HomeMy WebLinkAbout08-20-73 1264 ~ August~, 1973 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 20, 1973 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Schnirring, Kramer, Hallberg, O'Connor, Fischer, Novak, and Mayor Petersen. Members absent: Councilmen Collins and Driscoll. l The first item on the agenda was the third and final reading and adoption of the Ordinance adopting the Codification of all City Ordinances. The Clerk report~d that the first reading and passage was May 21, 1973 and the second June 4, 1973. He further reported that the official newspaper of the City published on August 16, and would further publish on August 23 and August 30, a "Notice of Availability of Copies of Revised and Codified Ordinances of the City of Hastings, Minnesota" setting forth the fact that copies of the City Code were available at the Clerks Office, that the Code contains provisions and revisions not previously published, and that copies were available to the public. It was further noted that a public hearing had been held by the City Council at the August 7, 1973 meeting, on the "Zoning Ordinance" provisions of the City Code, to satisfy the requirement that any amendments to a Zoning Ordinance must be preceded by a Public Hearing. Councilman Hallberg then moved the third reading, and Councilman Schnirring seconded the motion for passage of the third reading of the following Ordinance: Ordinance Number One (1), Second Series r I i i. "AN ORDINANCE ADOPTING A REVISION AND CODIFICATION, WITH CERTAIN ADDITIONS AND DELETIONS, OF ALL ORDINANCES OF THE CITY OF HASTINGS, MINNESOTA, PURSUANT TO AUTHORITY GRANTED IN MINNESOTA STATUTES, SECTION 415.021, EXCEPT SUCH ORD- INANCES AS ARE NUMBERED AND CITED IN THE TEXT OF CHAPTERS 1 THROUGH 12 INCLUSIVE, (COMMONLY REFERRED TO AS REFERENCE LEGISLATION), AND ALSO EXCEPT SUCH ORDINANCES AS ARE DES- CRIBED IN THE CATEGORIES LISTED IN CHAPTER 13 (COMMONLY REFERRED TO AS SPECIAL LEGISLATION); ESTABLISHING A NAME FOR SAID CODIFICATION, MEANS OF CITATION, EFFECTIVE DATE, NOTICE AND PRINTING PROCEDURE, SPECIFICATIONS AND INSTRUC- TIONS; AND, PROVIDING PENALITIES FOR THE VIOLATION THEREOF." Section I. Adoption. All ordinances of the City of Hastings, Minn- esota, heretofore adopted, except such ordinances as are numbered and cited in the text of Chapters 1 through 12, inclusive, and also except such ordinances as are categorized in Chapter 13, should be and are hereby revised, codified, and, with additions and deletions, adopted as set forth in that certain document known as the CITY CODE OF THE CITY OF HASTINGS, MINNESOTA, pursuant to authority granted by Minnesota Statutes, Section 415.021. Section II. Citation. The CITY CODE may be cited as "City Code, Section " r Section III. Effective Date, Printing and Notice of Availability. The CITY CODE shall be effective on September 1, 1973. The City Clerk shall cause said CITY CODE to be printed in loose leaf form and copies thereof in a substantial quantity made available for distribution to the public at a reasonable charge, the exact quantity, charge, and printing specifications to be more specifically determined by the City Council. The City Clerk shall cause Notice of Availability of copies to be pub- lished in the official newspaper for at least two (2) succesive weeks prior to such effective date, which notice shall state that copies of the CITY CODE are available at his office for general distribution to the public at a reasonable charge. Section IV. Prima Facie Evidence. Such codification, known as the CITY CODE, is hereby declared to be prima facie evidence of the law of the City of Hastings, Minnesota. 1265 Section V. Penalty. Every person violates the CITY CODE when he intentionally performs an act therein prohibited or declared unlawfult or fails to perform an act thereby requiredt and upon conviction thereoft shall be sentenced as for a misdemeanor to not more than ninety (90) days or a fine of not more than $300.00t or botht ort as for a petty misdemeanort sentence or a fine of not more than $10 . Councilman Schnirring introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT WHEREASt pursuant to a written contract signed with the City of Hastings on the 1st day of MaYt 1972t Bituminous Surface Treating Company having satisfactorily completed the 1972 Construction programt Commission No. 5782. Moved by Councilman Hallbergt seconded by Councilman Fischer to I A' 1266 accept the recommendation of the Planning Commission to approve the request of Victor Rehm for the Vacation of the Alley located in Block 71, Town of Hastings, subject to reservation of an easement for utilities and that a Public Hearing be held on Monday, September 17, 1973 at 8:00 o'clock P.M. in the Council Chambers of the City Hall and that the follow- ing notice be published, mailed and posted as required. Bids to be opened September 12, 1973 at 2:00 o'clock P.M. and awarded on Sept- ember 17th at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Ayes, all; Nays, none. Ayes, all; Nays, none. 1267 The Council then received a report from the Building Inspector on the condition of the property at 2nd and Washington Streets (Lot 5, Block 112, Town of Hastings) known as the Prano property. Complaints about the property: electrical wiring in hazardous condition; garage and other out buildings in disrepair and filled with discards and refuse, attract- tag~rodents; heating system presents a serious hazard; structure in serious condition and unfit for human habitation; plumbing does not meet minimum code; cesspool overflows when in use, is now full, and depth from ground level to bottom is less than four feet and is inadequate. The Inspector reported that property presents a hazard and should be secured to avoid children from playing therein as property is uninhabited. o Moved by Councilman Hallberg, seconded by Councilman Kramer to have the Building Inspector temporarily secure property and notify the owner to permanently secure the property in accordance with the law. Ayes, all; Nays, none. / Moved by Councilman Hallberg, seconded by Councilman Kramer that the City Clerk be and hereby is authorized and directed to advertise for bids for a new heating and air conditioning unit for the Council Chambers of City Hall, with specifications on file in the City Clerk's Office. Bids to be