HomeMy WebLinkAbout09-07-71 807 Hastings, Minnesota September 7, 1971 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 7, 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, Christenson and Mayor Rotty. Members absent: Councilmen O'Connor, Wilson and Driscoll. Minutes of the last meeting were read and approved. The Public Hearing on the petition to rezone Lots 14 thru 17, Block 4, Vermillion Addition to the City of Hastings from Resi- dential 2 to Commercial 2 was commenced at 8:00 o'clock P.M. pursuant to notice. The Clerk reported that notiees had been mailed and posted as required by the Zoning Ordinance. He further reported that since the agenda for this meeting had been set, the owner of the above described property had submitted a request in writing that the request for rezoning be withdrawn. It was moved by Councilman Kane, seconded by Councilman Collins that the request for rezoning be withdrawn. Ayes, all; Nays, none. 'I I I The Public Hearing on the application for Special Use Permit to allow construction of an apartment in the basement at 418 West 12th Street was commenced at 8:00 o'clock. ~~M. purs~ant td noticeA The Clerk reported that notices had been mailed and posted as required by the Zoning Ordinance. The persons requesting the Special Use Permit were not in attendance. It was moved by Councilman Kane, seconded by Councilman Novak that the hearing be continued to 8:00 o'clock P.M., Monday, September 20, 1971 and that the persons requesting the Special Use Permit be notified to appear at this hearing. Ayes, all; Nays, none. Moved by Councilman Novak, seconded by Councilman Hallberg to pass the first reading of an Ordinance entitled "AN ORDINANCE ESTABLISHING A NATURAL RESOURCES AND RECREATION ADVISORY COMMISSION". Ayes, all; Nays, none. -1 I I Moved by Councilman Hallberg, seconded by Councilman Christenson to negate the lease with the Chicago, Milwaukee, St. Paul & Pacific Railroad Company on the following described property used by the City for stockpiling sand: Ayes, all; Nays, none. South 100 feet of West 50 feet of Lot 7, Block 16, Original Town Addition to the City of Hastings. Councilman Christenson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT WHEREAS, pursuant to a written contract signed with the City of Hastings on the 5th day of April, 1971, Gerard Denn having satisfac- torily completed the remodeling of the Council Chambers of the City Hall according to the contract, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The work completed under said contract is hereby accepted and approved, and -\ r BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to issue a proper order for final payment of $1,865.43 on such contract, taking the contractor's receipt in full. Moved by Councilman Christenson, seconded by Councilman Kane to refer to the Planning Commission the application for a Special Use Permit to contruct an apartment in the basement of the dwelling on Lot 15l, Westwood 4th Additon Replat. Ayes, all; Nays, none. r-' I Councilman Christenson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT WHEREAS, pursuant to a written contract signed with the City of Hastings on the 19th day of April, 1971, Bituminous Surface Treating Company having satisfactorily completed their share of the 1971 Improve- ment Program, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The work under said contract is hereby accepted and approved, and BE ~T F~THER RESOLVED, that the City Clerk and Mayor are hereby directed to issue a' p~ope:r-J6fder for final payment of $2,264.48 on such contract, taking the contractor's receipt in full. Councilman Hallberg introduced the following resolution and moved its adoption: RESOLUTION TO PROCEED WITH ACQUISITION OF VERMILLION RIVER PARKWAY BE IT RESOLVED that the City Clerk is hereby authorized to proceed with application for Federal Funds to acquire necessary lands for park and recreation purposes and Corps of Engineers Flood Control Projects along and adjacent to the Vermillion River from the "Old Mill Park" to CSAH #47 bridge, in accordance with recommendations as outlined in the five-year plan by the Hastings Planning Commission. Adopted by the City Council this 7th day of September, 1971. Moved by Councilman Hallberg, seconded by Councilman Christenson that the Council accept, with regrets, the resignation of Leonard Bauer from the Hastings Planning Commission. Ayes, all; Nays, none. (Resignation to be effective September 7, 1971) Moved by Councilman Christenson, seconded by Councilman Hallberg to refer to the Planning Commission the request to rezone the following described property from A~Ticultural to Residential 3:Ayes, all, Nays, none. That part of the Northeast l/4 of the Northeast l/4 of Section 35, Tl17N Rl7W, described as follows: Commencing at the Southeast corner 809 of said NE l/4 of NE 1/4; thence N 00 Ol' W on an assumed bearing along the east line of said NE l/4 of NE l/4 for a distance of l43.09 feet to the centerline of County Highway No. 54; thence N 820 35' 30" W along said centerline for a distance of 54l.33 feet to the point of beginning of the tract to be described thence S 70 24' 30" W for a distance of 208.71 feet; thence N 820 35' 30" W for a distance of 208.71 feet; thence N 70 24' 20" for a distance of 208.71 feet to the center- line of said County Highway No. 54; thence S 820 35' 30" E along said centerline for a distance of 208.71 feet to the point of beginning. Councilman Christenson introduced the following resolution and moved its adoption: RESOLUTION FOR HEARING ON PROPOSED ASSESSMENTS 1\ I i LJ WHEREAS, by resolution passed by the City Council on February l6, 1971, the City Clerk and City Engineer were directed to prepare a proposed assessment of the cost of the following improvements: PROPOSAL I STREET SURFACING, CONCRETE CURB AND GUTTER AND SIDEWALK Westview Drive from l5th Street to l4th Street, 14th Street from Bauer's Addition to Westview Drive; and Sun Valley Lane within Dakota Hills 2nd Addition - Bituminous Surfacing and Concrete Curb, Gutter, and Sidewalk. Alley from Sibley Street to Ramsey Street between 2nd and 3rd Streets - Bituminous Surfacing. 5th Street from Sibley Street to Ramsey Street - Concrete Sidewalk on the South side of the street.
