The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, June 5, 1972 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Kane, Collins, Hallberg,
O'Connor, Wilson and Mayor Rotty.

Members absent:
Councilmen Driscoll and Christenson.
Minutes of the last meeting were read and approved.
The Clerk presented affidavits showing publication of notice
of call for bids on $55,000 General Obligation State-Aid Street Bonds
of 1972 of the City, for which bids were to be received at this meet-
ing, in accordance with the resolution adopted by the City Council
on May I, 1972. Said affidavits were examined, found to comply with
the provisions of Minnesota Statutes, Chapter 475 and Minnesota
Statutes, Section 162.18, and were approved and ordered placed on file.
The Council proceeded to receive and open bids for the sale
of said bonds. The following bids were received:

The Council then proceeded to consider such bids. After the
bids had been considered and discussed, member Wilson introduced the
following resolution and moved its adoption:
RESOLUTION ACCEPTING BID ON SALE OF
$55,000 GENERAL OBLIGATION
STATE-AID STREET
BONDS OF 1972
AND PROVIDING FOR THEIR ISSUANCE

BE IT RESOLVED by the Council of the City of Hastings,
Minnesota, as follows:
1. That the bid of Piper, Jaffray & Hopwood, Inc. to purchase
$55,000 General Obligation State-Aid Street Bonds of 1972 of the City
in accordance with the notice of bond sale, at the rates of interest
hereinafter set forth, and to pay therefor the sum of $55,000 (plus a
premium of -0-) is hereby found, determined and declared to be the
most favorable bid received, and is hereby accepted and said bonds
are hereby awarded to said bidder. The City Clerk is directed to retain
the deposit of said bidder and to forthwith return the good faith
checks or drafts to the unsuccessful bidders. Said bonds shall be
payable as to principal and interest at Northwest National Bank of
Minneapolis.

2. The $55,000 negotiable coupon general obligation bonds
of the City shall be dated July 1, 1972 and shall be issued forth-
with. Said bonds shall be 11 in number and numbered from 1 to 11,
both inclusive, in the denomination of $5,000 each. Said bonds shall
mature serially, lowest numbers first, without option of prepayment,
on July 1 in the years and 'amounts as follows:
Years
$10,000 in each of/the 1973 to 1976,
both inclusive;
$15,000 in the year 1977.
3. Said bonds shall provide funds for the improvement of
state-aid streets in the City. The total cost of said improvements,
including the cost of construction under the terms of the lowest
bid received for each phase thereof, engineering, legal and other
professional charges, publication and printing costs, and all other
costs necessarily incurred and to be incurred from the inception to
the completion of the improvements, is estimated to be at least
equal to the amount of the bonds herein authorized.

4. The bonds of said issue maturing in the years and
bearing the serial numbers set forth below shall bear interest, pay-
able January 1, 1973 and semiannually thereafter on July 1 and Janu-
ary 1 of each year, at the respective rates per annum set opposite
said maturity years and serial numbers:

KNOW ALL MEN BY THESE PRESENTS that the City of Hastings,
Dakota and Washington Counties, Minnesota, certified that it is
indebted and for value received promises to pay to bearer, without
option of prepayment, the sum of

on the first day of July, 19 and to pay interest thereon from the
date hereof until the principal is paid at the rate of per cent
( %) per annum, payable on the first day of January, 1973 and
semiannually thereafter on the first day of July and the first day of
January in each year, in accordance with and upon presentation and
surrender of the interest coupons hereto attached, as the same sever-
ally become due. Both principal and interest are payable at
in any coin or currency of the United Statesof
America which at the time of payment is legal tender for public and
private debts.
This bond is one of an issue in the total principal amount
of $55,000 all of like date and tenor, except as to maturity and
interest rate, which bond has been issued pursuant to and in full
conformity with the Constitution and laws of the State of Minnesota
for the purpose of providing money for improvement of state-aid
streets in the City, and is payable out of the General Obligation
State-Aid Street Bonds of 1972 Fund of the City. This bond constitutes
a general obligation of the City, and to provide moneys for the prompt
and full payment of said principal and interest when the same become
due, the full faith and credit and taxing powers of said City have
been and are hereby irrevocably pledged.

IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions
and things required by the Constitution and laws of the State of Minne-
sota to be done, to happen and to be performed, precedent to and in
the issuance of this bond, have been done, have happened and have been
performed, in regular and due form, time and manner as required by
law, and this bond, together with all other debts of the City outstand-
ing on the date hereof and the date of its actual issuance and delivery
does not exceed and constitutional or statutory limitation of indebted-
ness.

6. The bonds shall be executed on behalf of the City by the
signature of its Mayor and the signature of its Clerk and be sealed
with the seal of the City; provided, that one of such signatures and
the seal of the City may be printed facsimiles. The interest coupons
pertaining thereto shall be executed by the printed, engraved or
lithographed facsimile signatures of the Mayor and Clerk.
7. The said bonds when so prepared and executed shall be
delivered by the Treasurer to the purchaser thereof upon receipt of
the purchase price, and the said purchaser shall not be obliged to
see to the proper application thereof.

8. There is hereby created a special fund to be designated
"General Obligation State-Aid Street Bonds of 1972 Fund" to be held
and administered by the City Treasurer separate and apart from all
other funds of the City. Said fund shall be maintained in the manner
herein specified until all the the bonds herein authorized and the
interest thereon have been fully paid. In said fund there shall be
maintained two separate accounts to be designated as the "Construction
Account" and the "Sinking Fund Account", respectively. The proceeds
of the sale of the bonds herein authorized less accrued interest
received thereon, shall be credited to the Construction Account from
which there shall be paid all costs and expenses of said improvements
in accordance with the provisions of law and the rules and regulations
of the Highway Commissioner relating to the establishment, location,
relocation, construction, reconstruction. and improvement of municipal
state-aid streets within said City, and the moneys in said account
shall be used for no other prupose, provided that if upon completion
of said improvements there shall remain any unexpended balance in said
account. then such sum shall be transferred to the Sinking Fund Account
established herein. There shall be credited to the Sinking Fund
Account all moneys from time to time available in the City's normal
maintenance account in the Municipal State-Aid Street Fund while these
bonds remain outstanding, and all interest on the obligations issued
hereunder shall be paid out of these moneys. There shall also be
credited to said Sinking Fund Account all moneys allotted or to be
allotted to the City from its account in the Municipal State-Aid Street
Fund for the payment of the principal and interest on the obligations
issued hereunder as they respectively become due, all collections of
taxes which may be levied for the payment of the principal and interest

on the obligations issued hereunder, all City funds at any time trans-
ferred to said Sinking Fund Account, all accrued interest received upon
delivery of said obligations and all fund remaining in the Construction
Account after completion of the improvements and payment of the costs
thereof. The Sinking Fund Account shall be used solely to pay princi-
pal and interest on the bonds issued hereunder.
9. If any moneys of the City other than moneys received
from the Municipal State-Aid Street Fund are used for the payment of
the obligations issued hereunder, the moneys so used shall be restored
by the City from the Construction or Maintenance Account in the Muni-
cipal State-Aid Street Fund which are not required to be paid into a
Sinking Fund for obligations.

10. There is hereby irrevocably pledged and appropriated
to the Sinking Fund Account established hereunder an amount of the
moneys allotted or to be allotted to the City from its account in
the Municipal State-Aid Street Fund sufficient to pay the principal
of and interest on the bonds issued hereunder as they respectively
become due.
11. For the prompt and full payment of the principal of
and interest on said bonds as the same respectively become due, the
full faith, credit and taxing powers of the City shall be and are
hereby irrevocably pledged.
12. Upon delivery of said bonds and the receipt of payment
therefor, the City Council shall forthwith adopt a resolution certi-
fying to the State Commissioner of Highways the amount of money
required annually for the payment of principal and interest on the
bonds, and the City Clerk shall forthwith transmit said resolution to
the Commissioner of Highways, all in accordance with M.S.A. 162.18 and
the form resolution hereto attached as Exhibit A and incorporated
herein by reference. Upon receipt from the State Auditor of the
annual amount of money needed for paument of principal and interest
due each year, the same shall be deposited in the Sinking Fund
Account established hereunder.
13. The City Clerk is hereby directed to file certified
copies of this resolution with the County Auditors of Dakota and
Washington Counties, Minnesota, together with such other information
as they shall require, and to obtain from said Auditors their certi-
ficate that said bonds have been entered in said Auditor's Bond
Registers.

