HomeMy WebLinkAbout03-20-72 909 Hastings, Minnesota March 20, 1972 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, March 20, 1972 at 7:30 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll, Christenson and Mayor Rotty. r Members absent: None. Moved by Councilman Novak, seconded by Councilman Driscoll to approve the minutes from the last meeting. Ayes, all; Nays, none. The Clerk presented affidavits showing publication of notice of call for bids on $350,000 General Obligation Improvement Bonds of 1972 of the City, for which bids were to be received at this meeting, in accordance with the resolution adopted by the City Council on Feb- ruary 7, 1972. Said affidavits were examined, found to comply with the provisions of Minnesota Statutes, Chapter 475, and were approved and ordered placed on file. The Council proceeded to receive and open bids for the sale of said bonds. The following bids were received: Bidder Dain, Kalman & Quail, Inc. After the bids had been considered and discussed, Councilman Kane introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID ON SALE OF $350,000 GENERAL OBLIGATION IMPROVEMENT BONDS OF lQV2 AND PROVIDING FOR THEIR ISSUANCE 910 BE IT RESOLVED by the Council of the City of Hastings, Minne- sota, as follows: 1. That the bid of Dain, Kalman & Quail, Incorporated to purchase $350,000 General Obligation Improvement Bonds of 1972 of the City, in accordance with the notice of bond sale, at the rates of interest hereinafter set forth, and to pay therefor the sum of $347,158.00 (plus a premium of -0-) is hereby found, determined and declared to be the most favorable bid received, and is hereby accepted and said bonds are hereby awarded to said bidder, The City Clerk is directed to retain the deposit of said bider and to forthwith return the good faith checks or drafts to the unsuccessful bidders. Said bonds shall be payable as to princip&and interest at the First National Bank of St. Paul. o 2. The $350,000 negotiable coupon general obligation bonds of the City shall be dated April 1, 1972 and shall be issued forth- with. Said bonds shall be 70 in number and numbered from 1 to 70, both inclusive, in the denomination of $5,000 each. Said bonds shall mature serially, lowest numbers first, without option of prepayment, on April 1 in the years and amounts as follows: $45,000 in each of the years 1973 to 1978 both inclusive. $40,000 in each of the years 1979 and 1980. 3. Said bonds shall provide funds to help defray the expense of refunding $535,000 Temporary Improvement Bonds of 1969. The total cost of said refunding, including legal and other professional charges, publication and printing costs, and all other costs necessarily in- curred and to be incurred in connection with said refunding, is esti- mated to be at least equal to the amount of the bonds herein authorized. 4. The bonds of said issue maturing in the years and bearing the serial numbers set forth below shall bear interest, payable October 1, 1972 and semiannually thereafter on April 1 and October 1 of each year, at the respective rates per annum set opposite said maturity years and serial numbers: o Maturity Years 1973-76 1977-78 1979 1980 Serial Numbers Interest Rate 1-36 37-54 55-62 63-70 3.60% 3.90% 4.00% 4.10% 5. The bonds and interest coupons to be issued hereunder shall be in substantially t~e following form: UNITED STATES OF AMERICA STATE OF MINNESOTA DAKOTA AND WASHINGTON COUNTIES CITY OF HASTINGS No. $ GENERAL OBLIGATION IMPROVEMENT BONDS OF 1972 KNOW ALL MEN BY THESE PRESENTS that the City of Hastings, Dakota and Washington Counties, Minnesota, certified that it is in- debted and for value received promises to pay to bearer, without option of prepayment, the sum of o THOUSAND DOLLARS on the first day of April, 19 and to pay interest thereon from the date hereof until the princIpal is paid at the rate of percent ( %) per annum, payable on the first day of October, 1972 and semiannually thereafter on the first day of April and the first day of October in each year, in accordance with and upon presentation and surrender of the interest coupons hereto attached, as the same severally become due. Both principal and interest are payable at 911 in any coin or currency of the United States of America which at the time of payment is legal tender for public and private debts. r This bond is one of an issue in the total principal amount of $350,000 all of like date and tenor, except as to maturity and interest rate, which bond has been issued pursuant to and in full con- formity with the Constitution and laws of the State of Minnesota for the purpose of providing money to help defray the cost of refunding Temporary Improvement Bonds of 1969, dated July 1, 1969, and is payable out of the Temporary Improvement Bonds of 1969 Fund of the City. This bond constitutes a general obligation of the City, and to provide moneys for the prompt and full payment of said principal and interest when the same become due, the full faith and credit and taxing powers of said City been and are hereby irrevocably pledged. IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions