thereof. Erickson City Clerk Councilman Hallberg introduced the following resolution and moved its adoption: MINNESOTA HIGHWAY SAFETY PROGRAM 'xY \~ u PROJECT FOR CORRECTING REGULATORY AND WARNING SIGN DEFICIENCIES ROADWAY SIGNING AGREEMENT TO PARTICIPATE (Revised March 1, 1974) WHEREAS, under the Federal Highway Safety Act of 1966, one of the objectives set forth by the Department of Transportation is the conformance of all traffic control devices to the National Manual on Uniform Traffic Control Devices for Street and Highways (MUTCD); and WHEREAS, funds are available through the Federal Highway Administration for the replacement of non-standard devices; and WHEREAS CITY OF HASTINGS (County or Municipality Name) is desirous of bringing the traffic control devices on streets and roads under its jurisdiction into conformance with National Standards; NOW, THEREFORE, (1) It is hereby agreed that the City of Hastings will comply with the conditions set forth in the Project Description and will remove, re- place, or install all regulatory and warning signs necessary to comply I~ with National standards (MUTCD) as determined through an inventory of in- . place signs and a survey of needed additional signs. Such removal, re- L_j placement, or installation to be done by the City on all streets and roads under its jurisdiction and completed by January 1, 1977. (2) The State of Minnesota, Department of Highways, will review the work done and certify to the Federal Highway Administration satisfactory com- pletion for reimbursement from available Federal Highway Safety Funds for 90% of the actual project cost of such work in accordance with conditions set forth in the Project Description and the estimate of costs. Ten per- cent (10%) of the project cost shall be paid by the City. Reimbursement is applicable only to the work done on the non-Federal Aid portion of the streetf'and road system by June 30, 1976. The amounts for reimbursement of materials shall be limited to costs of standard materials commonly used by the Minnesota Highway Department. (3) The City agrees to maintain all such sign installations in satisfac- tory condition. AN ORDINANCE REGULATING THE USE OF MOTOR Jf1 VEHICLES ON PUBLIC PROPERTY, EXCEPT STREETS: SEMI-PUBLIC PROPERTY, AND PRIVATE PROPERTY IN THE CITY OF HASTINGS THE CITY COUNCIL OF THE CITY OF HASTINGS DOES ORDAIN: .,--- Section 7.65. Regulation of Motor Vehicles on Public, Semi-Public and private property. Subdivision 1. Definitions. The following terms shall have the indicated meanings when used in this ordinance. A. Motor Vehicles. Self-propelled motorized vehicles, whether or not licensed by the State of Minnesota, including automobiles, trucks, motorcycles, motor scooters, mini bikes, dune buggies, trail bikes, go- carts and all terrain vehicles (but specifically excluding snowmobiles as defined and regulated by City Code). B. Public Property: Property owned by a governmental body that may be used by the public, subject to reasonable regulations by the government body, in- cluding: public parks; county, city and school parks, grounds, yards and parking lots, but ex- cluding state, city and county streets and roads. C. Semi-Public Property: privately owned property, generally open for use by the public, including commercial and institutional parking lots and other property generally used by patrons of a commercial business or institution. r- ,.i, D. Private Property: Property, whether owned by government unit or private person or corporations, not open for use by the public, including but not limited to yards of residences, apartment buildings, industrial and commercial locations, railroads, ceme- teries, and golf courses. E. Parking Lots: Areas designated for parking of motor vehicles and access and entrance roads used in con- nection with said parking lots. Subdivision 2. It is hereby declared unlawful for any person to operate a motor vehicle: a. On private property of one other than the owner, and on semi-public property (except parking lots), without express permission of owner. b. On public property (excluding parking lots) unless area is expressly posted to allow said use by govern- mental unit having control of area in which case operation thereon shall comply with all posted re- strictions and regulations. ,.--. , I c. On parking lots and (when authority is granted as above provided) on public property, semi-public property and private property (i) (ii) (iii) contrary to posted instructions and directions. at unsafe or unreasonable speeds. in a careless, reckless or negligent manner so as to endanger life or property. while under the influence of an alcoholic beverage or narcotic drug or combination thereof. (iv) 1464 d. (v) so as to create or cause unnecessary engine noises or tire squeal or so as to cause the tires to spin or slide upon the acceleration or stopping of said vehicle or so as to cause the motor vehicle to turn abruptly or swerve from side to side or so as to create a sub- stantial likelihood of damage to person or property. On any public, semi-public or private property (except parking lots) during the hours from 10:00 P.M. to 8:00 A.M. except that a property owner or persons specifi- cally authorized by him may operate between these hours but said operation shall comply with the prohibition set forth in Subdivision 2 (c) Subdivision 3. Equipment. It is unlawful to operate a motor vehicle on public, private or semi-public property, including parking lots, unless equipped as follows: a. With standard mufflers which are properly attached and which reduce the noise of operation of the motor vehicle to the minimum necessary for operation. No muffler cutouts, by-passes, straight pipes or similar devices shall be allowed. b. Without brakes adequate to control the movement of and to stop and hold the vehicle. c. Without a "deadman" throttle which when pressure is re- moved will cause the motor to be disengaged from the drive system if such a throttle was part of the original equip- ment on the vehicle. d. When operated at night, without at least one clear lamp attached to the front, with sufficient intensity to re- veal persons and vehicles at a distance of at least 100 feet ahead during the hours of darkness under normal at- mospheric conditions. Said headlamps shall be so aimed that glaring rays are not projected into the eyes of an incoming vehicle operator. It shall also be equipped with at least one red tail lamp, having a minimum candle power of sufficient intensity to exhibit a red light plainly visible from a distance 500 feet to the rear during the hours of darkness under normal atmospheric conditions. This equipment shall be required and shall be in operating condition when the vehicle is operated during the hours of one-half hour after sunset to one-half hour before sunrise or at times of reduced visibility. Subdivision 4. It is unlawful to chase, drive after, run over, kill or injure any animal with a motor vehicle. Subdivision 5. Vehicles not licensed under the laws of the State of Minnesota may not be operated on parking lots, whether publicly owned or semi-private property unless specifically authorized by the owner thereof. Subdivision 6. Helmets required. Persons operating motor vehicles the operation of which requires the operator to wear a helmet under regu- lations of the State of Minnesota and in particular the Public Safety Depart- ment thereof shall, when operated in the City of Hastings, be operated by a person wearing an approved helmet. r-~ ~- ------- lJ o Subdivision 7. Passengers may not be carried in or upon the vehicle if under the laws of the State of Minnesota, passengers are not allowed when such vehicle is operated on the public roads. When passengers are under State Law allowed on or in the vehicle, said passengers shall be governed by State Law applicable to passengers on vehicles of that type when operated on public right of way. Subdivision 8. Penalty. It is a misdeanor to violate any pro- vision of this ordinance and any person violating the terms of this ordinance shall, upon conviction thereof, be fined a sum not to exceed $300 or shall be imprisoned for a period of not to exceed ninety (90) days, or both.
