Home My WebLink About01-08-73 7:00 Mtg 1090 Hastings, Minnesota January 8, 1973 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday January 8, 1973 at 7:00 o'clock P.M. in the Cduncil Chambers of the City Hall. I Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll, Christenson, and Mayor Rotty. Members absent: None. Minutes of the last meeting were read and approved. The first item on the agenda was the Hearing on adoption of the proposed City Charter by Ordinance. Mr. Walter Petersen, Chairman of the Charter Commission reported that the Charter Commission had previously approved the amend- ~d;'Charter and had referred it to the City Council for adoption by ordinance in accordance with Minnesota Statutes Annotated, Chapter 410. The City Clerk reported that the City Council had previously, unanimously, voted in favor of adopting the new amended City Charter, by ordinance, at the first and second reading of the Ordinance adopt- ing the same held December 4, 1972 and December 18, 1972. The Clerk further reported that a public hearing was scheduled for this time on the Ordinance adopting the amended City Charter, and the Clerk further reported that two weeks published notice of this Public Hear- ing has been given in the official newspaper of the City. Which notice sets forth in full the text of the proposed Charter. I The Mayor asked for comments from persons wishing to be heard on the proposed amended Charter. All persons present wishing to be heard on the matter were heard by the Council. A discussion was heard regarding ta~adoption of the new amended Charter. Moved by Councilman Driscoll, seconded by Councilman Wilson to declare the Hearing closed. Ayes, all; Nays, none. Councilman Kane introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING FEES FOR COLLECTION OF GARBAGE WITHIN THE CITY OF HASTINGS NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: That a fee of three dollars and seventy-five cents ($3.75) be set for the collection and disposal of garbage for residential pickup by a private concern in the City of Hastings, effective as of January 1, 1973. The next item for consideration was the proposed revision of subparagraph F of Paragraph V of the Subdivision Ordinance of the City of Hastings originally adopted by the City Council December 16, 1968. Also to be considered with the foregoing amendment to the land sub- division ordinance was a proposed Sidewalk Ordinance for the City of Hastings. The clerk reported that the proposed amendment to sub- paragraph F of Paragraph V of the Subdivision Ordinance and the pro- posed Sidewalk Ordinance had previously received two favorable read- ings and votes by the City Council and that the matter was now before the City Council for a third reading and adoption. [ Councilman Novak moved and Councilman Driscoll seconded the motion to pass the third reading of the proposed amendment of Sub- paragraph F. of Paragraph V of the Subdivision Ordinance and to pass a third reading of the proposed Sidewalk Ordinance, thereby placing sh~dcamendment and said ordinance into effect, subject to publication. The proposed amendment is in words as follows: F. SIDEWALKS AND DRIVEWAYS Grading of boulevards iniall new developments shall be accom- plished so as to accomodate construction of sidewalks thereon regard- less of whether said boulevard is part of the Main ~edestrian Route Plan of the City. Any "Pedestrian Ways" located in the Plat, as said term is defined in the City Sidewalk Ordinance, shall be designated as such on the Plat and dedicated to the public. Any sidewalks con- structed in any subdivision shall be in accordance with specifications 1125 established by the City Engineer's office. Each and every driveway shall be constructed of concrete from the concrete curb and gutter to the property line or property side of the sidewalk. In cases where driveways are constructed after curbing and sidewalks are in place, the sidewalk shall be reconstructed in accordance with driveway specifications for the width of the drive- way. Preamble r-, Orderly and safe movement of pedestrian traffic in the city i l requires the existence of a system of sidewalks to provide access from residential areas to schools and commercial areas, and to con- nect schools and commercial areas to each other. This system of main sidewalks shall be known as Main Pedestrian Routes. The existence of this system is a benefit to all citizens in the city, present and future. Each new residence constructed in the city increases the demand for such a system, and benefits therefrom. 2. Designation of Main pedestrian Routes Main pedestrian Routes shall be designated as such by the City Council, because of present or anticipated heavy pedestrian use. ,/ I , A plan showing the Main pedestrian Routes of the city shall be adopted by the city council. The Main Pedestrian Route Plan attached hereto is hereby adopted as the Main Pedestrian Route Plan for the city as of this date. Said plan shall be revised .' as needed to accomodate expansion in the city and chahges in ped- estrian needs. 3. P~destrian Ways Designated - Right of Ways. Main Pedestrian Routes may be along streets in street right- of-ways, or between streets in which case they shall be known as "Pedestrian Ways", shall be dedicated to the public, and on plats hereinafter filed shall be designated as "Pedestrian Ways".. 