May 15, 1972
The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, May 15, 1972 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Kane, Collins, O'Connor,
Wilson, Driscoll, Christenson and Mayor

Councilman Hallberg.
Minutes of the last meeting were.read and approved.
The Mayor declared open the Public Hearing on the application
of Dennis Held for a Variance in accordance with Section 12.3 of the
City Zoning Ordinance dated December 7, 1970 and a Variance in accord-
ance with Section I, Sub-paragraph F of the Land Subdivision Ordinance
dated December 16, 1968 to allow expansion of the school bus garage
in the area between 9th & 10th Streets, West of Pine Street. All
persons present were given an opportunity to be heard. No on appeared
in opposition to the Variance. The Mayor declared the hearing closed.
The Council deferred action to June 5, 1972 awaiting a report from
the School Board of Independent School District #200.
Moved by Councilman Novak, seconded by Councilman Collins
that the City desires to participate in the construction of a National
Guard Armory in Hastings during the fiscal year 1973 with the stipula-
tion that final plans be presented to the Council before contracts
are let.
Moved by Councilman Collins, seconded by Councilman Driscoll
to limit debate on the new Armory construction. Ayes, all; Nays, none.

Moved by Councilman O'Connor, seconded by Councilman Wilson
to table the action on the construction of a new Armory and that the
question be placed before the public as a referendum vote on the
September 12, 1972 Primary Election ballot for the City of Hastings.
Ayes, Councilmen O'Connor and Wilson; Nays, Councilmen Novak, Kane,
Driscoll, Collins and Christenson. Motion lost.
Roll was then called on Councilman Novak's motion that the
City participate in the construction of a new Armory. Ayes, Councilmen
Novak, Kane, Collins and Driscoll; Nays, Councilmen O'Connor, Wilson
and Christenson. Motion carried.
Moved by Councilman Driscoll, seconded by Councilman Christenson
to pass the second reading of the following Ordinance: Ayes, all; Nays,
none.
AN ORDINANCE REGULATING
AND LICENSING HOME OCCUPATIONS
1. Definitions - A Home Occupation is a use of a residence
for non-residential purposes, as more fully defined in the Hastings
Zoning Ordinance.

2. Commencing July 1, 1972, all home occupations, whether
now existing or hereafter commenced, shall require a license therefore.
Such licenses shall be for one year period, from July 1 of the year
to June 30 of the following year.
3. The City Clerk shall forthwith prepare "Applications
for License" and "License" forms.
4. Pending further Council action, by resolution, the
annual license fee shall be $10.00.
5. The location, type of facility, etc. shall comply
with all other City Ordinances, including the City Zoning and City
Subdivision Ordinances.

Moved by Councilman Driscoll, seconded by Councilman Kane
to approve a Cigarette License for King's Cove, Route #4, Hastings
for the balance of the calendar year 1972. Ayes, all; Nays, none.
Moved by Councilman Wilson, seconded by Councilman
Christenson to appoint Wallace H. Erickson and Donald Fluegel to
represent the City in labor negotiations for 1973 contracts with
Municipal Drivers, Helpers & Public Employees Union, Local #664 and
International Union of Operating Engineers, AFL-CIO, Local No. 49.

Moved by Councilman Kane, seconded by Councilman Driscoll
to refer to the Planning Commission the request of Murray Laub,
dba Master Incorporated to vacate the alley from Tyler Street to
CMStP Railroad spur between 1st & 2nd Streets. Ayes, all; Nays,
none.

Moved by Councilman Kane, seconded by Councilman Collins
to approve a Popcorn License for James Thiel effective for one year
beginning May 16, 1972. Ayes, all; Nays, none.
Moved by Councilman Wilson, seconded by Councilman Kane
that a Public Hearing be held on Monday, June 5, 1972 at 8:00 o'clock
P.M. in the Council Chambers of the City Hall and that the following
notice be published, mailed and posted as required by Ordinance.

NOTICE OF PUBLIC HEARING
ON APPLICATION FOR VARIANCE
Notice is hereby given that the City Council of the City of Hastings
will meet in a Public Hearing on Monday, June 5, 1972 at 8:00 o'clock
P.M. CDST in the Council Chambers of the City Hall to consider the
following:
Application for Variance to City Zoning Ordinance
allowing an addition to a non-conforming structure
according to Section 6.4 of the Zoning Ordinance
on the following described property:
Part of Lots 2 & 3, Block 19, Com. 28' W of SE
corner Lot 2, W 71' North to North line Lot 3
E 15 ft., S 72 ft., E 16 ft., S 20 ft., E 6 ft.,
S 22 ft., E 34 ft., S 26 ft. to south line and
beginning. (204 E. 3rd Street)
Persons desiring to be heard in reference to this variance may be
heard at this time.

Driscoll to approve expenses for three firemen to attend the Minne-
sota State Fire Convention at Brainerd on June 9, 10 & 11, 1972.

Kane to accept the resignation of James Mullenbach from the Charter
Commission effective immediately. Ayes, all; Nays, none.
Moved by Councilman Christenson, seconded by Councilman
Kane to approve a transfer of $134.00 from the General Fund to the
Improvement Bonds of 1969 Payment Account for miscellaneous costs
resulting from the resale of 1969 Temporary Improvement Bonds. Ayes,
all; Nays, none.

