The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, April 19, 1971 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Kane, Collins, Hallberg,
O'Connor, Wilson, Driscoll, Christenson,
and Mayor Rotty.

Minutes of the last meeting were read and approved.
Councilman Driscoll introduced the following resolution
and moved its adoption:
RESOLUTION ACCEPTING BIDS ON 1971 IMPROVEMENTS
WHEREAS, pursuant to an advertisement for bids for the 1971
Improvements, bids were opened and tabulated according to law, and the
following bids were received complying with the advertisement:

NOW THEREFORE BE IT RESOLVED by the City Council of Hastings:

1. The Mayor and City Clerk are hereby authorized and directed
to enter into a contract with the Austin P. Kell~r Co.,
and Bituminous Surface Treating Co. for the improvements
as stated above according to the plans and specifications
therefore approved by the City Council and on file in the
office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids
except that the deposits of the successful bidder and the
next lowest bidder shall be retained until a contract has
been signed.

Councilman Kane seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, all; Nays, none.

The Mayor declared open the public hearing on the application
of Clarence Merk1ing, owner of the South 22' of Lot 8 and All of Lot 9
Block 1, Vermillion Addition to the City of Hastingsto grant a variance
from Section 9.9.2.4 of the Zoning Ordinance to allow construction of
an apartment unit at first floor level for management purposes. The
Clerk reported that notice had been given as required by Section
12.3.2 of the Zoning Ordinance. All persons present were given an oppor-
tunity to be heard. Whereupon the following resolution was offered by
Councilman Hallberg:
WHEREAS, a written application for a variance has been sub-
mitted; the conditions and requirements of Section 12.3.1 are hereby
found to exist; that notice of public hearing has been given as re-
quired by Section 12.3.2; a Public Hearing held and all persons present
given an opportunity to be heard; further that the applicant has set
forth reasons justifying the granting of a variance and the granting

of the variance is in harmony with the general purposes and intent of
the Ordinance and will not be injurious to the neighborhood or detri-
mental to the public welfare.
THEREFORE, the requested variance should be and hereby is
granted, subject to that the a~tment constructed be used as a
manager residence only.

Councilman Hallberg introduced the following resolution and
moved its adoption:
RESOLUTION IN OPPOSITION TO
PENDING "TAX FREEZE" LEGISLATION
WHEREAS, there is presently pending before the Minnesota
State Legislature, legislation which would freeze local property tax
revenues and would further require referendums before levies could be
increase;
WHEREAS, it appears that such legislation, if passed, would
impose an undue burden upon efficient administration of 'local govern-
ment without corresponding benefit to the municipalities or its
constituents.

NOW, THEREFORE, BE IT RESOLVED That the City of Hastings
take a position in opposition -to passage of said legislation (being
Senate File #1204 and House File #1553), and the state legislators
representing the district in which the City of Hastings is located are
urged to take a position in opposition to said legislation.

RESOLUTION REQUESTING MINNESOTA STATE
LEGISLATURE TO CORRECT INEQUITIES IN THE
DISTRIBUTION OF CIGARETTE AND LIQUOR TAXES

WHEREAS, a number of state taxes, such as highway user taxes,
sales tax, cigarette and liquor taxes are shared with local government
units on the basis of population; and
WHEREAS, the use of 1970 census figures in the distribution
of said taxes for the calendar year 1971 was of substantial importance
and concern to fast-growing municipalities in the State of Minnesota;
and
WHEREAS, after due investigation and inquiry, City of Hastings
budget revenue estimates for 1971 were based upon the use of the 1970

census rather than the 1960 census; and
WHEREAS, highway user taxes and sales taxes are in fact being
distributed on the basis of the 1970 census; and

WHEREAS, the first half of cigarette and liquor tax apportion-
ment has in fact been distributed on the basis of the 1960 census,
contrary to the previous understandings received, thereby creating an
inequitable situation whereby certain municipalities received more than
their equitable share and numerous other municipalities have received
less than their equitable share; and
WHEREAS, said inequities are having a substantial impact on
the revenue structure of numerous municipalities, and;
WHEREAS, it appears that the only way in which these inequi-
ties can be corrected is through the passage of a state law authorizing
and directing the State Auditor to distribute said cigarette and liquor
taxes on the basis of the 1970 census, and further that said inequity
in the distribution of the first half of said cigarette and liquor
tax apportionment be corrected in the computation and distribution of
the second half of said cigarette and liquor tax apportionment;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Hastings, that the State Legislature now in session be, and hereby
is requested to provide for the distribution of cigarette and liquor
taxes to local governments during calendar year 1971 on the basis of
the 1970 census and is further requested to authorize and direct the
State Auditor to distribute the second half of said sums in such a
way as to compensate for the inequities created through the distribu-
tion of the first half of the apportionment on the basis of the 1960
census.

Further that copies of this resolution be forwarded to the
representatives in the State Legislature from the districts in which
the City of Hastings is located.

Councilman Novak came in at this time.
Councilman O'Connor introduced the following resolution and
moved its adoption:
RESOLUTION OPPOSING PROPOSED REAL
ESTATE TAX DISTRIBUTION LEGISLATION
WHEREAS, Senate File 1133 relating to a program to alleviate
fiscal disparities has been introduced in the State Legislature; and
WHEREAS, The City Council of the City of Hastings, Minnesota
has determined that passage of Senate File l133 would do serious damage
to the tax base, as well as the governmental programs of Dakota County
and the City of Hastings and other municipalities and townships.
NOW THEREFORE, BE IT RESOLVED, That the City Council of the
City of Hastings strongly oppose Senate File 1133 and directs that this
Resolution be forwarded to the Dakota County Delegation, with the
strong recommendation that they also actively oppose its passage.

