November 5, 1973
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, November 5, 1973 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present:
Councilmen Collins, Schnirring, Hallberg,
Fischer, Kramer, Driscoll, Novak and Mayor
Petersen.

Minutes of the last meeting were read and approved.
Councilman Hallberg introduced the following resolution and
moved its adoption:
BIDS ON COLD STORAGE BLDG. IN PUBLIC WORK GARAGE AREA
WHEREAS, pursuant to an advertisement for bids for furnishing
the City with a Cold Storage Building at the Public Works Garage Area, the
following bids were received complying with the advertisement:

WHEREAS, the low bidder did not propose structure as directly
stated in the specifications and

WHEREAS, Graus Construction is the lowest responsible bidder,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
1. The Mayor and City Clerk are hereby authorized and directed
to enter into a contract with Graus Construction for the construction of a
Cold Storage Building according to the specifications therefore approved by
the City Council and on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits ma w their bids, after a contract
has been signed.

Councilman Schnirring seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, Councilmen Collins,
Schnirring, Hallberg, Fischer and Driscoll; Nayes, Councilmen Kramer and
Novak.

Moved by Councilman Driscoll, seconded by Councilman Fischer to
pass the third reading on the Central Natural Gas Ordinance. Motion carried
by the following vote: Ayes, all; Nayes, none.
Section 12.80 GAS RATES hereto adopted by the City Council, is
hereby amended to read as follows:
The City Council of the City of Hastings, Minnesota does ordain:

SUBD. 1. Retail Natural Gas Firm Rates Schedule for Residential, Commercial
and Small Volume Industrial Consumers;

SUBD. 2. COST OF GAS ADJUSTMENT. Whenever there is a change in the cost
of gas purchased by the Company, the above rates will be in-
creased or decreased by the amount by which the annual town
border cost per MCF shall be changed. Provided however, that
Central Natural Gas Company will give written notice to the
Council of its intention to adjust rates by increasing same
under the foregoing provision at least thirty (30) days before
said rates are adjusted.

Moved by Councilman Driscoll, seconded by Councilman Hallberg that
Robert Moore Construction be granted an extention of time for completion of
the work on the 1973 Construction Program, Commission #6005. The period of
field inspection of the work to be extended to November 16, 1973. Following
this date, the cost of field inspection of all construction and cleanup
operations shall be charged as liquidated damages as provided for in Article
9, Liquidated Damages, on page 2-13 of the Special Provisions. Ayes,
Collins, Schnirring, Hallberg, Fischer, Driscoll and Novak; Nayes Councilman
Kramer.
The acting Engineer, Mr. Winters, next addressed the Council with
reference to proposed construction work to be accomplished in 1974 on
Eddy Street between 15th and 17th Street and also proposed construction
work on the short street between Highway 61 and Eddy Street adjacent to [J
Coun~y Road 47. Mr. Winters stated that the status of the legal descrip-
tions existing in the area is very confused and unclear due to the fact that
the property is not platted and is described by meets and bounds description.
Further that for determining proposed areas to be assessed, etc, it would
be advisable and in fact necessary to ascertain the exact legal descriptions
of the various properties in the area. He suggested that the City Council
authorize the City Attorney to undertake such a study and to expend City
funds for obtaining necessary stub abstracts and other necessary documenta-
tion.
Whereupon Councilman Hallberg moved and Councilman Driscoll
seconded the following Motion:
That the City Attorney be and is hereby authorized and instructed
to conduct a title search of the properties along Eddy Street between 15th
and 17th Streets and other adjacent areas in the proposed assessment district
for improvement of said Eddy Street surfacing and storm sewer. Further that
such a title search be conducted with reference to proposed benefitted areas
for improvement of the street existing between Highway 61 and Eddy Street
adjacent to County Road 47. That said authorization includes the right to
acquire stub abstracts on properties involved and to provide said data to
the engineer's office.
The above Motion upon being put to a vote was unanimously adopted.
Moved by Councilman Hallberg, seconded by Councilman Driscoll that 0
the next regular meeting of the City Council, November 19th, be set for L 1
7:00 P.M. Ayes, all; Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman Driscoll
that Hiram Kilborn, Lee Erickson and Mavis Nelson be re-appointed to the
Natural Resources Commission for a period of three years. Ayes, all; Nayes,
none.
Moved by Councilman Novak, seconded by Councilman Driscoll that
Barbara Thompson be hired as a Bookkeeper in the City Clerk's office at the
salary of $545.00 per month effective November 1, 1973. Ayes, all; Nayes,
none.

