HomeMy WebLinkAbout07-07-75 1755 Hastings, Minnesota July 7, 1975 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Hastings, Minnesota, was duly called and held at the City Hall in said City on the 7th day of July, 1975 at 7:30 o'clock P.M. Members present: Councilmen Kramer, Erickson, Novak, Schnirring, Latch, Elliott, Hallberg, Fischer and Mayor Petersen. Members absent: None. TIle Mayor opened the Public Hearing at 7:33 P.M. on the Re-hearing of the 1975 Construction Projects. Legal notices from the Newspaper and certified copies of the mailing list to all citizens concerned in the projects were read into the record. The Mayor gave everyone in the audience an oppor- tunity to address themselves to the issue. After di3cussion concerning the 1975 Construction Projects had been completed the ~~yor closed the Hearing at 8:04 P.M. The regular meeting of the City Council began at 8:05 P.M. TIle Minutes of the regular meeting of June 16, 1975 and the Special meeting of June 23, 1975 were approved with the following corrections: The Net Bid recorded for the Squad Car was $250.00. It is corrected to read $4,250.00; a typeographical error in the spelling of the word "park" was corrected. The vote on the adoption of the Resolution calling for a Rehearing on the 1975 Improvements was incorrectly recorded as Ayes, 6; It is corrected to read Ayes, 5. The first two errors pertain to the meeting of June 16th, the latter to the meeting of June 23rd. Councilman Hallberg introduced the following resolution and RESOLUTION #30-75 moved its adoption: REHEARING ON 1975 IMPROVEMENTS CORRECTIONS TO MINUTES RESOLUTION RATIFYING 1975 IMPROVEMENTS: PROPOSAL I, PROPOSAL I I, AND STATE AID PROJECTS WHEREAS : A. The City Council of the City of Hastings heretofore conducted a public hearing on 1975 Improvements for the City; B. The notice of said hearing was defective because it was not in technical compliance with Minnesota Statutes Chapter 427; C. Said defect with respect to those improvements in the notice ordered made by the City Council (the "1975 Improvements") can only be cured by calling a new public hearing pursuant to proper notice thereof; D. A rehearing on said 1975 Improvements, pursuant to proper notice thereof, has been held this date; NOW 1HEREFORE, BE IT RESOLVED by the City Council of the City of Hastings, Minnesota, as follows: 1. It is hereby found, determined and declared that it is expedient and necessary that said 1975 Improvements be made. 2. All prior actions taken with respect to said 1975 Improve- ments, including conducting a public hearing thereon, ordering said Improvements, approving final plans and specifications and advertising for construction bids, letting construction contracts therefor, calling for the sale of $280,000 G.O. Improvement Bonds and accepting the bid thereon to finance said improvements, are hereby ratified, affirmed and a approved. Councilman Erickson seconded the motion to adopt said resolution the same was passed by the following vote: Ayes, 7; Nayes, Councilman Kramer. 1756 RESOLUTION #31-75 DELETING OAK ST. FRavl IMPROVEMENTS FOR 1975 PUBLIC HEARING RENAMING STREETS WEST HASTINGS Councilman Kramer introduced the following resolution and moved its adoption: RESOLUTION DELETING OAK STREET FRCM IMPROVEMENTS FOR 1975 BE IT RESOLVED: that the resolution of the City Council heretofore adopted this date, relating to the 1975 Improvement Program, is hereby amended by deleting from said program, under Proposal I; Oak Street from 12th Street to 13th Street. Construction of Storm Drainage, Bituminous Surfacing and Concrete Curb and Gutter. Councilman Fischer seconded the motion to adopt said resolution and the following vote was recorded: Ayes, Councilmen Kramer, Latch, Schnirring, Hallberg and Fischer; Nayes, Councilmen Erickson, Elliott and Novak. MOtion passed. The Mayor opened the Hearing concerning the Renaming of Certain Streets in West Hastings at 8:24 P.M. The Administrator inserted the proper notices of publication of mailing as required. After giving everyone in the audience an opportunity to be heard, the Mayor closed the Hearing at 8:25 P.M. "" ORDINANCE #27-75 Moved by Councilman Latch, seconded by Councilman Erickson, FINAL READING to approve the Third and Final Reading of the Amendment to the AMENDMENT EAST Ordinance Rezoning East Hastings. Copy of resolution on file. HASTINGS REZONING Ayes, 8; Nayes, none. GRANT VARIANCE FRrn SIGN ORDINANCE APPROVE PHASE I I PARK PLAN SUBMIT LAWCON GRANT DOWNTOWN SIGN REGULATIONS ACTION DEFERRED SHORELINE ISSUE TO JULY 21st MEETING APPROVE USE OF ASSISTANCE FROM DAKOTA COUNTY BASEMENT HrnES TO PLANNING COM. APPROVE TRJ\NSFER LIQUOR LICENSE Moved by Councilman Hallberg, seconded by Councilman Schnirring to