14. The officers of the City are hereby authorized and
directed to prepare and furnish to the purchaser of said bonds, and
to the attorneys approving the legality of the issuance thereof,
certified copies of all proceedings and records of the City relating
to said bonds and to the financial condition and affairs of the City
and such other affidavits, certificates and information as are re-
quired to show the facts relating to the legality and marketability
of said bonds as the same appear from the books and records under
their custody and control or as otherwise known to them, and all such
certified copies, certificates and affidavits, including any hereto-
fore furnished, shall be deemed representations of the City as the
facts recited therein.
The motion for the adoption of the foregoing resolution was
duly seconded by Councilman Kane and upon vote being taken thereon,
the following voted in favor thereof: Councilmen Novak, Kane, Collins,
Hallberg, O'Connor and Wilson; and the following voted against the
same: None. Whereupon said resolution was declared duly passed and
adopted.

The Council then proceeded to consider such bids. After the
bids had been considered and discussed, Councilman Hallberg introduced
the following resolution and moved its adoption:

AND PROVIDING FOR THEIR ISSUANCE
BE IT RESOLVED by the Council of the City of Hastings,
Minnesota, as follows:
1. That the bid of Banc Northwest of Minneapolis to purchase
$390,000 Improvement Bonds of 1972, Series B of the City, in accordance
with the notice of bond sale, at the rates of interest hereinafter set
forth, and to pay therefor the sum of $388,050. (plus a premium of -0-)
is hereby found, determined and declared to be the most favorable bid
received, and is hereby accepted and saidbonds are hereby awarded to
said bidder. The City Clerk is directed to retain the deposit of said
bidder and to forthwith return the good faith checks or drafts to the
unsuccessful bidders. Said bonds shall be payable as to principal
and interest at the main office of the Northwestern National Bank of
Minneapolis in Minneapolis, Minnesota.

sional charges, publication and printing costs, interest accruing on
money borrowed for the improvements, is estimated to be at least equal
to the amount of the bonds herein authorized.

heretofore let and all other costs incurred and to be incurred and the
moneys in said account shall be used for no other purpose, provided
that if upon completion of said improvements there shall remain any balance
unexpended in said Construction Account, said balance may be transferred
by the Council to the fund of any other improvement instituted pursuant
to Chapter 429 M.S.A. There is hereby pledged and there shall be
credited to the Sinking Fund Account, all collections o~ special assess-
ments herein levied, all accrued interest received upon delivery of
said bonds, all funds paid for the bonds in excess of $382,360, bond
proceeds in the amount of $8,090 as capitalized interest, and all funds
remaining in said Construction Account after completion of the improve-
ments and payment of the costs thereof, not so transferred to the fund
of another improvement. The Sinking Fund Account shall be used solely
to pay principal and interest on the bonds issued hereunder and any
other general obligation bonds of the City hereafter issued by the
City and made payable from said account.
9. It is hereby determined that no less than $390,000 of the
cost of improvements shall be paid by special assessments to be levied
against every assessable lot, piece and parcel of land benefited by

said improvements. The City hereby covenants and agrees that it will do
and perform as soon as they may be done, all acts and things necessary
for the final and valid levy of such special assessments, and in the
event that any such assessment be at any time held invalid with respect
to any lot, piece or parcel of land due to any error, defect, or irregu-
larity, in any action or proceedings taken or to be taken by the City
or this Councilor any of the City officers or employees, either in
the making of such assessments or in the performance of any condition
presedent thereto, the City and this Council will forthwith do all such
further acts and take all such further proceedings as may be required
by law to make such assessments a valid and binding lien uport such
property. Said assessments shall be payable in equal, consecutive,
annual installments, with general taxes for the years shown below and
with interest on the deferred balance of all such assessments at the
rate of 8% per annum:

The Council then proceeded to consider such bids. After the
bids had been considered and discussed, Councilman Novak introduced
the following resolution and moved its adoption:

RESOLUTION ACCEPTING BID ON SALE OF
$102,000 GENERAL OBLIGATION WATER
REVENUE BONDS OF 1972
AND PROVIDING FOR THEIR ISSUANCE
WHEREAS:
A. The City owns and operates a municipal water facility
as a revenue producing public utility and there are outstanding Water
Revenue Bonds of 1953, 1960, 1961 and General Obligation Water Revenue
Bonds of 1968 and 1970 and General Obligation Water and Sewer Revenue
Bonds of 1971, the interest and principal of which eonstitute prior
liens upon the net revenues of said facility;
B. The City Council has heretofore determined that it is
necessary and expedient to issue $102,000 General Obligation Water
Revenue Bonds of 1972, pursuant to M.S.A. 475 and N.S.A. 444.075 to
finance to said water system;
BE IT RESOLVED by the Council of the City of Hastings,
Minnesota, as follows:
1. That the bid of Piper, Jaffray & Hopwood, Inc. to purchase
$102,000 General Obligation Water Revenue Bonds of 1972 of the City,
in accordance with the notice of bond sale, at the rates of interest
hereinafter set forth, and to pay therefor the sum of $100,249.68 (plus
a premium of -0-) is hereby found, determined and declared to be the
most favorable bid received, and is hereby accepted and said bonds
are hereby awarded to said bidder. The City Clerk is directed to
retain the deposit of said bidder and to forthwith return the good
faith checks or drafts to the unsuccessful bidders. Said bonds shall
be payable as to principal and interest at Northwestern National Bank
of Minneapolis.

2. The $102,000 negotiable coupon general obligation water
revenue bonds of the City shall be dated July 1, 1972 and shall be
issued forthwith. Said bonds shall be 22 in number and numbered from
972
1 to 22, both inclusive, in the denomination of $5,000 each, except
for bonds nos. 1 and 2 which shall be in the denomination of $1,000
each. Said bonds shall mature serially, lowest first, on January 1
in the years and amounts as follows:
$2,000 in the year 1974,
$5,000 in each of the years 1975 to 1990,
both inclusive;
$10,000 in each of the years 1991 and 1992.
3. Said bonds are issued to provide funds for the construc-
tion of water improvements in the City. The total cost of said
project, including the cost of construction under the terms of the
lowest bid received for each phase thereof, engineering, legal and
other professional charges, publication and printing costs, and all
other costs necessarily incurred and to be incurred from the inecp-
tion to the completion of the project, is estimated to be at least
equal to the amount of the bonds herein authorized.

4. The bonds of said issue maturing in the years and
bearing the serial numbers set forth below shall bear interest, pay-
able January 1, 1973 and semiannually thereafter on July 1 and Janu-
ary 1 of each year, at the respective rates per annum set opposite
said maturity years and serial numbers:

5. All bonds of this issue maturing in the years 1983 to
1992, both inclusive (bonds numbered 11 to 22, both inclusive), shall
be subject to redemption and prepayment at the option of the City in
inverse order of serial numbers, on January 1, 1982 and on any interest
payment date thereafter at par and accrued interest. At least thirty
days prior mailed notice of redemption shall in each case be given
to the bank where said bonds are payable and to the last known holder,
and prior published notice of redemption shall be given in accordance
with law. Holders desiring to receive mailed notice must register
their names, addresses and bond numbers with the City Clerk, but
published notice shall be effective without mailed notice.

the State of Minnesota for the purpose of providing money for the
construction of water improvements in the City, and is payable out of
the sinking fund account of the General Obligation Water Revenue Bonds
of 1972 Fund of the City.
This bond constitutes a general obligation of the City,
and to provide moneys for the prompt and full payment of said principal
and interest when the same become due, the full faith and credit and
taxing powers of said City have been and are hereby irrevocably
pledged.

IT IS HEREBY CERTIFIED AND RECITED that all acts, condition
and things required by the Constitution and laws of the State of
Minnesota to be done, to exist, to happen and to be performed, prede-
dent to and in the issuance of this bond have been done, do exist,
have happened and have been performed in regular and due form, time
and manner as required by law; that the City has covenanted and agreed
with the holders of said bonds that it will impose and collect
charges for the service, use and availability of its municipal water
facility at the times and in amounts necessary to produce net revenues,
adequate to pay all principal and interest when due on said bonds;
and that the City will levy a direct annual, irrepealable ad valorem
tax upon all of the taxable property in said City, without limitation
as to rate or amount, for the years and in amounts sufficient to pay
the principal and interest on the bonds of this issue as they respec-
tively become due, if the net revenues from said water facility and
any other revenues irrevocably appropriated to said sinking fund
account are insufficient therefor; and this bond, together with all
other indebtedness of the City outstanding on the date hereof, and on
the date of its actural issuance and delivery, does not exceed any
constitutional or statutory limitation of indebtedness.
IN WITNESS WHEREOF, the City of Hastings, Dakota and Washington
Counties, Minnesota, by its City Council has caused this bond to be
executed in its behalf by the signatures of the Mayor and the City Clerk,

