The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, February 28, 1972 at 8:00 o'clock P.M.
in the Council Chambers of the City Hall.

Members present: Councilmen Novak, Kane, Collins,
O'Connor, Wilson, Driscoll and
Christenson.
Members absent: Councilman Hallberg and Mayor Rotty.
Acting Mayor Novak presiding.
Minutes of the last meeting were read and approved.
Moved by Councilman Collins, seconded by Councilman Driscoll
to grant a Variance to Section 7.3 "Signs" of the City Zoning Ordinance
dated December 7, 1970 to Mr. Fred Larson dbal Hastings Sewing Machine
Company, 220 East Second Street. Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Kane
that the following Certificate of Correction be granted. Ayes, all;
Nays, none.

I, Charles E. Dahlgren, do hereby certify that the original plat titled
"Dakota Hills Second Addition" was surveyed by me and filed in the
office of the Register of Deeds, Dakota County, Minnesota, in Book No.5
of Plats, Page No. 43, on November 13, 1969, and that said plat as
therein filed is defective by reason that in the dedication the property
description of the area of said plat which lies within the West 1/2 of
the Southwest 1/4 of Section 28, Township 115, Range 17, Dakota County,
Minnesota, because the word phrase "Northwest 1/4" appears in two (2)
places, instead of the correct word phrase "Southwest 1/4".
I, Charles E. Dahlgren, do further certify that the correct property
description in the dedication on said plat (with the corrected phrase
underlined) is as follows: Commencing at the Southwest corner of the
West 1/2 of the Southwest 1/4; thence on an assumed bearing of North
00 degrees, 01 minutes, 104 seconds East along the West line of said
West 1/2 of the Southwest 1/4, a distance of 183.0 feet to the point
of beginning; thence North 00 degrees, 01 minutes, 04 seconds East
along the West line of said West 1/2 of the Southwest 1/4, a distance

Christenson that the Planned Residential Development concept for
Town House construction, rezoning as required and vacation of certain
streets within Dakota Hills Second Addition be referred to the Planning
Commission for study. Ayes, all; Nays, none.
Moved by Councilman Wilson, seconded by Councilman Christenson
that a Public Hearing be held on Monday, March 20, 1972 at 8:00 o'clock
P.M. in the Council Chambers of the City Hall and that the following
notice be published, mailed and posted as required by the City Zoning
Ordinance, and further, that the amendment to the Ordinance as stated 0
below in the Notice of Hearing pass the first reading. Ayes, all;
Nays, none.
NOTICE OF PUBLIC HEARING
ON AMENDMENTS TO CITY ZONING ORDINANCE
Notice is hereby given that the City Council of the City of Hastings,
Minnesota will meet in a Public Hearing On Monday, March 20, 1972 at
8:00 o'clock P.M. in the Council Chambers of the City Hall to consider
amendments to the City Zoning Ordinance dated December 7, 1970 in the
following particulars:
Delete Section 7.3.7.1
Insert Section 7.3.7.1 Signs bearing only property numbers or post
box numbers.
Delete Section 7.3.6
Insert Section 7.3.6 Signs are prohibited within the public right-of-
way or easements except that signs may protrude not more than fifteen
(15) inches from any building facade over the public right-of-way or
easements. The City Council may grant permission to locate signs and
decorations on or within the right-of-way for a specified time not to
exceed sixty (60) days.

Delete Section 7.3.18
Insert Section 7.3.18 Any present non-conforming sign shall be made
to conform to this Ordinance before January 1, 1975. Any owner of a
present non-conforming sign wishing to continue use of the sign after
January 1, 1975, must, before, January 1, 1975, apply for and receive
a Variance from this Section of the Ordinance.
Persons desiring to be heard in reference to these amendments may be
heard at this time.

