The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday June 18, 1973 at 8:00 o'clock P.M. in the
Council Chambers of City Hall.
Members present: Councilmen Schnirring, Kramer, O'Connor,
Wilson, Driscoll, Novak, and Mayor Petersen.
Members absent: Councilmen Collins, and Hallberg.

Minutes of the last meeting were read and approved.
The Mayor declared open the Public Hearing on St. John's
Lutheran Church request for a Variance in accordance with Section 9.15
"District Lot Regulations" of the City Zoning Ordinance dated December
7th, 1970 to reduce the rear and side yard set-back on Lots 7 and 8,
Block 54 of the Town of Hastings.
All persons present were given an opportunity to be heard.
Planning Commission Chairman, Richard Jensen reviewed the findings of
the Commission resulting in the approval of said Variance.
The Mayor declared the Hearing closed.
Moved by Councilman Kramer, seconded by Councilman O'Connor
to approve the Variance as requested for the above described property.
Ayes, Councilmen Schniriing, Kramer, O'Connor, Driscoll, and Novak.
Nays, Councilman Wilsoh.

The next item On the agenda was the Public Hearing on the
Petition for Vacation of that portion of Oak Street in the City of
Hastings, Dakota County~ Minnesota, lying northerly of State Through
Highway 1155 and". southe1!'1.y of Block 44f,Addition No., l3.to the City of
Hastings; bounded on the West by Lot 1, Block 4, Wm. Allison's Addition
to the Town of Hastings, and on the East by Lot 2, Block 3, Wm. Allisons
Addition to the Town of Hastings.
The Petition, signed by the owners of all abutting property
was submitted to the Council and received.
All persons present were given an opportunity to be heard.
No one spoke in opposition to the vacation. The petition requested
the vacation. The matter was discussed thoroughly.
After everyone had been given an opportunity to be heard,
the Mayor declared the public hearing closed.
Councilman Driscoll introduced the following resolution and
moved its adoption:
RESOLUTION VACATING PUBLIC STREET

Re: That portion of Oak Street in the City of Hastings,
Dakota County, Minnesota, lying Northerly of State
Through Highway 1155, and Southerly of~lock 44, Add-
ition No. 13 to the City of Hastings, bounded on the
West by Lot 1, Block 4, Wm. Allison's Addition to
the Town of Hastings, and on the East by Lot 2, Block
3, Wm. Allison's Addition to the Town of Hastings.
WHEREAS, all the owners of all of the property abutting the
aforedescribed portion of Oak Street have heretofore filed with the
City Council of the City of Hastings a verified petition requesting
the vacation of said portion of Oak Street; and
WHEREAS, by order of the City Council, a notice of a public
hearing on said vacation was duly advertised by a notice in the Hastings
Gazette, the legal newspaper for the City of Hastings, which notice
appeared more than ten days prior to the said hearing; and
WHEREAS, a hearing was held on said vacation at a regular
meeting of the Hastings City Council on June 18, 1973; and

WHEREAS, all persons present were given an opportunity to
be heard on the question of said vacation; and
WHEREAS, no one appeared in opposition to said vacation; and
WHEREAS, said petition was duly received, and found to be in
proper order and signed by all abutting property owners; and
WHEREAS, the requirements of the City Charter as well as
Minnesota Statutes Annotated 440.135 are found to have been complied
with; and
WHEREAS, it is in the best interests of the City of Hastings
that said street be vacated.

NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDAINED:
That the aforedescribed portion of Oak Street in the City of
Hastings, Dakota County, Minnesota, be and the same hereby is, vacated,
effective this date, June 18, 1973.
This vacation shall not destroy or interfere with the right of
any person, corporation or municipality owning or having control of any
electric light or telephone pole or lines existing upon such street or
under such street at the time of the vacation thereof, or with any sewer
or water pipes, mains or hydrants thereon or thereunder nor shall it
interfere with the right of the owner of said lines or appurtenances to
enter upon such vacated street or portion t of for the purpose of the
repairing or otherwise attending to said ines r appurtenances.

