The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, October 6, 1975 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Kramer, Eri ckson, Latch, Elliott,
Schnirring, Hallberg, Fischer and ~~yor
Petersen.
Members absent: Councilman Novak.
The ~myor asked for additions or corrections to the Minutes of
September 10, 1975, hearing none he declared the Minutes approved as
read.
The Mayor asked for additions or corrections to the Minutes of
September 15, 1975, hearing none he declared the Minutes approved as
read.
Moved by Councilman Elliott, seconded by Councilman
Erickson to pass the Third and final Reading of the Rezoning
Amendment and Ordinance #34 Second Series for James Weiland,
517 E. 3rd. Street. Ayes, 7; Nayes, none.
Subject to the following conditions: Mr. Weiland will
be willing to hook up to city water and sewer (as per letter
dated August 28, 1975) if the present and proposed structures
are either added on to or if the nature of the business changes
from the current use.

Moved by Councilman Latch, seconded by Councilman
Schnirring to approve the Special Use Permit for the Hastings
Co-op Creamery, 17th & Vermillion Sts. Ayes, 7; Nayes, none.
Subject to the following conditions:
1. Any mechanical equipment on top of the new structure
must be screened.
2. The blacktop area north of the new structure must maintain
a 10 foot setback from the property line, although landscaping will
not be required in this area until street improvements are completed
on 17th Street.
3. Sod and landscaping should be provided along the east
property line adjacent to the proposed parking lot.

Moved by Councilman Kramer, seconded by Councilman
Erickson to approve the Special Use Permit for Leonard Bauer
23rd Street South. Ayes, 7; Nayes, none.
Subject to the following conditions:
1. Submittal of a landscaping plan which must be
approved by the City Planning Director.
2. Access to the garage and parking area should be
limited to one (1) twenty two foot wide driveway (maximum)
and the driveway should enter on 22nd or 23rd Street since
Cannon Street is not an improved road.
3. No signs will be allowed for the four plexes.
4. Internal parking lots and driveways must be black-
topped.
5. The plan should designate a refuse area which will
be screened.
6. The petitioner should be required to maintain a setback
of 35' from the front property line for the proposed structure.
7. A plan should indicate drainage and elevation of the
finish grade at the homesites.
8. Water should be provided to the lot with access on 22nd
Street by extending the line from Vermillion down 22nd Street.
9. Street paving for 22nd and 23rd Streets should be included
as part of the 1976 Capital Improvements Program.

A report was given by Mr. Art Baumeister concerning the
Industrial Park Sign. After hearing the report it was the con-
census of the Council and Mayor that the development and final
design of the Park sign should continue and that it be referred
to the Planning Commission for their comments.
MY. Baumeister and Mr. Ackerman came before the Council
and discussed in general the issues of Grants, Appraisals and
other maintenance, and repairs to the old Court House with which
the City has been looking at recently. It was suggested by the
Council that MY. Ackerman prepare a proposal for the City Council
regarding what would be involved as far as cost in doing a com-
plete detailed study on the old County Court House and that this
proposal be brought before the Council on October 20th at 7: 00
P.M. so that the Council may have an opportunity to review it
and determine whether or not it wishes to proceed with the matter
of the old County Court House.
Moved by Councilman Kramer, seconded by Councilman
Hallberg to extend the time to Refining Systems, Inc. to November
14th or closing date, whichever occurs earliest due to the fact
that an Audit had to be performed on the Refining Systems, Inc.
before the sale of the Industrial Revenue Bonds would be approved.
This extension is for the sale of land under a Contract for Deed.

The Council discussed briefly the pro~osed resolution
regarding raising the Revenue Bond Limit to $10,000,000 without
restrictions. The Mayor asked that this item be put on the Agenda
for the meeting of October 20th.
Moved by Councilman Hallberg, seconded by Councilman
Kramer to approve cancelling the outstanding checks on the list
that was presented before the Council by the City Administrator
in reference to people for whom the City has sent checks to and
the individuals have not cashed them. Ayes, 7; Nayes, none.

Moved by Councilman Schnirring, seconded by Councilman
Fischer to adopt the Capital Improvements Program Report with
the additions and incorporation of the Planning Commission's
comments. Ayes, 7; Nayes, none.
Moved by Councilman Kramer, seconded by Councilman Fischer
to move the First Reading of the Ordinance to change the street
names, to be adopted as presented by the Planning Commission which
will be Blueberry Court and Blueberry Lane and Rosemary Court and
Rosemary Lane. Ayes, 6; Nayes, Councilman Elliott.
Moved by Councilman Schnirring, seconded by Councilman
Erickson to approve the appointment of Michael Gegen~ 1128 West
15th Street to the Hastings HRA Commission for a five year term.
His term of office will run from October 1, 1975 to October 1,
1980. Ayes, 7; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Schnirring to approve Dexter Marston's comments in the letter to
State Representative Humphrey concerning the Mandatory Planning
Bill.
Moved by Councilman Hallberg, seconded by Councilman Kramer
to amend Dexter Marston's letter to delete item #3, the rest of
the letter to go as is. Ayes, Elliott, Kramer and Hallberg;
Nayes, Fischer, Erickson, Schnirring and Latch. Motion failed.
Item #3 remains in the letter.
The Mayor then called for a vote on the motion which was
to approve Dexter Marston's letter as presented to the Council
this evening. Ayes, 6; Nayes, Councilman Kramer. Motion carried.
The City Council accepted the report from the City
Administrator concerning his meeting with Mr. Olson from thel!1
Mobile Home Court and ordered the report to be put on file.
Moved by Councilman Hallberg, seconded by Councilman
Kramer to state that the City Council would be agreeable to
participate in constructing the ~bnument to the Spiral Bridge
as presented by Dr. Weiss's proposal. City participation would
involve putting in a concrete base on which the monument would
rest and further that the City Council would prefer. to see the
monument put in the vicinity of the end of the north end of
Sibley Street by the current barricades in front of the American
Legion building. Ayes, 7; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Schnirring to approve the appointment of two individuals to the
CETA employ of the City, whose terms of employment will be till
June 30, 1976 unless the County gets an extension of the program
for an additional 90 days at which time the terminatimn of employ-
ment would be September 30, 1976. The two individuals are:
Harold Welch who will be the Assistant Ice Arena Manager; and
Raymond Garcia who will be the Planning/Engineering Aide. The
Assistant Ice Arena ~~nager's salary will be $791.66 per month
and the Planning/Engineering Aide will be $750.00 per month.
Both of the CETA individuals will be entitled to City fringe
benefits. Their beginning time of employment is Oct. 1, 1975.

City Administrator on unpaid water and sewer bills, to the
County Auditor so that he may properly assess these costs to the

report and the issue of deferrment of assessments for Senior

COilllcil meeting allocating $20,000 to th e Ice Arena for parking
lot and internal improvements to now read: The COilllcil hereby
authorizes $20,700 of Federal Revenue SharilLg Filllds to be spent
for the parking lot and driveway at the Ice Arena. This does not
include any inside building costs and be it hereby resolved that
any additional costs needed to bring the Ice Arena up to a fully
operational six month facility be put on a referendum to the

the Engineer's Office and the results of the bids to be forwarded
to the COilllcil for their consideration at the next regular COilllcil
