January 17, 1972
The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, January 17, 1972 at 8:00 o'clock P.M. in
the Council Chambers of the City Hall.
Members present: Councilmen Novak, Collins, Kane, Hallberg
O'Connor, Wilson, Driscoll, Christenson
and Mayor Rotty.

Members absent: None.
Minutes of the last meeting were read and approved.
Moved by Councilman Christenson, seconded by Councilman
Wilson to ratify the Mayor's appointment of Councilman Hallberg to
be the Hastings representative to the Southeast Sanitary Sewer Area
No.6 Advisory Commission. Ayes, all; Nays, none.
Moved by Councilman O'Connor, seconded by Councilman
Christenson to write off as uncollectible $985.42 in Ambulance accounts
representing bills dated back to 1965 and have been returned from the
Credit Bureau as uncollectible. Ayes, all; Nays, none.
Councilman Hallberg introduced the following resolution and
moved its adoption:
RESOLUTION APPOINTING CITY BUILDING OFFICIAL
BE IT RESOLVED that pursuant to Statutory Authority, Leslie
Matula is hereby appointed as City Building Official and was engaged
in that capacity as of May 28, 1971 on behalf of and for the City of
Hastings, Dakota County, Minnesota.
Adopted by the City Council this 17th day of January, 1972.

Councilman Driscoll seconded the motion to adopt
resolution and the same was passed by the following vote:
Councilmen Novak, Hallberg, O'Connor, Wilson, Driscoll and
Nays, Councilmen Kane and Collins. Motion Carried.

transfer the Taxi Cab License presently held by Richard Holzemer to
James K. Bender effective immediately. Ayes, all; Nays, none.
Councilman O'Connor introduced the following resolution and
moved its adoption:
RESOLUTION ON FEATHERSTONE ASSESSMENTS
RESOLVED: That the following Stipulation is hereby adopted
and the City Clerk and City Engineer of Hastings are hereby authorized
and directed to implement said stipulation in accordance with the terms
and conditions thereof, and the Mayor, City Clerk and City Attorney are
hereby authorized daa directed to execute such documents as may be re- O.
quired to implement said supplement.

It is hereby stipulated and agreed by and between Glenn
Harold Featherstone and Louise Featherstone, Appellants, and the City
of Hastings, Dakota County, Minnesota, a Municipal corporation, Respon-
dant, that the appeal and other proceedings pending in the above
matter may be dismissed upon their merits upon the following terms
and conditions:

1. 1967 INTERCEPTOR ASSESSMENT
With respect to the foregoing described 1967 Interceptor
Sewer Assessment, Commission #5013 of the City of Hastings, the same
shall be reduced in an amount from $5,868.00 to $2,000.00, and that
the first payment heretofore made by the Appellants of $685.11 shall
be credited against said $2,000.00, and the balance shall be recerti-
fied to the County Auditor of Dakota County, Minnesota, to be spread
over a period of six years remaining on said assessment, subject,
however, to such deferrment as may be available to the Appellants,
pursuant to the so called Green Acres Act.
2. NORTHWEST AREA TRUNK SANITARY EXTENSION OF 1969 and 1970
The Appellants herein will be granted relief to the extent
of $3,305.82 on the foregoing described Northwest Area Trunk Sanitary
Sewer Extension of 1969-1970, Commission #5470 of the City of Hastings,
and the balance thereof will be respread and certified to the County
Auditor of Dakota County, Minnesota, subject, however, to such defer-
rment as may be available to the Appellants pursuant to the Green Acres
Act.
3. NORTHWEST AREA TRUNK SANITARY SEWER ASSESSMENT OF 1969 & 1970
With respect to the foregoing described Northwest Area Trunk
Sanitary Sewer Assessment, in the amount of $20,563.20 which is Com-
mission #5259, the same shall remain as is, and no relief shall be
granted the Appellants thereon. Subject, however, to such deferrment
as may be available to the Appellants pursuant to the Green Acres Act.

4. NORTHWEST STORM SEWER PONDING BASIN OF 1969
That with respect to the Northwest Storm Water Ponding Basin,
Commission #5395 in the amount of $6,879.00 the same shall remain as
is, subject to the Green Acres Act.
Upon compliance by the City of Hastings with the foregoing
settlement provisions and the recertification to the Auditor of
Dakota County, Minnesota, all proceddings in the above entitled matter
shall be dismissed with prejudice and upon their merits, and the
Stipulation of Dismissal, will be filed with the Clerk of the District
Court of Dakota County, Minnesota.

Councilman Hallberg seconded the motion to adopt
resolution and the same was passed by the following vote:

Nays, Councilmen Kane and Collins. Motion carried.

Moved by Councilman Hallberg, seconded by Councilman Wilson
to refer to the Planning Commission the Final Plat of Kugler and Fluegel.
Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Kane
to authorize the City Engineer to enter into a contract agreement with
William Pechecek for operation and maintenance of the Sewage Pumping
Station for the Lakeview Terrace Mobile Home Park. Ayes, all; Nays,
none.
Moved by Councilman Christenson, seconded by Councilman
Wilson to appoint Richard Holmes Assistant Fire Chief effective
January 17, 1972 for a six month probationary period, conditioned
on the completion of two correspondence courses or equivalent to, on
Administration and Fire Fighting Tactics within the six month period.
Moved by Councilman Collins, seconded by Councilman Driscoll
to table the above motion. Ayes, Councilmen Kane, Collins and Driscoll;
Nays, Councilmen Novak, Hallberg, O'Connor, Wilson and Christenson.
Motion lost.
Roll was then taken on the main motion appointing Richard
Holmes Assista~Fire Chief with the conditions as sighted in the
main motion. Ayes, Councilmen Novak, Kane, Collins, Hallberg, O'Connor,
Wilson and Chr'istenson;Nays ,-Councilman Driscoll. Motion passed.
Moved by Councilman O'Connor, seconded by Councilman Hallberg
that the bills as audited be approved and the City Clerk be instructed
to issue warrants for the same. Ayes, all; Nays, none.'
Moved by Councilman Christenson, seconded by Councilman
Collins that the meeting be adjourned. Ayes, all; Nays, none.