7. The bonds shall be executed on behalf of the City by
the signature of its Mayor and the signature of its Clerk and be
sealed with the seal of the City; provided, that one of such signa-
tures and the seal of the City may be printed facsimiles. The interest
coupons pertaining thereto shall be executed by the printed, engraved
or lithographed facsimile signatures of the Mayor and Clerk.
8. For the convenience and proper administration of the
moneys to be borrowed and repaid on said bonds, and to make adequate
and specific security to the purchasers and holders of said bonds from
time to time, there is hereby established a separate fund of the
municipality to be known as the General Obligation Water Revenue Bonds
of 1972 Fund. Said fund shall be continued and maintained as a
separate permanent fund of the municipality until all bonds herein
authorized are paid. There shall be established and maintained in
said fund the following separate accounts to which shall be credited
and debited all net revenues and disbursements of said fund as here-
inafter set forth. The Clerk and Treasurer of the municipality and
all municipal officials and employees concerned therewith shall
establish and maintain financial records of the receipts and dis-
bursements of the municipal water facility in accordance with this
resolution. In such records there shall be established and maintained
accounts of the General Obligation Water Revenue Bonds of 1972 Fund
for the purposes and in the amounts as follows:

(a) A "Construction Account" into which there shall be paid
the money derived from the' sale of the bonds authorized hereunder less
any accrued interest received thereon and less any amount paid for
said bonds in excess of $100,000. From the Construction Account shall
be paid all costs and expenses of making the improvements to said
water facility, including legal, engineering and financing expenses.
Any balance remaining in said account after completion of said costs
shall be transferred to the Sinking Fund Account. All moneys remain-
ing in the Operation and Maintenance Account heretofore established
for said water facility after paying or providing for the items
payable from said account sahlI constitute and are referred to in
this resolution as "net revenues".

(b) A"Sinking Fund Account" for the payment of principal
of and interest on the bonds herein authorized. There shall be
irrevocably appropriated and pledged to said account the net revenues
of the facility not otherwiS8pledged to the payment of other obliga-
tions of the City, in an amount, together with other funds which may
hereafter from time to time be irrevocable appropriated to said
account sufficient to meet the requirements of M.S.A. 475.61 for the
payment of the principal and interest of this issue. There shall
also be irrevocably appropriated and pledged to the Sinking Fund
Account accrued interest payable at the time of delivery of said
bonds, all funds paid for said bonds in excess of $100,000, and all
collections of taxes which may hereafter be levied for the payment
of the principal and interest of the bonds of this issue, together
with other funds which may from time to time be irrevocably appropri-
ated to said account to meet the principal and interest requirements
of this issue. No money shall be paid out of the Sinking Fund Account
except to pay such principal and interest.
(c) Net revenues in excess of those required for the fore-
going may be used for any proper purpose.
9. It is hereby found, determined and ,declared that the
net revenues of said facility in excess of those net revenues pledged
to the payment of said previous bond issues (hereinafter "excess net
revenues") are sufficient in amount to pay when due the principal of
and interest on the bonds herein authorized and said excess net
revenues of said water facility are hereby pledged for the payment
of the bonds of this issue, but solely to the extent required to meet
105% of the principal and interest requirements of this issue as
the same become due. Nothing contained herein shall be deemed to
preclude the City from making further pledges and appropriations of
said excess net revenues of the wa~er utility for the payment of
other or additional obligations of the City, provided that it has
firstbeen determined by the City Council that the estimated net

revenues of said utility will be sufficient in addition to all other
sources, for the payment of the bonds herein authorized and such
additional obligations and any such pledge and appropriation of said
excess net revenues may be made superior or subordinate or on a parity
with the pledge and appropriation herein.

10. In accordance with M.S.A. 444.075, the City of Hastings
hereby covenants and agrees with the holders of the bonds herein
authorized that it will impose and collect charges for the service,
use, availability and connection to said water utility at the times
and in the amounts required to produce excess net revenues adequate
to pay all principal and interest when due on the bonds herein authorized.
11. The full faith and credit of the City is hereby irrevocably
pledged for the prompt and full payment of the principal and interest
on the bonds herein authorized. If the excess net revenues of the
water utility appropriated and pledged to the payment of principal and
interest on the bonds herein authorized, together with other funds
irrevocably appropriated to the Sinking Fund Account herein established
shall at any time be insufficient to pay such principal and interest
when due, the City covenants and agrees to levy, without limitation
as to rate or amount an ad valorem tax upon all taxable property in
the City sufficient to pay such principal and interest as it becomes
due.
12. The City Clerk is hereby directed to file certified
copies of this resolution with the County Auditors of Dakota and
Washington Counties, Minnesota, together with such other information
as they shall require, and to obtain from said Auditors their certi-
ficate that said bonds have been entered in said Auditor's Bond
Registers.

