HomeMy WebLinkAbout07-06-71 772 Hastings, Minnesota July 6, 1971 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, July 6, 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Christenson and Mayor Rotty. ~ Members absent: Councilmen Wilson and Driscoll. Minutes of the last 'meeting were read and approved. The City Clerk reported that the owners of the Hy-De-Hy Bottling Works property requested that the second reading to rezone their property be held over until the meeting of July 19, 1971. Moved by Councilman Hallberg, seconded by Christenson to pass the first reading to amend Section 6 of an Ordinance entitled "AN ORDINANCE RELATING TO AND REGULATING THE LICENSE AND SALE OF NON-INTOX- ICATING MALT LIQUORS, PROHIBITING THE I. SAhE: THEREOF AT" WHOLESALE OR RETAIL EXCEPT AS LICENSED BY THIS ORDINANCE AND PROHIBITING THE SALE TO ANY PERSONS UNDER THE AGE OF TWENTY-ONE YEARS, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH" as follows: Ayes, all; Nays, none. Section 6. Fees "and the sum of $25.00 if the application is for Off Sale License." Moved by Councilman Hallberg, seconded by Councilman Collins to pass the first reading to amend Section 4 of an Ordinance entitled "AN ORDINANCE LICENSING AND REGULATING THE SALE OF INTOXICATING LIQUORS WITHIN THE CITY OF HASTINGS, DAKOTA COUNTY, MINNESOTA, REPEAL- ING INCONSISTENT ORDINANCES AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF" as follows: Ayes, all; Nays, none. -- Section 4. Fees "The annual fee for an Off Sale License shall be $300.00." Moved by Councilman Christenson, seconded by Councilman Kane to approve an Off Sale 3.2 Beer Non-Intoxicating Malt Beverage License for David Huisenga, Four Seasons Produce, 1512 Vermillion Street. Ayes, Councilmen Kane, Collins, Hallberg, O'Connor and Christenson. Council- man Novak abstained. Moved by Councilman O'Connor, seconded by Councilman Hallberg to approve the following investment of City funds: Ayes, all; Nays, none. Improvement Bonds 1971 Construction Acct. $100,000. Industrial Park Bonds 1971 Const. Acct. 300,000. Water & Sewer Rev. Bonds 1971 Const. Acct. 289,852. Councilman Christenson introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING WORKING CONDITIONS, WAGES AND HOURS FOR FIRE DEPARTMENT EMPLOYEES IN THE CITY OF HASTINGS FOR 1971 'I i I WHEREAS, the City Council feels that it is for the best interest of the City of Hastings, the Fire Department employees, and for their designated bargaining representative, Municipal Drivers, Helpers and Public Employees Union, Local #664, for the purpose of establishing conditions of employment of the employees of the Fire Department and to insure a friendly spirit of cooperation between the City, its employees, and their designated bargaining representatives, and to avoid disrup- tion in the service and operation of said Fire Department, and to secure the benefits intended to be derived by the City, its employees, and 773 their designated bargaining representatives, to adopt the hereinafter set out rules and regulations covering the employment and working conditions of the employees of the Fire Department. NOW THEREFORE, BE IT RESOLVED by the City Council that the following rules and regulations covering the employment of the employees of the Fire Department be adopted and placed in effect as follows, to wit; -- I I ! ARTICLE I Recognition The City hereby agrees to recognize Municipal Drivers, Helpers & Public Employees Union, Local #664, as the bargaining representative of all employees employed in the Fire Department. ARTICLE II Seniority The City hereby does recognize seniority rights and employees shall be promoted, demoted, laid off, and returned to service according to their length of service, providing, however, that such employees qualify to perform the work; and provided..further, that such employees shall not establish seniority rights until they have passed a probationary period of six months. ARTICLE III Vacations The employees shall be granted the following vacation schedule: -- Years of Service Days Vacation 1 5 2 to 5 10 6 11 7 12 8 13 9 14 10 15 11 16 12 17 13 18 14 19 15 20 All vacation pay shall be accrued, and in the event an employee's employment is terminated for any reason,' the employee shall receive, upon his termination, the vacation pay which he has coming to him at that time on a pro-rata basis. No more than four consecutive weeks vacation can be taken at one time. In computing vacation pay, length of service shall be based upon the anniversary date of the day an employee commences employment. All employees are to be paid their vacation pay prior to their leaving for their vacation. -- I ARTICLE IV Grievances Should any grievance arise as to the interpretation of or adherence to the terms and provisions of this resolution, the employees affected may, either directly or through their designated bargaining Tepresentative, take the matter up with the department head in an effort to effect a satisfactory settlement. If the department head and the employees are unable to agree, then the matter shall be referred to the designated bargaining representative, who shall endeavor to effect a satisfactory settlement with the City Councilor its authorized representative. 