Notice is hereby given that the City Council of the City of Hastings,
Minnesota will meet in-a Public Hearing on Monday, March 20, 1972 at
8:00 o'clock P.M. in the Council Chambers of the City Hall to consider
amendments to the City Zoning Ordinance dated December 7, 1970 in the
following particulars:
Section 2.2 DEFINITIONS
Home Occupation

Delete the existing definition and insert the following:

An occupation conducted in a dwelling unit, provided that:
No person other than members of the family residing on the premises
shall be engaged in such occupation;
The use of the dwelling unit for the home occupation shall be clearly
incidental and subordinate to its use for residential purposes by its
occupants, and not more than 25 per cent of the floor area of the
dwelling unit including basement shall be used in the conduct of the
home occupation.
There shall be no change in the outside appearance of the building or
premises, or other visible evidence of the conduct of such home occu-
pation other than one, non-illuminated sign in accordance with
Section 7.3.19.1 of this Ordinance.
No home occupation shall be conducted in any accessory building; No
traffic shall be generated by such home occupation in greater volumes
than would normally be expected in a residential neighborhood, and
any need for parking generated by the conduct of such home occupation
shall be met off the street and other than in a required front yard.
No equipment or process shall be used in such home occupation which
creates noise, vibration, glare, fumes, odors, or electrical inter-
ference detectable to the normal senses off the lot, if the occupation
is conducted in a single-family residence, or outside the dwelling
unit if conducted in other than a single-family residence. In the
case of electrical interference, no equipment or process shall be
used which creates visual or audible interference in any radio or
television receivers off the premises, or causes fluctuations in line
voltage off the premises.

Delete Section 9.3.2.4.1
Insert Section 9.3.2.4.1 Not more than 25 per cent of the gross floor
area including basement of the residence is used for this purpose.
Section 9.3.2.4.5 shall be renumbered 9.3.2.5

that the annual Financial Statement for the fiscal year ended December
31, 1971 for the City of Hastings, as prepared by the Administrator,
Clerk-Treasurer be and hereby is accepted. Ayes, all; Nays, none.
Moved by Councilman Wilson, seconded by Councilman Driscoll
that the Comprehensive Report on the Sanitary Sewerage System for the
City of Hastings as prepared by the firm of Toltz, King, Duvall,
Anderson & Associates, be approved and be submitted to the Metropolitan
Sewer Board in accordance with the 1969 Minnesota Metropolitan Sewer
Act. Ayes, all; Nays, none.

Bailey Addition - School District #200 took ownership on
November 13, 1971. Exempt for 1972.

Town of Hastings Addition - State of Minnesota took these
two parcels on December 2, 1969. County did not realize
this had not been taken off the tax rolls. Exempt for
1971 and 1972.
Addition 13 - County found affiant to be erroneously
assessed for fireplace. Abate value of fireplace ($300.)
Addition 13 - In checking with other homes in the area,
the County found this home to be over-valued by
comparison.
Councilman Driscoll introduced the following resolution
and moved its adoption:
CHICAGO, MILWAUKEE, ST. PAUL & PACIFIC
RAILROAD BRIDGE - HASTINGS
WHEREAS, the Department of Transportation, United States
Coast Guard is updating plans for alteration of the "Hastings Railroad
Drawbridge Mile 813.7, Upper Mississippi River",
AND WHEREAS, said alteration shall be performed under the
Truman-Hobbs Act and the present structure is declared an unreason-
able obstruction to navigation,

AND WHEREAS, the present swing bridge, pivot pier, pivot
pier protection and sheer fences shall be removed and replaced with
a vertical left span,
NOW, THEREFORE, be it resolved that the City Council of the
City of Hastings is in favor of said improvement as proposed and as
expeditiously as possible.

NOTICE OF HEARING
ON DOWN TOWN PARKING LOT
Notice is hereby given that the City Council of the City
of Hastings, Minnesota, will meet in the Council Chambers of the City
Hall at 7:00 o'clock P.M. on Monday, April 3, 1972 to consider the
following improvements:

Lots 1 thru 4, Block 3, Original Town Addition
Purchase of Land, Bituminous Surfacing,
Maintenance Agreement, and Incidental Costs
Thereto.
The City Council proposes to assess all or part, of the cost
for such improvements against every lot, piece or parcel of land
within the Corporate Limits that benefits from said improvements
according to the special benefits received without regard to cash
valuation.
The estimated cost of said improvements is $90,000.00.

quest from James & Hazel Haas to sell Lots 7 & 8, Block 120, Original

family dwelling or to sell said property to the City of Hastings as
being contiguous to the East Side Chestnut Street City Park. Ayes,

Minnesota Minnesota Chief of Police Institute on March 15 thru 17,
