March 15, 1971
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, March 15', 1971 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Kane, Collins, Hallberg,
O'Connor, Wilson and Driscoll.
Members absent: Councilman Christenson and Mayor Rotty.
Acting Mayor Novak presiding.
Minutes of the last meeting were read and approved.
Councilman Kane introduced the following resolution and moved
its adoption:
BIDS ON CRUSHING GRAVEL
WHEREAS, pursuant to an advertisement for bids for crushing
gravel for the City of Hastings, the following bids were received comply-
ing with the advertisement:

WHEREAS, it appears that Solberg Construction Company is the
lowest responsible bidder,
NOW THEREFORE BE IT RESOLVED By the City Council of Hastings:
The Mayor and City Clerk are hereby authorized and directed to
enter into a contract with Solberg Construction Company for the crushing
and screening of 8,000 cubic yards of gravel according to the specifica-
tions therefore approved by the City Council and on file in the office of
the City Clerk.
The City Clerk is hereby'authorized and directed to return forth-
with to all bidders the deposits made with their bids, after a contract
has been signed.
Adopted by the City Council this 15th day of March, 1971.

Council Wilson seconded the motion to adopt said resolution and
the the same was passed by the following vote: Ayes, all; Nays, none.

The Mayor declared open the Public Hearing on the application
by the property owners of Lots 15 & 16, Block 6, W. G. LeDuc's Addition
to the City of Hastings, requesting a Special Use permit to allow construc-
tion of a gasoline service station on that property, and further requesting
a variance from the requirement that all gasoline pump islands be located
not less than 30 feet inside exterior property lines.
The City Clerk reported that notice had been given as required
by Section 12.3.2 of the Zoning Ordinance.
All persons present were given an opportunity to be heard. A
representative of Clark Oil Company which holds an option on the property
made a presentation in support of the request. No one spoke in opposition
to the request for a Special Use Permit, but opposition to the requested
variance was expressed. The representative of Clark Oil stated that
Clark Oil would comply with the gas pump island set back requirement.

Whereupon the following resolution was offered by Councilman
Wilson, seconded by Council O'Connor:
WHEREAS a written application for a Special Use permit has been
submitted under Sections 7.1 and 9.9.3 of the Zoning Ordinance which
states the" grounds for the request, the Notice requirements of Section
12.2.2 have been met, a Public Hearing" has been held and all persons
given an opportunity to be heard, the Planning Commission has studied
and reported o~ the request, the Council sitting as a Board of Adjustment
is empowered to grant the permit, the granting will not adversely affect
the public interest, compliance with all special rules for Special Use
permits for a service station have been provided for and arrangements have ]
been made to meet applicable requirements of Section 12.2.5 of the
Zoning Ordinance; [_
THEREFORE the requested Special Use permit for a gasoline ser-
vice station should be and hereby is granted.
Upon being put to a vote, the following voted in favor of the
resolution: Councilmen Novak, Kane, Hallberg, O'Connor, Wilson and
Driscoll; and the following voted against: Councilman Collins. The
Mayor declared the motion carried and the permit granted.

to deny the requested variance from Section 7.1.6 of the Zoning Ordinance
by Clark Oil Company. Ayes, all; Nays, none.
Donald Carl requested a Special Use permit in accordance with
Section 9.4, R-2 Medium Density Residence, subparagraph 9.4.2.4 - Special
Use, to construct an apartment unit in the basement of his home at 406
West 18th Street, Lot 9, Block 13, young's Addition to the City of I~'
Hastings. Moved by Councilman Kane, seconded by Councilman Hallberg to J
refer this matter to the Planning Commission. Ayes, all; Nays, none. L
The Council received a request for a permit for Planned Resi-
dential Development Unit, Section 7.6 of the Zoning Ordinance for the
Leo Schumacher property in part of the S 1/2 of NE 1/4 of Section 29,
Tl15N, R17, presently zoned R-3. Moved by Councilman Driscoll, seconded
by Councilman Wilson to refer this matter to the Planning Commission.

