July 10, 1972
The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, July 10, 1972 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Kane, Hallberg, Collins, Wilson,
Driscoll, Christenson, and Mayor Rotty.

Councilmen Novak and O'Connor.
Moved by Councilman Driscoll, seconded by Councilman Christ-
enson to approve the non-intoxicating 3.2. Beer On Sale license for
Eddy's Pharmacies, Inc. of 301 East 2nd Street. Effective date July
10, 1972. Ayes, all; Nays, none.
Moved by Councilman Christenson, seconded by Councilman Kane
to cancel the taxi-cab license of James K. Bender dba Jim's Cab, dated
January 17, 1972. Ayes, all; Nays, none.
Moved by Councilman Kane, seconded by Councilman Driscoll to
refer the Neal Siewert preliminary plat to the Planning Commission
described to wit; the East ~ of the East ~ of the Northwest ~ of
Section 32, Township 115, Range 17; together with that part of the
West ~ of the Northeast ~ of Said Section 32 lying adjacent to and
West of the plat of Town's View Estates and North of the East-West
centerline of said Section 32; except the North 455.04 feet thereof
and also except the South 355 feet of the East 380 feet thereof; con-
taining 64 acres more or less. Ayes, all; Nays, none.

that a Public Hearing be held on Monday August 7, 1972 at 8:00 o'clock
P.M. in the Council Chambers of the City Hall and that the following
notice be published, mailed and posted as required by the City Zoning
Ordinance dated December 7, 1970. Ayes, all; Nays, none.
NOTICE OF PUBLIC HEARING
Notice is hereby given that the City Council of the City
of Hastings, Minnesota will meet in a Public Hearing on Monday, August
7, 1972 at 8:00 o'clock P.M. in the Council Chambers of the City Hall
to consider the following:
A variance in accordance with Section 9.15
"District Lot Regulations" of the City
Zoning Ordinance dated December 7, 1970.
to reduce the required set-back on Lot 1, Block 8, Towns View Estates
Addition. Persons desiring to be heard in reference to this matter
may be heard at this time.

to accept the resignation of Frank Siekert from the Planning Commission
of the City of Hastings, effective July 10, 1972. Ayes, all; Nays, none.
Moved by Councilman Hallberg seconded by Wilson that the City
Clerk be instructed to send letters of commendation to Frank Siekert
for Planning Commission, James Mullenbach for Charter Commission, and
Ray Knutson for Natural Resources Commission in appreciation for their
services rendered to the City of Hastings. Ayes, all; Nays, none.

Councilman Christenson introduced the following resolution
and moved its adoption:
RESOLUTION
BE IT RESOLVED by the City Council of the City of Hastings,
Minnesota that the Legislature of the State of Minnesota is hereby
urged to pass legislation, and the State Representative and State
Senator representing the City of Hastings are hereby urged to propose
in the State Leg~slature a bill to accomplish the foregoing:
The Fire Department Relief Association of the City of Hastings
shall pay to a retired fireman after twenty (20) years service a
lump sum benefit of Four Hundred ($400.00) Dollars per year of service,
up to a maximum benefit of Ten Thousand ($10,000.00) Dollars.

RESOLUTION
CERTIFICATION OF SEWER AND WATER OPERATOR

WHEREAS, Section G (3) and (dd) of Regulations WWOB 1 requires
certification of persons in responsible charge of water supply systems
and waste water treatment facilities, and
WHEREAS, plant operators in responsible charge of the systems
on July 1, 1972 can be certified without examination, and
NOW THEREFORE, BE IT RESOLVED, that Mr. Arnold Endres, Super-
intendent of the Water and Sewer f~cilities for the City of Hastings,
be hereby certified as a Class "c" operator.

RESOLUTION
WHEREAS, the County of Dakota is the owner of the following
described property, to wit:

Addition, according to the plat thereof now on
file and of record in the office of the Register
of Deeds in and for Dakota County, Minnesota, and
WHEREAS, the City of Hastings is the owner of the following
described property, to wit:

WHEREAS, it is to the mutual benefit of both the County of
Dakota and the City of Hastings to convey their respective parcels to
each other with no consideration paid by either,
NOW, THEREFORE BE IT RESOLVED, that the City of Hastings
convey the abovedescribed parcel of land, which said City owns, to the
County of Dakota, and that the Mayor and City Clerk of the City of
Hastings be authorized to execute the necessary documents for said
conveyance, and the City Clerk be authorized to deliver said conveyance
to the County of Dakota upon receipt from the County of Dakota a
conveyance by said County to the City of Hastings of the above-
described lands presently owned by the County of Dakota.
This transaction is made pursuant to M.S. 465.035.

