Members absent: None. as read. The Minutes of the meeting of January 20, 1975 were approved COW1cilman Novak moved, COW1cilman Kramer seconded, to pass the third and final reading and adoption of the Amend- ment to the C-3 Zoning Ordinance allowing Creameries as a Special Use. A copy of said Amendment is on file in the office of the Administrator. Ayes, 8; Nayes, none. COW1cilman Schnirring moved, Councilman Novak seconded, to approve the First Reading of the Amendment to the C-3 Zoning Ordinance concerning the Special Use for Small Animal Clinics. Ayes, 8; Nayes, none. COW1cilman Fischer moved, COW1cilman Novak seconded, to approve the final Plat of Westview Shopping Center, waiving the Park fee requirement since a 5% land dedication was given to the City prior to platting. Ayes, 8; Nayes, none. Ivbved by COW1cilman Novak, seconded by C0W1ci1man Erickson, to table the appeal of the Planning Director's Adm. decision concerning Wilford Lehmann. Ayes, COW1cilmen Erickson, Latch, Hallberg, and Novak. Nayes, COW1cilmen Fischer, Elliott, Schnirring and Kramer. Being a tie vote, the Mayor voted in favor of the motion. The ~~yor presented a report to the COW1cil concerning REPORT ON LAND the Industrial Committee's recommendations on land sales in the SALES IN IND. PARK Industrial Park: The COW1cil ordered the report to be put on fileFILED Councilman Fischer moved, COW1cilman Kramer seconded to change tae cOW1cil meeting Ibf February 17th to February 18th because February 17th is Washington's birthday and a legal holiday. Ayes, 8; Nayes, none. COW1cilman Hallberg moved, COW1cilrnan Kramer seconded to approve the abatement that was submitted by the County Assessor, reducing the valuation on Blks 1 thru 99, W42ft of Lot 2, B1k 4 & all of Lots 3 & 4 of Block 4, City of Hastings. Said property owned by Northern States Power Co. Ayes, 8; Nayes, none. COW1cilrnan Latch moved, COW1cilman Erickson seconded, to approve the hiring of a firefighter in the Fire Department to replace the vacancy created by Mr. Truax. Mr. Truax was appointed as the Assistant Fire Chief and Fire ~~rshall for the City of Hastings. Ayes, 6; Nayes, COW1cilmen Kramer and Hallberg. MOtion carried. BRIDGE APPROVE DELETION CONZEMIUS PROP.- ASSESSMENT DENY PARKING SPACE REQUEST Moved by Councilman Elliott, seconded by Councilman Hallberg, to approve the low informal quote of the General Electric Company for the Street Dept. radio for $830.00 Ayes, 8; Nayes, none. Councilman Novak moved, Councilman Latch seconded, to approve the Ride Along Program just for the Explorer Scouts and to provide the City's insurance coverage to protect the Explorer Scouts as they participate in this program. Ayes, 8; Nayes, none. The City Attorney reported to the Council concerning the monolithic concrete pour for the Ice Arena floor issue with the Architect. The Council instructed the City Attorney to talk to the Loosen Const. Co. in regard to the dispute over costs and report back to the Council on February 18th, the results of that conversation. Councilman Hallberg introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT WHEREAS, pursuant to a written contract signed with the City of Hastings on the 29th day of March, 1974 said Chlorine Bldg. having been completed, NOW, "THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The work completed under said contract is hereby accepted and approved subject to lein waivers and final check lists, and BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to issue a proper ord~f final payment of $11 ,266.20 on such contract to Hartfo d Ins':',~ompany, Bonding Co. for Run~za Builders. Adopted by the City Council day of February, 1975. Councilman Fischer seconded the motion to adopt said resolution and the same was passed by the following vote: Ayes, 8; Nayes, none. - t::: ..... --J o t\: Councilman Novak moved, Councilman Hallberg seconded, to approve the informal quote from the Al Sieben Construction Company of $3,410.00 for the purpose of creating a new entrance into the City Hall basement at the rear of the building. Ayes, 8; Nayes, none. Councilman Hallberg moved, Councilman Novak seconded, to authorize the City Engineer to begin the final design and specifications for the Pleasant Drive Bridge. Ayes, 7; Nayes, Councilman Kramer. Motion carried. Councilman Erickson moved, Councilman Latch seconded, to approve the deletion of the Conzemius property Sanitary Sewer Assessment because of an error causing the property to be assessed twice and the necessary adjustment be made in the Tax Rolls and a refund be approved and returned to the Conzemiusowners, if payment has been made. Ayes, 8; Nayes, none. Moved by Councilman Kramer, Seconded by Councilman Schnirring, to deny the request from the Dakota County Sheriff Dept. for additional reserve parking spaces as requested in their letter of January 22, 1975. Ayes, 5; Nayes, Councilmen Elliott, Latch and Novak. ~btion carried. 