HomeMy WebLinkAbout09-07-76 Hastings, Minnesota September 7, 1976 1975 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 7, 1976 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Kramer, Erickson, Latch, Novak, Schnirring, Trautmann, Hallberg, and Mayor Petersen. Members absent: Councilman Fischer. The Mayor asked if there were any corrections or additions to the Hinutes of the Council meeting of August 16, 1976 and hearing none declared the Minutes approved as read. The Mayor declared the Public Hearing open at 8:06 p.m. regarding the vacation of Oak Street between 10th and 11th Streets. Notices of the publi- cation of the Hearing were read into the record. After the Mayor had given all persons in the audience and members of the Council an opportunity to be heard on the subject, declared the Hearing to be closed at 8:07 P.M. Moved by Councilman Schnirring, seconded by Councilman Trautmann to approve the vacation of Oak Street between 10th and 11th Streets. Moved by Councilman Kramer, seconded by Councilman Novak to amend the motion to read: to approve the vacation of Oak Street between 10th and 11th Streets and to maintain permanent easement rights for all existing utilities. Ayes, 7; Nayes, none. The original motion as amended was passed by the following vote: Ayes, 7; Nayes~ 7; Nayes, none. Moved by Councilman Novak, seconded by Councilman Hallberg to approve an Industrial Bond sale to the Rosewood Corporation in the amount of approximately $625,000 for the purpose of coming into the Hastings Industrial Park. Ayes, 7; Nayes, none. Moved by Councilman Hallberg, seconded by Councilman Novak to approve the earnest money contract needed to purchase the land for the Rosewood Corporation. The Rosewood Corporation will be buying three (3) acres of land for 36,000 sq. ft. building with options at later dates to buy two additional three acre parcels. Ayes, 7; Nayes, none. Moved by Councilman Trautmann, seconded by Councilman Schnirring to approve the third and final reading of the Amendment to the Zoning Ordinance concerning Henry Gydesen, being Lot 3, Block 36 Town of Hastings and rezoning same from C-3 to R-2. Ayes, 7; Nayes, none. Copy of ordinance on file in city offices. A presentation was given by Amenity I in regard to its Park Plan proposals, the Old Mill Park and the Hagen property. After the presentation the Council thanked Amenity One for the presentation. The Council held a discussion regarding the transfer of land in Industrial Park to the Old Mill Park design concept. The Council made no determin- ation at this time but will address itself to that issue at a later date. PUBLIC HEARING VACATE PART OF OAK STREET ORDINANCE NO. 47 APPROVE VACATION OF OAK STREET ORDINANCE NO. 48 APPROVE INDUSTRIAL BOND FOR ROSEWOOD CORPORATION APPROVE EARNEST MONEY CONTRACT FOR ROSEWOOD CORP. ORDINANCE NO. 45 AMENDMENT TO ZONING CODE H. GYDESEN AMENITY ONE PARK PLAN PRESENTATION INDUSTRIAL PARK LAND TRANSFER POSTPONED 1976 FIRST READING PARK DEDICATION ORDINANCE APPROVE LIQUOR LICENSE TRANSFER-NYBO"S HOLD OVER REQUEST PARK IMPROVE. TO CORPS OF ENG. Moved by Councilman Novak, seconded by Councilman Trautmann that the Park Dedication Ordinance be referred to the Planning Commission for their review but to pass the first reading of the Ordinance with the following change: to read from 8% to 13% as apposed to the original recommendation of the Commission. The reason for referring this motion to the Commission is to get their reaction to the change in percentage~. Ayes, 7; Nayes, none. Moved by Councilman Erickson, seconded by Council- man Schnirring to approve the transfer of the On-Sale and Sunday On-Sale liquor licenses from Castle Corporation dba; Nybo's to John Schrode and Walter Carlson, dba; Tobie's of Hastings, 314 Vermillion St. Hastings, Mn. Ayes, 7; Nayes, none. After a brief discussion on the letter to the Corps of Engineers requesting Park Improvements on the Vermillion River the Council decided to hold this item over to September 20th Council meeting. No action was taken. CALL FOR PUBLIC Moved by Councilman Hallberg, seconded by Council- HEARING ON ASSESS- man Schnirring to instruct the Administrator to establish MENTS. FLOOD the assessment procedures required for the Vermillion River CONTROL PROJECT Control Project as soon as possible and if this motion fails by two votes then the condemnation procedures which are currently in process in the courts should stop. The Administrator is further instructed to set the necessary Public Hearing date. Ayes, 6; Nayes, Novak. Motion carried. APPROVE PROFILE EXT. MAIN. PROGRAM INDUSTRIAL PARK LAND SET AT $10,000 PER ACRE ESTABLISH SITE WATER/SEWER BLDG. AUTHORIZE AUDIT FOR CITY PUBLIC HEARING VACATE STREET COUNTRY ESTATES ADDITION ORDINANCE 1/46 SETTING MAYOR AND COUNCIL SALARIES Moved by Councilman Trautmann, seconded by Council- man Novak to grant Profile Extrusions permission to put in their maintenance program as specified in their letter which would be the construction of a third dry-well, and to further move from the 1978 Public Improvement Program into the 1977 Improvement Program, the 10th Street project for putting in Sanitary Sewer. This would move this project up a year ahead of schedule which might help relieve the situation. Ayes, 7; Nayes, none. Moved by Councilman Novak, seconded by Councilman Trautmann to establish the price of land in the Industrial Park at $10,000 per acre for Mr. Olson or anyone else who wishes to purchase property in the Park. Ayes, 7; Nayes, O. Moved by Councilman Hallberg, seconded by Council- man Novak to establish the construction site of the pro- posed water and sewer building as adjacent to the existing city street garage, and as an addition to said garage. Ayes, 6; Nayes, Latch. Moved by Councilman Hallberg, seconded by Councilman Latch to authorize the State Auditors of the State of Minn. to audit the City of Hastings for the years 1975 and 1976. Ayes, 7; Nayes, none. Moved by Councilman Hallberg, seconded by Council- man Latch to approve the Administrator's establishment of the date of September 20, 1976 for the Public Hearing to consider the Country Club's request to vacate Crest Lane and all of the unnamed circular drive surrounding Lot 4, Country Estates Addition a~ well as the creation of a cul-de-sac at the terminus of Hilltop Lane. Said Public Hearing to be at 8:00 P.M. in the Council Chambers. Ayes, 7; Nayes, none. Moved by Councilman Trautmann, seconded by Council- man Kramer to pass the Third and Final Reading of the Ordinance setting the Mayor and Council salaries. Ayes, 7; Nayes, none. 1977 Moved by Councilman Novak, seconded by Councilman Kramer to approve the first reading of the Industrial Park Board Ordinance with the following correction to include the Mayor as a non-voting member of the Board and to specify that his primary function is to act as the liaison between the Council and the Industrial Park Advisory Board. Ayes, 6; Nayes, Erickson. Moved by Councilman Erickson, seconded by Councilman Hallberg to approve the second reading of the Ordinance Licensing of Bingo Games. Ayes, 7; Nayes, none. Moved by Councilman Kramer, seconded by Councilman Latch to refer to the Planning Commission the Council's concern over swimming ordinance proposals to get their recommendations. Ayes, 7; Nayes, none. The Administrator informed the Council that the Insurance Company would be willing to insure the City's liability for the raising of the water in Lake Rebecca under a special rider policy which would have a premium cost of $100.00 Moved by Councilman Novak, seconded by Council- man Trautmann to authorize the Administrator to pay the cost of $100.00 for the special insurance rider covering the Lake Rebecca raising of the water level project that is being done by the Corps of Engineers.
