HomeMy WebLinkAbout02-02-76 1857 Hastings, Minnesota February 2, 1976 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, February 2, 1976 at 8:00 o'clock P.M. in the Council Chambers of theCity Hall. Members present: Councilmen Erickson, Novak, Latch, Schnirring, Elliott, Hallberg, Fischer and ~~yor Petersen. Members absent: Councilman Kramer. The ~~yor asked if there were any additions or corrections to the ~linutes of the regular meeting of January 19, 1976 and hearing none from the Council declared the ~tinutes approved as read. "'. .....,-,.. The Mayor opened the Public Hearing at 7: 35 p.m. con- PUBLIC HEARING cerning the adoption of the 1975 proposed assessments for the 1975 Construction projects. The Administrator read into the record that he was in receipt of a certified copy of the publi- cation of the notice of public hearing and in receipt of a certi- fied copy from tile City Clerk of the mailing list to which notices of this meeting had been sent to all affected property owners. The ~hyor asked if there were any comments or discussion on those projects. Having given everyone in the audience an apprtunity to be heard, the following motions then were made: Moved by Councilman Schnirring, seconded by Councilman WESTVIEh! SHOPPING Fischer that pursuant to the request of Industrial Builders, Inc. CENTER SPECIAL sole owner of Westview Shopping Center area (entire area south of ASSESSMENTS IND. S.T.H. 55, east of Pleasant Drive, West of Westview Drive and BLDRS. South of 13th Street) the special assessments, present and future, for improvements benefitting any portion or all of said area shall be spread on a square footage basis against the entire described area, and payments against any portion of said area shall be accepted on a square footage basis: and releases from the lien for assessments shall be made accordingly for payments so made. Moved by Councilman Schnirring, seconded by Councilman Fischer to deny to the residents of Sixth Street the forgiveness of the curb and gutter portion of the street improvement assess- ments. Ayes, 6; Nayes, Councilman Latch. Hearing no other comments from the audience, the ~~yor closed the Public Hearing at 8:30 p.m. Councilman Erickson introduced the following resolution RESOLUTION #9-76 and moved its adoption: ADOPTION OF 1975 ASSESSMENTS RESOLUTION ADOPTING ASSESS~ffiNTS WHEREAS, pursuant to proper notice duly given as required by law, tile Council has met and heard and passed upon all objections to the proposed assessments for the improvement of the following: PROPOSAL I BITUMINOUS SURFACING, CONCRETE CURB AND GUTTER AND SIDEWALK Westview Drive from Trunk Highway 55 to Pleasant Drive - Bituminous Surfacing, Concrete Curb and Gutter, and Storm Drainage Construction. 15th Street from Pleasant Drive to Brittany Road - Bituminous Surfacing, Concrete Curb and Gutter, and Concrete Sidewalk Construction. 6th Street from Forest Street to Pine Street - Bituminous Surfacing. DESCRIPTIONS FOR AREAS BENEFITED BY STORM SEWER Blocks 1 and 2 of the Plat of Westview Shopping Center 1st Add. NOW, THEREFORE BE IT RESOLVED by the City Council of Hastings: 1. Such proposed assessments, a copy of which is attached hereto and made a part llereof is hereby accepted and shall constitute the special assessments against the lands therein, and each tract of land therein included is hereby found to be benefited by the pro- posed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday,of January, 1977. Any deferred installments shall bear interest at the rate of eight percent (8%) per annum. To the first installments shall be added interest on the entire assessment, from the date of this assessment resolution until December 31, 1976. To each subsequent installment when due shall be added interest for one year on all unpaid installments. ./ 3. The owner of any property so assessed may, for 30 days after notification from the City Treasurer, pay to the City Treasurer, the whole of the assessment without interest, and he may at any time,prior to certification of the assessment to the County Auditor, as herein provided, pay the whole of the assessment against any parcel with interest accrued to the date of payment to the City Treasurer, and he may at any time thereafter pay the County Treas- urer the entire amount of the assessment remaining unpaid with in- terest accrued to December 31st of the year in which such payment is made. - ~ ....... --1 r--. -- f\: 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessment shall be collected and paid over in the same manner as other numicipal taxes. Councilman Novak introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ISSUANCE OF REVENUE BONDS TO FINANCE A PROJECT ON BEHALF OF IBI CORPORATION, REQUESTING APPROVAL BY THE DEPARTMENT OF ECON<Jv1IC DEVELOPMENT, AND AUTHORIZING THE PREPARATION OF NEC- ESSARY DOCUMENTS PURSUANT TO THE MUNICIPAL INDUSTRI.AL DEVELOPMENT ACT Councilman Latch seconded the motion to adopt said resolution and the same was passed by the following vote: Ayes, 7; Nayes, none. Further, that this money be used for the purpose of building a fence around the Old Mill Ruins. Ayes, 7; Nayes, none. Moved by Councilman Fischer, seconded by Councilman Hallberg to accept the Park Development Plan of Amenity I as presented to us this evening and forwarded to us from the Natural Resource Connnission, as a development guide for the City of Hastings to follow for park land acquisition and development. Ayes, 7; Nayes, none. It is the intent of the Council, with this motion, that the Plan just accepted for the Park Development of the City of Hastings does show the current goals and objectives the City would wish to follow. If new ideas and new developments should occur in the future the Council wishes to maintain the necessary flexibility to adjust those goals and objectives and to keep the options open should circumstances justify any necessary change. Dennis Pellant of the Chamber of Commerce gave a status report on the Lake Rebecca Project. It is hopeful of achieving additional funding for the Project. Moved by Councilman Novak, seconded by Councilman Schnirring to sell to Mr. Maurice Zweber, for the amount of $626.66, a .33712 acre parcel of land