HomeMy WebLinkAbout11-01-76 Hastings, Minnesota November 1, 1976 2019 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, November 1, 1976 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Kramer, Erickson, Novak, Latch, Schnirring, Trautmann, Fischer, Hallberg and Mayor Petersen. Membets absent: None. The Mayor asked if there were any additions or corrections to the Minutes of the meeting of October 18, 1976 and hearing none declared the minutes approved as read. Moved by Councilman Latch, seconded by Councilman Kramer to approve the Preliminary Plat of Franzmeier's "Tannebaum" on 22nd and Pine St. subject to the following: A. Granting variances for: 1. Length of Cul-de- sac. 2. Width of Right of Way. 3. Distance of surface drainage. B. Obtaining easements in Country Club 3rd Add. for utilities. C. Vacation of existing 33' easement along eastern and southern boundary of property. D. Provision for a temporary easement to allow a cul-de-sac if necessary on the West end of the proposed Southview Drive. Also, that cash be accepted instead of land far as the Park Dedication requirements. Ayes, 7, Nayes, Trautmann. Moved by Councilman Schnirring, seconded by Councilman Kramer to deny the variance request of Kerr-McGee at 1610 Vermillion Street since there was no evidence of hardship. Ayes, 8; Nayes, none. Moved by Councilman Novak, seconded by Councilman Hallberg to approve the variance of Nick Freiermuth on Manor Lane, the variance being granted on the grounds that there is the need to amend foot- note 'g' on Page 50 of the City Zoning Code. Ayes, 7; Nayes, Kramer. Moved by Councilman Latch, seconded by Councilman Novak to approve the Second Reading of the Ordinance changing the name of the street, Hilltop Lane to Hilltop Court. Ayes,S; Nayes, Erickson, Trautmann, Hallberg. Motion carried. Moved by Councilman Hallberg, seconded by Councilman Fischer to approve the First Reading of an Ordinance regulating the use of parks. Moved by Councilman Erickson, seconded by Councilman Trautmann to table this Reading of the Ordinance until the next regular Council meeting of November 15, 1976 to give the Council more time to review it in more detail. FREIERMUTH ORDINANCE 1149 SECOND;,REAQING STREET NAME CHANGE ORDINANCE IJ50 FIRST READING PARK REGULATIONS TABLE FIRST READINC PARK REGULATIONS ORDINANCE 11-15-76 2020 1976 STORM SEWER PROJECTS DISCUSSED TABLE ASSESSMENT DECISION TO 11/15/76 APPROVE INCREASE FIREFIGHTER FUND MOTIONS UPDATING BLDG. INSPECTOR CAR ALLOWANCE JAN JORGENSON FULL TIME-SALARY INC. CANVASS BALLOTS 11/4/76 Four property owners were in the audience and addressed the City Council with reference to the assess- ments that were approved at the last Council meeting concerning the 1976 Improvement project for Storm Sewer in 18th Street and Manor Lane. As a result of some of these concerns regarding an overlapped area of assess- ments, the Council did wish to consider the possibility of looking into their complaints to see if there is justification for consideration. Moved by Councilman Kramer, seconded by Councilman Fischer to give the individuals who raised complaints the same break in the overlapped area on their property in the assessments as we gave to other individuals concerned with the Franzmeier Addition at the last assessment hearing. Moved by Councilman Erickson, seconded by Councilman Novak to table this item until the next regular council meeting of 11/15/76. Ayes, 7; Nayes, Trautmann. Item tabled. Moved by Councilman Novak, seconded by Council- man Fischer to approve the increase in the Firefighter Retirement Pensions in accordance with the following: SEC. 8 MINNESOTA STATUTES 1974 SECTION 69.06 IS AMENDED TO READ: 69.06 (Service Pensions) Every Fire Depart- ment Relief Association organized under any laws of this State where the majority of its members are volun- teers may provide in its certificate of incorporation or by-laws for a service pension in an amount not to exceed $600.00 per year of service to be paid in a lump sum where the retiring member qualifies for a service pension under the provisions hereinbefore set forth. Ayes, 7; Abstained, Latch. The City Administrator pointed out to the Council that the Auditor's have requested that an appropriate motion be made adjusting the Building Inspector's car allowance figure that has occurred