The City COWlcil of the City of Has tings, Minnesota met in a
regular meeting on Tuesday, September 2, 1975 at 8:00 o'clock P.M. in the
COWlcil Chambers of the City Hall.

Members present: Councilmen Kramer, Erickson, Novak, Latch,
Schnirring, Elliott, Hallberg and ~myor
Petersen.
Members absent:
None.
The City Administrator pointed out to the Council
that in the Minutes Wlder the heading of setting the Public
Hearing for the 1974 Supplemental Assessment Rolls, the Minutes
should reflect that the Hearing is called for September 15, 1975
at 7:30 P.M. The Minutes were approved as amended.
The Minutes of the Informal Meeting of August 20, 1975
were approved as read.
AMEND MINUTES OF
AUGUST 18-75
The COWlcil had a brief discussion concerning a HRA VACANCY NOTED
vacancy on the HRA Authority Corrnnission. The name of Paul Kranz
was suggested as a possibility to fill that vacancy. The
Administrator was asked to contact Mr. Kranz to see if he would
be willing to fill the vacancy and report back to the Council at
the next regular meeting.
The COWlcil had a discussion concerning the First FIRST READING OF
Reading to the Zoning Amendment for the Burns & Enstad proposal BURNS & ENSTAD
but decided at this time to take no action with the item carried ZONING TO 9-15-75
over to the next Agenda of the Council meeting of Sept. 15, 1975.MEETING
~IDved by COWlcilman Novak, seconded by Councilman
Elliott to move the First Reading for the Zoning Amendment for
James Weiland, 517 E. 3rd. St. subject to the following con-
ditions: Mr. Weiland will be willing to hook up to city water
and sewer (as per letter dated August 28, 1975) if the present
and proposed structures are either added on to or if the nature
of the business changes from the current use. Ayes, 6;
Nayes, Schnirring and Kramer. Motion passed.
Moved by COWlcilman Kramer, seconded by COWlcilman
Latch to approve the Special Use Permit for Raymond IlIa, 2222
Vermillion St. subject to the conditions cited in the Staff
memo of August 25, 1975. Ayes, 8; Nayes, none.
The COWlcil, after a brief discussion concerning
the Capital Improvements Program as forwarded to them from the
Planning Commission, with recorrnnendations, asked the Staff to
give further study to the Program with particular emphasis on
examining various financial arrangements that could be used
for fWlding. Of particular interest is the impact of state law
which authorizes a minimum of 20% of a new construction project
to be assessed directly to the benefited properties and there-
fore allows 80% of the cost of the project to be certified on
theCity's levy. It is hoped that this report will be forth-
coming at the next regular scheduled COWlcil meeting.
Dexter ~rston reviewed with the Council the final
application for the COImnWlity Development Project. The COWlcil
requested time to review this in more detail and suggested that
this item be delayed Wltil the September lOth meeting at which
time it could be further discussed.

After a brief discussion on the Home Occupation
Ordinance and a review of the Planning Commission recommen-
dation, the Council wished to have time to review this in
more detail. The Council reques ted that this be put on the
Agenda for the next meeting, September 15, 1975.
A review of the Planning Commission Committee System
was undertaken. Members of the Council seemed to be satisfied
with the current system, no further action was required.
Mr. Paul Reuter asked the Council to give some indi-
cation as what its intentions were regarding the possible
extention of water and sewer into the Marshan Twp. to reach
the site of the proposed Tru-Valu structure. The Council asked
the Staff to review the matter and consider this request as an
official request by Mr. Reuter to extend water and sewer into
Marshan 1'wp. The Staff to make a report to the Council concern-
ing the various issues involved with such a request.
Mr. Jolm Kranz asked the City to consider increasing
the current rubbish rate for the residential district from the
current $11.25 per three months to $13.00 per three months.
The Council asked the Staff to give consideration to this
request and review whether or not it is reasonable and to examine
other municipalities to see if this is a comparable three month
rate. ~bved by Councilman Kramer, seconded by Councilman
Sclmirring that the study be done on the Trash rates. Ayes, 8;