from the 15th Street Ponding Basin Area as referred to in ~IT. Marston's memo dated January 30, 1976. The remaining portion of the land shall be limited in use to Park land and/or as a Ponding Basin. Ayes, 6; Nayes, Councilman Elliott. Moved by Councilman Schnirring, seconded by Councilman Fischer to acquire all of the Star Realty property which the Council has been discussing this evening and which is in direct relationship to the U.S. Corps of Engineers Flood Control Project, on the Vermillion River, plus acquire property all along the Vermillion River in accordance with the desires of the Natural Resource Commission's recommendations and that the purchase of this property be done with the comvination use of the EPA refund monies, Federal Revenue Sharing Funds, Assessments which may be determined at some time in the future and that a Referendum be considered to pay either a portion of, or the total cost of the property. Ayes, 4; Nayes, Erickson, Elliott and Novak. Motion carried. The City Attorney stated he would have ready for the Council, at the next regular meeting of February 17th, the des- criptions of said properties so that a motion can be made wllich would include the legal descriptions. 1863 LAKE REBECCA REPORT SELL LAND TO MAURICE ZWEBER ACQUIRE FLOOD CONTROL PROJECT PROPERTY The City Planner informed the Council of the Settregren SETTREGREN BILLBOARD billboard issue and asked whether or not the Council wished to ISSUE make an exception in this case, to the current sign ordinance. ~bved by Councilman Erickson that a variance be granted. The motion died for lack of a second. Moved by Councilman Hallberg, seconded by Councilman Erickson to approve the appointments of Theodore Shannon, 1319 w. 21st St., Judy Sivek, 521 Westview Drive and Robert Kulzer, 220 W. 10th St., to the HRA to fill the current three vacancies that exist. Ayes, 7; Nayes, none. Randy Wilhite reported to the Council on the latest status of the YAC and the various projects and concerns it has. One of the issues that Mr. Wilhite asked the Council to consider was raising his salary from $12,000 to $16,500. Moved by Councilman Novak, seconded by Councilman Elliott that the City Administrator be directed to contact the current chairman of the Board of Directors of YAC and other members of the YAC Board in an attempt to provide the Council with a written review and evaluation of Mr. Wilhite's performance in his current position. The Administrator should also examine comparable salaries and qualifications of individuals who have similar positions in other YAC projects throughout the metropoli- tan area so that the Council would have some criteria by which to base any salary increase. Be it further moved that the Adminis- trator prepare this report as soon as possible so that action may be taken. Ayes, 7; Nayes, none. Moved by Councilman Novak, seocnded by Councilman Elliott to accept the report of John Lightbourn in reference to the Ice Arena. Ayes, 7; Nayes, none. ~bved by Councilman Fischer, seconded by Councilman Erickson to change the Council meeting date from February 16, to February 17, 1976 due to the fact that February 16th is a legal holiday. APPOINT 1HREE MEMBERS TO HRA YAC REPORT ACCEPT ICE ARENA REPORT CHANGE COUNCIL MEETING DATE 1864 ORDINANCE #38 THIRD READING SIDEWALK FEE Moved by Councilman Elliott, seconded by Councilman Erickson to approve the Third and Final Reading of the Side- walk Fee Removal. Copy of Ordinance on file in City Offices. Ayes, 7; Nayes, none. EDUCATIONAL INCENTIVE Moved by Councilman Hallberg, seconded by Councilman PROGRAM-NON UNION Fischer to adopt the following policy for an educational EMPLOYEES incentive program which will affect the Non-union employees only. In order to qualify for the City of Hastings Educational Incentive Program, the Program will pay for only earned College credits that have received a grade of 'C' or better and must be certified to and approved by the City Administrator. Course work graded by the past system must be approved by the Admin- istrator before the course is taken. The educational incentive compensation is in addition to the base salar~ and shall be paid at the rate of 40~ per approved quarter credit per month. A maximum of 180 quarter credits for a degree is established. Candidates for the educational incentive program must have completed six months consecutive service with the City of Hastings. If it is the intent of the employee to pursue the successful completion of a degree, he must so state a letter of intent to the City Administrator in advance of undertaking any courses for that degree. Be it further moved that this program be reviewed in one year's time and a report of participants be submitted to the Council. Ayes, 6; Nayes, Erickson. RETROACTIVE Moved by Councilman Schnirring, seconded by Councilman EDUCATIONAL INCENT Novak to pay the Chief of Police, effective January 1, 1976, PAYMENT TO CHIEF OF $16.40 a month for college credit which he has successfully POLICE completed. The Chief of Police is authorized to participate . in the just recently adopted College Incentive Program. Ayes, 6; Nayes, Erickson. Motion carried. PARKING RESTRICTION Moved by Councilman Hallberg seconded by Councilman CHANGED DOWNTOWN Erickson to readjust the parking requirements in the Downtown PARKING LOT Parking Lot as follows: The furthest South side, which is nearest the alley, be continued to operate under the current two hour parking limitation. This applies to approximately 14 parking spaces. The remaining parking spaces in the Down- town Parking Lot are to revert to a twenty-four hour time period. This change is to be accomplished as soon as possible by the City Staff. A review of this arrangement should be made again in September.of 1976. Ayes, 7; Nayes, none. APPOINT TREASURER BICENTENNIAL 4TH ST & T.H.6l SIGNAL UPDATE ~bved by Councilman Hallberg, seconded by Councilman Fischer to accept the resignation of Charles Keller from the City of Hastings Bicentennial Commission and to appoint in his place, B.H. (Bushy) Wirt as acting Treasurer for the Bi- centennial Commission. Ayes, 7; Nayes, none. The City Engineer reviewed with the Council, the 4th St. signal situation through T.H. 61.