Councilman Driscoll introduced the following resolution and
moved its adoption:
RESOLUTION GIVING PRELIMINARY APPROVAL
TO A PROJECT UNDER THE MUNICIPAL INDUS-
TRIAL DEVELOPMENT ACT, REFERRING THE
PROPOSAL TO THE DEPARtMENT OF ECONOMIC
DEVELOPMENT FOR APPROVAL, AND AUTHORI-
ZING PREPARATION OR NECESSARY DOCUMENTS
BE IT RESOLVED, by the City Council of the City of Hastings,
Minnesota, as follows:
Section 1. Recitals
1.1 The welfare of the State of Minnesota requires active
promotion, attraction, encouragement and development of economically
sound industry and commerce through governmental acts to prevent so
far as possible emergence of blighted lands and areas of chronic un-
employment, and the State has encouraged local government units to
prevent such economic deterioration.

1.2 Two facto~s necessitating such active promotion and
development are the increasing concentration of population in the
Minneapolis - St. Paul Metropolitan area and the rapidly accelerating
amounts and costs of governmental services required to meet the needs
of the increased population, and the need for development of land use
which will provide an adequate tax base to finance these costs.
1.3 The City of Hastings has grown from 6,546 people in
1950 to 8,965 people in 1960 and to 12,179 people in 1970. Since then
the trowth rate of the City has continued and is expected to further
rapidly increase; the result of which is that the rate of unemployment
among residents of the City is unacceptable.
1.4 It is eS8ential to the City's ability to support its

governmental services and its direct and indirect general obligation
debt which is in excess of $8,000,000 and 38% of its taxable assessed
valuation that the property tax base of the City be expanded.
1.5 The H. D. Hudson Manufacturing Company, a Minnesota
Corporation (Hereinafter called the Company), is presently engaged in
the manufacture of spray equipment in the City of Hastings and is con-
sidering a project for the constructing and equipping of an addition to
its present building on land presently owned by the Company. Cost of
the project is estimated to be $850,000.

1.6 Completion of the proposed project would significantly
add to the tax base of the City and the school districts of which it
is a part; would increase employment in the area; and would add to the
level of economic activity in the Community.
1.7 The City has been advised by representatives of the
Company that conventional commercial financing to pay the capital cost
of the project will be at such high costs of borrowing as to made the
economic feasibility of operating the project questionable. Whereas,
with the aid of municipal financing, the project, as proposed, is
economically feasible.
1.8 The City is authorized by Minnesota Statutes, Section
474, to issue its revenue bonds to finance capital projects consisting
of property used and useful in connection with a revenue producing
enterprise, such as that of the Company, and the issuance of such bonds
by the City would be a substantial inducement to the Company to complete
the proposed project within the City.

1.9 The City has received from the Company information as to
its operations and financial condition and has referred such information
to the City's Financial'Consultants, Springsted Incorporated, for eval-
uation and has received a report from the consultant indicating that the
financing of the project by the City through the issuance of revenue
bonds as proposed is feasible and that such bonds, in the opinion of the
consultant, are marketable.
Section 2. Issuance of Bonds
On the basis of information given the City to date, it appears
that it would be in the best interest of the City to issue its Industrial
Development Revenue Bonds under the provisions of Chapter 474 to finance
the Project of the Company.
Section 3. Preliminary Approval of Project

The Project above referred to is hereby given preliminary appro-
val by the City, subject to approval of the Project by the Commissioner of
Economic Development and to the mutual agreement of this Body and the
Company as to the details of the Bond Issue and provisions for their
payment. In all events, it is understood, however, that the Bonds of
the City issued for the Project shall not constitute a charge, lien
or encumbrance, legal or equitable, upon any property of the City except
the Project, and each Bond, when, as, and if issued, shall recite in
substance that the Bonds, including interest thereon, is payable solely
from the rentals received from the Project and property pledged to the
payment thereof, and shall not constitute a debt of the City. It is
further understood that the Company shall comply with all necessary
requests made on behalf of the City by its financial consultant for
information necessary to the consultant to advise the City of the
feasibility of the Project and the issuance of bonds therefor and said
consultant shall be furnished with: (1) copies of all correspondence
between the Company and the Underwriter which purchases the Bonds; and
(2) copies of all proceedings which are part of the legal transcript
necessary for the issuance of the Bonds; and further, said consultant
shall be advised by the Company of all meetings between it and said
Underwriter, which meeting the consultant may be in attendance.
Section 4. Application to Commissioner
In accordance with Minnesota Statutes, Section 474.01, Sub-
division 7, the Administrative Clerk/Treasurer is hereby authorized and

directed to submit the proposal for the Project to the Commissioner of
Economic Development for his approval. All officers, employees and
agents of the City are hereby authorized to provide the Commissioner
with any preliminary information he may need for this purpose.
Section 5. Reimbursement of Expenditures
Any costs or expenses including fees of the City's financial
consultant and administrative expenses, incurred by the City in connec-
tion with the issuance of any bonds for the Project, or in connection
with the p~oposed issuance of any such bonds which are not issued,
shall be paid by the Company.
Section 6. Expenditures for Project

