The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, October 18, 1976 at 8:00 o'clock P.M.
in the Council Chambers of the City Hall.
Members present: Councilmen Kramer, Erickson, Novak, Latch,
Schnirring, Trautmann, Hallberg, Fischer,
and Mayor Petersen.
Members absent: None.
The Mayor asked if there were any additions or corrections
to the Hinutes of the meeting of October 4, 1976 and hearing none
declared the Minutes approved as read.
The Mayor asked if there were any additions or corrections
to the Minutes of the meeting of October 6, 1976 and hearing none
declared the Minutes approved as read.
AWARD BID - FARM LAND LEASE

LEASE
Councilman Erickson introduced the following
resolution and moved its adoption:
WHEREAS, pursuant to an advertisement for bids to
lease approximately 106.6 acres of land for agricultural
purposes for the 1977 and 1978 crop season, at the Hastings
Industrial Park, the following bid was received complying
with the advertisement.

NOW, THEREFORE BE IT RESOLVED by the City Council of
the City of Hastings, Minnesota:
The Mayor and City Clerk are hereby authorized and
directed r into a Lease Agreement for the leasing
of 106.6 in the Industrial Park for the
1977 and
Council of the City of Hastings,
October, 1976.

Councilman Hallberg seconded the motion to adopt said
resolution and the same was passed by the following vote:

The Mayor declared the Public Hearing on the
adoption of the 1976 Assessments open at 8:05 P.M.
The Administrator read into the record the notices of
mailing and certification of the Notice of Public
Hearing, thereby declaring the Hearing had been called
according to Minnesota Law. The Mayor established the
procedure of taking each project to be considered for
assessment giving anyone in the audience an opportunity
to be heard in regard to any item that came up in order
on the list. The Council would cast its vote for each
one as it went along.

Moved by Councilman Erickson, seconded by Council-
man Trautmann to approve the payment from available city
funds for T.H. #61, 12th Street to 6th Street; Sidewalk.
Ayes, 8; Nayes, none.
Moved by Councilman Hallberg, seconded by Council-
man Fischer to approve the assessment for Manor Lane,
Manor Court and 18th Street; Sanitary Sewer, Watermain,
and Storm Sewer with the reduction of proposed storm
sewer assessment of Lot 255, a Replat of Westwood Add.
4th Section, to zero assessment. Further, to reduce
Lots 250 through Lots 254, Replat of Westwood Add. 4th
Section, to one-fourth of the proposed Storm Sewer
Assessment.
Moved by Councilman Schnirring, seconded by Council-
man Kramer to reduce the assessment on the previously
assessed property who paid a storm sewer assessment in
1959, the balance of the assessment to be pciked up by
the City.
The Mayor called for a vote on the Amendment, vote as
follows: Ayes, Trautmann, Schnirting, Kramer. Nayes,
Fischer, Erickson, Latch, Hallberg, Novak. Motion defeated.
Moved by Councilman Novak, seconded by Councilman
Hallberg to amend the initial motion by simply stating the
balance yet to be paid after reductions were done as
called for in the initial motion, be paid for out of
Federal Revenue Sharing Funds which the City would
dedicate to this specific purpose. The Mayor called for
a vote on this motion. Ayes, 8; Nayes, none.
The Mayor called for a vote on the original motion
as amended. Ayes, 8; Nayes, none.

Councilman Schnirring to approve the assessment for
12th Street, Honeysuckle Lane to Pleasant Drive;
Sanitary Sewer and Watermain. Ayes, 8; Nayes, none.

Moved by Councilman Erickson, seconded by
Councilman Kramer to approve the E. lath Street,
T.H. #61 to R.R. track;storm sewer assessment with a
one-half reduction applied to the proposed assessments.
The remaining half is to be paid out of Federal Revenue
Sharing Funds or Local State Aid monies, if they are
available. Ayes, 8; Nayes, none.
Hearing no other comments from the audience
and no other motions to be made, the Mayor closed the
Public Hearing at 10:30 P.M.

ASSESSMENTS
WHEREAS, pursuant to proper notice duly given
as required by law, the Council has met and heard and
passed upon all objections to the proposed assessments
for the improvement of the following:
PROPOSAL I
BITUMINOUS SURFACING, CONCRETE CURB AND GUTTER
AND SIDEWALK
North Frontage Road from Westview Dr. to Hy-De-Hy Building -
Surfacing and Curb and gutter.
Bahls Dr. from North line of Lot 7 to South Frontage Road-
Surfacing and Curb and Gutter.
2004
Honeysuckle Lane and 12th Street from Westview Drive to 14th
Street- Surfacing and Curb and Gutter.
23rd Street from T.H. 61 to Cannon Street-Surfacing, and Curb
and Gutter.

STATE AID PROJECTS
Pleasant Drive from 15th Street to T.H. 55-Surfacing, Curb and
Gutter and Sidewalk.
South Frontage Road from Westview Drive to Pleasant Drive-
Surfacing, Curb and Gutter, Sidewalk, Sewer and Water extensions.
South Frontage Road from Lyn Way to Westview Drive-Surfacing,
Curb and Gutter and Sidewalk.
STATE HIGHWAY TURNBACK PROJECT
East 10th Street from T.H. 61 to C.M.ST.P.&P Railroad-Street
Reconstruction with Surfacing, Curb and Gutter, Sidewalk, Storm
Sewer, and miscellaneous construction.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Hastings, Minnesota:
1. Such proposed assessments, a copy of which is attached
hereto and made a part hereof is hereby accepted and shall
constitute the special assessments against the lands
therein, and each tract of land therein included is hereby
found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the
installments to be payable on or before the first Monday of
January, 1977. Any deferred installments shall bear
interest at the rate of eight percent (8%) per annum. To
the first installments shall be added interest on the
entire assessment, from the date of this assessment
resolution until December 31, 1977. To each subsequent
installment when due shall be added interest for one year
on all unpaid installments.

3. The owner of any property so assessed may, for 30 days
after notification from the City Treasurer, pay to the City
Treasurer, the whole of the assessment without interest,
and he may at any time, prior to certification of the assess-
ment to the County Auditor, as herein provided, pay the whole
of the assessment against any parcel with interest accrued
to the date of payment to the City Treasurer, and he may at
any time thereafter pay the County Treasurer the entire
amount of the assessment remaining unpaid with interest
accrued to December 31st of the year in which such payment
is made.
4. The City Clerk shall forthwith transmit a certified
duplicate of this assessment to the County Auditor to be
extended on the proper tax lists of the County and such
assessment shall be collected and paid over in the same manner
as other municipal taxes. Total amount to be assessed is
$276,665.09.
