Members present: Councilmen Novak, Kane, Hallberg, Collins, O'Connor, Wilson and Driscoll. fl Members absent: Councilman Christenson and Mayor Rotty. Acting Mayor Novak presiding. Minutes of the last meeting were read and approved. The Council heard all persons interested in said improvements. All persons present were afforded an opportunity to present their views and objections to the making of said improvements. And have presented such plans and specifications to the Council for approval. NOW THEREFORE BE IT RESOLVED by the City Council of Hastings, Minnesota: 1. Such plans and specifications, a copy of which is on file in the City Clerk's Office are made a part hereof are hereby approved. o 2. The City Clerk shall prepare and cause to be inserted in the official newspaper an advertisement for bids upon the making of such approved plans and specifications. The advertisement shall be published for three (3) weeks and shall specify the work to be done and shall state that the bids will be opened and considered by the Council at 2:00 o'clock P.M. on April 27, 1972 in the Council Chambers of the City Hall and awarded on Monday, May 1, 1972 at 8:00 o'clock P.M. and that no bids will be considered unless sealed and filed with Clerk and accompanied by a cash depository, cashier's check, bid bond or certified check payable to the Clerk for five (5) percent of the amount of such bids. 903 Councilman Wilson seconded the motion to adopt said resolution and the following votes were cast: Ayes; Councilmen Novak, Kane, Hallberg, O'Connor, Wilson, Driscoll. Nays; Councilman Collins. The Mayor declared the resolution adopted with the following exceptions: That the following two projects: r Proposal I Item 3. Sun Valley Drive east boundary of Bauer's First Addition to Westview Drive - Concrete Sidewalks. Item 6. Westview Drive from 23rd Street to Southview Drive - Bituminous Surfacing and Concrete Curb and Gutter and limited Storm Drainage. had not been adequately petitioned for, and since M.S.A. 429 requires a 4/5ths vote of the entire Council (7 of 8), and since the affirmative vote was six ayes, these two projects would not be included in the 1972 Improve- ment Program unless the Council acts specifically to include them, with an affirmative vote of 4/Sths of the entire Council. After lengthy discussion the following transpired: Moved by Councilman O'Connor, seconded by Councilman Hallberg to reconsider including Proposal I, Item 6 as stated above in the 1972 Improvement Program. Ayes; Councilmen Novak, Kane, Hallberg, O'Connor, Wilson and Driscoll. Nays; Coun~ilman Collins. Motion lost for lack of a 4/5ths vote of the entire Council. Moved by Councilman Collins, seconded by Councilman Kane to reconsider including Proposal I, Item 6 as stated above in the 1972 Improvement Program. Ayes, all; Nays, none. l Moved by Councilman Collins, seconded by Councilman Driscoll to include Proposal I, Item 6 - Westview Drive from 23rd Street to Southview Drive - Bituminous Surfacing and Concrete Curb and Gutter and limited Storm Drainage in the 1972 Improvement Program. Ayes, all; Nays, none. The Mayor declared that based upon the foregoing votes, Proposal 1, Item 6 - Westview Drive from 23rd Street to Southview Drive Bituminous Surfacing and Concrete Curb and Gutter and limited Storm Drainage i$ part of the 1972 Construction Program and is to be included in Ordering the Improvements and Advertisement of Bids. "SIGNS" Delete Section 7.3.7.1 Insert Section 7.3.7.1 Signs bearing only property numbers or post box numbers. n Delete Section 7.3.6 Insert Section 7.3.6 Signs are prohibited within the public right-of- way or easements except that signs may protrude not more than fifteen (15) inches from any building facade over the public right-of-way or easements. The City Council may grant permission to locate signs and decorations on or within the right-of-way for a specified time not to exceed sixty (60) days. Delete Section 7.3.18 Insert Section 7.3.18 Any present non-conforming sign shall be made to conform to this Ordinance before January 1, 1975. Any owner of a 904 present non-confornming sign wishing to continue use of the sign after January 1, 1975, must, before, January 1, 1975, apply for and receive a Variance from this Section of the Ordinance. Moved by Councilman Wilson, seconded by Councilman Hallberg to pass the second reading of an AMENDMENT TO THE CITY ZONING ORDINANCE dated December 7, 1970 in the following particulars: Ayes, all; Nays, none. "HOME OCCUPATIONS" Section 2.2 Definitions Delete the existing definition and insert the following: An occupation conducted in a dwelling unit, provided that: No person other than members of the family residing on the premises shall be engaged in such occupation; The use of the dwelling unit for the home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants, and not more than 25 per cent of the floor area of the dwelling unit including basement shall be used in the conduct of the home occupation. There shall be no change in the outside appearance of the building or premises, or other visible evidence of the conduct of such home occupa- tion other than one, non-illuminated sign in accordance with Section 7.3.19.1 of this Ordinance. No home occupation shall be conducted in any accessory building; No traffic shall be generated by such home occupation in greater volumes than would normally be expected in a residential neighborhood, and any need for parking generated by the conduct of such home occupation shall be met off the street and other than in a required front yard. o No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors, or electrical interfer- ence detectable to the normal senses off the lot, if the occupation is conducted in other than a single-family residence. In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises, or causes fluctuations in line voltage off the premises. o Delete Section 9.3.2.4.1 Insert Section 9.3.2.4.1 Not more than 25 per cent of the gross floor area including basement of the residence is used for this purpose. Section 9.3.2.4.5 shall be renumbered 9.3.2.5 Councilman O'Connor introduced the following resolution and moved its adoption: RESOLUTION TO PUBLIC EXAMINER BE IT RESOLVED by the City Council of the City of Hastings, Minnesota that the Public Examiner be requested to examine the books, accounts, records and affairs of the City Government of the City of Hastings, Minnesota from the date of the last audit to December 31, 1972.