Moved by Councilman Wilson, seconded by Councilman Driscoll
to authorize the City Clerk to advertise for bids for Tank Wagon and
Station Pump delivery of Regular and Premium Gasoline for the City;
bids to be opened at 8:00 o'clock P.M. CDST on Monday, June 5, 1972
in the Council Chambers of the City Hall. Ayes, aJl; Nays, none.
Moved by Councilman O'Connor that the City Council impose

a 60 day moratorium for building permits on 50 foot lots and a Study
Committee headed by the City Engineer and including representatives
from the Planning Commission report back in 60 days as to whether or
not building on 50 foot lots meets the City Building Codes. Motion
failed for lack of a second.

Moved by Councilman Wilson, seconded by Councilman Kane to
refer to the Planning Commission the request of Siewert Construction ~
Company for a Variance to Section 9.15 of the City Zoning Ordinance
"District Lot Regulations" to reduce the required set-back on Lot 1,
Block 8, Towns View Estates Addition. Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Kane
to approve the application of Walter Nei to engage in a Home Occupa-
tion of selling live bait from his residence at 1006 East Second
Street. Ayes, all; Nays, none.
Moved by Councilman Wilson, seconded by Councilman Driscoll
to authorize the City Engineer to prepare plans and specifications
and receive bids for construction of watermain extensions to the
proposed Regina Hospital Medical Office Building. Cash payments for
all costs to be borne by the owners of the property through which
the utility is extended. Ayes, all; Nays, none.
Moved by Councilman Novak, seconded by Councilman Collins
to request the Chief of Police, Fire Chief and Building Inspector
to examine the property described as Lots 5 & 6, Block 112, Town
of Hastings Addition and provide the Council with a report of the
condition thereof. Ayes, all; Nays, none.
Councilman Wilson introduced the following resolution and
moved its adoption:

BE IT RESOLVED that the plat of Old Bridge Addition to the
City of Hastings, Dakota County, Minnesota legally described as follows:
All that part of West 1/2 of SE 1/4 of Section 29,
Tl15N, R17W lying Westerly of the Right-of-way of
Pleasant Drive and North of the center line of the
Vermillion River and South of a line parallel to
and 2059.47 feet North of the South of West 1/2 of
Southeast 1/4.

Be and hereby is accepted, subject to the payment of the
Interceptor Sewer charge, subject to the requirements of the "Land
Subdivision Ordinance" dated December 16, 1968, and the City Zoning
Ordinance dated December 7, 1970, subject to dedication of Public
Lands and utility easements, subject to cash payment to the City an
amount equal to five percent (5%) of the present assessed value, as
determined by the County Assessor, of the property lying within the
above described Addition, in lieu of Park Land dedication required
under the Subdivision Ordinance, and subject to the presentation of
the hard shell plat to the City Clerk for signature and filing with
the Register of Deeds of Dakota County, Minnesota.

Councilman Christenson seconded the motion to adopt said

The City Council of the City of Hastings desires to convey

to you an expression of itscommendation and grateful acknowledgement
for the valued servic~rendered by you in the public interest as the
Director of the Regina Memorial Hospital and Residence Home and the
proposed Regina Medical Center.
The Mayor and Members of the Council sincerely appreciate
the worthwhile contribution that you have made toward the communal
welfare and material development of the City of Hastings.
Adopted by the City Council this 15th day of May, 1972.

WHISPERING OAKS
TOWNHOUSE DEVELOPMENT
The next item on the agenda was the application for a
planned unit development permit for the Whispering Oaks Town House
Development. The City Cler, Engineer and Attorney reported on a
special meeting with the developer. Based upon that meeting, the
following recommendations were made: That a Planned Unit Development
permit be issued for Phase I consisting of approximately 14 acres
bounded by Pleasant Drive on the South, an unnamed street on the west,
and a further unnamed street on the North, which would allow for
126 units. That a Development Contract be entered into at this time
incorporating the following recommendations:
That the property would be platted in accordance with the
City Subdivision Ordinance. After completion of the first 75 units,
the developer would complete the "common facility" consisting of an
indoor swimming pool and a structure with meeting room, sauna,
kitchen facilities, game room, etc. with a cost of approximately
$150,000. That these common facilities be adequate to accomodate 126
units.

The taxes ~n common areas would be assessed against the
owned areas. The plat would incorporate utility easements. The
exhibited landscape plan would be incorporated and become a. condi-
tion of the contract. The developer would petition for improvement
of Pleasant Drive during the 1973 construction season. A detailed
utility plan would have to be submitted to the City Engineer for
approval before installation of any utilities. Before commencement
of utility construction, a bond would be posted with the City to
guarantee landscaping in accordance with the landscape plan.
There will be a separate water meter for each unit. Pro-
tective covenants applicable to the project would be essentially as
existing in 9 Mile Village Town House Development.
After a discussion, it was moved by Councilman Novak,
seconded by Councilman Wilson to adopt the recommendations of the
Committee and authorize issuance of a Planned Unit Development
Permit after execution of a contract incorporating the recommendations.

Moved by Councilman Driscoll, seconded by Councilman
Christenson that the bills as audited be.approved anq ,the City Clerk
be instructed to issue warrants for the~same. Ayes~ all; Nays,
none.
