May 19, 1975
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, May 19, 1975 at 8:00 o'clocK P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Fischer, Erickson, Elliott, Kramer,
Schnirring, Latch, Hallberg, Novak and f~yor
Petersen.
Members absent: None.
The Minutes of the meeting of May 5, 1975 were approved with the
following corrections: The vote on the Resolution providing for the public
sale of $280,000 General Obligation Improvement Bonds of 1975 was incorrect.
The vote was recorded as 8 Ayes. It is corrected on the original copy to
read; Ayes, 7; Nayes, Councilman Kramer. The two Resolutions for final
payment of 1974 Construction and State Aid Construction to Arcon, Inc. and
Husting & Engstrom Inc. respectively, did not have the second to the motion
or the votes on the Resolutions recorded. It is corrected on the original
copy to read; Councilman Erickson seconded the motion for final payment to
Arcon, In., and the vote was Ayes, 8; Nayes, none. Councilman Elliott
seconded the motion for final payment to Husting & Engstrom, Inc. and the
vote was; Ayes, 8; Nayes, none.
Councilman Fischer introduced the following resolution
and moved its adoption:

RESOLUTION AWARDING BID FOR TRAFFIC
SIGN PROGRAM AND SIGN POSTS
WHEREAS, pursuant to an advertisement for bids for fur-
nishing the City with Traffic Signs and Sign Posts, the following
bids were received complying with the advertisement:
Lyle Sign, Inc.
M-R Sign Co. Inc.
Gopher Stamp & Die Co.
Vulcan Signs & Stampings, Inc.
Tucker Co. J:nc.

WHEREAS, Lyle Sign, Inc. is the lowest responsible bidder;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
1. The Mayor and City Clerk are hereby authorized and directed
to enter into a contract with Lyle Sign, Inc. for the Signs and Sign
Posts according to the spe~ifications therefore approved by the City
Council and on file in the office of the City Engineer.

Councilman Kramer seconded the motion to adopt said Resolution
and the same was passed by the following vote: Ayes, 8; Nayes, none.

BUILDING PERMITS Moved by Councilman Novak, seconded by Councilman Erickson
EAST HASTINGS AREA to allow building permits which are received from the East
Hastings Area to exceed 10% limitation as specified in the current
Zoning Ordinance. The Staff is to process those requests.
Ayes, Councilmen Erickson, Elliott, Latch and Novak; Nayes, Fischer
Schnirring, Kramer and Hallberg. The tie vote was broken by the
Mayor voting yes. Motion passed.

Moved by Councilman Erickson, seconded by Councilman Fischer
to refer the re-zoning proposal of the East Hastings Area to the
Planning Commission for their review and comments. Ayes, 8;
Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman Fischer
to approve the final Plat of Franzmeier 1st Addition, subject to
the provision of any necessary easements for sanitary sewer for
~ots 1 & 2, Block 1. Ayes, 8; Nayes, none.
Moved by councilman Schnirring, seconded by Councilman
Kramer to deny the Petition for Utilities as presented by. Louis
Franzmeier for his development. Ayes, Councilmen Fischer, Kramer,
Schnirring; Nayes, Erickson, Elliott, Latch, Hallberg and Novak.
Motion failed.
Moved by Councilman Latch, seconded by Councilman Erickson
to call for a Public Hearing on June 2, 1975 to consider the
Public Utilities request of Louis Franzmeier. The Staff is to
determine as best as it can the estimated cost of the project,
time schedules and other factors relating to this effort.
Moved by Councilman Novak, seconded by Councilman Fischer,
that this item be tabled until the meeting of June 2, 1975.

Moved by Councilman Elliott, seconded by Councilman Kramer
to accept the Planning Commission's recommendation concerning the
Archdiocese of the Twin Cities, 1199 Bahls Dr., Hastings, Mn. and
to further move the First Reading of the Re-Zoning Ordinance for
the Archdiocese in this area. The Staff is instructed to incor-
porate into the Ordinance itself a statement to the effect that
the Re-Zoning that is being considered in this Ordinance is being
done only under the understanding that the Archdiocese will con-
struct and operate housing for the Elderly, for if in fact the
Archdiocese is unable to comply with its project, this Re-Zoning
will no longer be in effect. Ayes, 7; Nayes, Councilman Schnirring.
Moved by Councilman Kramer, seconded by Councilman Novak to
approve the Horne Occupation Permit for Robert Barron, 1201 Lyn Way~
This permit to be reviewed in one year.
Moved by Councilman Elliott, seconded by Councilman Novak, that
this item be tabled to the June 2, 1975 meeting. The Staff to obtain
additional information from the school to see if there will be a
traffic problem or concern with the children in the area. Ayes. 6;
Nayes, Councilmen Kramer and Latch. Motion carried.
Moved by Councilman Schnirring, seconded by Councilman Elliott
to grant the Petitioners' request to install "No Parking" signs on
Lyn Way. Ayes, 8; Nayes, none.
Councilman Kramer moved, Councilman Latch seconded, to
approve the variance for Jean Angell, 1904 Pine St., permitting
a fireplace to encroach on the required yard area.
Councilman Hallberg moved, Councilman Fischer seconded,
to approve the final Plat of Polka Dot Dairy, 1st Addition at 250 E.
17th Street. Ayes, 8; Nayes, none.
Moved by Councilman Latch, seconded by Councilman
Hallberg, to approve the Resolution regarding the Corrnnunity
Development Act of 1974. A copy of said Resolution is on file
City Administrator's Office. Ayes, 8; Nayes, 'none.
Moved by Councilman Fischer, seconded by Councilman
Schnirring to approve the request for the planting of a tree on
City property. The tree to be at least 2~" caliber size.
Ayes, 8; Nayes, none.
Moved by Councilman Latch, seconded by Councilman Novak,
to table the Duane Groth proposal for property concerning the
Vermillion River Project to the meeting of June 2, 1975.
Ayes, 8; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Hallberg, to approve the Engineer Secretary, Diane Latuff as a
permanent part-time employee and that an increase of 20~ an
hour be granted, effective May 19, 1975. Ayes, 8; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman
Latch to approve the Certificate of Correction of Plat: Dakota
Hills 4th Addition, as presented before the Council this
evening. Ayes, 8; Nayes, none.
Moved by Councilman Latch, seconded by Councilman Novak,
to re-affirm the city policy as stated in the letter of June 23,
1970 concerning the city's responsibility to do what improvement
it can in the drainage ditch area of the back yard of Mr. Ruhr.
Ayes, 8; Nayes, none.
