The City Council of the City of Hastings, Minnesota met in a
regular meeting on Tuesday, February 17, 1976 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Fischer, Erickson, Elliott, Kramer,
Schnirring, Novak and Mayor Petersen.
Members absent: Councilmen Latch and Hallberg.
The ~~yor asked if there were any additions or corrections to
the Minutes of the Public Hearings held January 29th and February 5, 1976
and hearing none declared the Minutes approved as read.
The ~~yor asked if there were any additions or corrections to the
Minutes of the regular meeting of February 2, 1976 and hearing none declared
the Minutes approved as read.
The Mayor opened the Public Hearing at 7:30 P.M.
concerning the Industrial Park to Southwest Area Watermain
Connection. The City Clerk read into tfue record that he was
in receipt of a certified copy of the notice of publication
of the Public Hearing and a certified copy of the mailing
list. The Public Hearing had been properly called.
The ~~yor asked for comments or discussion from the
Audience, giving everyone an opportunity to be heard who so
desired.
Willard Bauer and Loren Bauer, the owners of 87.5 ac.
of land through which the proposed water interconnection is to
be installed presented a letter as to why they objected to the
Project.
Moved by Councilman Erickson, seconded by Councilman
Kramer to continue the Public Hearing at the next regular Council
meeting of March 1, 1976 at 7:30 P.M. Ayes, 6; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Schnirring to deny the request from Dakota Realty for the
Special Use Permit to have a Health Club in R3 & R4 Zone as
recommended by the Planning Commission. Ayes, 6; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Kramer that the Ordinance concerning Flood Plain Zoning be
referred to the Planning Commission of the City Council
for further study. Ayes, 6; Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman
Kramer to request the Army Corps of Engineers to submit a pro-
posal outlining the scope of services they can provide for a
Park Plan for the Old Mill Park and Addition, and that this be
accompanied by completion dates for the planning process.
Ayes, 6; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Fischer to accept the letter of resignation from James Caturia
as a HRA'member and that a letter of appreciation be sent to
him for the fine work he has done on the Commission. Ayes, 6;
Nayes, none.
Moved by Councilman Elliott, seconded by Councilman
Fischer to approve the following listed transfers for the
1975 Financial Statement: Ayes, 6; Nayes, none.

Moved by Councilman Kramer, seconded by Councilman
Schnirring to table the First Reading of the Civil Defense
Ordinance to the first meeting of the Council in March for
the purpose of having the City Administrator contact Mr.
Dennis Hoveland, Dakota County Civil Defense Director, re-
garding the wording of the Ordinance. Ayes, 6; Nayes, none.
Moved by Councilman Novak, seocnded by Councilman
Erickson that the letters of resignation from William Wendler
and Kenneth Matsch as Volunteer Firemen be accepted, and that
a letter of appreciation be sent to them thanking them for
their dedicated service while they were in the employ of the
City. Ayes, 6; Nayes, none.
Moved by Councilman Kramer, seconded by Councilman
Fischer to authorize the advertisement of Bids for Crushing
and Screening 10,000 yards of Gravel for the Street Dept.
Bids to be opened March 12, 1976 at 10:00 a.m. and considered
for award at the Council meeting of March 15, 1976 at 8:00 p.m.

DAKOTA COUNTY TO Moved by Councilman Erickson, seconded by Councilman
INSTALL DIRECTIONAL Schnirring that the request of Dakota County for permission to
SIGN TO GOVT. CENTERinstall a highway directional sign to the Dakota County Govt.
Center, north of the Frontage Road and West of Westview
Drive, be granted. Ayes, 6; Nayes, none.

Moved by Councilman Schnirring, seconded by Councilman
Elliott that the City Attorney draw up an Ordinance establish-
ing a Water Availability Charge (WAC) for new connections to the
Water System. Ayes, Fischer, Elliott and Schnirring; Nayes,
Novak, Kramer and Erickson. Being a tie vote, the Mayor voted
Naye. Motion ~ost.

