HomeMy WebLinkAbout04-17-72 931 Hastings, Minnesota April 17, 1972 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, April 17, 1972 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. n Members absent: Councilmen Novak, KaTe, llins, Hallberg, O'Connor, Wilson, Drisc 1, Christenson and Mayor Rotty. None. . Members present: Minutes of the last meeting were read and approved. Moved by Councilman Hallberg, seconded by Councilman Wilson to pass the second reading of an AMENDMENT TO THE CITY ZONING ORDIN- ANCE Dated December 7, 1970, to rezone the following from Agriculture to Residential 3 for Planned Unit Development (Townhouses) in accord- ance with Section 17 of the City Zoning Ordinance. Outlot E of Imperial Estates Addition City of Hastings, Dakota County, Minnesota Moved by Councilman O'Connor to refer to the Dakota County Planner the project of Townhouses in the Imperial Estates Addition. Motion lost for lack of a second. Roll was then taken on the motion to pass the second reading of an AMENDMENT TO THE CITY ZONING ORDINANCE to rezone Outlot E of Imperial Estates Addition. Ayes, Councilmen Novak, Kane, Collins, Hallberg, Wilson, Driscoll and Christenson. Nays, Council- man O'Connor. Motion passed. r Moved by Councilman Novak, seconded by Councilman Kane to delete Concrete Sidewalks and related Sidewalk Construction on Westview Drive, 14th Street to 15th Street from Proposal I of the 1972 Improvement Program. Ayes, Councilmen Novak, Kane, Collins and Driscoll; Nays, Councilmen Hallberg, O'Connor, Wilson and Christenson. The City Clerk declared there were four "aye" votes and four "nay" votes. There being a tie vote, the Mayor cast the deciding vote and voted in the affirmative, and the Mayor declared the motion passed. Moved by Councilman Novak, seconded by Councilman Kane to pass the first reading to amend the Land Sub-Division Ordinance by removing Item F "Sidewalk Section" (Page 13). After considerable discussion, the moving and seconding parties withdrew the motion. Moved by Councilman Kane, seconded by Councilman Driscoll that the following letter be sent to the Dakota County Board with a copy to William Flynn, State of Minnesota, Department of Safety, Civil Defense: Ayes, all; Nays, none. Dakota County Board Dakota County Court House Hastings, Minnesota Subject: Letter of Interest to Participate in Single Local Civil Defense Organization, Dakota Co. r Gentlemen: This letter signifies the interest of the City of Hastings to participate in the proposed single local Civil Defense Organiza- tion of Dakota County with a single Civil Defense director plan. Moved by Councilman O'Connor, seconded by Councilman Novak for a ten minute recess. Ayes, Councilmen Novak, Kane, Hallberg, O'Connor, Wilson, Driscoll and Christenson. Nays, Councilman Collins. Motion passed and the Council recessed at 10:05 P.M. The Mayor reconvened the meeting at 10:15 P.M. Councilman Kane again made the motion to refer to the Planning Commission the Ackerberg Phase I Development Plan, seconded by Councilman Wilson. o Mr. Ackerberg reviewed the history of the project and insisted on issuance of a building permit. Roll was then taken on the motion for referring to the Planning Commission.with the following results: Ayes, all; Nays, none. Mr. Ackerberg then made a statement to the Council to the following effect: That he objected to the matter again being re- ferred to the Planning Commission, and he would seek legal counsel on the matter, and seek damages caused by the refusal to grant the building permit. He stated that he was ready to execute the Develop- ment Agreement with the City, and was insisting on issuance of the building permit. Moved by Councilman Kane, seconded by Councilman Driscoll that a Public Hearing be held on Monday, May 15, 1972 at 8:00 o'clock P.M. in the Council Chambers of the City Hall and that the following notice be published, mailed and posted as required by the City Zoning Ordinance dated December 7, 1970. Ayes, all; Nays, none. NOTICE OF PUBLIC HEARING o Notice is hereby given that the City Council of the City of Hastings, Minnesota will meet in a Public Hearing on Monday, May 15, 1972 at 8:00 o'clock P.M. in the Council Chambers of the City Hall to consider the following: A variance in accordance with Section 12.3 of the City Zoning Ordinance dated Dec. 7, 1970 and A variance in accordance with Section I, Sub- paragraph F of the Land Sub-Division Ordinance dated December 16, 1968 to allow expansion of the school bus garage in the area between 9th & 10th Streets, West of Pine