Moved by Councilman Novak, seconded by Councilman Driscoll to refer
to the Safety Committee the Ordinance on "Regulating Snowmobiles" for amend-
ments, to include "All Terrain Vehicles", also that a copy of the proposed
Ordinance be given to all Council members. Ayes, all; Nayes, none.
Moved by Councilman Driscoll, seconded by Councilman Collins that
the City Clerk be authorized to advertise for bids for a Dump Truck and
Steel Roller for the Street Department and a Station Wagon for the Engineer
Department. Bids to be opened on Friday, November 16, 1973 at 2:00 o'clock
P.M. and to be awarded on Monday, November 19, 1973 at 7:00 o'clock P.M.
Moved by Councilman Kramer, seconded by Councilman Novak that the
Station Wagon for the Engineer Department be deleted in the advertisement for
bids. Ayes, Councilmen Collins, Schnirring, Kramer, Fischer and Novak;
Nayes, Councilmen Hallberg and Driscoll.
The roll was then called on the main motion, deleting the Station
Wagon. Ayes, all; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman Kramer that
a Public Hearing be held on Monday, November 19, 1973 at 7:00 o'clock P.M.
in the Council Chambers of the City Hall and that the following notice be
published, mailed and posted as required by the City Zoning Ordinance.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the City Council of the City of
Hastings, Minnesota will meet in a Public Hearing on Monday, November 19,1973
at 7:00 o'clock P.M. in the Council Chambers of the City Hall to consider
the following variance request from the City Zoning Ordinance.

The next item for consideration was the request by AI Enstad for
a sanitary sewer study and design preparation incident to the proposed con-
struction of a commercial building on the north frontage road adjacent to the
day care center. It was stated that Mr. Enstad and others do anticipate con-
structing such a building and would like to have plans prepared which would
allow connection of said building with the sanitary sewer system.
Upon motion made by Councilman Kramer, seconded by Councilman
Fischer, the following was adopted:
I
That the City Engineer's Department be and hereby
are authorized and instructed to conduct an in-
vestigation of the sanitary sewer work that will
be required to connect a commercial building and
the subject property to the City system. Further
that plans and specifications for construction of
said facilities be prepared by the City Engineer's
office, but that the foregoing be accomplished only
after the applicant has agreed to bear the cost
therefor.
The motion was unanimously adopted.

The Clerk next stated that an application had been received for a
Sauna License under 5.70 of the City Code. It was noted that said City Code
provision prohibits the issuance of a license under certain conditions.
Councilman Novak moved and Councilman Fischer seconded the
following motion:
That the Chief of Police and City Attorney determine
whether the applicant meets the requirements of Section
5.70 of the City Code.
The motion was unanimously adopted.

The next item for consideration was the proposed acquisition of the
Charles Most property, which is located between the present terminus of the
Milwaukee Road - spur line and the Industrial Park. It was stated that the
acquisition of said property for extension of the railroad line into the
Industrial Park was necessary. The City Attorney reported that the owners
had agreed to sell the property to the City of Hastings for a cash price of
$15,000.00. It was reported that the property had been appraised. It was
further reported that the Mayor's Advisory Committee on the Industrial Park
had unanimously recommended acquisition of the property for the $15,000.00
price.
Whereupon Motion was made by Councilman Hallberg, seconded by
Councilman Kramer as follows:
That the City of Hastings acquire the following real estate located
in the City of Hastings, Dakota County, Minnesota:
Part of the SE~ of NW~ of Section 34, Township 115 North, Range 17
West described as follows:
Beginning at a point 171 feet Easterly of the intersection of the
institutional coal spur and the Chicago Milwaukee St. Paul and
Pacific Railroad spur track; thence Easterly on the South rail
of the coal spur 400 feet; Thence North 0 degrees 57 minutes 10
seconds East 342.23 feet; to the intersection with the CMstP and P Railroad
spur track; thence Southwesterly along the CMstP and P Railroad
spur track 521 feet to the point of beginning, containing
approximately 1.5 acres more or less, according to the
Government Survey thereof.