In anticipation of the approval by the Commissioner of Econom-
ic Development and the issuance of revenue bonds to finance the Project,
and in order that completion of the project will not be unduly delayed
when approved, the Company is hereby authorized to made such expenditures
and advances toward payment of costs of the Project as it considers
necessary, subject to reimbursement from the proceeds of the revenue
bonds when issued, but otherwise without liability on the part of the
City. The City presently intends to issue its bonds to finance the
project, but shall not be required to issue such bonds unless the terms
and conditions thereof finally agree 0 the City and the Company are
satisfactory to it.

to advertise for bids for crushing 8,000 cubic yards of gravel for the
Street Dep~rtment. Bids to be opened on Monday July 2, 1973 at 8:00

Councilman O'Connor introduced the following resolution and
moved its adoption:
RESOLUTION URGING ESTABLISHMENT OF A
COMMON CIVIL DEFENSE ORGANIZATION FOR
DAKOTA COUNTY, MINN.
WHEREAS, municipal Civil Defense organizations have been
inactive on a local basis in recent years; and
WHEREAS, volunteer directors at the local lavel have not
had the time or community support to develop good organizations; and
WHEREAS, because of lack of volunteer time and community
support, disaster preparedness plans have not been developed, either
locally or on a county level; and
WHEREAS, such lack of efforts has deprived Dakota County
municipalities from participation in Federal Assistance Programs; and
o
WHEREAS, a common Civil Defense organization at the County
level would afford a more pratical and uniform coordinating plan for
the local Civil Defense Units, which in turn would provide more uniform
emergency service to Dakota County citizens; and
WHEREAS, there is a legal basis for a common Civil Defense
organization; and
WHEREAS, this common Civil Defense organization should have
a paid staff director who could coordinate all local and County efforts;
NOW THEREFORE BE IT RESOLVED by the City Council of the City

WHEREAS, pursuant to a written contract signed with the City
of Hastings on the 14th day of November, 1972, Riverside Sand and
Gravel Company, having satisfactorily completed their work within the
Industrial Park for extension of Sanitary S-ewer to (1) Hastings Sanitary
Disposal and (2) Hastings Industrial Builders.

NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:

Moved by Councilman O'Connor, seconded by Councilman Kramer
to refer to Committee the request by the Hockey Boosters Association
for the City Council to approve a Municipal Bond Election to provide
adequate money to build and equip a Divic Ice Arena for the City of
Hastings.
The Mayor appointed Councilmen O'Connor and Novak to work
with the Association in studying all aspects of the Proposal, and
instructed the City Clerk to contact our Bonding Consultant Firm of
Springsted, Inc. as to the total cost of a $550,000. Bond Issue on
a 10, 15, or 20 year term. Ayes, all; Nays, none.
The Mayor read a letter from Police Chief Daryl Plath in
regard to the price of gasoline for Station delivery on the Squad
cars from Rother's Skelly Service.
It was moved by Councilman Schnirring, seconded by Councilman
Driscoll to hold over any action on the matter until the July 2nd meet-
ing. Ayes, Councilmen Schnirring, O'Connor, Wilson, and Driscoll. Nays, 0

Councilman Schnirring introduced the following resolution
and moved its adoption:
RESOLUTION ON FEDERAL GRANT FOR LAW
ENFORCEMENT COMMUNICATION SYSTEM
Authorizing the County of Dakota to act as grantee for the
Dakota County Law Enforcement Communication System Grant Application;
WHEREAS, the Dakota County Chief's of Police Association is
submitting an application for funding of the Dakota County Law Enforce-
ment Communication System Project:

WHEREAS, the City of Hastings requests the County of Dakota
to act as grantee for this project:
NOW THEREFORE BE IT RESOLVED, that the County of Dakota act
as grantee for the Dakota County Law Enforcement Communications System
Project and administer the funds on behalf of the Dakota County Law
Enforcement Communication System for the period of twelve months;