grant the following variances to sign requests: Dakota Realty, 1304 Vermillion Street,; Sunset Motel, 1520 Vermillion Street; and Gerth's Insurance, 507 Vermillion Street, on the grounds that the petitioners had received a sign permit within the effective date of the Ordinance, the signs were in- spected by an official of the City and finally, the violations were minor in nature. Ayes, 7; Nayes, Councilman Kramer. Moved by Councilman Schnirring, seconded by Councilman Novak, to approve the amount of $3,000 to be spent for Phase II of tl1e City of Hastings Comprehensive Park Plan which is cur- rently being done by Amenity One. The $3,000 is to be taken out of Federal Revenue Sharing Funds. Ayes, 7; Nayes, Councilman Kramer. Moved by Councilman Kramer, seconded by Councilman Fischer, to authorize the City Administrator to submit the Lawcon Grant to the Federal Government for the possibility of receiving Federal monies for future park development. Ayes, 8; Nayes, none. After a general discussion on the Downtown Sign Regulations the Council decided to defer any action on the matter at this time. After the Council had a brief discussion concerning the Shoreline Regulations, the Council wished to have this item laid over to its next regular meeting on July 21, 1975. Moved by Councilman Latch, seconded by Councilman Kramer, to approve the use of assistance from Dakota County for the City of Hastings comprehensive planning process. Ayes, 8; Nayes, none. MOved by Councilman Schnirring, seconded by Councilman Kramer to refer the issue of the basement homes which exist inthe City of Hastings, to the Planning Commission for their recommendation to come to the Council at a later date. Ayes, 8; Nayes, none. Moved by Councilman Erickson, seconded by Councilman Schnirring, to approve the transfer of the Off-Sale Liquor License of Larry Davis, dba House of Wines, 1300 Vermillion Street, Hastings, to William J. Zuzek, dba same, effective July 8, 1975. Ayes, 8; Nayes, none. C01.Ulcilman Kramer moved, Cmmcilman Erickson seconded to approve the Third and Final Reading of the Amendment to the Water Utility Ordinance which reflects the changes in the time frames required for payment of bills. Ayes, 8; Nayes, none. Councilman Schnirring moved, Councilman Hallberg seconded to approve the Second Reading of the Proposed Dog Ordinance for the City of Hastings. Ayes, 8; Nayes, none. ,,--. Moved by Councilman Hallberg, seconded by Councilman Kramer to approve the Second Reading of the N.S.P. Franchise for the City of Hastings.\ Ayes, 8; Nayes, none. ;; The Council held a general discussion concerning the needed members on the City of Hastings Charter Commission. The Mayor brought forth the name of James Grier to be considered. In view of the fact that there were no other proposals at this time the item will be laid over to the next agenda at the Council meeting of July 21, 1975. Moved by Councilman Novak, seconded by Councilman Erickson to authorize the necessary purchase and/or bidding procedures required to buy the following two items for the City of Hastings Fire Department. (1) An Ambulance with the specifi- cations known as 6l-M Model. (2) A Firetruck that is both a Pumper and Ladder combination as presented before the Council this evening. Ayes, 6; Nayes, Councilmen Kramer and Hallberg. Moved by Councilman Elliott, seconded by Councilman Novak, that the current Administrative car will be transferred to the Fire Department as of January 1, 1976 for the purpose of becoming an exclusive administrative car for the Fire Chief. Ayes, 5; Nayes, Councilmen Fischer, Schnirring and Kramer. Motion passed. Moved by Councilman Kramer, seconded by Councilman Novak to authorize the expenditure of $300 of Federal Revenue Sharing Funds for the purpose of sending the Hastings High School Band to Moorehead, Minnesota to represent the City of Hastings in conjunction with the Nelson-Lucking Post #47 of the American Legion for their Convention Parade on July 12, 1975. Ayes, 8; Nayes, none. 1757 ORDINANCE #28-75 FINAL READING OF AMENDMENf TO WATER UTILIlY ORDINANCE SECOND READING OF DOG ORDINANCE SECOND READING OF N.S.P. FRANCHISE MEMBERS FOR CHARTER COMM. TO JULY 21st. AUTHORIZE ADVERTISE BIDS FOR FIRETRUCK & AMBULANCE ADMINISTRATIVE CAR TO FIRE CHIEF USE $300 AUTHORIZED TO BAND TRIP EXPENSE The next item on the Agenda was the matter of the con- RESOLUTION NO. 32-75 dition of the structures located at 2nd and Washington Streets, REMOVE STRUCTURES Hastings, Minnesota known as the "Prano" property, legally des- PRANO PROPERlY cribed as Lots 5 through 8 inclusive, Block 112, Town of Hastings. Reports previously received from the Fire Marshal and Building Inspector were reviewed and discussed. The City Attorney re- ported that