HomeMy WebLinkAbout07-19-76 Hastings, Minnesota July 19, 1976 1958 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, July 19, 1976 at 8:00 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Erickson, Novak, Schnirring, Latch, Fischer, and Mayor Petersen. Members absent: Councilmen Trautmann, Kramer, Hallberg. The Mayor asked if there were any additions or corrections to the minutes of the meeting of July 6, 1976 and hearing none declared the minutes approved as read. The Mayor asked if there were any additions or corrections to the minutes of the meeting of July 14, 1976 and hearing none declared the minutes approved as read. Moved by Councilman Latch, seconded by Councilman Erickson to grant the variance request to Peavey Mills concerning the front yard setback requirements to allow for the construction of their building 1'5~" from the right-of-way at one point and 4" at another. The new construction will not be any closer to the right-of-way than the existing building. Ayes, 5; Nayes, none. Moved by Councilman Novak, seconded by Councilman Fischer to approve the First Reading of the Ordinance Requiring Dedication of Lands for Park, Open Space and Related Uses. Ayes, 5; Nayes, none. Moved by CouncilmanSchnirring, seconded by Councilman Fischer to approve the Home Occupation Permit for Lil's Day Care Center, 525 McNamara St. for a period of one year, to July 1, 1977. Ayes, 5; Nayes, none. Moved by Councilman Schnirring, seconded by Councilman Fischer to instruct the Staff that a strict enforcement of the Zoning violations should be per- formed by the Staff, particularly in relating to Site Plans. It is understood that when a developer comes before the City Council and gets a site plan approved, that site plan represents an agreement of what the developer will and will not do. In the event that the developer runs into situations of extreme hardship in which some of the initial agreements become unreasonable, the Staff should bring those items before the Council so that the Council may have an opportunity to review and amend or modify the site plan as initially proposed. Ayes, 5; Nayes, none. Councilman Novak departed the Council Chambers at 8:21 P.M. and returned at 8:27 P.M. Moved by Councilman Fischer, seconded by Councilman Erickson to approve the following list of Polling Places for the Primary and General elections September 14, 1976 and November 2, 1976 respectfully. PERMIT LIL'S DAY CARE CENTER ENFORCE ZONING VIOLATIONS - SITE PLANS APPROVE POLLING PLACES FOR ELECTIONS 1959 ALLOW FUNDS FOR POLICE RESERVE VEHICLE APPROVE NAME CHANGE ON LIQUOR LICENSE APPOINT THREE MEMBERS TO VOLUNTEER FIRE DEPT. HESELTON REQUEST WITHDRAWN Mr. Tix of the Police Reserve requested that the City Council assist them in the purchase of a vehicle to replace the current red station wagon which the service uses. After discussion of the matter the following motion was made. Moved by Councilman Novak, seconded by Councilman Latch to allow the amount of $1,000 from the Civil Defense Fund toward the purchase of a vehicle, and that $425.00 be taken from Federal Revenue Sharing Funds to make up the balance of the purchase cost. Be it further resolved the current red ambulance being used by the Civil Defense P0lice Reserve be auctioned off. Ayes, 5; Nayes, none. Moved by Councilman Erickson, seconded by Councilman Latch to approve the name change on the Off-Sale Liquor License from: Vermillion Bottle Shop, Inc. to: The Bar, Inc. Ayes, 5; Nayes, none. Moved by Councilman Schnirring, seconded by Councilman Novak to approve the following individuals as new members of the Volunteer Fire Department. Ayes, 5; Nayes, none. William Ziemer Kenneth Warner Douglas Dietman 1002 W. 15th St. 709 W. 14th St. 1130 Bahls Dr. The City Attorney pointed out a letter which had been written to the City Council concerning Mr. Heselton's previous request in the East Hastings area. The issue has been resolved by Mr. Heselton concerning this matter and he had requested it be removed from the Agenda. No further action was taken by the Council regarding the Heselton proposal. REVISE VERMILLION Moved by Councilman Schnirring, seconded by RIVER FLOOD Councilman Novak to approve the revision in the CONTROL PROJECT Vermillion River Flood Project Resolution #24-76. Ayes, 5; Nayes, none. Copy of Revision and Resolution in file in City Offices. FINAL READING ANNEXATION ORD. NOWICKI, OLSON SIEBEN PROP. COMMITTEE TO REVIEW CITY CODE An Ordinance of the City of Hastings Annexing Certain Lands in Sections 3 & 4, Township 117 (Marshan) Range 17. Moved by Councilman Schnirring, seconded by Councilman Fischer to approve the Third and Final Reading of the Ordinance on Annexation concerning the Nowicki petition. Ayes, 5; Nayes, none. Moved by Councilman Novak, seconded by Councilman Schnirring to approve the Third and Final Reading of the Ordinance on Annexation concerning the Willis Olson petition. Ayes, 5; Nayes, none. Moved by Councilman Novak, seconded by Councilman Latch to approve the Third and Final Reading of the Ordinance on Annexation concerning the petition of Al Sieben. Ayes, 5; Nayes, none. Moved by Councilman Schnirring, seconded by Councilman Fischer that the City Council hereby set up a Committee for the purpose of reviewing the City Code with the City ATtorney to determine possible changes, modifications, or elimination of laws we currently have on the books. Ayes, 5; Nayes, none. Additional discussion of this item continued, whereby the Mayor and Council appointed Erwin Schnirring, Dexter Marston, City Attorney and one member from the Planning Commission as the makeup of this Committee. Moved by Councilman Fischer, seconded by Councilman Novak to approve the Resolution concerning the Metropolitan Waste Control Rules and Regulations being included as part of the Comprehensive Sewer Plan. Ayes,S; Nayes, none. Moved by Councilman Schnirring, seconded by Councilman Erickson to approve the partial payment to B-Tu Mix in the amount of $173,998.22 for State Aid 1976 Construction. Ayes,S; Nayes, none. Moved by Councilman Erickson, seconded by Councilman Latch to approve the Stage 8 Theatre license to Mr. I. Burger for one year. ~yes, 5; Nayes, none.
