The City Council of the City of Hastings, Minnesota met
ln a regular meeting on Monday, May 17, 1976 at 8:00 o'clock P.M.
in the Council Chambers of the City Hall.
Members present: Councilman Kramer, Erickson, Hallberg,
Schnirring, Trautmann, Fischer, Novak,
Latch and Mayor Petersen.
Members absent: None.
The Mayor asked if there were any corrections or additions
to the regular meeting of May 3, 1976 and hearing none declared
the Minutes approved as read.
The Mayor asked for any corrections or additions to the
Special Meeting of the Council of May 5, 1976 and hearing none
declared the Minutes approved as read.
The Mayor declared the Public Hearing open at 8:02 P.M.
concerning the Whispering Oaks Addition, 1975 Improvements and
Assessments. The City Administrator read into the record the
certified copy of the newspaper notice of the meeting and stated
he was in receipt of a certified copy of the mailing list to all
property owners involved.
The Mayor opened the meeting to any member of the public
who had anything to say. After having given everyone an oppor-
tunity to be heard the Mayor closed the Public Hearing at 8:08 P.M.
Moved by Councilman Hallberg, seconded by
Councilman Kramer to approve the assessments and to
certify the assessments for the Whispering Oaks Add.

Moved by Councilman Hallberg, seconded by
Councilman Trautmann to authorize the Mayor and City
Administrator to sign the necessary documents to
approve the change in the Airport contract relation-
ship between the City of Hastings, Wold Associates
and Kirkham-Michaels. This change is to reflect the
fact the City does not have any objections to allow-
ing Wold & Associates to give its final work require-
ments over to Kirkham-Michaels. It is the City's
understanding that Kirkham-Michaels is willing to
undertake this additional burden and the payment for
work will now be made to Kirkham-Michaels.

Moved by Councilman Erickson, seconded by
Councilman Latch to approve the proposed increase in
Ambulance rates as presented this evening by the City
Staff. This rate generally reflects a 25% increase
across the board. Ayes, 7; Nayes, Kramer.

Moved by Councilman Novak, seconded by
Councilman fischer to instruct the City Administrator
to write a letter to the Dakota County Commissioners
stating the City of Hastings is no longer interested in
continuing negotiations concerning the old County Court-
house. The City does not have any interest at this time
to consider taking over the Courthouse as a City opera-
tion. Ayes, 8; Nayes, none.
Moved by Councilman Schnirring, seconded by
Councilman Fischer to direct the Staff to take all of
the funds out of the Sidewalk & Emergency Fund that are
necessary, to do the Sidewalk Replacement Project on
Vermillion Street, between 6th and 12th Streets.

Moved by Councilman Novak, seconded by
Councilman Hallberg to authorize the expenditure of
$10,000 from the City of Hastings' Sidewalk Fund and an
additional $10,000 to be taken from Federal Revenue
Sharing Funds to pay for the Replacement Sidewalk Program
on Vermillion Street, from 6th to 12th Street. Ayes, 5;
Nayes, Fischer, Schnirring, Kramer. Motion passed.
Moved by Councilman Latch, seconded by
Councilman Hallberg to authorize the advertisement of
Bids for one Police Squad Car, bids to be opened at
10:00 a.m. on June 7, 1976 and considered for award
at the Council meeting of June 7, 1976 at 8:00 p.m.

Moved by Councilman Latch, seconded by
Councilman Novak to recognize the resignation of Larry
Kaeder as a volunteer firefighter on the Hastings
Volunteer Fire Department. The resignation to be
effective May 15, 1976. Ayes, 8; Nayes, none.
Moved by Councilman Novak, seconded by
Councilman Fischer to call for a Public Hearing on
June 21, 1976 at 7:30 p.m. for a review of the proposed
Flood Plain Ordinance for the City of Hastings.
Ayes, 8; Nayes, none.
Moved by Councilman Schnirring, seconded by
Councilman Fischer that the City Attorney proceed with
the necessary condemnation procefures for the property
that would be involved in the Vermillion River Flood
Control Project as proposed by the Corps of Engineers.
Ayes, Fischer, Schnirring, Kramer, Trautmann; Nayes,
Erickson, Latch, Hallberg, Novak. Being a tie vote,
the Mayor voted Naye. Motion defeated.
Moved by Councilman Schnirring, seconded by
Councilman Fischer that the City Council establish
a Committee which will include three members of the
Natural Resources Commission, to study the Flood
Control Project and the various property costs and
come back to the Council with a recommendation of
which course of action to take and which Flood Control
Project to be considered. Ayes, Fischer, Schnirring,
Hallberg; Nayes, Erickson, Trautmann, Latch, Kramer,
Novak. Motion defeated.
Moved by Councilman Novak, seconded by
Councilman Erickson to appoint the City Attorney and
City Administrator as being the City's representatives
to begin discussions with the Star Realty Company
concerning the various property requirements and
property costs involved with implementing the U.S.
Corps of Engineers Flood Control Project dated 1970.
After these discussions take place, a review is to be
conducted with the Natural Resources Comm. and report
back to the Council on the feasibility of this Project
as soon as possible. Ayes, 5; Nayes, Kramer Hallberg,
Schnirring. Motion passed.

WHEREAS, pursuant to a written contract signed with the
City of Hastings on the 3rd day of November, 1975, Pine Bend
Paving having satisfactorily completed the Parking Lot
Improvement for the Ice Arena; and
NOW, THEREFORE BE IT RESOLVED by the City Council of
City of Hastings, Minnesota:

approved subject to lein waivers and final check lists; and