774 ARTICLE V Discrimination No employee shall be discriminated against and no employee shall be discharged for giving information regarding alleged violation of this reso 1ution. ARTICLE VI 1 ; Sick Leave and Other Leave of Absence ~ Sick Leave: All Jetnp1oyees'~or't1i.e City shall be entitled to accumulate one day of sick leave for each month of employment and allowed accu- mulation of sick leave up to one hundred twenty (120) days. Employees shall bank an additional one-half (1/2) day per month after the accu- mulation of the 120 days to be used only in cases of very prolonged illnesses. Sick leave will be granted for actual sickness, temporary physical disability and quarantine. The City may require a doctor's certificate on sick leave claims of three days or more. Personal Leave: All employees of the(C~ty shalL be entitled to three (3) days personal leave per year which shall not accumulate. Personal leave for purposes of this paragraph includes and is limited to: Death in the immediate family, death of spouse, parent, brother, sister, child, grandparent, and spouse's parent, brother, sister, child or grandparent; and critical illness of immediate family. ARTICLE VII Severance Pay If an employee retires at age 65, or as otherwise provided by law, or is forced to retire due to physical condition not allowing him to con- tinue gainful employment, or voluntarily terminates employment with the City after due notice, with the consent of the City, but not if discharged or resigns by the request of the City, all and in each case after ten (10) years of service, they will receive thirty-five percent (35%) of unused sick leave, based on their current hourly rate, as severance pay. The one-half day per month accumulated after the 120 days, will not be considered for severance pay purposes. I-~ L__] ARTICLE VIII Hours of Employment The regular work day shall consist of 24 hours per day. The regular work week shall consist of an average of fifty-seven (57) hours in one (1) week. An employee called back to work after he has completed his regular work day or called out on his day off shall receive $3.00 per hour. ARTICLE X Holidays All employees shall be paid for seven (7) holidays, based on eleven (11) hours per day, in cash, on December 15th of the year, regardless of number of holidays actually worked. 775 ARTICLE XI Educational Instructional Time A m~n~mum of four (4) hours and not to exceed eight (8) hours per day on regular days off be granted at the regular call back rate per hour for educational instructional time. ARTICLE XII ,.--- , Leave of Absence Employees subpoenaed as witnesses or called and selcted for jury duty shall receive their regular compensation and other benefits for their e~ploymentless the amount received by them as jurors or witness fees. The City agrees to grant the necessary time off without pay to any employee designated to attend a labor convention or to serve in any capacity on other official union business. ARTICLE XIII Job Classification The City will forthwith undertake a job cl~ssification study of the Fire Department.. At the conclusion of the study, the Union will be advised of City findings and recommendations. The Union will be given an opportunity to be heard before implementation of any recommendations arising from the study. ARTICLE XIV Insurance Benefits All regular employees will continue to be covered under the hospita1- medical-surgical insurance plan adopted by the City. Full cost of employee coverage to be paid by the City. Cost of dependent coverage to be paid by the employee. All regular employees will also receive a $5,000 Life Insurance policy with the full cost of the premiums to be paid by the City. Also, the City will provide a long-term disability insurance policy with no cost to the employee, as follows: Eligibility: Each active, full-time employee who works a minimum of 30 hours per week, except temporary employees. Qualifying Period: Benefits accrue with respect to anyone period of total disability after the expiration of a qualify- ing period of three (3) consecutive months. Benefit Period: Monthly benefits are payable during the continuance of total disability as follows, but in no event are benefits payable beyond the attainment of age 65. a) total disability due to sickness to age 65. b) total disability due to accident to age 65. Monthly Schedu~Amount: Sixty percent (60%) of normal monthly earnings to a maximum benefit of $1,200. ARTICLE XV -- Legal Protection Employees facing legal charges as a result of their job performance when they are proceeding under their supervisor's direct orders, will be defended by the Ctiy. Employees involved in litfgation because of negligence, ignorance of laws, non-observance of laws or a,s a result of an employee's judgmental decision of the job will not require numicipa1ity legal protection. ARTICLE XVI Amendments may be made to this resolution at any time by the City Council 776 with the approval of Municipal Drivers, Helpers & Public Employees Union, Local #663. ARTICLE XVI Effective Date This resolution shall be considered to have been in full force and effect as of January 1, 1971. Adopted by the City Council this 6th day of July, 1971. Councilman Novak introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING WAGES, PROCEDURES, ETC. FOR THE POLICE DEPARTMENT EMPLOYEES OF THB CITY OF HASTINGS FOR 1971. WHEREAS, the City has been negotiating with the Municipal Drivers, Helpers & Public Employees Union, Local #663 representing the Police Department Employees regarding wages and related matters; and WHEREAS, agreement has not been reached; and WHEREAS, it appears to be in the best interest of the City and the employees of the Police Department to put into effect the following pay schedule and related matters; and WHEREAS, the intent and purpose of this resolution is to: I' I I 1. Establish certain hours, wages, and other conditions of employment, and 