Moved by Councilman Christenson, second~d by Councilman
Hallberg that the City of Hastings sell Lot 1, Block 2, containing
4.8344 acres at a cost of $10,000.00 per acre of Hastings Industrial
Park No.1, to Industrial Builders Inc. for a cash payment of $48,344.00,
and grant a one year option on Lot 2, Blk. 2, of said plat for an option
fee of $1.00 to Industrial Builders Inc, Ayes, all; Nays, none,
Moved by Councilman Wilson, seconded by Counciltnan Ch3:'istenson
that the City Engineer instruct Bernard Husting and John Engstrom to
clean up their storage area on State Street between 6th and 7th Streets,
and that this be accomplished by Monday, July 17th, 1972, Ayes, Council-
men Hallberg, Wilson, and Christenson; Nays, Councilmen Kane, Collins,
and Driscoll. There being a tie vote, the Mayor cast the deciding
vote and voted Nay. The motion was defeated.

AGREEMENT
THIS AGREEMENT, made and entered into this 10th day of
July, 1972, by and between THE CITY OF HASTINGS, a Municipal corp-
oration, under the laws of the State of Minnesota, hereinafter
referred to as "The City", and THE SISTERS OF CHARITY OF OUR LADY
MOTHER OF MERCY CORPORATION, hereinafter referred to as "The Sisters";
WITNESSETH:

WHEREAS, The Sisters have undertaken contruction of a
medical clinic facility in the east one-half of the southeast quarter
of Section 20, Township 115 North, Range 17 West, Dakota County,
Minnesota, which will require the connection to municipal sanitary
sewer and water services operated by the City of Hastings; and
WHEREAS, the closest existing water line terminates at the
northerly boundary line of Imperial Estates Addition and sanitary
sewer exists adjacent to the subject property; and
WHEREAS, the parties have arrived at an agreement with
reference to the dedication of certain properties and installation
of utility lines and wish to set forth those agreements in writing;
NOW, THEREFORE, it is hereby agreed as follows:
1. The Sisters will grant to The City of Hastings a public
street and utility easement in form as set forth on the attached
Exibit A incorporated herein, and will further obtain additional signa-
tures necessary to properly execute said document.

2. The City of Hastings will install, in accordance with
generally accepted municipal engineering standards a 10 inch water
main from the southerly terminus of the easement described on Exh~b1t
A, to a point approximately 970 feet south of the northerly terminus
of said easement which is the point approximately due west of the pro-
posed clinic site. The' City! will further install from said point a
6 inch lateral water main into the east one-half of the southeast
quarter of Section 20 up to the proposed clinic site. Further the
City will install'an 8 inch lateral sewer from the clinic site approx-
imately due west to the point in said easement described on Exhibit
A wherein is located the sanitary sewer trunk line.
3. The City will prepare all plans, specifications and let
contracts for the performance of the foregoing work.
4. The Sisters will pay the City for the foregoing work,
the sum of the contract price payable to persons engaged by the City
to perform said work, plus 10% of said contract price to cover the
City's costs in preparation of plans, specifications and supervision
of said work. The estimated cost is watermain, $22,000.00; sanitary
sewer, $6,700.00.
5. The easement granted by Exhibit A shall be perpetual.
The right of the 'City, its agents, employees and contractors to enter
on the east one-half of the southeast quarter of Section 20 owned by
the Sisters shall exist during the period of construction of' the
utility lines into the property to serve the clinic building.

to increase Mr. Tom Donahue's salary by $100.00 per month effective
July 1, 1972 in accordance with his meeting requirements for which
budgeted fund.s are,. flvailable. Mr. Donahue received his Bachelor of
Science degree. from Marquette. University and his duties have been
increased to overall supervision of construction inspection and survey
and other Engineer-in-Training responsibilities in assisting the City
Engineer. Ayes, all; Nays, none.
