The City Council of the City of Hastings, Minnesota met
in a regular meeting on Monday, June 21, 1976 at 7:30 P.M. in
the Council Chambers of the City Hall.
Members present:
Councilmen Erickson, Latch, Trautmann,
Hallberg, Fischer and Mayor Petersen.
Members absent:
Councilmen Schnirring, Kramer and Novak.
The Mayor opened the Public Hearing concerning the Flood
Plain Ordinance at 7:34 P.M. The City Administrator read the
official notices of publication in the legal newspaper which
called the Public Hearing and declared the Hearing properly called.
The Mayor gave an opportunity to all persons in the
audience to speak on the issue of the Flood Plain Zoning Ordinance
and after all individuals had done so declared the Hearing closed
at 9:15 P.M.
The Mayor asked if there were any additions or corrections
to the Minutes of June 7, 1976 and hearing none declared the
Minutes approved as read.
Moved by Councilman Trautmann, seconded by
Councilman Hallberg to approve the First Reading of
the Flood Plain Ordinance. Ayes, 3; Nayes, Erickson,
Latch. The City Attorney declared that the Ordinance
requires a majority of the full Council in order to
pass an ordinance of this type therefore the motion
did not pass.
Moved by Councilman Fischer, seconded by
Councilman Hallberg to approve the Resolution con-
cerning the annexation of certain properties in
Marshan Township to the City of Hastings. Willis
Olson, 80 acres in Section 3; Aloyius Sieben, 58.42
acres in Section 4; Raymond Nowicki, 126.75 acres in
Section 4; all in Township 114, Range 17. Copy of
Resolution on file in city offices. Ayes, 5; Nayes, O.
Moved by Councilman Trautmann, seconded by
Councilman Fischer to approve the First Reading of
the Ordinance on Annexation concerning the properties
as listed in the foregoing motion. Ayes,S; Nayes, O.
Moved by C~uncilmau Latch, seconded by
Councilman HallbergOtft~P~~rlance for Jim McNamara,
1800 Ashland St. to construct a garage which would be
6.5 feet from his property line as apposed to 10 feet.
because the intent of the ordinance which requires the
maintenance of a 10 foot setback from the side property
line and a clear vision area at all intersections is
still maintained with the McNamara proposal. Ayes,S;

Moved by Councilman Trautmann, seconded by
Councilman Erickson to table the appeal of the admin-
istrative decision concerning Lawrence Heselton, East
1st Street until the July 6th meeting. Ayes,S; Nayes,
Moved by Councilman Latch, seconded by Council-
man Hallberg to approve the forwarding of a letter to
the office of HUD in the Federal government stating the
Council's position at this time is one which favors the
location of a Senior Citizen Housing Project in the
downtown area of the City of Hastings, within the HRA's
redevelopment district which currently exists. Ayes,S;
Nayes, none.

A discussion was held concerning a new proposal
for the Red Owl store and its expansion plans, in the
Midtown Shopping Center area. After the discussion the
Council instructed the Staff to pursue the feasibility
of such a proposal with the Developer, meet with the
citizens of the neighborhood and discuss the Staff's
findings in terms of costs and feasibility and the
procedures of relocation. It was further suggested
that the method the Council would like to see developed,
if it is a feasible project, would be by the HRA's
creation of a district. It was hoped that the Staff
could develop sufficient additional information on this
proposal to report back to the Council by July 6th of
its findings.
Moved by Councilman Latch, seconded by Council-
man Hallberg to table the considerations for the
Mobile Horne Ordinance until such time as the Planning
Commission reports corne back from the Commission con-
cerning ordinance changes and corrections. Ayes, 5;
Nayes, none.
Mr. Art Baumeister addressed the Council to
inform them he had a proposed sale of 3.44 acres in
the Industrial Park for a firm named Electro Fab, Inc.
Electro Fab would be looking to the construction of
a 12,000 sq. ft. building. The development proposal
they have corne forth with does at this time rest
upon their being able to obtain financing for their
venture.
Moved by Councilman Trautmann, seconded by
Councilman Latch to approve the sale of land to
Electro Fab with the understanding this approval is
contingent upon the firm's ability to achieve financ-
ing for their endeavor. Ayes, 5; Nayes, none.
LIQUOR LICENSE Mr. Erickson discussed with the Council the
REQUEST REFERRED Viking Bar's request for a Sunday Liquor license.
TO COMMITTEE The Council instructed the Staff to refer this to
the license committee for review.
CONSULTANT HIRED Moved by Councilman Hallberg, seconded by
OLD MILL PARK Councilman Latch to hire Mr. Clarence Smith of
DEVELOPMENT Amenity One as the Consultant in reference to devel-
oping a proposal for the Old Mill Park and Addition.
Be it further moved that the Mayor and Administrator
be authorized to sign the contract for Mr. Smith's
services as has been presented to the Council tonight.