and things required by the Constitution and laws of the State of Minne- sota to be done, to happen and to be performed, precedent to and in the issuance of this bond, have been done, have happened and have been performed, in regular and due form, time and manner as required by law, and this bond, together with all other debts of the City out- standing on the date hereof and the date of its actual issuance and delivery does not exceed any constitutional or statutory limitation of indebtedness. The City Clerk is directed to cause said bonds to be prepared and the Mayor and Clerk are authorized and directed to execute the same, and to cause said coupons to be executed and authen- ticated by the printed, engraved or lithographed facsimile signatures of said officers. 7. The said bonds when so prepared and executed shall be delivered by the Treasurer to the purchaser thereof upon receipt of the purchase price, and the said purchaser shall not be obliged to see to the proper application thereof. l 8. There has heretofore been created pursuant to resolution of the City Council, dated July 7, 1969, a special fund designated "Temporary Improvement Bonds of 1969 Fund" held and administered by the City Treasurer separate and apart from all other funds of the City. Said fund shall continue to be maintained in the manner specified in said resolution until all of said Temporary Improvement Bonds of 1969 and the bonds herein authorized and the interest thereon have been fully paid. In said fund there shall be maintained, in addition to the"Construction Account" and the "Sinking Fund Account" heretofore established, a "Payment Account". The proceeds of the sale of the bonds herein authorized, less accrued interest received thereon and less any amount paid for said bonds in excess of $343,138, shall be credited to the Payment Account, from which}~here shall be paid all costs and expenses of refunding said Temporary Improvement Bonds, 912 including all costs incurred and to be incurred and the moneys in said account shall be used for no other purpose, provided that if upon com- pletion of said refunding there shall remain any unexpended balance in said Payment Accoun~, said balance shall be transferred by the Council to the Sinking Fund Account. There has heretofore been pledged and credited to the Sinking Fund Account, all collections of special ass- essments heretofore levied with respect to the improvements financed by Temporary Improvement Bonds, all accrued interest received upon delivery of the bonds herein authorized and said Temporary Improve- ment Bonds, and all funds remaining in said Construction Account after completion of said improvements and payment of the costs thereof, not transferred to the fund of another improvement. In addition to said amounts there is hereby pledged and credited to the Sinking Fund Account, all funds paid for the bonds herein authorized in excess of $343,138. The Sinking Fund Account shall be used solely to pay prin- cipal and interest on the Temporary Improvement Bonds of 1969 and the bonds issued hereunder. o 9. The estimated collections of special assessments hereto- fore levied with respect to the improvements financed by said Tempor- ary Improvement Bonds of 1969, and other revenues pledged for the payment of the bonds, herein authorized, will produce at least five per cent in excess of the amount needed to meet when due the principal and interest payments on the bonds. 10. For the prompt and full payment of the principal of and interest on the bonds herein authorized, as the same respectively become due, the full faith, credit and taxing powers of the City shall be and are hereby irrevocably pledged. 11. The City Clerk is hereby directed to file certified copies of this resolution with the County Auditors of Dakota and Washington Counties, Minnesota, together with such other information as they shall require, and to obtain from said Auditors their certifi- cates that said bonds have been entered in the said Auditor's Bond Registers. o 12. The officers of the City are hereby authorized and directed to prepare and furnish to the purchaser of said bonds, and to the attorneys approving the legality of the issuance thereof, certified copies of all proceedings and records of the City relating to said bonds and to the financial condition and affairs of the City, and such other affidavits, certificates and information as are required to show the facts relating to the legality and marketability of said bonds as the same appear from the books and records under their custody and control or as otherwise known to them, and all such certi- fied copies, certificates and affidavits, including any heretofore furnished, shall be deemed representations of the City as to the facts recited therein. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Novak, and upon vote being taken thereon, the following voted in favor thereof: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll and Christenson; and the following voted against the same: None~ adopted. Whereupon said resolution was declared duly passed and ATTEST: Inll~ -l~ City Clerk cfeY-~ o The Mayor declared open the Public Hearing on Amendments to the City Zoning Ordinance dated December 7, 1970 regarding "Signs" and "Home Occupations". The Clerk presented affidavits of publication of Notice of Hearing as required by law. The Hearing commenced at 8:00 o'clock P.M. as advertised. All persons were given an opportun- ity to be heard. No one appeared regarding the Amendments as adver- tised. The Mayor declared the Hearing closed. Moved by Councilman Hallberg, seconded by Councilman Wilson to pass the third and final reading of an Amendment to the CITY ZONING 913 ORDINANCE dated December 7, 1970 in the following particulars: Ayes, all; Nays, none. The City Council of the City of Hastings does ordain: "SIGNS" Delete Section 7.3.7.1 Insert Section 7.3.7.1 Signs bearing only property numbers or post box numbers. '- Delete Section 7.3.6 Insert Section 7.3.6 Signs are prohibited within the public right-of- way or easements except that signs may protrude not more than fifteen (15) inches from any building facade over the public right-of-way or easements. The City Council may grant permission to locate signs and decorations on or within the right-of-way for a specified time not to exceed sixty (60) days. Delete Section 7.3.18 Insert Section 7.3.18 Any present non-conforming sign shall be made to conform to this Ordinance before January 1, 1975. Any owner of a present non-conforming sign wishing to continue use of the sign after January 1, 1975, must, before, January 1, 1975, apply for and receive a Variance from this Section of the Ordinance. ~ Adopted by the City Council this 20th day of March, 1972. 0' !J /~ C2~ Moved by Councilman Wilson, seconded by Councilman Hallberg to pass the third and final reading of an Amendment to the CITY ZONING ORDINANCE dated December 7, 1970 in the following particulars: Ayes, all;; Nays, none. bJ .JI~ - City lerk ATTEST: v "HOME OCCUPATIONS" "~' Section 2.2 Definitions Delete the existing definition and insert the following: An occupation conducted in a dwelling unit, provided that: No person other than members of the family residing on the premises shall be engaged in such occupation; The use of the dwelling unit for the home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants, and not more than 25 per cent of the floor area of the dwelling unit including basement shall be used in the conduct of the home occupation. There shall be no change in the outside appearance of the building or premises, or other visible evidence of the conduct of such home occu- pation other than one, non-illuminated sign in accordance with Section 7.3.19.1 of this Ordinance. No home occupation shall be conducted in any accessory building; No traffic shall be generated by such home occupation in greater volumes than would normally be expected in a residential neighborhood, and any need for parking generated by the conduct of such home occupation shall be met off the street and other than in a required front yard. No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors, or electrical interfer- ence detectable to the normal senses off the lot, if the occupation is conducted in ohter than a single-family residence. In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises, or causes fluctuations in line voltage off the premises. Delete Section 9.3.2.4.1 914 Insert Section 9.3.2.4.1 Not more than 25 per cent of the gross floor are including basement of the residence is used for this purpose. Councilman Christenson introduced the following resolution and moved its adoption: .......1 RESOLUTION TO RELEASE STATE AID FUNDS WHEREAS, the City of Hastings did enter into a Construction Agreement No. 56641 for the following project: S.P. 1913-24 Traffic control signal with street lights at the intersection of T.H. 61 and 15th Street - M.S.A.P. 30-128-07 AND, WHEREAS, the project is complete and the City does desire to pay the City Share from M.S.A. funds; NOW, THEREFORE, BE IT RESOLVED that the Commissioner of Highways be and is hereby requested to authorize payment from the regular M.S.A. Construction Account in the amount of $10,255.50. Moved by Councilman Driscoll, seconded by Councilman Wilson that the following fund transfers be made for the purchase of the Front End Loader and the Snow Loader by the Street Department: Ayes, all; Nays, none. $20,000 from the Sewer Fund Income Account (Waste Water) $16,000 from the Street Truck Sinking Fund $36,000 to the Street Fund - Machinery & Equipment Councilman Wilson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT [ WHEREAS, pursuant to a written contract signed with the City of Hastings on the 20th day of September, 1971, Keys Well Drill- ing Company having satisfactorily completed the construction of a Water Well in the Industrial Park, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The work completed under said contract is hereby accepted and approved, and 915 BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to issue proper order for final payment of $5,023.65 on such contract, taking the contractor's receipt in full.
