HomeMy WebLinkAbout07-19-71 785 Hastings, Minnesota July 19, 1971 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, July 19, 1971 at 8:00 o'clock P.M. in the Council Chambers @f the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll and Mayor Rotty. --., Members absent: Councilman Christenson. Minutes of the last meeting were read and approved. Moved by Councilman Wilson, seconded by Councilman Driscoll to pass the second reading to rezone the Hy-De-Hy property from I-2 to C-l in accordance with Section 17 of the City Zoning Ordinance dated December 7, 1970. Ayes, Councilmen Novak, Kane, Collins, O'Connor Wilson and Driscoll; Nays, Councilman Hallberg. Motion carried. Moved by Councilman O'Connor, seconded by Councilman Driscoll to pass the second reading to amend Section 6 of an Ordinance entitled "AN ORDINANCE RELATING TO AND REGULATING THE LICENSE AND SALE OF NON- INTOXICATING MALT LIQUORS, PROHIBITING THE SALE THEREOF AT WHOLESALE OR RETAIL EXCEPT AS LICENSED BY THE ORDINANCE AND PROHIBITING THE SALE TO ANY PERSONS UNDER THE AGE OF TWENTY-ONE YEARS, AND REPEALING ALL ORDIN- ANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH" as follows: Ayes, Councilmen Kane, Collins, Hallberg, O'Connor, Wilson and Driscoll. Councilman Novak abstained. Motion carried. Section 6. Fees "and the sum of $25.00 if the applicati,?n is for Off Sale License." Moved by Councilman Kane, seconded by Councilman Hallberg to pas:; the second reading to amend an Ordinance entitled IIAN ORDINANCE PROVIDING FOR SEWAGE SERVICE CHARGES AGAINST THE OWNERS OR OCCUPANTS OF PROPERTY NOW OR HEREAFTER CONNECTED WITH THE SEWERAGE SYSTEM OF THE CITY OF HASTINGS" as follows: Ayes, all; Nays, none. Section C: The minimum charge for every sewer connection shall be $5.00 per quarter. Moved by Councilman Driscoll, seconded by Councilman Wilson to remove from the table the matter regarding an application for a Special Use Permit for the construction of a car wash on Lots 3 & 4, Block 18, W. G. LeDuc's Addition to the City of Hastings, that was tabled on July 6, 1971. Ayes, all; Nays, none. Moved by Councilman Wilson, seconded by Councilman Driscoll to approve the construction of a car wash on Lots 3 & 4, Block 18, W. G. LeDuc's Addition to the City of Hastings, subject to all requirements being met satisfactory to the Engineer. Motion withdrawn. Moved by Councilman Wilson, seconded by Councilman Kane that a Public Hearing be held on Monday, August 16, 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall and that the following notice be published, mailed and posted as required by Ordinance: Ayes, all; Nays, none. NOTICE OF PUBLIC HEARING ON APPLICATION FOR SPECIAL USE PERMIT '1 Application has been made to the Hastings City Council, sitting as a Board of Adjustment, to grant a Special Use Permit to allow con- struction of a car wash within a C-3 zone according to Section 9.9.3 of the City Zoning Ordinance dated December 7, 1974 on the following described property located the the City of Hastings, Dakota County, Minnesota: ,..,........, ; , , Lots 3 & 4, Block 18, W. G. LeDuc's Addition A Public Hearing on the application for a Special Use Permit will be held by the City Council sitting as a Board of Adjustment at a regular meeting of the City Council scheduled for Monday, August 16, \. 786 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Moved by Councilman Novak, seconded by Councilman Driscoll to table the question of establishing a Housing Authority for the City of Hastings. Ayes, Councilman Novak, Kane, Collins, Wilson and Driscoll; Nays, Councilmen Hallberg and O'Connor. Motion carried. Moved by Councilman Driscoll, seconded by Councilman O'Connor to delete the paragraph under Article XV "Legal Protection" in the Union Contract between the City of Hastings and the Fire Department employees and insert "A11 employees shall be given legal protection as provided for by Minnesota Statutes." Ayes, all; Nays, none. r- I I I Moved by Councilman Collins, seconded by Councilman Driscoll that the Engineer be authorized to hire Graus Construction Company, general contractors of Hastings on a time and material basis for emergency construction of a concrete retaining wall through Block 23, Original Town Addition, at a cost not to exceed $3,675.00 Ayes, all; Nays, none. Moved by Councilman O'Connor, seconded by Councilman Wilson to approve the following partial payment for work performed on the 1971 Improvement Program: Ayes, all; Nays, none. Bituminous Surface Treating Co. $7,194.60 Moved by Councilman Wilson, seconded by Councilman Driscoll, that the next regular Council meeting be set for Tuesday, August 3, 1971 instead of the regular meeting date of the first Monday in August due to a lack of quorum that could be in attendance on Monday. Ayes, all; Nays, none. Councilman Driscoll introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING MUNICIPAL STATE AID HIGHWAYS WHEREAS, it appears to the City Council of the City of Hastings, Minnesota, that the street hereinafter described should be designated a Municipal State Aid Street under the provisions of Minnesota Laws 1959, Chapter 500: I NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings that the road described as follows, to wit: Eas~ 10th Street (SP 1924 T.H. 291) from T.H. 61 (Vermillion Street) to CSAH 54 (State Hospital Entrance) be and hereby is established, located, and designated a Municipal State Aid Street of said City, subject to the approval of the Commissioner of Highways of the State of Minnesota. BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to forward two certified copies of this resolution to the 787 Commissioner of Highways for his consideration, and that upon his approval of the designation of said road or portion thereof, that same be con- structed, improved and maintained as a Municipal State Aid Street of the City of Hastings, to be numbered and known as Municipal State Aid Street 30-132.