APPROVE AGREEMENT Moved by Councilman Fischer, seconded by
RE: VERMILLION Councilman Trautmann authorizing the Mayor and City
RIVER PROJECT Clerk to sign the agreement with the State of Minn.

Moved by Councilman Fischer, seconded by
Councilman Erickson to change the date of the next
Council meeting from July 5th to July 6th because the
5th of July is a Monday which is a legal holiday.

Moved by Councilman Fischer, seconded by
Councilman Erickson to accept the resignation of
Reinold Judge from the Volunteer Fire Department. The
City Council extends its deep appreciation for a job
well done to Mr. Judge for his services to the City.

Moved by Councilman Hallberg, seconded by
Councilman Latch to accept the recommendations of
John Lightbourn concerning the Ice Arena for the
improvements and also authorized the expenditure as
stated in the letter for the imTIPovements to be made.

The Administrator informed the Council that
Mr. Murray Laub of Master Industries, Inc. had re-
quested the City to allow Master Ind. to pay the
newly established SAC charge on his plant operation
of $12,600 over a period of ten months, in equal
installments. In other words, $2,600 be paid immed-
iately upon issuance of the permit and the balance
of $10,000 to be paid at the rate of $1,000 per
month for ten months. The City Council after consid-
eration made the following motion.
Moved by Councilman Erickson, seconded by
Councilman Latch to deny Master Industries, Inc. the
right to make a series of payments for the SAC charge
and the full amount be due at the time of the issuance
of the permit so that when the City has to pay the SAC
charges to the Metropolitan Waste Control Comm. the
full amount of money that is paid will have been the
amount from Master Ind. Inc. Ayes, 5; Nayes, none.
Moved by Councilman Erickson, seconded by
Councilman Trautmann to authorize the purchase of a
rebuilt engine for the 1973 Pontiac ambulance which
is currently in service in the department. The
repairs that have been done on the 1973 ambulance
have not resolved the problem and the purchase of a
rebuilt motor is less expensive than the purchase of
a new engine. Therefore, let it be resolved that we
will agree to pay a total of $1,267.89, which will
cover a past repair bill of $483.88 plus the rebuilt
engine cost of $967.89, less $183.88. Ayes, 5; Nayes,
none.
Moved by Councilman Latch, seconded by
Councilman Hallberg to send to the Planning Commission
the request of G. Gordon Anderson on Zweber Lane, to
purchase city property with the intent of evening up
his own property lines. Ayes, 5; Nayes, none.
Moved by Councilman Erickson, seconded by
Councilman Trautmann to approve the partial payment
to B-Tu Mix in the amount of $44,926.26 for 1976
Improvements. Ayes, 5; Nayes, none.
Moved by Councilman Latch, seconded by
Councilman Trautmann to approve the partial payment of
$41,069.07 to Keller Const. for 1976 Utility Const.
Ayes, 5; Nayes, none.
The City Engineer reviewed the F.A.U. Five
Year Program, that included the Pleasant Avenue Bridge
as a Federal Project, with the Council. The Council
directed the Engineer to pursue the program as pre-
sented. The F.A.U. program will be placed on a future
Council agenda for further consideration and council
consideration of necessary resolutions.
The City Engineer presented the Street Sign
Replacement Program, informing the Council of the
efforts being made in that area.