1677 Councilman Novak introduced the following resolution and moved its adoption: RESOLUfION RECEIVING PRELIMINARY REPORT AND SETTING PUBLIC HEARING ON PROPOSED IMPROVEMENTS SET PUBLIC HEARING 1975 IMPROVEMENTS ~:#9 WHEREAS, a preliminary report has been prepared by the City Engineer with respect to the improvements described in the Notice of Hearing herinafter set forth, and \~ffiREAS, said Engineer has advised this Council that the aforesaid improvements are feasible and should be make as proposed ln the Notice of Hearing thereon, and WHEREAS, the Council considers it expedient to make the follow- lng listed improvements, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings, Minnesota as follows: 1. Such Feasibility Reports are hereby accepted and approved. 2. Said Improvements are hereby combined and designated 1975 Improvement~ and shall be ~dertaken pursuant to the provisions of Chapter 429, Minnesota Statutes 1961. 3. A Public r~aring relative to said improvements will be held on ~~rch 11, 1975 at 7:30 o'clock P.M. in the Council Chambers of the City Hall for the consideration of said im- provements, the nature of which, the estimated cost thereof, the area proposed to be assessed therefore, are described in the Notice of Hearing which shall be in substantially the following form and is made a part thereof. Notice is hereby given that the City Council of the City of Hastings, Minnesota, will meet in the Council Chambers of the City Hall at 7:30 o'clock P.M. on Tuesday, ~furch 11, 1975 to consider the following improvements designated Improvements 1975: PROPOSAL I BITUMINOUS SURFACING CONCRETE c,1JRB AND GlTITER AND SIDEWALK 1. Pine Street from 2nd Street to 6th Street. Sanitary sewer replacement and installation of services as necessary. 2. South Frontage Road from Pine Street to Prairie Street - Sanitary Sewer. 3. South Frontage Road from Westview Drive to Pleasant Drive. Sanitary sewer and watermain construction. 4. 23rd Street from Trunk Highway 61 to Cannon Street. Sanitary sewer, sewer and water services, street grading and gravel base construction. STATE AID PROJECTS 1. Pleasant Drive from Trunk Highway 55 to 4th Street - Bituminous sur- facing, Concrete Curb and Gutter, and Concrete Sidewalk Construction. 2. Pleasant Drive from Honeysuckle Lane to Trunk Highway 55 - Bituminous Surfacing, Concrete Curb and Gutter, and Concrete Sidewalk Construction. 3. South Frontage Road from Lyn Way to Westview Drive - Bituminous Surfac- ing, Concrete Curb and Gutter, and Concrete Sidewalk Construction. 4. Pine Street from 2nd Street to Trunk Highway 55 - Street Reconstruction with Bituminous Surfacing, Concrete Curb and Gutter, Concrete Sidewalk, and Storm Sewer Construction. 5. South Frontage Road from Pine Street to Prairie Street - Street Grading, Gravel Base and Storm Sewer Construction. 6. South Frontage Road from Westview Drive to Pleasant Drive. Street Grading, Gravel Base, and Storm Sewer Construction. 7. Pleasant Drive from Old Bridge Lane to CSAH 47 - Street Grading, Gravel Base, Storm Sewer Construction. STATE HIGHWAY TURNBACK PROJECT 1. 10th Street from Trunk Highway 61 to the Chicago, Milwaukee, St. Paul and Pacific Railroad. Street Reconstruction with Bituminous Surfacing Concrete Curb and Gutter, Concrete Sidewalk, Storm Sewer and Pedestrian Underpass Construction. __ ~ The City Council proposes to assess all or part of the cost for such improvements against every lot, piece or parcel of land within the Corporate Limits that abuts upon said improvements according to the Special benefits received without regard to cash valuation. ....., ~ '::I N The estimated cost of said improvements is $1,458,380 Persons desiring to be heard in reference to the proposed improve- ments may be heard at said time and place. Dated this 3rd day of February, 1975. The City Clerk is hereby authorized and directed to cause said notice to be given two publications in the official newspaper and to give mailed notice to every property owner whose property is benefited by said improvements.