RESOLUTION ON STATE-AID PROJECT

WHEREAS, The City of Hastings has obtained the Commissioner's
approval of the plans for the following Municipal State-Aid Street
Project:
S. A. P. No. 30-129-04
Located North of T.H. 55
Consisting of Grading, Gravel, Base and Storm Sewer
AND, WHEREAS, said City is prepared to proceed with the con-
struction of said project by providing local funds to supplement the
available funds in its Municipal State-Aid Street Account.
WHEREAS, repayment of the funds so advanced by the municipality
is desired in accordance with the provisions of Chapter 309, Laws of
1963.
NOW, THEREFORE, BE IT RESOLVED That the Commissioner of High-
ways be and is hereby requested to approved this basis for financing
said construction project and to authorize repayments from the subse-
quent accruals to the Construction Account of Municipal State-Aid Street
Fund for said City, within the limitations provided by law and at the
times and in the amounts as herein indicated (not to exceed five years).

Councilman Christenson introduced the following resolution

RESOLUTION TO ESTABLISH SPEED ZONES ON
COUNTY HIGHWAY SYSTEMS WITHIN THE CITY OF HASTINGS

WHEREAS, the County State-Aid Highways No. 42, 47 and 54 and
County Road 91, lie within the corporate limits of the City of Hastings;
and
WHEREAS, the County Traffic Engineer, Mr. Kenneth W. Anderson,
in his lette:r dated April.rla 1-,.1971, requested a formal Council Resolu-
tion for speed zone studies on the above stated highways; and
WHEREAS, the State Highway Department requests formal action
by County Boards to establish speed zones on the basis of traffic and
engineering studies for all streets and roads within Minnesota.
NOW THEREFORE, The City Council does hereby request that the
County Traffic Engineer take what action is necessary to establish
studies on the aforementioned County Road Systems within the corporate
limits of the City of Hastings, and that such speed zones as are appro-
priate be established. Further, that the State Highway Department be
requested to perform whatever duties are necessary in establishing
such speed zones.

BE IT RESOLVED by the City Council of the City of Hastings,
Minnesota as follows:
1. It is hereby found, determined and declared that this
City should issue the following bonds:
(a) $410,000 General Obligation Bonds of
1971, Series A for the purpose of
acquiring and improving property for
economic development.
(b) $280,000 Improvement Bonds of 1971,
Series A for various improvements in
the City.

(c) $385,000 General Obligation Water and
Sanitary Sewer Revenue Bonds of 1971,
Series A for water and sewer improve-
ments in the City.
2. The City Council hereby ratifies, approves and affirms
the findings made by the Council pursuant to its resolution of
October 5, 1970 calling for an election of $775,000 General Obliga-
tion Economic Development Bonds of 1971 insofar as said findings re-
late to the projects financed by the foregoing bond issues.
3. A financing committee appointed by the City Council shall
meet at the time and place specified in the form of notices herein-
after contained for the purpose of opening sealed bids for each of
the foregoing bond issues and shall report to the City Council. The
City Council shall thereafter consider said bids and award the sale
of each bond issue in accordance with the terms and conditions of
the appropriate notice of bond sale.
4. The City Clerk is hereby authorized and directed to cause
notice of the time, place and purpose of said meeting to be published
in the official newspaper of the City and in Commercial West not less
than ten days in advance of date of sale of each bond issue, as pro-
vided by law, which notice shall be in substantially the following
form with respect to each bond issue:

The motion for the adoption of the foregoing resolution
was duly seconded by Councilman Wilson and upon a vote being taken
thereon, the following voted in favor thereof: Councilmen Novak,
Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll and Christenson;
and the following voted against the same: None.
Whereupon said resolution was declared duly passed and
adopted.

PAYING AGENT
May be named by bidder subject to Issuer's acceptance, which may be
assumed unless the Purchaser is otherwise notified within 24 hours after
the issuer has been advised of the proposed agent. Issuer will pay
customary charges.
DELIVERY
Within 40 days after award, subject to the unqualified approving
legal opinion of Messrs. Briggs & Morgan of St. Paul, Minnesota, and
customary closing papers, including a statement of non-litigation.
Bond printing and legal opinion will be paid for by the Issuer.
Delivery will be at a place of the Purchaser's choice. Payment must
be made in Federal Funds or equivalent immediately available funds on
day of delivery. Legal opinion will be printed on the bonds.
TYPE OF BID
Sealed bids for not less than $404,110 and accrued interest on the
principal sum of $410,000 from the date of the bonds to date of del-
ivery must be filed with the undersigned prior to time of sale, to-
gether with a certified or cashier's check in the amount of $8,200,
payable to the order of the Treasurer of the Issuer, to be forfeited
as liquidated damages if the bidder fails to comply with the accepted
bid.

All rates must be in integral multiples of 5/100 of 1% and may not
exceed 7% per annum. All bonds of the same maturity must bear a
single rate from date of issue to maturity. No rate of any maturity
may be more than 1% lower than the highest rate carried by any of the
preceding maturities. Additional coupons may not be used. No limita-
tion is placed upon the number of rates which may be specified.
AWARD
Award will be made on the basis of ,lowest dollar interest cost; deter-
mined by the addition of any discount to and the deduction of any
premium from the total interest on all bonds from their date to their
stated maturity. The net effective average rate of the issue may not
exceed 7% per annum. The Issuer reserves the right to reject any and
all bids, to waive informalities and to adjourn the sale.