in the past. Moved by Councilman Erickson, seconded by Councilman Trautmann that the Council hereby approve for the year 1974 a $75.00 a month allowance that was made at that time. Further be it resolved that for the year 1975 the allowance be increased to $125 per month and for the year 1976 the car allowance be increased to $158 per month. Be it further under- stood that the City Council has for the year of 1977 allocated a city vehicle to the Building Inspector and will no longer have the monthly allowance as in the past, but that his gasoline expenses will be provided for in the budget. He will draw his fuel allotment from the City tanks. Ayes, 8; Nayes, none. Moved by Councilman Trautmann, seconded by Councilman Schnirring to accept Jan Jorgenson as a full time employee of the City and to allot her a $50.00 a month increase. Moved by Councilman Erickson, seconded by Councilman Fischer to amend the motion to authorize a $90.00 a month increase in salary effective Nov. 1, 1976. Ayes, 7; Nayes, Trautmann. The Mayor called for a vote on the original motion as amended. Ayes, 7; Nayes, Trautmann. Moved by Councilman Novak, seconded by Council- man Trautmann that the City Council have a special meeting on November 4, 1976 at 4:30 P.M. for the purpose of canvassing the ballots from the General Election of November 2, 1976 Ayes, 6; Nayes, Kramer and Latch. Motion carried. Moved by Councilman Schnirring, seconded by Councilman Fischer to approve an increase in the salaries of the Election Judges to $3.00 an hour. This to be established as the permanent rate effective this date, November 1, 1976. It is the intent this salary raise go into effect for the November 2, 1976 General Election. Ayes, 8; Nayes, none. The City Administrator reminded the Council that the Public Hearing on the Airport Study Phase II is to be held on November 10, 1976 at 8:00 P.M. in the Council Chambers and requested all members of the Council to make an effort to attend. This meeting will be held jointly with Marshan Town Board. 2021 INCREASE ELECTION JUDGES SALARIES PUBLIC HEARING AIRPORT STUDY 11/10/76 The Administrator also notified the Council AMERICAN LEGION that the American Legion Convention (District) will CONVENTION IN be held in Hastings in 1977, May 20th through May 22nd.HASTINGS 1977 The Legion has requested the City offices be used as meeting rooms for various delegate functions as well as whatever support the City may give to this Convention. A general discussion was held by the City Attornay regarding some updated information on the Flood Plain Ordinance. The City Council requested the first reading of this Ordinance be put on the next Agenda for the November 15, 1976 meeting for consideration. The City Attorney informed the Council that the City of Hastings is in a lawsuit regarding a police officer's action against an escapee from the State Institution at Red Wing. It appears this indi- vidual who escaped from the institution stole an automobile and while racing through the City of Hastings was pursued by the local police force. In the attempt to stop the individual a weapon was used on the vehicle and the vehicle crashed. The individual was injured and sent to the hospital. The basis of the case is the hospital is suing the City for the hospital bill of the individual while he was recuperating from the accident. Councilman Erickson introduced the following resolution and moved its adoption: A RESOLUTION OF THE CITY OF HASTINGS SETTING FORTH THE POLICY WITH REFERENCE TO ASSESSMENT FOR SOUTHWEST AREA WATER LINE Councilman Schnirring seconded the motion to adopt said resolution and the same was passed by the following vote. Ayes, 8; Nayes, none. A copy of this resolution is on file in the City Office. Moved by Councilman Novak, seocnded by Councilman Erickson to grant an extension of time to the Collins Electric Company they requested on the Vermillion Street lighting contract to December 8, 1976. Ayes, 8; Nayes, none. Moved by Councilman Erickson, seconded by Councilman Latch to approve the partial payment to Collins Electric in the amount of $27,429.99. Ayes, 8; Nayes, none. Moved by Councilman Novak, seconded by Councilman Trautmann that the City pay the amount of $250 to cover the deductible for the glass window claim as per the letter from Crum & Forster Insurance Company.