Moved by Councilman Kane, seconded by Councilman Hallberg to
advertise for bids for the remodeling of the Council Chambers, bids to
be opened at 2:00 o'clock P.M. on Monday, AprilS, 1971 and awarded at

with Dakota County for sharing costs of remodeling and use of the

AGREEMENT

THIS AGREEMENT, made and entered into this 15th day of March,
1971, by and between the County of Dakota, hereinafter referred to as
the County, and the City of Hastings, hereinafter referred to as the City,
both entities being municipal corporations in the State of Minnesota;
WHEREAS, the County is in need of additional courtroom space
to accomodate District Court functions; and,

WHEREAS, the City has, on the second floor of 'its City Hall
in Hastings, Minnesota, facilities which could be used by the District
Court, said facilities however requiring certain remodeling and refur-
bishing prior to said use; and,
WHEREAS, the County is willing to assist in paying for said
re~ode1ing and refurbishing; and,

WHEREAS, the City is willing to allow the District Court to
use said facilities for up to three years in consideration of the
County's assistance in paying for said remodeling;
NOW, THEREFORE, IT IS HEREBY UNDERSTOOD AND AGREED by the
parties as follows:

1. The City will forthwith undertake remodeling and refurbish-
ing of the present Municipal Court facilities on the second floor of the
City Hall in Hastings, Minnesota in manner and to an extent to be agreed
upon by the representatives of the parties hereto.
2. The County will pay fifty percent (50%) of the cost of
said remodeling and refurbishing but under no conditions will said fifty
percent (50%) exceed Ten Thousand Dollars ($10,000.00).
3. The sum determined by the paragraph immediately above to
be paid by the County to the City shall be paid in installments of One
Thousand Dollars ($1,000.000), the first of said payment to be due
May 1, 1971, and a like payment on the 1st day of each and every month
thereafter until the lst day of December, 1971, at which time the entire
unpaid balance shall be paid by the County to the City.
4. The District Court shall be entitled to use the remodeled
facilities for up to three (3) years as its need may be from time to
time. The Municipal Court and the District Court shall by mutual
agreement determine the use to be made by the respective courts.

to approve the following partial payment for work performed on the
Well Nm. 5 Pump House being constructed under Water Revenue Bonds of
1970. Ayes, all; Nays, none.

Joanne Cobian be granted a leave of absence from March 29, 1971 to
May 10, 1971. Ayes, all; Nays, none.

Moved by Councilman Kane, seconded by Councilman Collins to
grant a Sunday Liquor License to the American Legion Nelson Lucking
Post #47 to July 1, 1971.
Moved by Councilman O'Connor, seconded by Councilman Hallberg
to table the motion to grant a Sunday Liquor License to the American
Legion Nelson Lucking Post #47. Ayes, Councilman Hallberg, O'Connor
and Wilson; Nays, Councilmen Kane, Collins, Driscoll; 'Councilman
Novak abstained. Motion failed.
Moved by Councilman Kane, seconded by Councilman Driscoll to
limit debate and call the question on the Sunday Liquor License for
the American Legion Nelson Lucking Post #47. Ayes, Councilmen Kane,
Collins, Wilson and Driscoll; Nays, Councilmen Hallberg and O'Connor;
Councilman Novak abstained. Motion failed for lack of a two-thirds
majority.

A vote was then called for on the main motion to grant a
Sunday Liquor License to the American Legion Nelson Lucking Post #47
to July 1, 1971. Ayes, Councilmen Kane, Collins, Hallberg, Wilson
and Driscoll; Nays, Councilman O'Connor; Councilman Novak abstained.
Motion was passed.
Councilman Collins introduced the following resolution and
moved its adoption:
RESOLUTION
ESTABLISHING WORKING CONDITIONS, WAGES AND HOURS
FOR PUBLIC WORKS DEPARTMENT EMPLOYEES IN THE
CITY OF HASTINGS FOR 1971, 1972 & 1973
WHEREAS, the City Council feels that it is for the best inter-
est of the City of Hastings, the Public Works Department employees, and
for their designated bargaining representatives, Local No.'49, Interna-
tional Union of Operating Engineers, AFL-CIO, for the purpose of estab- r-'i
1ishing conditions of employment of the employees of the Public Works I
Department and to. insure ~,fr1.~tld1y spirit of cooperation between the LJ
City, its employees, and their designated bargaining representatives,
and to avoid disruption in' the service and operation of said Public
Works Department, and to secure the benefits intended to be derived by
the City, its employees, and their designated bargaining representatives,
to adopt the hereinafter set out rules and regulations covering the
employment and working conditions of the employees of the Public Works
Department,
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
following rules and regulations covering the employment of the employees
of the Public Works Department be adopted and place in affect as follows,
to wit:

ARTICLE I
Recognition

The City hereby agrees torecogn~ze Local No. 49, International Union of
Operating Engineers, AFL-CIO, as the bargaining representative of all
employees employed in the Public Works Department.
ARTICLE II
Seniority

The City hereby does recognize 'seniority rights and employees shall be
promoted, demoted, laid off, and returned to service according to their
length of service, providing however, that such employees qua l'i fy to
perform the work, and provided further, that such employees shall not
establish seniority rights until they have been employed for thirty (30)
days.
ARTICLE III
Vacations
The employees shall be granted the following vacation schedule:

All vacation pay shall be accrued, and in the event an employee's
employment is terminated for any reason, the employee shall receive,
upon his termination, the vacation pay which he has coming to him at
that time on a pro-rata basis. No more than four consecutive weeks
vacation can be taken at one time.
In computing vacation pay, length of service shall be based upon the
anniversary date of the day an employee commences employment.
All employees are to be paid their vacation pay prior to their leaving
for their vacation.
ARTICLE IV
Grievances

Should any grievance arise as to the interpretation of or adherence to
the terms and provisions of this resolution, the employees affected may,
either directly or through their designated bargaining representative,
take the matter up with the department head in an effort to effect a
satisfactory settlement. If the department head and the employees are
unable to agree, then the matter shall be referred to the designated
bargaining representative, who shall endeavor to effect a satisfactory
settlement with the City Councilor its authorized representative.
ARTICLE V
Discrimination
No employee shall be discriminated against and no employee shall be
discharged for giving information regarding alleged violation of this
resolution.
ARTICLE VI
Sick Leave and
Other Leave of Absence
Sick Leave: All employees of the City shall be entitled to accumulate
one day of sick leave for each month of employment and allowed accumula-
tion of sick leave up to one hundred twenty (120) days. Employees shall
bank an additional one-half (lf2) day per month after the accumulation
of the 120 days to be used only in cases of very prolonged illnesses.
Sick leave will be granted for actual sickness, temporary physical
disability and quarantine. The City may require a doctor's certificate
on sick leave claims of three days or more.

Personal Leave: All employees of the City shall be entitled to three
(3) days personal leave per year which shall not accumulate. Personal
leave for purposes of this paragraph includes and is limited to: death
in the immediate family, death of spouse, parent, brother, sister, child,
grandparent, and spouse's parent, brother, sister, child or grandparent;
and critical illness of immediate family.
ARTICLE VII
Severance Pay
If an employee retires at age 65, or as otherwise provided by law, or is

forced to retire due to physical condition not allowing him to continue
gainful employment, or voluntarily terminates employment with the City
after due notice, with the consent of the City, but not if discharged
or resigns by the request of the City, all and in each case after ten
(10) years of service, they will receive thirty-five percent (35%) of
unused sick leave, based on their current hourly rate, as severance pay.
The one-half day per month accumulated after the 120 days, will not be
considered for severance pay purposes.
ARTICLE VIII
Hours of Employment

The regular work day shall consist of eight (8) hours per day and the
regular work week shall consist of forty (40) hours in anyone week.
Overtime shall be paid at the rate of one and one-half (1-1/2) times
the regular hourly rate of pay for all work performed after eight (8)
hours in anyone day, and forty (40) hours in anyone week.
All hours worked on Saturdays, Sundayst holidays and days observed as
legal holidays will be paid at one and one-half times the regular
h'our1y rate.
An employee called back to work after he has completed his regular work
day or called out on his day off shall receive a minimum of two (2)
hours pay at the overtime rate.
On all classifications when full time work is available, senior employees
shall be given the first opportunity to work the full week if the senior
employees are available. There shall be no discrimination in favor of
junior employees. This shall operate within the classification only.
"Full-time" work shall be construed to mean the regular work week or
day as defined in thts Article. No part-time employees shall be per-
mitted to work until all regular employees have been given opportunity
to work a full eight (8) hours that day or a full forty (40) hours

ARTICLE X
Holidays
All regular employees of the City who have been in the employment of the
City for more than thirty (30) days shall be entitled to the following
holidays with pay:

