HomeMy WebLinkAbout08-16-71 799 Hastings, Minnesota August 16, 1971 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 16, 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll, Christenson and Mayor Rotty. Members absent: None. Minutes of the last meeting were read and approved. The Mayor declared open the public hearing on the application of Paul Reuter, owner of Lots 3 & 4, Block 18, W. G. LeDuc's Addition to the City of Hastings to grant a Special Use Permit to allow construc- tion of a car wash within a C-3 zone according to Section 9.9.3 of the City Zoning Ordinance dated December 7, 1970. The Clerk reported that notice had been given as required by Section 12.3.2. All persons were given an opportunity to be heard. After lengthy discussion, it was mbved by Councilman Kane, seconded by Councilman Driscoll to limit debate on the above question. Ayes, Councilmen Kane, Collins, and Driscoll. Nays, Councilmen Novak, Hallberg, O'Connor, Wilson and Christenson. Motion lost. After further discussion, it was moved by Councilman Novak, seconded by Councilman Christenson that a Special Use Permit be granted to Paul Reuter when the following requiremenmare met to the satisfac- tion of the City Engineer: Ayes, Councilmen Novak, Kane, Collins, O'Connor, Driscoll and Christenson. Nays, Councilmen Hallberg and Wilson. Motion carried. ----- Requirements to be met before granting a Special Use Permit for car wash on Lots 3 & 4, Block 18, W.G. LeDuc's Addition: 1. Construction to be in accordance with sketch plan on file in the Office of the City Engineer and easements to be furnished as required. 2. Fence south edge of structure to blend with entrance and exit. . 3. Close Vermillion Street center island. 4. Relocate curb openings if necessary, subject to Minnesota Highway Department approval. 5. Submit a topographic map showing present and proposed conditions. 6. Adhere to all sections of the Zoning Ordinance pertaining to service stations. 7. Fencing subject to approval of adjacent property owners and as recommended by the City Engineer. Councilman Driscoll introduced the following resolution and moved its adoption: -\ I BIDS ON PAINTING WATER TANK WHEREAS, pursuant to an advertisement for bids for painting the 150,000 gallon steel elevated water tank for the City of Hastings, the following bids were received complying with the advertisement: Contractor Contract Amount Hourly Crew Rate Larson Tank Co. $3,150.00 $25.00 800 Contract Hourly Contractor Amount Crew Rate Schumann Bros., Inc. $2,250.00 $35.00 Brown Sandblasting & Painting 3 ,200. 00 12 . 00 Toombs-Anderson 1,800.00 9.50 Anderson Sandblast & Painting 3,200.00 17.50 ,--- WHEREAS, it appears that Toombs-Anderson is the lowest responsible bidder, NOW, THEREFORE BE IT RESOLVED by the City Council of Hastings: The Mayor and City Clerk are hereby authorized and directed to enter into a contract with Toombs-Anderson for painting the 150,000 gallon steel elevated water tank, according to the specifications there- fore approved by the City Council and on file in the office of the City Clerk. The City Clerk is hereby authorized and directed to return forth- with to all bidders the deposits made with their bids, after a contract has been signed. Moved by Councilman Driscoll, seconded by Councilman Christenson that the City Clerk be and hereby is authorized and directed to advertise for bids for the construction of a water well in the Industrial Park. Bids to be opened Tuesday, September 14, 1971 at 2:00 o'clock P.M. in the City Hall; bids to be awarded at 8:00 o'clock P.M. on September 20, 1971 in the Council Chambers of the City Hall. Ayes, all; Nays, none. Moved by Councilman Novak, seconded by Councilman Kane to approve the following partial payment for work performed on the 1971 Improvement Program: Ayes, all; Nays, none. . Ayes, Councilmen Novak, Kane, Collins, Hallberg, Wilson, Driscoll and Christenson. Nays, Councilman O'Connor. Motion carried. ,-. I Councilman Hallberg introduced the following resolution and moved its adoption: ACCEPTANCE OF COUNTRY CLUB SECOND ADDITION FINAL PLAT BE IT RESOLVED, that the plat of Country Club Second Addition to the City of Hastings, Dakota County, Minnesota, legally described as follows: Beginning at a point 1321.63 feet west and 85.20 feet north of the center of Section 33, Tl15N, R17W, which point is the northwest corner of Lot 1, Block 7, thence N 000 00'40" 801 E 722.13 feet; thence N 890 41' E 323.63 feet ; thence S 000 00' 20" W 688 feet; thence S 890 41' W 127.63 feet; thence S 000 02' E 35.35 feet; thenee N 890 58' W 196 feet to the point of beginning. Together with Lot 23 of Auditor's'Subdivision No. 11 of the City of Hastings, County