The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, December 20, 1976 at 8:00 o'clock P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Fischer, Erickson, Trautmann, Kramer,
Schnirring, Latch, Hallberg, Novak and Mayor
Petersen.
Members absent: None.
The Mayor asked if there were any corrections or additions to the
Minutes of the meeting of December 6, 1976. The Minutes were approved with
the following corrections: 1. that it is the Second Reading of the Amend-
ment to the Zoning Ordinance that was passed and not the First Reading,
2. the motion regarding the termination of the Bicentennial Commission be
corrected to read that $1,500 be granted to the Hastings Historic Commission
to complete three publication projects that were not completed during the
Bicentennial year.
The next item was the Public Hearing on the Midtown
HRA proposal. The Mayor called on the City Planner, Mr. Marston.
Mr. Marston stated that under the law, before the HRA passed on
the project, the Planning Commission must act on it. Further,
that the Planning Commission had not passed on the project before
the HRA acted on it. Accordingly the matter will have to be
referred back to the HRA so that it may consider and act on it
subsequent to Planning Commission action. The Mayor stated that
anyone present wishing to make a statement could do so, but that
this would not be considered the public hearing of the Council
on the matter. Everyone wishing to be heard was given an oppor-
tunity to speak. Thereafter the Mayor thanked those present for
their attendance and comment.
Moved by Councilman Latch, seconded by Councilman
Erickson to refer the proposed Mobile Home Ordinance back to the
City Planner for his comments in regards to whether a mobile
home park should be a permitted use in certain zones of the City
or whether a new zone should be created expressly for mobile
home parks. Ayes, 4; Nayes, Trautmann, Schnirring, Kramer and
Hallberg. Being a tie vote the Mayor voted yes. Motion carried.
Moved by Councilman Novak, seconded by Councilman
Trautmann to call two Public Hearings, one on January 10, 1977
and one on January 17, 1977, at 8:00 o'clock P.M. to discuss the
Community Development Block Grant Program for the fiscal year
1977. Notices to be published on December 30, 1976 and January
6, 1977. Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Trautmann to pass the Third and final Reading of the amendment
to the rezoning of Blocks 130, 134, 135, Town of Hastings, from
1-2 to R-2. Ayes, 7; Nayes, Hallberg.
l10ved by Councilman Latch, seconded by Councilman
Hallberg to pay to Kirkham-Michels & Assoc. $6,400 for profess-
ional services in connection with preparation of Phase II of the
Airport Master Plan as per contract. Ayes, 8; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman
Fischer that Thomas Simmons, Administrative Assistant, salary
be set at $14,500 per year, effective January 1, 1977. Ayes, 8;
Nayes, none. Amendment: Funds to be taken from Revenue Sharing
Monies.
Moved by Councilman Erickson, seconded by Councilman
Trautmann to authorize the advertisement for bids for a six
passenger Station Wagon for the Fire Department. Bids to be
opened at 10:00 A.M. on Monday, January 10, 1977 and awarded
at the City Council meeting at 8:00 P.M. on Monday, January 10,
1977. Ayes, 8; Nayes, none.

Moved by Councilman Kramer, seconded by Councilman
Fischer to pass the Second Reading of the Flood Plain Ord.
Ayes, 5; Nayes, 3. Six votes are needed to pass the reading
of an ordinance therefore the Second Reading was not passed.
Councilman Kramer departed the Council Chambers at
this time.
Moved by Councilman Hallb erg, seconded by Council-
man Schnirring to adopt the Revised Assessment Policy dated
December 3, 1976 on record in the Engineer's office. The
basic change was to eliminate the assessment of 5% of each
additional side benefitted on lots that have more than one
side fronting on a sewer or water extension. Only the
initial abutting side will be assessed. Ayes, 7; Nayes, none.
A report was given by the City Engineer on the South-
west Ponding Basin. A brief discussion took place regarding
the November 18, 1976 report. No action was necessary by the
Council.
Moved by Councilman Schnirring, seconded by Council-
man Fischer to approve the Ordinance establishing an Industrial
User Strength Charge and to pass the First Reading of said
Ordinance. Further, the City to enter into the Joint Powers
and Agency Agreement Ayes, 7; Nayes, none. Copy of Ordinance
#50 on file in the office of the City Clerk. A copy of the
Joint Powers and Agency Agreement with the Metropolitan Waste
Control Commission on file in the office of the City Engineer.
Moved by Councilman Novak, seconded by Councilman
Erickson to approve the partial payment to Collins Electric
in the amount of $65,451.11 for the Street Lighting Project.

Moved by Councilman Hallberg, seconded b y Councilman
Novak to approve the application of the VFW Club for a Bingo
License. Ayes, 7; Nayes, none.
Moved by Councilman Novak, seconded b y Councilman
Latch to approve a Gas Fitters License for Richard J. Podgorski,
15963 Fame Ave. Hastings, Mn. Ayes, 7; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Trautmann to accept the resignation of Theodore Shannon from
the HRA. Ayes, 7; Nayes, none.

to pay the bills as audited. Ayes, 7; Nayes, none.