New Year's Day - January 1
Washington's & Lincoln's Birthday - the third Monday
Good Friday fin February
Memorial Day - the last Monday in May
Independence Day - July 4
Labor Day - the first Monday in September
Columbus Day - the second Monday in October
Veterans Day - the fourth Monday in October
Thanksgiving Day - the fourth Thursday in November
Christmas Day - December 25
providing that such employee shall work his regular work day preceding
such holiday and the day succeeding such holiday, unless the employee
is on vacation or absent from work because of an excused sick leave,
or on account of an industrial accident. In the event that New year's
Day, Independence Day or Christmas Day should fall on a Sunday, the
following Monday shall be celebrated as the holiday. In the event
that New Year's Day, Independence Day or Christmas Day fall on a
Saturday, the preceding Friday shall be celebrated as the holiday.
ARTICLE XI
Leave of Absence
Employees subpoenaed as witnesses or called and selected for jury duty
shall receive their regular compensation and other benefits for their
employment less the amount received by them as jurors or witness fees.
The City agrees to grant the necessary time off without pay to any
employee designated to attend a labor convention or to serve in any
capacity on other official Union business. Union stewards may be
present during discussions regarding problems involving employees.
ARTICLE XII
Miscellaneous Working Rules
No supervisor shall be allowed to operate any equipment when any regu-
lar employee is in a laid off ,status.
ARTICLE XIII
Job Classification
The City will forthwith undertake a job classification study of the
Public Works Department. At the conclusion of the study, the Union will
be advised of the City findings and recommendations. The Union will be
given an opportunity to be heaD before implementation of any recommenda-
tions arising from the study.
ARTICLE XIV
Insurance Benefits

All regular employees will continue to be covered under the hospita1-
medical-surgical insurance plan adopted by the Ctiy. Full cost of
employee coverage to be paid by the City. Cost of dependent coverage
to be paid by the employee. All regular employees will also receive
a $5,000 Life Insurance policy with the full cost of the premiums to
be paid by the City. Also, the City will provide long-term disability
insurance policy with no cost to the employee as follows:
Eligibility: Each ac~ive, full-time employee who works a
minimum of 30 hours per week, except temporary employee.
Qualifying Period: Benefits are payable during the contin-
uance of total disability as follows, but in no event are
benefits payable beyond the attainment of age 65.

Benefit Period: . Monthly benefits are payable during the
continuance of total disability as follows but in no event
are benefits payable beyond the attainment of age 65.

Monthly Schedule Amount: Sixty percent (60%) of normal
monthly earnings to a maximum benefit of $1,200.
ARTICLE XV
Legal Protection

Employees facing legal charges as , a result of their. job performance
when they are proceeding under their supervisor's direct orders, will
be defended by the City.
Employees involved in litigation because of negligence, ignorance of
laws, non-observance of laws or as a result of an employee's judgmen-
tal decision on the job will not require municipality legal protection
ARTICLE XVI
Amendments
Amendments may be made to this resolution at any time by the City Council,
with the approval of Local 49, International Union of Operating Engineers.
ARTICLE XVII
Effective Date
This resolution shall be considered to have been in full force and
effective as of January 1, 1971.

Councilman O'Connor introduced the following resolution and
moved its adoption:
RESOLUTION: COURTHOUSE
WHEREAS, the County of Dakota is presently planning the
construction of a new Courthouse building: and,
WHEREAS, it appears beneficial to the City of Hastings, as
well as the County of Dakota, that the new facility be located in the
City of Hastings; and,
WHEREAS, the City is wi11ing to offer all reasonable induce-
ments possible to encourage construction of the Courthous on the present
Courthouse site or immediately adjacent thereto.
NOW, THEREFORE, BE IT RESOLVED that the City of Hastings by
its City Council does hereby urge the Dakota County Board of Commiss~
ioners to construct the new Courthouse facility on or adjacent to
the present location in Hastings;

The City of Hastings, hereby advises the County Board that
it will in every way reasonable possible assist and cooperate with the
County in the location and construction of the Courthouse building,
including, but not limited vacation of Sib1~y Street between 3rd and
4th Streets, providing access to needed utilities, development of
traffic flow patterns, and such other and further assistance as may
be reasonable within its power to provide.

ON APPLICATION FOR VARIANCE
Notice is hereby given that the City Council of the City
of Hastings will meet in a Public Hearing in the Council Chambers of
the City Hall on Monday, April 19, 1971 at 8:00 o'clock P.M. to
consider the following variance request from the City Zoning
Ordinance:
Variance from Section 9.9.2.4 of the Zoning Ordinance.
An apartment unit at first floor level for management
purposes on the South 22' of Lot 8 and All of Lot 9,
Block 1, Vermillion Addition to the City of Hastings.
Persons desiring to be heard in reference to this variance
may be heard at this time.