opened on September 17th at 8:00 o'clock P.M. at the City Council Meeting. Ayes, all; Nays, none. The City Clerk read a letter submitteciby the Chamber. of Commerce requesting the City to write a letter to the State Highway Department asking that a directional sign be located on the grass area directly South of the Highway 61 bridge. Moved by Councilman O'Connor, seconded by Councilman Fischer to direct the City Clerk to write a letter to the State Highway Department request- ing a directional sign to be located South of the Highway 61 bridge. Ayes, all; Nays, none. The City Engineer, John Davidson read a letter from Mr. & Mrs. Otto 0 Theuer, members of the National Trust for Historic Preservation, request- . .. ing a relocat~on site for the Walbridge house presently located at 117 East 7th Street so that restoration could be accomplished. Moved by Councilman Kramer, seconded by Councilman Novak to re~er this matter to the Planning Commission. Ayes, all; Nays, none. Moved by Councilman Novak, seconded by Councilman O'Connor to refer to the Planning Commission the Variance request of Mr. Tom Reuter to erect a home on his property located on Lots 2 and 3, Block 7, Original Town of Hastings in accordance with well and septic tank regulations. Ayes, all; Nays, none. Moved by Councilman Hallberg, seconded by Councilman O'Connor that the City Clerk be authorized and directed to advertise for bids for one (1) squad car for the Police Department. Bids to be opened September 4th, 1973 at 8:00 o'clock P.M. in the Council Chambers of City Hall. Ayes, all; Nays, none. The next item on the Agenda was the property at 106 West 6th Street. The Building Inspector reported on the condition of the property and that the owner would razw the property if so ordered by the City. Pursuant to the foregoing and in accordance with Chapter 393 of the Laws of 1965, it is hereby ordered that the above referred to structures be razed and removed on or before November 30, 1973. l It is further ordered that all personal preperty or fixtures loca- ted on the premises shall be removed by the persons owning the same prior to the above date and if not so removed, the City of Hastings may remove and sell such personal property or fixtures at private auction. You are further advised that unless the aforementioned demolition and removal is completed on or before November 30, 1973; or an answer is served upon the City of Hastings and filed in the office of the Clerk of District Court of Dakota County, Minnesota, within twenty (20) days from the date of the service of this order, upon you, a motion for sum- mary enforcement of this order will be made to the District Court of Dakota County. Bailey's Addition) in the City of Hastings. Aye~, all; Nays, none. The next item on the Agenda was the matter of the proposed "Ice Arena" and related facilities for the City. Representatives of the Hockey Boosters Association addressed the Council. The Council committee's report was de- livered. A discussion was held. Whereupon Councilman Novak introduced the following resolution and moved its adoption: RESOLUTION CALLING FOR AN ELECTION ON $560,000. GENERAL OBLIGATION BONDS FOR ICE ARENA AND RELATED FACILITIES WHEREAS, the City Charter and State Statutes (Chapters 471 & 475) authorize the City of Hastings to issue General Obligation Bonds to finance acquisition, equipping and maintenance of land, buildings and other recreational facilities for a skating rink and arena and other kinds of athletic activities with related parking facilities, and n i, ) WHEREAS, the City Council is resolved to issue General Obligation Bonds in an amount not exceeding $560,000. for the above specified pur- poses, subject to approval of the electorate at a special election on said matter, and WHEREAS, the Council wishes to provide for a special election on said matter NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota, as follows 1. That a special election is hereby called for October 2, 1973, from 7:00 A.M. to 8:00 P.M. 2. The entire City shall constitute one election district. The sole polling place shall be the Hastings High School. 1269 3. Each qualified elector of the City may cast his ballot at the polling place. 4. The issue submitted for election shall be as set forth in the next following paragraph setting forth the notice of Special Election. 5. The Clerk shall cause to be published in the official newspaper as required by law, the following notice: NOTICE OF SPECIAL ELECTION o NOTICE IS HEREBY GIVEN, that a special election will be held in and for the City of Hastings, Dakota and Washington Counties, Minne- sota, on October 2, 1973 between the hours of 7:00 o'clock A.M. 'and 8:00 o'clock P.M. at which time the following question will be submitted: "Shall the City of Hastings, Minnesota, through its City Council, be authorized to borrow money by issuing general obligation negotiable coupon bonds in an amount not to exceed $560,000. in order to acquire, equip and maintain land, build- ings and other recreational facilities for a skating rink and arena and other kinds of athletic activities together with realted automobile park- ing facilities. For purposes of this election, the entire City of Hastings shall constitute one election district. The polling place for said district shall be the Hastings High School. The Clerk shall cause the above Notice of Election to be posted in 3 places ten (10) days before said election and the above Ballot to be posted four (4) days before said election, both postings of Notice and Ballot to be at the polling place and the other conspicuous places in the City. 8. Said election shall be held and conducted in accordance with the City Charter and statutes of the State of Minnesota applicable thereto. The Council shall meet as required by law for the purpose of convassing said election and declaring the results. ~ The motion for the adoption of the foregoing resolution was duly seconded by Councilman Hallberg and upon a vote being taken thereon, the following voted in favor; Councilmen Schnirring, Kramer, Hallberg, Fischer, and Novak; no one voted against; Councilman O'Connor abstained. Moved by Councilman Novak, seconded by Councilman Schnirring that the bills as audited be approved and the City Clerk be instructed to issue order checks for the same. Ayes, all; Nays, none.