of Dakota, State of Minnesota, Be and hereby'is accepted, subject to the payment of the Interceptor Sewer charge of $4,050.00, subject to the requirement of "Land Sub-Division Ordinance" dated December 16, 1968, subject to dedi- cation of 19th Street from Country Club Second Addition to Pine Street, subject to dedication of public lands as shown on the plat, and subject to the presentation of the hard shell plat to the City Clerk for signa- tures and filing with the Register of Dee~of Dakota County, Minnesota. lJ Adopted by the City Council this 16th day of August, 1971. NOTICE OF PUBLIC HEARING ON REZONING Notice is hereby given that the City Council of the City of Hastings, Mirtnesota will meet in a Public Hearing in the Council Chambers of the City Hall on Tuesday, September 7, 1971 at 8:00 o'clock P.M. to consider the request to rezone the following property from Residential-2 to Commercial-2 in accordance with Section 17 of the City Zoning Ordinance dated December 7, 1970: 1'1 I Lots 14 thru 17, Block 4, 'Vermillion Addition to the City of Hastings Persons desiring to be heard in reference to this rezoning may be heard at this time. After further discussion the following motion was offered by Councilman Hallberg, seconded by Councilman Wilson: That The Planning Commission be authorized and instructed to hold a public hearing on the comprehensive plan as heretofore deli- vered to the Council at a time and place to be set by the Planning Commission, with notice of the time, place and purpose of the hearing to be published in official newspaper of the City at least ten (10) days prior to the date of the hearing. r 1 l_~ Further, that after the public hearing the Planning Commission shall transmit its report of the public hearing to the Council for further action by the City Council. Ayes, all; Nays, none. ~ 802 Reports were received from the Chief of Police, Fire Chief, Building Inspector, City Engineer, City Clerk and City Attorney on the condition of the Lynn property in East Hastings. A full discussion took place. It was requested that the County Welfare Department be requested to find suitable living quarters for the inhabitants of the Lynn property. --- \ Councilman O'Connor offered a motion, seconded by Councilman Christenson, which motion moved adoption of the following order: Ayes, Councilmen Novak, Collins, Hallberg, O'Connor, Wilson, Driscoll and Christenson; Nays, Councilman Kane. Motion carried. CITY OF HASTINGS IN THE MATTER OF THE HAZARDOUS BUILDING LOCATED ON LOT 4, BLOCK 4, BARKER"S ADDITION TO THE CITY OF HASTINGS AND ADJACENT STREET & ALLEY RIGHT OF WAY v/ TO: Elmer J. Lynn, Cecil Lynn, and all other persons claiming any right, title or interest in the aforementioned premises: Pursuant to Chapter 393 of the Laws of 1965, the Hastings City Council, having duly considered the matter, finds the buildings located on the above described property to be hazardous for the following reasons: The City Council after receipt of numerous complaints, ordered an inspection and a repopt.,.t1w;eof to be made by the Chief of Police, the Fire Chief, the City Health Officer, the City Engineer, and the City Building Inspector, which reports were submitted to the City Council on August 1', 1971; that said reports state that the building is dilapidated, in extreme state of disrepair, is of unsightly appearance, violates numerous provisions of the building code in force in the City of Hastings, completely lacks sanitary facilities, and running water, that the struc- tures are uninhabitable, that the structure is deteriorated and inadequate, has tin for roofing, has rotted sills and base, is littered with junk and rubble, is structurally unsound and unsafe, and constitutes a fire hazard, a health hazard and a hazard to public safety. Pursuant to the foregoing and in accordance with Chapter 393 of the laws of 1965, it is hereby ordered that the above referred to structures be razed and removed on or before November 16, 1971. It is further ordered that all personal property or fixtures located on the premises shall be removed by the persons owning the same prior to the above date and if not so removed, the City of Hastings may remove and sell such personal property or fixtures at private auction. You are further advised that unless the aforementioned demoli- tion and removal is completed on or before November 16, 1971; or an answer is served upon the City of Hastings and filed in the office of the Clerk 0f District Court of Dakota County, Minnesota, within twenty (20) days from the date of the service of this order, upon you, a motion for summary enforcement of this order will be made to the District Court of Dakota County. r-, I i !
