HomeMy WebLinkAbout08-16-76 Yastings, Minnesota August 16, 1976 1969 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 16, 1976 at 7:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilman Erickson, Latch, Schnirring, Trautmann, Hallberg, Fischer, Kramer and Mayor Petersen. Members absent: Councilman Novak. The Mayor asked if there were any additions or corrections to the minutes of the meeting of August 2, 1976 and hearing none declared the minutes approved as read. The Mayor asked if there were any additions or corrections to the minutes of the Special meeting of August 9, 1976 and hearing none declared the minutes approved as read. The Mayor opened the Hearing on the Park Dedication Ordinance at 7:45 P.M. The Administrator read into the record the Notices of the Public Hearing. The Mayor gave everyone in the audience and the Council an opportunity to be heard on the subject. After discussion on the item was completed, the Mayor declared the Public Hearing closed at 8:12 P.M. Moved by Councilman Latch, seconded by Councilman Erickson to table the Park Dedication Ordinance at this time and that it be sent to the Planning Commission for their review. The Planning Commission is to reconsider the percentage of land and cost as being considered for Park Dedication Ordinance. The Planning Commission's recommendation to be forwarded to the Council as soon as possible. Ayes, 7; Nayes, none. Moved by Councilman Fischer, seconded by Councilman Erickson to accept the bid of Mutual Benefit Life Insurance Company for long term disabil- ity and to accept the bid of Wisconsin Life Insurance Company for Life, AD & D and Health Policies for the City of Hastings. Copy of Resolution on file in City offices. Ayes, 6; Nayes, none. Councilman Trautmann abstained. Moved by Councilman Schnirring, seconded by Councilman Trautmann that the City Council forward to the Hastings HRA Commission the proposal of whether or not to create an HRA District in the so called Midtown Area. The Council looks favorable upon the creation of such a district and requests the HRA to act upon whether or not they wish to consider and create the district in the near future. Ayes, 5; Nayes, Erickson and Latch. Moved by Councilman Latch, seconded by Councilman Erickson to grant the Variance and Special Use Permit as requested in the Henry Gydesen applica- tion at 118 E. 5th Street. Be it further moved that the Second Reading of the Rezoning of the property at 118 E. 5th St. from C-3 to R-2 be approved. Ayes, 7; Nayes, none. PUBLIC HEARING PARK DEDICATION ORDINANCE TABLE PARK ORD. REFER TO PLANNING RESOLUTION #43-76 AWARD BIDS FOR HEALTH, LIFE, LONG TERM DISABIL. INSURANCE HRA DISTRICT IN MIDTOWN REFERRED TO HRA COMMISSION ORDINANCE #45 SECOND READING REZONING, VARIANCE & SPECIAL USE H. GYDESEN 1970 GRANT VARIANCE O'CONNELL-THUET 906 VERMILLION Moved by Councilman Kramert seconded by Councilman Fischer to grant the Variance as it applies to the O'Connell and Thuet application at 906 Vermillion St't for ten parking stalls and to except the recommendations from the Planning Commission. The Council concurs with the recommen- dation. Ayes, 7; Nayest none. LAKE REBECCA Moved by Councilman Hallberg, seconded by WATER LEVEL Councilman Fischer that the City of Hastings should LIABILITY FOR assume the liability for the property known as the CERTAIN PROPERTY Hastings Cemetary property and the Hoffman property, ASSUMED BY CITY which border on the Lake Rebecca shoreline, for the RESOLUTION #46-76purpose of allowing the maximum of a three foot (3) rise in the water level. It is to be clearly under- stood the City is accepting the liability for those two properties onlYt and the Administrator should look into the possibilities of obtaining a special rider to our liability insurance policYt from our current carrier, to see whether or not this risk can be assumed under a short term insurance rider. Ayes, 7; Nayes, none. NEXT COUNCIL SEPT. 7, 1976 SECOND READING ORDINANCE #46 COUNCIL & MAYOR SALARY CHANGES FIRST READING ORDINANCE #47 LICENSING BINGO GAMES-SET FEES DATE Moved by Councilman Kramer, seconded by Councilman Trautmann to change the meeting date of the next Council meeting from September 6t 1976 to September 7, 1976 because September 6th is Labor Day, an official holiday. Ayest 7; Nayest none. Moved by Councilman Trautmann, seconded by Councilman Erickson to approve the Second Reading of an Ordinance raising the City Council and Mayor salaries. Ayes, 6; Nayest Fischer. Moved by Councilman Erickson, seconded by Councilman Trautmann to move the First Reading of the ordinance "Licensing of Bingo Games" Further that a license