Street. Persons desiring to be heard in reference to this matter may be heard at this time. BY ORDER OF THE CITY COUNCIL this 17th day of April, 1972. Wallace H. Moved by Councilman Collins, seconded by Councilman Driscoll to approve the request of the Veterans of Foreign Wars to sponsor a circus on June 3, 1972 using the Spiral Park area as a location for the event. George Freiermuth - Hastings Liquors Lawrence Yanz - Bierstube David Huisenga - Four Seasons Produce Councilman Driscoll introduced the following resolution and moved its adoption: RESOLUTION PLAT CHECK AUTHORIZATION DAKOTA COUNTY SURVEYOR WHEREAS, the office of Dakota County Surveyor was created on January 3, 1972; and WHEREAS, the State of Minnesota Statutes Chapter 505 require fixed platting requirements; and n WHEREAS, the interpretation of said Statutes can create a difference in standards set by the various municipalities; and WHEREAS, a review of each plat could be made by the County Surveyor at no cost to the City, NOW THEREFORE, Be it resolved by the City Council of the City of Hastings, Minnesota that the County Surveyor is hereby authorized to check plats and registered land surveys for their compliance with State Statutes, and the County Surveyor's signature block will be affixed to the plat to that effect. Councilman Driscoll introduced the following resolution and moved its adoption: n AGREEMENT RESOLUTION Relating to Parking Restrictions On M.S.A.P. 30-132-041 From Prairie Street to Lyn Way In the City of Hastings, Minnesota THIS AGREEMENT, made and entered into this 17th day of April, 1972, by and between the City of Hastings, Dakota County, Minnesota and the Commissioner of Highways, State of Minnesota. The Municipal corporation shall hereinafter be called the "City", and the Commissioner of Highways of the State of Minnesota, hereinafter shall be referred to as the "Commissioner", WITNESSETH: " WHEREAS, the "City" has planned the improvement of T.H. 55 South Frontage Road from Prairie Street to Lyn Way; and J 934 WHEREAS, said improvement does not conform to the approved minimum standards as previously adopted for such Municipal State Aid Streets and that approval of the proposed construction as a Municipal State Aid Street project must therefore be conditioned upon certain parking restrictions; and WHEREAS, the extent of these restrictions that would be a necessary prerequisite to the approval of this construction as a Municipal State Aid project in the "City", has been determined. NOW, THEREFORE, IT IS HEREBY AGREED, by and between the parties hereto as follows: o That the "City" shall restrict the parking to motor vehicles on and along the north curb line of said T.H. 55 South Frontage Road, at all times, unless hereinafter authorized in writing by the Commissioner. Moved by Councilman Novak, seconded by Councilman Driscoll to pass the first reading of the following Ordinance: Ayes, all; Nays, none. AN ORDINANCE REGULATING AND LICENSING HOME OCCUPATIONS 1. Definitions - A Home Occupation is a use of a residence for non-residential purposes, as more fully defined in the Hastings Zoning Ordinance. o 2. Commencing J~ly 1, 1972, all home occupations, whether now existing or hereafter commenced, shall require a license therefore. Such licenses shall be for one year period, from July 1 of the year to June 30 of the following year. 3. The City Clerk shall forthwith prepare "Applications for License" and "License" forms. 4. Pending further Council action, by resolution, the annual license fee shall be $10.00. 5. The location, type of facility, etc. shall comply with all other City Ordinances, including the City Zoning and City Sub-Division Ordinances. Moved by Councilman Kane, seconded by Councilman Collins to refer to the Planning Commission the request of Robert Schommer for a Variance for R-1 expansion in a C-3 zone at 204 E. 3rd Street, described as follows: Ayes, all; Nays, none. Moved by Councilman Kane, seconded by Councilman Driscoll to advise the operator of the Red Owl Store in the Midtown Shopping Center that paper and cardboard could no longer be stored behind the premises, as it violates City Codes. Moved by Councilman Wilson, seconded by Councilman Kane that the City Council of the City of Hastings approves in principal the concept of the "Guidelines for Community Schools" as set forth by the State of Minnesota. Ayes, all; Nays, none. Moved by Councilman Collins, seconded by Councilman Hallberg that the bills as audited be approved and the City Clerk be instructed to issue warrants for the same.