And pay therefore the sum of $15,000.00 from Industrial Park funds. The
exact terms and conditions of said closing are to be as approved by the
Mayor and the City Clerk upon advice of the City Attorney.
Upon being put to a vote, the foregoing was unanimously adopted.
Reports were received from the Fire Marshall and the Building
Inspector on the condition of the property owned by Mr. Robert Schmitz and
wife at 520 West Second Street, Hastings, Minnesota. The City Attorney
stated that he had also viewed the property during the last week, accompanied
by the owner, Mr. Schmitz. A discussion took place with reference to the
property. Photographs taken by the building officials were received and re-
viewed. Each of the councilmen stated that they considered the property
uninhabitable, dilapidated, a fire hazard and a hazard to public safety and
health.
Whereupon Councilman Hallberg moved adoption of the following
order which motion was seconded by Councilman Schnirring.
ORDER FOR REMOVAL OR REPAIR

IN THE MATTER OF THE HAZARDOUS BUILDING LOCATED
AT 5Z0 WEST SECOND STREET, HASTINGS, MINNESOTA
To: Robert J. Schmitz and Elizabeth Schmitz

Pursuant to Chapter 393 of the Laws of 1965, the City Council of the
City of Hastings having duly considered the matter, finds the above described
building to be a hazardous building for the following reasons:
The Council of the City of Hastings after receipt of numerous
complaints, ordered an inspection thereof to be made of the
above described property, said report being submitted on the
5th day of November, 1973 by the Building Inspector and the
Fire Marshall of the City. Said Report stated, and photographs
exhibited, showed that said building is generally dilapidated
and in an extreme state of disrepair. That it is of a generally
unsightly appearance. That it violates numerous provisions of
the building code, fire code, and other codes adopted by
reference therein. That a substantial portion of the interior
walls have been broken. That substantially all windows are
broken and glass along with other debris is strewn throughout
the structure. That the plumbing and wiring are inoperative
and inadequate. That there is not adequate heating facilities
in the structure. That the sills and walls are deteriorating.
That there are not existent sufficient and adequate sanitary
facilities. That the sewer system is not hooked to the city
sanitary system nor is it'provided with an adequate private
sanitary system. That in numerous respects the structure does
not comply with applicable building codes. The sinks and tubs
are unusable as is the lavatory. It does not have operational
running water. The structure is generally uninhabitable due
to its filthy and deteriorated condition. The flooring and
floor supports are deteriorated. That a portion of the premises
are water soaded. That it further lacks basic sanitation
requirements.

Pursuant to the foregoing and in accordance with Chapter 393 of the
Laws of 1965, it is hereby ordered that the above hazardous building be repaired
and made safe and not detrimental to public health, welfare and safety by
repairing the same to meet the building codes and other codes incorporated therein
which codes are in force and effect in the City of Hastings or
That said building be razed and removed as an alternate to being
repaired to comply with said codes, which repair to compliance or razing and
removal be accomplished within 45 days of the date of the service of this Order
upon the owners.
It is further ordered that all personal property or fixtures that
may unreasonably/interfere with the raz ing, should the owner choose not to
repair same or raze and remove same, be removed from said building within 45
days and if not so removed by the owner, the City of Hastings may remove and
sell such personal property and fixtures at private auction.
You are further advised that unless such corrective action (either
repair to comply with code, or razing and removal) is taken or an answer is
served upon the City of Hastings and filed in the Office of the Clerk of District
Court of Dakota County, Minnesota within 45 days from the date of service of this
Order upon you a Motion for Summary Enforcement of this Order will be made to
the District Court of Dakota County.
You are further advised that if the City of Hastings is compelled to
take any corrective action herein all necessary costs expended by said City
will be assessed against the real estate and collected as other taxes.

Said Motion to approve said Order upon being put to a vote was
approved unanimously.

as audited be approved and the City Clerk be instructed to issue warrants