be granted to the VFW Club and the fee for said license be established at $10.00 per year. Ayest 7; Nayest none. RESOLUTION #44-76 Moved by Councilman Hallberg, seconded by ORDER FINAL PLANSCouncilman Fischer to adopt the Resolution for order- PUBLIC WORKS ACT ing TKDA to prepare final plans and specification~ and apply for federal monies to construct same under the Public Works Act of 1976. The priority of projects be established thusly: FIRST READING FLOOD PLAIN ORDINANCE TO SEPT. 7-76 1. Highest priority is to order in the final plans and specifications for the East Hastings Sanitary Sewer and Water Project. To submit an application to the federal government for $595tOOO. 2. For the Watermain extension Project from the Industrial Park to the Southwestern part of the City of Hastings in the amount of $311,600. 3. Construction of a City building to house the Sewer and Water Department of the City of Hastings. 4. Ice Arena Improvements. The vote on the above motion was Ayes, 7; Nayes, none. Moved by Councilman Hallbergt seconded by Councilman Erickson to hold the item of the First Reading of the Flood Plain Ordinance to the meeting of September 7t 1976 and requested the Stafff to make final verification of the map that' the lines on the map are correct. Ayest 7; Nayes, none. Moved by Councilman Latch, seconded by Councilman Hallberg to approve the list of Election Judges for the September 14, 1976 Primary which will be in the First and Fourth Wards, as follows: Ayes, 7; Nayes, none. The specific wording of said Referendum item to be as follows: "Should Sections 3.06 and 4.02 of the Home Rule Charter of the City of Hastings be amended so as to give all executive and administrative authority over the City of Hastings Police Department to the City Council, rather than to the Mayor, and to further allow the City Council to delegate to the City Administrator administrative duties with regard to the Police Department, except the authority to hire and discharge employees?" Ayes, 4; Nayes, Latch, Erickson, Trautmann. Motion carried. Moved by Councilman Kramer, seconded by Councilman Fischer to adopt the following Resolution: Ayes, 6; Nayes, Kramer. Motion carried. RESOLUTION AUTHORIZING SUBMISSION OF QUESTION TO THE VOTERS-ELIMINATION OF LIMIT OF ON-SALE LIQUOR LICENSES 1971 APPROVE ELECTION JUDGES FOR PRIMARY ELECTION APPROVE CHARTER AMENDMENTS FOR GENERAL ELECTION REFERENDUM ITEM RESOLUTION #45-76 ISSUANCE OF LIQUOR LICENSES REFERENDUM ITEM WHEREAS, the State liquor control act limits the number of on-sale liquor licenses in this city, exclusive of special club licenses, to t lve (12) but authorizes the voters of the city to eliminate the statutory limit and leave the maximum number of such licenses to Council determination; and WHEREAS, many citizens believe that the present limit is unduly restrictive under conditions now existing in the city and the Council deems it advisable to give the voters an opportunity to vote upon the question of removing the statutory limit; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Hastings, Minnesota: 1972 1. Pursuant to Minnesota Statutes, Section 340.11, Subdivision 18, a election shall be held in the usual polling places in the city on the 2nd day of November, 1976 from 7:00 o'clock a.m. to 8:00 p.m. for the purpose of voting on the following proposition: "Shall the City Council be allowed to issue 'on-sale' licenses for the sale of intoxicating liquor at retail in excess of the number now permitted by law?" 2. The City Clerk shall prepare the necessary ballots and other ction supplies, give proper notice, and arrange other det i1s ecessary for the election. this by the City Council of the City of Hastings f August, 1976. PARTIAL PAYMENT B-TU MIX CO 1976 CONSTRUC- TION Moved by Council an Erickson, seconded by Councilman Latch to approve the partial payment to B-Tu Mix Company for 1976 Construction in the amount of $90,326.23. LIGHTING PROJECT Moved by Councilman Trautmann, seconded by Councilman Kramer to leave the current extent of the Vermillion Street Lighting Project as represented in the initial bids and specifications. No expansion of the project is to be undertaken. Ayes, 7; Nayes, none. HOSPITAL COMMUNI- Moved by Councilman Kramer, seconded by CATION ANTENNA Councilman Hallberg to approve the construction of FOR RADIO an antenna for the State Hospital, for the radio SYSTEMS APPROVED communications systems on top of the water tower in the Hastings Industrial Park. Ayes, 6; Nayes, none, Abstained, Fischer. PAY BILLS Moved by Councilman Erickson, seconded by Councilman Trautmann to pay the bills as audited. Ayes, 7; Nayes, none.