4. Cons~ruction of Sidewalks in the Main Pedestrian Routes. Sidewalks in Main Pedestrian Routes shall be constructed when r-- r \ so ordered by the City Council, and shall be constructed generally in accordance with the Capital Improvements Plan of the City. Funds for construction and maintenance of sidewalks in the Main Pedestrian Routes shall be paid for by the City solely, from the Main pedestrian Route Fund created by this ordinance. In October of each year, the council shall determine the sidewalk construction to be accom- plished in the subsequent construction season. . ~~27 ~ -: 5. Fund Created. There is hereby created a special fund in the city which is designated as the "Main pedestrian Route Fund". 6. Payment to Fund from General Levy. The City Council may include in the general tax levy for payrnento into this fund, such amounts as it determines to be needed for con- . struction and maintenance in the budget year. 7. Payment into Fund - Permit Fees. (a) Hereafter, upon issuance of each building permit for a "principal structure" as herein defined, the owner of the lot on which the "principal structure" will be constructed, or his agent, shall pay into the fund the sum of One Hundred Fifty- DOllars and not 100 ($150, 0,0) " . .'..... ~ ."-, . . A principal structure for purpose of this ordinance includes residences, apartment buildings, commercial buildings, townhouses, and industrial buildings,but excludes bill- boards, garages, and also excludes permits issued for repair, ex- pansion or maintenance. (b) Permit for Construction of Pe estr1an Route Lots W1t Allowed .0 Provided, however, that if the application is for construction of a principal structure on a lot not adjacent to a main pedestrian route, and the lot has at that time adjacent thereto, on street right of way, a sidewalk, the applicant shall pay into the Fund a fee computed at 50% of the above specified amount. (c) Subsequent Construction of Sidewalk on Lot Not on Main Ped- estrian Route - Credit Given A person who has paid into the fund pursuant to (a) above (or his successor in ownership of the lot on which the principal structure was built) for construction of a principal structure on a lot not on the main pedestrian route, who thereafter has a sidewalk con- structed adj acent to his lot, either at;. his request or p';ursuant to statutory pe~ition procedures (now M.S.A. 429) shall ha.ve paid from ',i> the fund'~S'lards the cost of construction of said sidewalk, a sum equal to;50% of the sum paid into the fund by him or his predecessor - in ownersh.l.p of said lot when the building permit was obtained, pur- o suant to (a) above. = 2 - _. .,1. The City Council may cond,iti.o,~'acceptance of a plat or issuance of a permit for a commercial, industrial or multiple unit residential development upon construction of sidewalks in the d~velopment, where heavy pedestrian use is anticipated. The cost of said sidewalk shall be borne by said developer. 8. Sidewalks on Non-Main Pedestrian Routes Nothing herein contained shall limit the right of property owners to petition for construction of sidewalks pursuant to procedures established by Minnesota Statutes, with the cost thereof assessed against adjacent property owners in accordance with said statute. The cost of replacement of sidewalks not on main pedestrian routes shall be ,borne one-half by the City and one-half by the adjacent property owner. 9. Obligation of Adjacent Property Owners Regarding Sidewalks (a) The owners and occupants of any premises in the City are hereby required to keep all sidewalks along or in front of their premises free from all abstructions and they are f~rther required to. remove all snow, ice, dirt, rubbish or obstructions from the side- walk along or in front of their premises. (b) No person shall shut off or. obstruct ?ny sidewalk in the City of Hastings without obtaining a special p~rmit to do so. Such permit shall be issued by the City Clerk. (c) An owner, occupant, contractor or other person who, without first having obtained a permit, places or allows obstructions, snow, dirt, ice, or rubbish to remain on the sidewalk or sidewalks along or in front of his property, or property on. which he is working, is guilty of a petty misdemeanor. Further, any person who places obstructions, snow, ice, dirt or rubbish on any sidewalk in the City, without first having obtained a permit, is guilty of a petty misdemeanor. Said persons may be subjected to punishment ., prov~ded for petty misdemeanors by State law. Further, the City may remove said snow, ice, dirt, rubbish or obstructions and assess the cost of said removal against any person wrongfully placing or allowing it to remain on said sidewalk, may collect said cost by - - 3 - J !2,9 .. legal action, or may levy the cost of said removal against the adjacent property owner to be collected with real estate taxes due in the next. succeeding year. 10. Severability. Should any section or provision of this Ordinance be declared by the Courts to be unconstitutional or invalid, such decision shall not affect the validity of the Ordinance as a whole, or any part thereof other than the part so declared to be unconstitutional and invalid. o " Moved by Councilman Wilson, seconded by Councilman O'Connor . to table the Sidewalk Ordinance.
