The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, October 4, 1971 at 7:30 P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Kane, Collins, Hallberg, O'Connor
Wilson, Driscoll, Christenson and Mayor Rotty.
Members absent: Councilman Novak.

Minutes of the last meeting were read and approved.
Councilman Driscoll introduced the following resolution and
moved its adoption:
RESOLUTION ADOPTING ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by law,
the Council has met and heard and passed upon all objections to the pro-
posed assessments for the improvement of the following:
PROPOSAL I
Street Surfacing, Concrete Curb and Gutter and Sidewalk:
Westview Drive from 15th Street to 14th Street
14th Street from Bauer's Addition to Westview Drive.
Sun Valley within Dakota Hills 2nd Addition
Bituminous Surfacing and Concrete Curb, Gutter and Sidewalk
Alley from Sibley Street to Ramsey Street between 2nd and 3rd Sts.
Bituminous Surfacing

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTINGS:
1. Such proposed assessments, a copy of which is attached hereto

and made a part hereof is hereby accepted and shall constitute the special
assessments against the lands therein, and each tract of land therein in-
cluded is hereby found to be benefited by the proppsed improvement in the
amount of the a~Sessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the installments to be
payable on or before the first Monday of January, 1972. Any deferred in-
stallments shall bear interest at the rate of eight percent (8%) per annum.
To the first installments shall be added interest on the entire assessment,
from the date of this assessment resolution, until December 31, 1971. To
each subsequent installment when due shall be added interest for one year
on all unpaid installments.
3. The owner of any property so assessed may, for 30 days after
notification from the City Treasurer, pay to the City Treasurer, 'the whole
of the assessment without interest, and he may at any time, prior to
certification of the assessment to the County Auditor, as herein provided,
pay the whole of the assessment against any parcel with interest accrued
to the date of payment to the City Treasurer, and he. may .at any time
thereafter pay the County Treasurer the entire amount of the assessment
remaining unpaid with interest accrued to December 31st of the year in
which such payment is made.
4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to fue County Auditor to be extended on the proper tax
lists of the County and such assessment shall be ,collected and paid over
in the same manner as other municipal taxes.

to pass the third reading of an Ordinance entitled "AN ORDINANCE v
ESTABLISHING A NATURAL RESOURCES AND RECREATION ADVISORY COMMISSION"
to finally read as follows:
The City Council does ordain:

SECTION I ESTABLISHED AND CREATED: In accordance with and subject
to the limitations of Minnesota Statutes Annotated
412.621 subdivision 1, there is hereby established and created an
Advisory Natural Resources and Recreation ConiInissionfor the City of
Hastings.
SECTION II NATURAL RESOURCES AND RECREATION ADVISORY COMMISSION -
MEMBERSHIP AND TERMS: Subdivision 1. The Natural
Resources and Recreation Commission shall consist of eleven members -
mine regular, one student representative and one member of the City
Council, all appointed as hereinafter set forth.
Subdivision 2. Nine regular members of the Commission
shall be appointed by the City Council for terms of three years each.
No less than five of said regular members shall be residents of the
City. Three (one of whom can be a School Board member) of said regular
members shall be appointed by the City Council with the approval of the
Board of Independent School District #200. Subsequent regular appoint-
ments shall be for three year terms expiring on December 31st of the
third year of such term and until a successor is duly appointed. In
the event of a vacancy, the City Council shall appoint a person to com-
plete the unexpired term, such appointment being made irt the same manner
as the original appointment. The nine members holding office at the
time of the adoption of this ordinance shall continue in office until
the term for which they were appointed shall have expired.

Subdivision 3. One member and,one a1tern~te, both of whom
shall be Senior High students of School District #200, shall be appointed
b~ and and serve at the pleasure of the Board of said School District,
upon the recommendation of the High School Student Council, for a one-
year term unless such appointment shall be sooner terminated by said
Board. Such member and alternate shall be appointed as soon as practi-
cable after the 1st day of September in the year in which such term
shall commence to serve until the 31st day of August in the succeeding
year. The named alternate may attend all meetings and in the absence
of the member shall vote and shall be counted in determining a quorum.
Subdivision 4. One voting member and one alternate, both
of whom shall be members of the City Council, shall be appointed by the
City Council for a one year term. No Council member shall serve as
member for more than two consecutive years. Such member and alternate
shall be appointed as soon as practicable after the 1st day of January
of each year, to serve until the 31st day of December of that year and
until his successor shall qualify.
SECTION III EXPENSES OF MEMBERS: The members of the Commission shall
serve without pay, but may be reimbursed for actual expenses
if funds therefor are provided in the adopted budgets of the Park Fund
and the Recreation Fund.
SECTION IV POWERS AND DUTIES: The Commission shall have the power
to adopt by-laws and elect such officers for such terms
as it deems desirable from the nine regular members and who are not
members of the City Council, School Board, Planning Commission. It
shall be the duty of the Commission to hold meetings of its members, and
to meet from time to time with the City Administrator and other officials
as may be designated to consider such matters pertaining to land
acquisition and other Open Space System programs and to Parks and Public
Recreation programs in the City as shall be referred to the Commission
by the City Council, City Administrator or School Board or as the members
of the Commission deem proper. The Commission shall make an annual
advisory report not later than 120 days prior to the end of the current
fiscal year which report shall contain the recommendations of the
Commission for program and budget for the ensuing year. Additional
Commission reports, conclusions, and recommendations shall be made to

the City Councilor Board of Education as may be requested or to any
or all of them as the Commission deems appropriate in the light of
the matter under consideration.
SECTION V
This Ordinance shall take effect upon publication.

WHEREAS, the 1970 Federal Highway Act for Federal Aid
Urban purposes requires that the urbanized area, as defined, is estab-
lished by the 1970 census and cannot be altered until 1980;
AND WHEREAS, the Highway Functional Classification Studies
which determines priorities, were established on the basis of present
use factors and could'provide construction funds for streets and
highways only within the defined "Urban Boundry";
AND WHEREAS, the present law limits the F.A.U. System to
routes that are functionally classified as "principal arterials", as
identified in the "National Transportation Planning Study";
AND WHEREAS, the National Transportation Planning Study was
performed within a very limited time and' should be given greater con-
sideration than was provided and the local units of government should
be permitted to make appropriate changes;
AND WHEREAS, the intent of the F.A.U. Program appears to be
for the purpose of providing Federal Funds to the urban cities to help
solve problems of financing improvements of major traffic carriers
within their jurisdiction;
AND WHEREA~on1y 4-1/2% of the princtpa1 arterials are under
local jurisdiction and 95-1/2% are under the jurisdiction of counties
or state agencies in Minnesota;

AND WHEREAS, a part of the total transportation requirements
of an urban area must be provided within the urban fringe and between
urban centers;
AND WHEREAS, a construction program based upon present
criteria of population densities and existing traffic carriers can
only provide outdated systems upon completion;

THEREFORE, BE IT RESOLVED, that the City Council of the
City of Hastings does oppose the rules and regulations under the 1970
Federal Highway Act as they relate to the "Urban Bounda1!'Y" and prior-
ity financing of F.A.U. Systems. That they would recommend an in-
depth study of functional classification for construction priority
purposes. That all studies should be based upon minimum 20-year
projections for the defined "Urban Boundary". And that existing
Comprehensive plans be used in establishing priorities rather than
present traffic on present or existing carriers.
