The City Council of the City of Hastings, Minnesota
met in a regular meeting on Tuesday, July 6, 1976 at 7:30
P.M. in the Council Chambers of the City Hall.
Members present: Councilmen Erickson, Novak, Latch,
Schnirring, Trautmann, Fischer and
Mayor Petersen.
Members absent: Councilmen Kramer and Hallberg.
The Mayor asked if there were any additions or corrections
to the Minutes of June 21, 1976 and hearing none declared the
Minutes approved as read.
The Mayor asked if there were any additions or corrections
to the Minutes of the meeting of the City Council acting as the
Equalization Board on June 28, 1976 and hearing none declared the
Minutes approved as read.
Moved by Councilman Trautmann, seconded by
Councilman Novak to allow Mr. Heselton to occupy the
structure on his property as a business operation and
to, in effect override the City Planner's administra-
tive interpretation of the zoning law. Ayes, 4;
Nayes, Fischer and Schnirring. The City Attorney
stated he did not feel this was a sufficient majority
as required under the Charter for passage of this
motion. Therefore it was requested that the City
Council withhold any further action on this item until
such time as the Attorney can review the motion and
report back to the Council on July 19, 1976 with a
final interpretation. The Council discussed this and
agreed the Attorney should get back with an official
decision on the vote.
Moved by Councilman Fischer, seconded by
Councilman Novak to approve the Second Reading of the
Ordinance on Annexation. Ayes, 6; Nayes, none.
Moved by Councilman Latch, seconded by
Councilman Trautmann to approve the resignation of
Hi Kilborn from the Natural Resources Commission.
The Council extends to him their deep appreciation
for a job well done. Ayes, 6; Nayes, none.
Moved by Councilman Novak, seconded by
Counci~man Erickson to extend the rezoning permit for
the Archdiocese of St. Paul-Minneapolis concerning
their property on 1199 Bahls Drive for a one year
period of time. This extension will be in effect
until July 1, 1977. Ayes,S; Nayes, Trautmann.
Moved by Councilman Schnirring, seconded by
Councilman Fischer to authorize the advertisement for
bids for Long Term Disability, Health-Major Medical,
and Life Insurance Policies for the City of Hastings~
Bids to be opened at 10:00 a.m. on Tuesday, August 10th
and considered for award at the Council meeting of
August 16, 1976. Ayes, 6; Nayes, none.
The Flood Plain Ordinance was again presented
to the Council for their review. Due to the fact
there were several questions the Council has in regard
to this ordinance, no action was being requested at
this time.

A discussion was held by members of the Council
on the downtown businessmen's concern for new street
lighting in the Second Street area. There was expression
in favor of the Al French design concept which he came
up with when working with the downtowners. It was also
stated the Downtown would be willing to pay for some of
the lighting improvements and did not, at this time,
want to consider using tax increment to defray such costs.
The Council suggested to the Administration that budget
time would be an appropriate time to address this request.
Hopefully, by that time the City would know whether or
not the Congress of the United States is going to extend
Federal Revenue Sharing Funds, and if so, the possible
use of some of those funds to defray part of the cost of
downtown lighting should be considered.
ACTION DELAYED ON After a general discussion of the revised
VERM. RIVER PROJ.resolution on the Vermillion River Project, the Council
RESOLUTION TO thought it best to delay this particular item until the
JULY 19TH. next regular council meeting of July 19th.
Councilman Trautmann requested that a re-
zoning of property described as: Country Estates
1st Addition and the unplatted property located
south of 23rd Street, East of Pleasant Avenue and
North of Vermillion River be considered and sent
to the Planning Commission.
Moved by Councilman Fischer, seconded by
Councilman Novak to refer the rezoning request of
Mr. Trautmann on the above described property, to
the Planning Commission for their recommendation
and report back to the City Council. Ayes, 6;
Nayes, none.
Moved by Councilman Erickson, seconded by
Councilman Trautmann to pay the bills as audited.
Ayes, 6; Nayes, none.