MOved by Councilman Sclmirring, seconded by Council-
man Kramer to approve the third and final reading and adoption
of the Amendment to the Liquor License which allows Wine Licenses
for Res tau rants in the City of Has tings . Ayes, 7; Nayes, Novak.
The Council reviewed the letter from the Downtown
Businessmen concerning making the Downtown Parking Lot a two hour
parking limit for a portion of the lot. As a result of the dis-
cussion that followed the Council asked the Staff to meet with
the Businessmen in an attempt to work out various alternatives
for the Council meeting of Sept. 15th, to include the possibility
of making the entire Second street area and side streets, which
are now a two hour parking limit to a four hour parking limit.
Coordination with the Chamber of Commerce should be made to get
their input into the report.
Mr. Willis Olson, owner of the MOvile Home Court in the
City of Hastings, appeared before the Council to discuss the
Mobile Home Ordinance and the January 1st, 1976 compliance date
that he is presently facing. After a discussion of the issue, the
Council requested the item to be carried over to the September 15th
Agenda at which time the residents of the Mobile Court could be
present to present their views on what compliance to the Ordinance
would mean to them.
Moved by Councilman Novak, seconded by Councilman
Sclmirring to allocate $25,000 as a maximum amount of Federal Revenue
Sharing Funds to underwrite the current Bicentennial Programs as
presented to the Council tonite in a document from Michael O'Connor.

Moved by Councilman Kramer, seconded by Councilman
Erickson to declare the 250 gallon oil heating tank, which is
currently the property of the Fire Department, as excess property
and hereby instruct the City Clerk to auction off the tank. The
money received from the Auction will be placed in the Fire Truck
Sinking Fund. Ayes, 8; Nayes, none.

Moved by Councilman Hallberg, seconded by Councilman
Novak to amend Resolution No. 19-75 to reflect the Municipal
Industrial Revenue Bond Issue for Arrow Engineering is no
longer to be $350,000 but is to be increased to $450,000 for the
purpose of financing a new plant in Hastings Industrial Park.
The amount of land involved is six (6) acres, as shown on Item Number 9
on the attached map with this Resolution. Copy of Amendment on
file in Administrator's Office. Ayes, 8; Nayes, none.

REFINING SYSTEMS
Moved by Councilman Hallberg, seconded by Councilman
Erickson to adopt and approve the Resolution for Refining Systems
for the Industrial Revenue Bond Issue of $1,400,000 for the
purpose of constructing in the Industrial Par~, a 20,000 square
foot building on 5.8 acres of land, as so designated on the map
of the Industrial Park as Item Number 7. Ayes, 8 Nayes, none.

Art Baumeister presented to the Council, for their con- COURT HOUSE ISSUE
sideration, a report concerning the status of the old Court House TO SEPT. 15th
in the City of Hastings. The Council instructed the Administrator
to put this item on the next regular scheduled Council meeting of
Sept. 15th.

Art Baumeister reported to the Council on a design
proposal for a sign in the Industrial Park and stated that he
would have a cost of that sign for the next Council meeting,
Sept. 15th. The Council instructed the Administrator to put
the item of the Industrial Park sign on the next AGenda for the
Council's consideration.
Moved by Councilman Kramer, seconded by Councilman
Fischer to approve the Hastings Jaycees use of the City Park
land on the corner of 18th Street and Vermillion Street from
Thanksgiving Day through December 24th, 1975 for the purpose
of selling Xmas trees to the general public. Ayes, 8; Nayes,
none.
Moved by Councilman Hallberg, seconded by Councilman
Schnirring to approve the order to remove the hazardous struc-
ture at 419 W. 17th Street. Ayes, 8; Nayes, none. Copy of
Order for Removal on file in Administrator Office.
Moved by Councilman Erickson, seconded by Councilman
Fischer to approve the partial payment to Fraser Const. Co. for
1975 Construction work in the amount of $25,158.24. Ayes, 8;
Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman
Hallberg to approve the transfer of the Gas Fitters License from
Central Natural Gas Company to Minnesota Gas Company. Ayes, 8;
Nayes, none.