the owners had been contacted but had not responded. It was further reported that there had been numerous complaints about the condition of the property which is hazardous and dilapidated and not capable of human habitation nor capable of any other use. After an extensive discussion, Councilman Hallberg introduced the following resolution and moved its adoption: , RESOLUTION ADOPTING ORDER FOR REMOVAL OF STRUCTURES ON PRANO PROPERlY 2ND AND WASHINGTON STREETS Councilman Erickson seconded the motion to adopt said resolution, the same was passed by the following vote: Ayes, 8; Nayes, none. Copy of Order for Removal is on file in City Administrator Office. Adopted by the City Council of the City of Hastings this 7th day of July, 1975. 1758 RESOLUTION #33-75 The next item on the Agenda was the matter of the condition REMOVE STRUCTURES of the structures located at East Second Street, known as the MAJESKI PROPERTY Majeski house, located on Lot 7, Block 108, City of Hastings. Re- ports previously received from the Fire Marshal and Building Inspector were reviewed and discussed. The City Attorney reported that the County which now holds title to the property pursuant to tax fore- closure had consented to the City removing the structures on the pro- perty and cleaning up the property and charging the costs back against the property for payment upon subsequent sale. After an ex- tensive discussion, Councilman Fischer introduced the following resolution and moved its adoption: RESOLUTION ADOPTING ORDER FOR REMOVAL OF STRUCIDRE ON MAJESKI PROPERTY ON EAST SECOND STREET :J Councilman Erickson seconded the motion to adopt said resolution, the same was passed by the following vote: Ayes, 8; Nayes, none. Copy of Order of Removal is on file in City Admin- istrator Office. Adopted by the City Council of the City of Hastings this 7th day of July, 1975. RESOLUTION #34~75 The next item on the agenda was the matter of the condition REMOVE STRUCTURES of the structure known as the Graus building or the Honda building HONDA BUILDING on Vermillion Street. The legal description of same being the South 23 ft. of the North 73 ft. of the' West 75 ft. 7!-z inches of \ Lots 3 & 4, Block 29, Town of Hastings. Reports were received from the Fire Marshal and Building Inspector and were reviewed and dis- cussed. The City Attorney reported that the owner of the property, Dakota County, had consented to having the property demolished due to its dilapidated and hazardous condition. A copy of the resolu- tion of the County was reviewed. After an extensive discussion, Councilman Erickson introduced the following Resolution and moved its adoption: RESOLUTION ADOPTTNG ORDER FOR REMOVAL OF STRUCIDRE KNOWN AS THE HONDA BLDG. ON VERMILLION STREET Councilman Latch seconded the motion to adopt said Resolution of order of removal and the matter processed accord- ing to the Statutes. Ayes, 8; Nayes, none. Copy of said order on file in the City Administrator Office. RESOLUTION #35-75 DEMOLITION OF BUILDINGS, PRANO HONDA & MAJESKI Adopted by the City Council of the City of Hastings this 7th day of July, 1975. The next item on the agenda was the matter of authorization to the City Administrator and Building Inspector to engage persons to demolish the structures in accordance with the foregoing three resolutions. The City Engineer submitted a report concerning the Stop Signs at 11th and Maple Streets. Councilman Hallberg moved, Councilman Kramer seconded, to accept the report. Ayes, 7; Nayes, Councilman Elliott. Moved by Councilman Kramer, seconded by Councilman Latch, to approve the Second Reading of the Amendment to the Street Renaming Ordinance. Ayes, 8; Nayes, none. Moved by Councilman Elliott, seconded by Councilman Schnirring to authorize the Administration to advertise for the hiring of an Assistant Engineer. Moved by Councilman Novak, seconded by Councilman Elliott to table this item until the meeting of July 21, 1975 due to the fact that we would have additional information concerning possible CETA Funds involved with this position. Moved by Councilman Latch, seconded by Councilman Hallberg to approve the No Parking considerations proposed by the City Engineer on the North side of Second Street from Pine Street to Forest Street. Councilman Fischer moved, Councilman Novak seconded to approve the change from angle to parallel parking for approxi- mately 100 feet on the South side of Second Street just West of Eddy Street. Ayes, 8; Nayes, none. Moved by Councilman Erickson, seconded by Councilman Elliott to approve the transfer of the Cigarette license of Robert Matsch, dba Colonial Liquors to Michael Woxland, dba same, and also approve the transfer of the Cigarette License of Larry Davis, dba House of Wines to William J.