13. The officers of the City are hereby authorized and
directed to prepare and furnish to the purchaser of said bonds, and
to the attorneys approving the legality of the issuance thereof,
certified copies of all proceedings and records of the City relating
to said bonds and to the financial condition and affairs of the City,
and such other affidavits, certificates and information as are re-
quired to show the facts relating to the legality and marketability
of said bonds as the same appear from the books and records under
their custody and control or as otherwise known to them, and all such
certified copies, certificates and affidavits, including any heretofore
furnished, shall be deemed representations of the City as to the facts
recited therein.
The motion for the adoption of the foregoing resolution was duly
seconded by Councilman Hallberg and upon vote being taken thereon, the
following voted in favor thereof: Councilmen Novak, Kane, Collins,
Hallberg, O'Connor and Wilson; and the following voted against the
same: None. Whereupon said resolution was declared duly passed and
adopted.

now existing or hereafter commenced, shall require a license therefore.
Such licenses shall be for one year period, from July 1 of the year

The next item for consideration was the matter of the Frontage Road
along the south side of Highway #55, and along the easterly side of
the School Property. Mr. Davidson reported on a meeting with the school
officials. The proposal of the School Board for consideration by the
Council was as follows: That if the School acquire the four parcels
of land presently owned by the Meiers family along Highway #55,
dedicate a portion thereof for service road along Highway #55 and
also dedicate the Easterly 33 feet of its property, running north and

& Co. Addition, that the City would then improve the property by
installation of a service road and not assess any portion of the cost
thereof to the school.
Moved by Councilman Hallberg, seconded by Councilman Wilson
that the Council go on record generally favoring the proposed concept,
and that the school be notified accordingly, with further details and
final approval to be at a later time. Ayes, all; Nays, none.

Moved by Councilman Hallberg, seconded by Councilman Wilson
to approve Dennis Held's request for a Variance allowing expansion of
the school bus garage between 9th & 10th Streets wes~ of Pine Street
subject to the following conditions: Ayes, all; Nays, none.
1. Compliance to all the requirements of the Zoning Ordin-
ance dated December 7, 1970, in particular Section 9.15
yard requirements.
2. Retaining the area adjacent to and between the building
and Pine Street as a grassed open space.
3. Screening on and along all property lines abutting resi-
dential zones. Screening to be approved by the City
Engineer.
4. Dedication of necessary T.H. 55 South Frontage access.
The next item for consideration was final approval of the
Fluegel-Kugler plat of properties located generally north of the
Vermillion River and dike, south and east of Southview Drive and
and south of Block 5, Country Club Addition. It was noted that the
proposed final plat, previously approved by the Planning Commission,
contained three lots and two outlots. After a discussion, Councilman
Kane introduced the following resolution and moved its adoption:

ACCEPTANCE OF FLUEGEL-KUGLER FINAL PLAT
BE IT RESOLVED that the Fluegel-Kugler plat of properties
in the NE 1/4 of the SW 1/4 of Section 33-ll5North, Range 17 (containing
3 lots and 2 outlots), in the City of Hastings, Dakota County, Minnesota
be and hereby is accepted, subject to the payment of the Interceptor
Sewer charge, subject to the requirements of the "Land Subdivision
Ordinance" dated December 16, 1968 and the "City Zoning Ordinance"
dated December 7, 1970, that before development of the outlots be
allowed, said outlots will have to be platted, that a temporary cul-
de-sac at the easterly end of Southview Drive be provided for turn
around of snowplows, subject to cash payment to the City an amount equal
to five percent (5%) of the present assessed value as determined by the

County Assessor, of the property lying within the above described
Addition, in lieu of park land dedication required under the Land
Subdivision Ordinance, and subject to the presentation of the hard
shell plat to the City Clerk for signature and filing with the
Register of Deeds of Dakota County, Minnesota.