A discussion was held in regards to the Vermillion
River Flood Project and Park land acquisition. Star Realty
was present and represented by their legal counsel. After the
discussion it was moved by Councilman Schnirring, seconded by
Councilman Erickson that this subject be tabled until the
Ivnrch 1st meeting. It was requested that input be submitted
by the Corps of Engineers, Natural Resources Commission and
Star Realty and their legal counsel. Ayes, 6; Nayes, none.
The City Attorney reported that a party had inquired
about purchasing land in the Industrial Park for a commercial
business and that, pursuant to Council direction discussions
are continuing with the owners of the Hastings Mobile Home
Terrace, looking to possible acquisition by them of a portion
of land in the Industrial Park for expansion of the mobile
home park. Further, that the enabling act which allowed the
City to purchase a portion of the lands now included in the
Industrial Park contained a phrase that the land was to be
conveyed to the City for "governmental and industrial purposes"

The Attorney asked the Council to pass a resolution urging the
legislature to pass a bill assuring the City that it can sell for commer-
cial uses, including a Mobile Home Park. Moved by Councilman Novak,
seconded by Councilman Kramer that our Senator and Representative be
urged to affect enactment of legislation clearly allowing sales of
Industrial Park land for commercial purposes including a Mobile Home
Park. Ayes, 6; Nayes, none.
The next item for consideration was the matter of the ORDER REGARDING
hazardous buildings at 213, 2l3~, 215, and 2l5~ Ramsey St. Said PECK PROPERTY
structures were discussed and the previously received report of
the building inspector was reviewed, which states in summary that
the structures are hazardous and require action to place them in
a safe condition. Prior correspondence and discussions with the
owner were reviewed. It was reported that a building permit, al-
though discussed with the owner, had not been issued as necessary
supporting data had not been provided. It is generally stated that
if the property was to be placed in a safe condition, not more
than 60 days would be necessary. It was further stated that action
would have to be initiated because of the hazardous condition.
Whereupon a motion was made by Councilman Schnirring, seconded by
Councilman Fischer that th~ following order be adopted. Ayes, 6;

ORDER FOR REMOVAL OR REPAIR
CITY OF HASTINGS
IN THE ~~TTER OF TI1E HAZARDOUS BUILDINGS LOCATED AT 213, 2l-~, 215, 2l5~
Ramsey Street legally described as:
The north 40 feet of Lot Five (5), Block
Fifteen (15), Town of Hastings, according
to the plat thereof now on file and of
record in the office of the Register of
Deeds in and for Dakota County, Minnesota.
TO: Dr. L.R. Peck and other persons having an interest In said property,
if any!
Pursuant to Chapter 393 of the Laws of 1965, as amended, the City
Council of the City of Hastings, having duly considered the matter, finds the
above described buildings to be hazardous for the following reasons:
The City Council after receipt of numerous complaints ordered an
inspection and a report thereof to be made of the above described
premises. Said report was prepared and submitted by the building
inspector and fire marshal. Said report states that said buildings
are generally dilapidated and in an extreme state of disrepair and
are hazardous and dangerous. That there are numerous conditions
in the buildings which violate basic safety requirements. Electrical
and plumbing systems are partially inoperative, inadequate and un-
safe. Structural walls are unsafe and there is a substantial poss-
ibility of collapse. Fire escapes are unusable. Rear deck and
railings are unusable and hazardous and lack proper support. Old
chimney is deteriorated and without proper flues. Combustible
materials exist throughout structure. Ceilings are collapsing.
Handrails, where required for safe passage are needed. There are
numerous pierced walls creating severe fire hazard. Venting is in-
adequate for the basic safety requirements as is heating. Leaking
and plugged water lines have caused structural faults. Inadequate
lighting in passage areas. Brick is loose and falling c::reating a
hazard. Support wall is leaning and deteriorating.
Pursuant to the foregoing and in accordance with Chapter 393 of the Laws of
1965, as amended, it is hereby ordered that the above hazardous buildings be
epaired and made safe and not detrimental to the public health, welfare and
safety by correcting the foregoing listed faults, or that in the alternative
at the option of the owner, that said property be razed and removed, and
further that said repair or razing be completed within sixty (60) days of
the service of this order.

It is further ordered that if said property is not repaired in
the time allowed, that all personal property or fixtures that may un-
reasonably interfere with razing shall be removed in said sixty (60) day
period and if not so removed the City of Hastings may remove and sell
such personal property, or fixtures at private auction.
Notice is further given that unless such corrective action (repair
or razing) is taken within said sixty (60) day period, or an answer is
served upon the City of Hastings and filed in the office of the Clerk of
District Court of Dakota County, Minnesota within twenty days from the date
of the service of this Order upon you, a motion for summary enforcement of
blis Order will be made to the District Court of Dakota County, Minnesota
at the expiration of said sixty (60) day period.
You are further advised that if the City of Hastings is compelled
to take any corrective action herein, all necessary costs, expended by
City will be assessed against the real estate and collected as other
tate taxes.
