The City COlUlcil of the City of Hastings, Minnesota met in a
regular meeting on Monday, March 1, 1976 at 7:30 o'clock P.M. in the
COlUlcil Chambers of the City Hall.
Members present: COlUlcilmen Kramer, Erickson, Novak, Latch,
Schnirring, Hallberg, Elliott and Mayor
Petersen.
Members absent: Councilwoman Fischer.
The Mayor asked for any additions or corrections to the ~linutes
of the meeting of February 17, 1976 and hearing none declared the Minutes
approved as read.
The ~nyor annolUlced that the Public Hearing which was started
on February 17, 1976 is hereby continued effective as of this time of
7:30 P.M. in reference to the Watermain Connection between Industrial
Park and the Southwest area in the City of Hastings.
The Mayor asked if there were any comments from the audience
to be made in regard to this project. He gave each individual an
opportuni ty to be heard. The Mayor, having given everyone an oppor-
tlUlity to be heard then closed the meeting at 8:38 P.M.
Moved by COlUlcilman Hallberg, seconded by Councilman
Elliott to adopt Proposal I-A as recommended by TKDA concerning
the Southwest Area and the Industrial Park inter-connection for
the water system without using current assessments. The esti-
mated cost of the project will be .311,300 and that cost is to be
made up by charging a Water Availability Charge on all new build-
ing permits issued in the City of Hastings at the rate of $250.00
being charged for a single family residence, $200.00 to be
charged per unit of an apartment structure, and $250.00 being
charged per 100,000 gallons, based on an estimated initial annual
consumption used by each and any industrial and commercial
establishment. The balance of the cost is to be paid from water
revenue at an estimation of $168,300. Be it further resolved that
a connection charge for lateral water main benefit for any property
that uses the watermain in the future. The money collected for the
connection charge should be used to reduce the amount to be paid
by the water revenue toward the project. Be it further resolved
that the Council hereby orders the final plans and specifications
of this project be done. The City Engineer and City Attorney draft
the necessary ordinance that is required to put this project into
effect as soon as possible so that the Council may act on it at a
Council meeting in the near future. Ayes, 5; Nayes, Councilmen
Erickson and Novak. Notion carried.
Moved by Councilman Kramer, seconded by Councilman
Schnirring to approve the First Reading of the Flood Plain
Ordinance and forward to DNR a copy of said ordinance for their
comments. Ayes, 4; Nayes, Erickson, Elliott and Latch.
Moved by COlUlcilman Schnirring, seconded by Councilman
Kramer to call for a Public Hearing on April 5, 1976 at 8:00 p.m.
in the COlUlcil Chambers of the City Hall, for the purpose of
reviewing the proposed Charter Amendments that have come before
the COlUlcil from the Charter Commission. Ayes, 7; Nayes, none.
Moved by COlUlcilman Schnirring, seocnded by Councilman
Novak to favorably comment upon the newly proposed budget of YAC
in which the Director's salary was increased by 12%. The City
COlUlcil has reviewed the hldgetary re'l.uests of YAC and consider
themselves to be properly informed on the level of expenditure
that YAC currently is conducting.

Moved by Councilman Kramer, seconded by Councilman
Latch to move the First Reading of the Civil Defense Ordinance
with the change being made in Pragraph 214.160, entitled; Civil
Defense Fund Created, should hereby read as follows: There
1S hereby establ1shed in the City Treasury a special fund to be
known as the Civil Defense Fund. Into this fund shall be
placed the proceeds of taxes levied for Civil Defense, money
transferred from other funds, gifts and other revenues to the
Civil Defense Agency. From it shall be made expenditures for
the operation and maintenance of the Civil Defense and other
expenditures for Civil Defense. Regular accounting, disburse-
ment, purchasing, budgeting and other financial procedures of
the City shall apply to the Civil Defense Fund. Ayes, 7;
Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Novak to establish a special meeting on March 10, 1976 at 7:30
p.m. in the Chambers of the City Hall for the purpose of the
Council meeting with members of the NRC, interested citizens in
the community, and representatives of the Corps of Engineers to
discuss the Vermillion River Control Project. Ayes, 6; Nayes,
Councilman Schnirring. Motion carried.
COMPREHENSIVE PLAN The City Planner reviewed with the Council the
MAP REPORT ACCEPTED Comprehensive Plan Map for the annexation area of Marshan, Mter
a brief discussion the Council ordered the report accepted.

