June 21, 1971
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, June 21, 1971 at 7:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Kane, Collins, Hallberg,
O'Connor, Wilson, Driscoll, Christenson,
and Mayor Rotty.
Members absent: Councilman Novak.
The Public Hearing on the application for variance to allow
construction of an addition to the Bierstube property, Midtown Shopping
Center, was commenced at 7:00 o'clock P.M. pursuant to notice. The
Clerk reported that notices had been mailed and posted as required by
the Zoning Ordinance. He further reported that since the agenda for
this meeting had been set, the owner of the Midtown Shopping Center had
submitted a request in writing that the request for variance be with-
drawn as the owner would not add onto the property as requested. It
was moved by Councilman Hallberg, seconded by Councilman Wilson that
the variance request be withdrawn. Ayes;0all; Nays, none. :
The Mayor declared open the Public Hearing on the Estab1isment
of a Housing Authority for the City of Hastings. The City Clerk pre-
sented affidavits of publication of Notice of Hearing as required by
law. This hearing commenced at 8:00 o'clock P.M. as advertised.
Mr. James Daglish representing the Housing Director of the
State Planning Agency and Mr. Gunner Isberg, Dakota County Planner
appeared and discussed the need for a Housing Authority in the City.
All other persons were given an opportunity to be heard. A
further report will be presented at the next Council meeting.
Minutes of the last meeting were read and approved.
Moved by Councilman Kane, seconded by Councilman Driscoll
that the next regular Council meeting be scheduled for Tuesday,
July 6, 1971, as the regular scheduled meeting date of July 5, 1971 is
a legal holiday. Ayes, all; Nays, none.
The next matter for consideration was the proposed rezoning of

the Hy-De-Hy property. It was noted. that although the notices, etc.
referred to proposed C-2 use, the purpose for which the rezoning was
requested would more properly call for C-l zoning. The petitioners
concurred and it was moved by Councilman Wilson, seconded by Councilman
Kane that the petition and request for rezoning be amended to a re-
quest for C-l zoning, not C-2 zoning. Ayes, all; Nays, none.
Moved by Councilman Wi-"lson,t seconded by. Councilman Driscoll
to pass the second reading to rezone the Hy-De-Hy property from I-2
to C-l in accordance with Section 17 of the City Zoning Ordinance
dated December 7, 1970.

Moved by Councilman Collins, seconded by Councilman Kane to
limit debate on the motion to rezone the Hy-De- Hy property. Ayes,
Councilmen Kane, Collins, Wilson and Driscoll. Nays, Councilmen
Hallberg, O'Connor and Christenson. Motion failed for lack of a
two-thirds majority favoring the motion.
Roll was then called on the main motion to amend the Zoning
Ordinance by a second reading to rezone the Hy-De-Hy property from
I-2 to C-l. Ayes, Councilmen Kane, Collins, Wilson, Driscoll and
Christenson. Nays, Councilmen Hallberg and O'Connor. Motion failed
for lack of a 75% majority voting in favor of the motion, pursuant to
Section 12.4 of the Zoning Ordinance.
Moved by Councilman Driscoll, seconded by Councilma~
Christenson to approve a Popcorn License for James Theil for one year
beginning June 22, 1971. Ayes, all; Nays, none.
Councilman Driscoll introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT
WHEREAS, pur~uant to a written contract signed with the City
of Hastings on the 17th day of August, 1970, Richert Plumbing & Heating
Company having satisfactorily completed their share of the 1970 Im-
provement Program,

NOW THEREFORE, BE IT RESOLVED By the City Council of the
City of Hastings, Minnesota:
The work completed under said contract is hereby accepted and
approved, and
BE IT FURTHER RESOLVED, that the City Clerk and Mayor are
hereby directed to issue a proper order for final payment of $11,414.70
on such contract, taking the contractor's receipt in full.
Adopted by the City Council this 21st day of June, 1971.

Corporation, 2101 Vermillion Street effective July 1, 1971 for a period

approve an Off Sale Liquor License for the On & Off Corporation, 2101
Vermillion Street effective July 1, 1971 for a period of one year.

Moved by Councilman Christenson, seconded by Councilman
Driscoll to accept the resignation of Ralph Shingledecker as a regular
fireman effective June 30, 1971, with the stipulation that he will
remain as a volunteer fireman with the City Fire Department. Ayes,
all; Nays, none.

Moved by Councilman Wilson, seconded by Councilman Driscoll
that Thomas Donahue, having satisfactorily completed his six month
probationary period, be established on a permanent status as Assistant
to the City Engineer at a monthly rate of $725.00, effective July 12,
1971. Ayes, all; Nays, none.

Moved by Councilman O'Connor, seconded by Councilman Hallberg
to authorize the City Engineer to. supervise the removal of granular
material from the City Ponding Basin West of State Street and North of
Highway 55. The granular material to be used for fill on sites outside
of the ponding Area; said removal to be at no cost to the City and in
accordance with development plans. Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Christenson
to authorize the City Engineer to act as an agent to negotiate with the
National Guard for additional 17 feet right-of-way along l60th Street
for the entrance road to the Industrial Park, for the purpose of sal-
vaging trees on the South side of l60th Street. Ayes, all; Nays, none.
Moved by Councilman Kane, seconded by Councilman Hallberg
that the request of William Pechacek for a variance to side yard require-
ments under Section 9.l5 of the City Zoning Ordinance for Lot 1 and part
of Lot 2, Block 40, Addition 13 to the City of Hastings be referred to
the Planning Commission. Ayes, all; Nays, none.
Moved by Councilman Christenson, seconded by Councilman
O'Connor that James Maher be hired as a Fireman for the Hastings Fire
Department effective July 1, 1971 at a monthly rate of $650.00 for a
period of six months; thereafter he will be paid according to Section IX
of the Union contract between the City and Municipal Drivers, Helpers
and Public Employees Union, Local 664. Ayes, all; Nays, none.

Driscoll that parking on the East side of Sibley Street between Second
Street no.:tth to the alley be converted from angle parking to parallel
parking because of the present traffic congestion. Ayes, all; Nays,
none.
Moved by Councilman Driscoll, seconded by Councilman Kane that
the bills as audited be approved and the City Clerk be instructed to
issue warrants for the same. Ayes, all; Nays, none.
