May 3, 1971
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, May 3, 1971 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen I~ne, Collins, Hallberg, O'Connor,
Wilson, Driscoll, Christenson and Mayor Rotty.

Members absent:
Councilman Novak.
Minutes of the last meeting were read and approved.
Moved by Councilman Kane, seconded by Councilman Christenson
that the City Clerk be and hereby is authorized and directed to advertise
for bids for regular and premium bulk and station pump delivery gasoline
for the City of Hastings, bids to be opened at 8:00 o'clock P.M., June 7,
1971 in the Council Chambers of the City Hall. Ayes, all; Nays, none.
Moved by Councilman Kane, seconded by Councilman Wilson to
approve expenses for the following to attend the League of Minnesota
Municipalities in Minneapolis on June 9, 10 and 11, 1971: Mayor, Council-
men, Administrator, City Engineer, City Attorney, Chief of Police, Fire
Chief and Chairman of the Planning Commission. Ayes, all; Nays, none.
Councilman O'Connor introduced the following resolution and
moved its adoption:
RESOLUTION OPPOSING RELOCATION OF
DAKOTA COUNTY SEAT OUTSIDE HASTINGS
WHEREAS, the City of Hastings is now, and has been since the
formation of Dakota County the County Seat of said Dakota County; and

WHEREAS, the City of Hastings as well as many businesses and
private citizens have invested in Hastings substantial sums of money
for government facilities, business places and private residences due
in part to the fact that Hastings is and has been the County Seat of
Dakota County; and
WHEREAS, the City of Hastings as well as many businesses and
private citizens would suffer severe economic hardships should the
County Seat for Dakota be relecated outside the City of Hastings; and
WHEREAS, there has been advanced no sound reason for moving
the County Seat out of Hastings; and
WHEREAS, there presently exists reasonable statutory procedures
for relocating a county seat which legislation has stood the test of
time; and
NOW THEREFORE BE IT RESOLVED:
That the Minnesota Legislature is hereby urged to defeat any
pending special legislation aimed at facilitating the relocation of the
Dakota County Seat outside Hastings.

Councilman Driscoll seconded the motion to adopt said resolution
and the same was passed by the fullowing vote: Ayes, all; Nays, none.
The City Attorney reported that numerous complaints had been
received about the condition of the Lynn property on East Third Street.
The complaints allege that the property is in violation of the building
codes, is unfit for habitation due to the unhealthy condition of the
property and that the structure may be on City property.

Moved by Councilman Driscoll, seconded by Councilman Kane
that the City Health Officer and the Building Inspector inspect the
property for violations, if any, and that the engineer's office deter-
mine whether the structure encroaches on City property. Ayes, all;
Nays, none.
Moved by Councilman Christ~nson, seconded by Councilman
Driscoll to approve the purchase of radios for the Police Department
for $728.00, with $500. to be charged to the Civil Defense Equipment
Fund and the remaining balance to be charged to the Police Equipment
Fund. Ayes, all; Nays, none.

Moved by Councilman Kane, seconded by Councilman Collins to
amend Sec1;:ion 7 of an Ordinance entitled "AN ORDINANCE LICENSING AND
REGULATING THE SALE OF INTOXICATING LIQUORS WITHIN THE CITY OF HASTINGS,
DAKOTA COUNTY, MINNESOTA, REPEALING INCONSISTENT ORDINANCES AND PROVI-
DING A PENALTY FOR THE VIOLATION THEREOF" to delete Memorial Day from
Section 7, shall pass its first reading. Ayes, all; Nays, none.
Moved by Counc~lman Wilson, seconded by Councilman Kane that
the request for a sign by First Federal Savings & Loan Company be
referred to the Planning Commission. Ayes, all; Nays, none.
Planned Unit Development Permit

Moved by Counctlman Hallberg, seconded by Councilman Wilson
to approve the Gasparre-Dokmo Planned Unit Development Permit subject
to the following conditions: Ayes, all; Nays, none.
l. That the 16.22 acres lying north and east of Westview
Drive within Imperial Estates Addition shall have no more
than 247 total units.
2. That all requirements of the Zoning Ordinance of the City
of Hastings dated December 7, 1970 be met, i.e. set-backs,
drainage, off-street parking, etc.

3. That each phase of the development will be complete in
itself .
Moved by Councilman O'Connor, seconded by Councilman Driscoll
that the preliminary plat of Hastings Construction Company's Dakota
Hills 3rd Addition be referred to the Planning Commission. Ayes, all;
Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Driscoll
to approve installation of septic tanks at the following locations:
Ayes, all; Nays, none.
1. Jerry Hoeschen, 1514 East 3rd Street
2. Peter Moes, 1500 East 3rd Street
3. John Weiland, 520 East 3rd Street
Moved by CouncilmanDrisco11, seconded by Councilman Kane that
the Hastings Sanitary Disposal, Inc. be charged a monthly flat fee of
$500. for dumping in the City Landfill with the understanding that the
hauler would continue to pick up the City's solid waste as in the past
and that the number of loads brought to the Landfill would continue to
be counted and any substantial increase in hauling would be justification
for an increase in monthly charges to the hauler. Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Wilson
that the following lease relating to the Rebe~ca Park area be returned
to the Corps of Engineers so that the Corps' 'cali in'c'lude.1this area in
their Pool Two Park Development program; Ayes, all; Nays, none.

that a Public Hearing be held on Monday, June 7, 1971 at 8:00 o'clock
P.M. in the Council Chambers of the City Hall and that the following
notice be published, mailed and posted as required by Ordinance: Ayes, all;

NOTICE OF PUBLIC HEARING ON
APPLICATION FOR SPECIAL USE PERMIT
Application has been made to the Hastings City Council, sitting
as a Board of Adjustment, to grant a Special Use Permit to allow con-
struction of a basement apartment in a single family residence on the
following described property located in the City of Hastings, Dakota
County, Minnesota:

A Public Hearing on the application for a Special Use Permit

range across fr~mthe Sanitary Landfill for the following reasons: Ayes,
all; Nays, none.
l. There is not enough space.
2. The residential properties are to close to the
adjacent property lines.
3. The terraine is not adequate for a backstop.

to deny the request of the Hy-de-hy Bottling Co. for rezoning its parcel
from 1-2 to C-2. Ayes, Councilmen Hallberg and Wilson; Nays, Councilmen
Kane, Collins, O'Connor, Driscoll and Christenson. Motion lost.

Notice is hereby given that the City Council of the City of
Hastings, Minnesota will meet in a Public Hearing in the Council Chambers