REPORT
Moved by Councilman Kramer, seconded by Councilman
Schnirring to approve Lot 3, Block 14, Addition #13 to be
forfeited for non-payment of taxes for the year 1969 and re-
classify it as non-conservation land in preparation for the sale
that will eventually be held on this land. Be it further moved
that a copy of this motion and the County documents be signed
and returned to the County as soon as possible. Ayes, 7;
Nayes, none.
The Chief of Police letter concerning the Bicentennial
Wagon Train passing through the City of Hastings was reviewed
by the Council and ordered to be put on file.
The Businessmens letter was presented to the Council
concerning a "No Parking Policy" on Second Street from the
Hwy 61 bridge east to the Grain Elevator be installed so that
no parking would take place during the hours of 3 a.m. to 7 a.m.
for the purpose of allowing the Street Dept. to properly sweep
the streets and remove snow i-lhen applicable. The Council dis-
cussed this matter in general, to include the costs of the
signs, and asked that this item be put on the Agenda of March
15th for further discussion.

Erickson to accept the Fire Department's Annual Report and
congratulations to the Fire Chief for an excellent report.

The City Attorney briefly discussed the proposed Fire
Code and its adoption for the City of Hastings. Moved by
Councilman Hallberg, seconded by Councilman Latch to move~the
approval of the First Reading of the Fire Code for the City
of Hastings. Ayes, 6; Nayes, Kramer.
POSSIBLE REFERENDUM The Mayor felt that due to the late hour of the meeting
IT~~ TABLED TO it would be preferable to move the item of possible referendum
MARCH 15 issues to the next Council meeting of March 15th. This to be
put on the Agenda for March 15th.
FIRST READING OF
FIRE CODE
Moved by Councilman Elliott, seconded by Councilman
Hallberg to approve the Administrator's recommendation for the
promotion of Barbara Thompson from Bookkeeper to Accountant,
and Marge Kelley from Water and Sewer Billing Clerk to position
of Bookkeeper. Each individual be given a $500 increase in
salary at the present time as a result of the promotion and that
six months from ~~rch 1, 1976 an additional $500 raise in salary
be allowed. The effective date of these promotions is ~~rch 1,
1976. Ayes, 7; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Latch to authorize the City Administrator to advertise in the
newspapers as required by the Affirmative Action Plan in the
City of Hastings, for the position of Water and Sewer Billing
Clerk, at a salary of $6,000 annually. Ayes, 7; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Latch to authorize the Bids for a Squad Car for the Police
Department and that the current 1973 police squad car be used
as a trade-in. Bid opening to be at 10:00 a.m. on March 15,
1976 and come before the Council for possible consideration for
award at 8:00 p.m. on March 15, 1976. Ayes, 7; Nayes, none.
The Council had a brief discussion concerning the
negotiations with the Four Diamonds ballfields in the City of
Marshan. Moved by Councilman Schnirring, seconded by Council-
man Kramer that the City of Hastings does not enter into
negotiations with the owners of the Four Diamond properties In
any way. It is the general feeling that the Leagues should
handle the necessary lease with the property. Ayes,S;
Nayes, Councilmen Elliott and Novak. Motion passed.
Councilman Kramer introduced the following resolution
and moved its adoption:
RESOLUTION RECEIVING PRELIMINARY REPORT AND
SETTING PUBLIC HEARING ON PROPOSED IMPROVEMENTS
WHEREAS, a preliminary report has been prepared by the
City Engineer with respect to the improvements described in the
Notice of Hearing hereinafter set forth, and
WHEREAS, said Engineers have advised this Council that
the aforesaid improvements are feasible and should be made as
proposed in the Notice of Hearing thereon, and
WHEREAS, the Council considers it expedient to make the
following listed improvements,

1. Such Feasibility Reports are here by accepted and
approved.
2. Said Improvements are hereby combined and designated
1976 Improvements and shall be undertaken pursuant to
the provisions of Chapter 429, Minnesota Statutes 1961.
3. A Public Hearing relative to said improvements will

The City Council proposes to assess all or part of the cost
for such improvements against every lot, piece or parcel of land within
the Corporate Limits that abuts upon said improvements according to the
special benefits received without regard to cash valuation.
The estimated cost of said improvements is $840,815.00
Persons desiring to be heard in reference to the proposed im:,'
provements may be heard at said time and place.
Dated this 1st day of March, 1976.
The City Clerk is hereby authorized and directed to cause said
notice to be given two publications in the official newspaper and to
give mailed notice to every property owner whose property is benefited
by said improvements. Such publications shall be one week apart and at
least thre da shall elapse between the last publication and the date
of hearing Mai ed notice shall be given not less than ten days before