2. Establish procedures for the resolution of disputes concerning this resolution's interpretation and/or application; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings that the following be ad~pted for the year 1971: RECOGNITION The City of Hastings recognizes the Union as the formal representative of all Police Department personnel except supervisory positions. DISCRIMINATION Neither the employer nor the Union shall discriminate against any employee covered by this resolution because of membership or non- membership in the Union. EMPLOYER AUTHORITY [-- , 1. Overtime and holiday pay shall be paid at the regular hourly rate. LEGAL PROTECTION All employees shall be given legal protection as provided for under Minnesota Statutes. UNIFORM ALLOWANCE Uniform allowance for a new employee will be set at $100. for leather goods and weapons and $250. for clothing allowance for the first year. Equipment shall remain the property of the City until after the six month probationary pe:dod. Clothing allowance after the first year will be $l62. 50. Keller $113,525. 58 The next item for discussion was the annexation proceeding presently pending before the Minnesota Municipal Commission involving the following described 40 acres adjacent to the present westerly limits of the City: The East 1/2 of the East 1/2 of the Northwest 1/4 of Section 32, Township 115 North, Range 17 West, Dakota County, Minnesota, containing 40 acres more or less, according to Government Survey. After discussion, it was moved by Councilman Christenson, seconded by Councilman O'Connor that the City advise the Minnesota Municipal Commission that the City will accept the 40 acre tract if the Commission so orders. Ayes, Councilmen Novak, O'Connor, Christen- son and Mayor Rotty. Nays, Councilmen Kane, Collins and Hallberg. Moved by Councilman Hallberg, seconded by Councilman Kane to table, to a day not certain, until all conditions recommended by the Planning Commission are complied with, the request of Paul Reuter for a Special Use Permit to construct a car wash on Lots 3 & 4, Block18, W. G. LeDuc's Addition to the City of Hastings, Ayes, all; Nays, none. Moved by Councilman Kane, seconded by Councilman Collins to refer to the Planning Commission the request by Leonard Bauer to 780 rezone Lots 14 thru 17, Block 4, Vennillion Addition (South Hastings) from Residential 2 to Commercial 3. Councilman Hallberg reported that the Corps of Engineers feels that the "by-pass" system may be feasible and has agreed to study the matter further and prepare preliminary plans to determine,feasibility, if the City so wishes. After further discussion, the following motion was offered by Councilman Hallberg, seconded by Councilman Novak that the Corps of Engineers be requested to study further the "by-pass" system alternative and prepare preliminary plans to allow determination of whether said alternative is feasible. Ayes, all; Nays, none. Moved by Councilman Christenson, seconded by Councilman Collins to pass the third reading of an Ordinance entitled "AN ORDINANCE PROHIBITING THREATENING, ABUSIVE OR HARASSING TELEPHONE CALLS AND IMPOSING A PENALTY THEREFORE" to finally read as follows: Ayes, all; Nays, none. The City Council of the City of Hastings does ordain: Subdivision 1. Whoever, (1) By means of a telephone, r Section 1. (a) Makes any comment, request, suggestion or proposal which is obscene, lewd, lascivious, filthy or indecent, (b) Makes a telephone, whether or not conversation ensues, without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person at the called number, (c) Makes or causes the telephone of another repeatedly or continuously to ring, with intent to harass any person at the called number, (d) Makes or causes to be made a telephone call with intent as a hoax to threaten to bomb or threaten that a bomb has been placed in any building or in any location other than a building where said bomb, if it were so placed, might cause injury or death to a person or damage to property, or (2) Knowingly permits any telephone under his control to be used for any purposes proQibited by this section, shall be guilty of a misdemeanor. o Section 2. TURE, OWNERSHIP~POS.sESS.ION:,,;..CUSTODY OR CONTROL, AND IMPOSING A PEN- ALTY THEREFORE" to finally read as follows: Ayes, all; Nays, none. The City Council of the City of Hastings does ordain: r- Section 1. No person shall manufacture, own, possess, or have in his custody or control any destructive device which shall include, but is not limited to, any device, apparatus, or equipment by whatever name known, which causes damage by combustion or explosion. It shall include any bomb, time bomb, Molotov cocktail, grenade, mine, rocket or missile, and any type of weapon which will, or is designed to, or may readily be converted to, expel a projectile by the action of any explosive, except commercially manufactured fire- arms. This provision shall not apply to owners, employees, or agents of bona fide business operations which store, transport, or use ex- plosives in said operation, nor shall it apply to a government official acting in the discharge of his official duties, nor shall it apply to persons who have procured dynamite as set forth in Minnesota Statutes Section 365.25 and other Emergency Regulations issued by the Governor of the State of Minnesota or the Minnesota Director of Public Safety. Section 2. No person shall manufacture, own, possess, or have in his custody or control any false or hoax device, apparatus, or equipment described in Section l, and place the same in any public building or place.
