Mtg. l882-A Hastings, Minnesota March 10, 1976 The Mayor convened a Special Meeting of the City Council of the City of Hastings, on Wednesday, ~~rch 10, 1976 at 7:30 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Fischer, Erickson, Schnirring, Latch, Hallberg, Novak and Mayor Petersen. Members absent: Elliott and Kramer. Also present were representatives of the Natural Resources Commission and various property owners involved as owners of property along the Vermillion River. Also present were representatives from the Corps of Engineers. A general discussion occurred regarding the various ways of dealing with the flood control problem along the Vermillion River. Property owners recommended reconsideration of the procedures discussed in 1970. After all persons had been given an opportunity to be heard, Councilman Schnirring introduced the following Resolution and moved its adoption: RESOLUTION #24 - 76 RESOLUTION DIRECTING CONDEMNATION OF LANDS NEEDED FOR PUBLIC PURPOSES OF FLOOD CONTROL & RECREATIONAL USES WHEREAS, in Spring of 1965 the Vermillion River.overflooded its banks, where said river passes through the City of Hastings, causing substantial personal and property damage in the City; and WHEREAS, subsequent to 1965 at the request of the City of Hastings, the United States Corps of Engineers did undertake an extensive study of the flood problem along the Vermillion River in the City of Hastings; and WHEREAS, the Corps of Engineers has submitted various items for con- sideration by the City to lessen or eliminate the flooding problem; and WHEREAS, numerous public hearings have been held in the City of Hastings commencing in 1969 regarding said flooding problem; and WHEREAS, the Corps of Engineers has agreed to undertake certain construction activities to control tlle flooding problem, at the U.S. Government expense, provided that the City of Hastings would provide all land necessary to accomplish this flood control work; and WHEREAS, the City of Hastings and the Corps of Engineers have agreed upon the type of flood control project to be undertaken; and WHEREAS, the construction plan agreed upon by the Corps of Engineers and the City of Hastings anticipate the acquisition of certain lands by tlle City of Hastings to be used for said flood control project and also for recreational, park and open space uses by the City of Hastings and its residents; and WHEREAS, the acquisition of said land, for flood control, open space, park and recreational uses is a public purpose, and that Council deems said acquisition necessary and essential for said public purposes; NOW, THEREFORE, be it resolved by the City Council of the City of Hastings as follows: 1. That the subject property, being the property to be acquired by the City is described as follows: Those properties lying in Dakota County, Minnesota generally described as follows: Commencing at the point of intersection of the westerly right-of-way line of Highway 61 and the center- line of Dakota County Highway 47, proceeding thence southwesterly along the centerline of said County Highway 47 to a point 200 feet westerly of the intersection of the centerline of said . 18-8 2 - B County #47 and the centerline of the Vermillion River (which intersection is in the southeast quarter of the southwest quarter of Section 33, Township 115, Range 17) thence proceed due south from said point (which point is 200 feet westerly of the intersection of County Road #47 and the River) to the south line of said Section 33, afore- said; thence proceed easterly along the south line of said Section j3 to the point of intersection with the southetly line of the retired Chicago Milwaukee and St. Paul Railway (H &D Division) right of way which right of way exists in a generally southwest - - northeast direction across the southeast quarter of said Section 33; thence northeasterly along the southerly line of said vacated railroad right of way to the point of intersection of said vacated railroad right of way and the easterly line of said Section 33; thence northerly along said easterly line of said Section 33 to a point due west of the most northwesterly corner of Block 2 in Vermillion Addition to the City of Hastings; thence easterly 33 feet to the most northwesterly corner of said Block 2, Vermillion Addition; thence southerly along the west line of said Block 2 a distance of 70.74 feet; thence north 60 degrees 36 minutes 33 seconds east a distance of 147.75 feet to a point on the north line of said Block 2; thence continuing north 60 degrees, 36 minutes 33 seconds east to the centerline of the now vacated, platted street along the north edge of said Vermillion Addition; thence easterly along the centerline of said vacated public street to the westerly right of way line of State through Highway 1/61; thence northerly along the westerly right of way line of said State through Highway 1/61 to the point of beginning. Except- ing from the foregoing the following: l. 2. County State Highway #47. That part of Lot 16, Auditor's Subdivision 1/9 described as commencing at the Southeast corner of Section 33, Township 115, Range 17, thence North 0 degrees 36 minutes 32 seconds west along the east line of said Section 33 a distance of 1871.40 to the point of beginning of this exception; thence south 61 degrees 27 minutes 28 seconds west a distance of 200 feet thence north 0 degrees 36 minutes 32 seconds west a distance of 120 feet thence north 61 degrees 27 minutes 28 seconds cast a distance of 200 feet to the east line of said Section 33 thence south 0 degrees 36 minutes 32 seconds east a distance of 120 feet to the point of beginning of this exception (Edwin Kitzman property). (Anna Kitzman exception). 2. That the City shall forthwith undertake eminent domain pro- ceedings to acquire the subject property. 3. That it is essential and necessary that said property be acquired by the City for public purposes consisting of flood control works, open space, park and recreational uses. Said motion to adopt said resolution was seconded by Councilman __ Fischer Upon being put to a vote the following Councilmen voted in favor: Fischer, Erickson, Schnirring, Latch, Hallberg, Novak. and the following Councilmen voted against said resolution: None. this by the City Council of the City of Hastings, Minnesota March, 1976.
