HomeMy WebLinkAbout03-01-71 687 Hastings, Minnesota March 1, 1971 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, March 1, 1971 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Kane, Collins, Hallberg, O'Connor, Wilson, Driscoll and Christenson. Members absent: Mayor Rotty. r- Acting Mayor Novak presiding. Minutes of the last meeting were read and approved. The Mayor declared open the public hearing on the application of William Erickson, owner of Lot 2, Block 4, Fasbender's Addition, to grant a variance from Section 9.15 of the Zoning Ordinance to allow construction of a garage within 30 inches of his westerly property line. The Clerk reported that notice had been given as required by Section 12.3.2 of the Zoning Ordinance. All persons present were given an opportunity to be heard. Whereupon the following resolution was offered by Councilman Kane: - i I WHEREAS, a written application for a variance has been sub- mitted; the conditions and requirements of Section 12.3.1 are hereby found to exist; that notice of public hearing has been given as re- quired by Section 12.3.2; a public hearing held and all persons present given an opportunity to be heard; further that the applicant has set forth reasons justifying the granting of a variance and that the vari- ance requested is the minimum varianee that will make possible the reasonable use of the land and the granting of the variance is in harmony ~ith the general purposes and intent of the Ordinance and will not be injurious to the neighborhood or detrimental to the public wel- fare: THEREFORE, the requested variance should be and hereby is granted. The Mayor declared open the public hearing on ..the requested rezoning of the following property: The South 75' of Lots 6 thru 10 amd all of Lots 11 thru 15, Block 48, Addition 13 and The South 75' of Lots 1 thru 9 and all of Lo~s 10 thru 18, Block 49, Add~tion No. 13 to the City of Hastings. Ii , i from Agricultural (A) to Residential (R-3) Zoning. The Clerk reported that notice had been given as required by the Ordinance. All persons present were given an opportunity to be heard. There were no objections. The Engineer stated that the requested rezoning was,to correct an error in the Zoning Map as adopted; that throughout all hearings on the Zoning Ordinance the subject property was designated R-3; however when the map was duplicated for publication the area was erroneously designated "A". Moved by Councilman Hallberg, seconded by Councilman Driscoll to pass the third reading to rezone the above property from "A" to "R-3". Ayes, all; Nays, none. Moved by Councilman Wilson, seconded by Councilman Kane to pass / 688 the third reading to amend an Ordinance entitled "AN ORDINANCE REGULATING THE OPERATION OF VEHICULAR AND PEDES TRIAL TRAFFIC WITHIN THE CITY OF HASTINGS" in the following particular: Ayes, all; Nays, none. ~he City Council of the City of Hastings does ordain: Section 15. Drunkometer B. & C. - Deleting 0.15 and inserting 0.10 per cent by weight of alcohol. Adopted by the City Council this 1st day of March, 1971. o Moved by Councilman Kane, seconded by Councilman Collins to delete sidewalk construction from 1971 Project SAP 30-12-06 (15th Street from Hy. #61 to Ashland Street). Ayes, Councilmen Novak, Kane, Collins, and Driscoll; Nays, Councilmen Hallberg, O'Connor, Wilson and Christenson. The Mayor declared the motion defeated for lack of a majority. Moved by Councilman Hallberg, seconded by Councilman Wilson to order in Project SAP 30-12-06 including sidewalks, pursuant to Engineer's report, however, that the Engineer is instructed to locate sidewalks to save as many trees as practical. Ayes, Councilmen Novak, Hallberg, O'Connor, Wilson and Christenson; Nays, Councilmen Kane, Collins and Driscoll. The Mayor declared the motion passed. The property owners of Lots 8 thru 11, Block 16, Addition 13 have applied for a Special Use Permit to construct a multiple dwelling on that property in accordance with Section 12.2 of the Zoning Ordinance. Moved by Councilman Driscoll, seconded by Councilman Christenson that a Public Hearing be held AprilS, 1971 at 8:00 o'clock P.M. by the City Council and that the following notice be published, mailed and posted as required by Ordinance: Ayes, all; Nays, none. Schumacher, sole owners of the Imperial Estates, Inc. subdivision, request the City Council to proceed with the 1971 Improvements, with, exceptions as follows: 1. North Frontage Road Street Construction. 2. Area Benefit Over-sizing Watermain. 3. North Frontage Road Watermain, and North Frontage Road Storm Sewer. sf Leo A. Councilman Hallberg introduced the following resolution and moved its adoption: RESOLUTION: DELETION FROM 1971 JMPROVEMENTS WHEREAS, the 1971 Construction Program included improvements in the Imperial Estates Addition to the City of Hastings and, - WHEREAS, the sole owners, Leo and Clara Gene Schumacher, of the Imperial Estates Addition have requested, by letter to the City Council that certain of these improvements be deleted from the 1971 Construction Program, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota that the following improvements be deleted from the 1971 Construction Program: 1. North Frontage Road Street Construction. 2. Area Benefit Over-sizing Watermain. 3. Notth Frontage R6ad-Watermain, and North Frontage Road Storm Sewer. Moved by Councilman Hallberg, seconded by Councilman Wilson to proceed with, the application for trees in accordance with there- quest of the Natural Resources Committee's letter signed by Mr. Ray Knutson. The trees will be accepted on the condition that the City can transplant the trees from the State Conservation property to other park and school areas within the corporate limits when the trees mature to a satisfactory size so that transplanting will assure their growth. Ayes, all; Nays, none. Mr~ Peter J. Moes who recently purchased a hOme at 1500 East 3rd Street requested permission to install a septic tank at that address. Moved by Councilman Kane, seconded by Councilman Driscoll 690 to refer this matter to the Planning Commission. Ayes, all; Nays, none. The City Clerk read the following letter from Mr. Ben Polga, Superintendent of Schools: February 26, 1971 Mr. Daryl Plath Chief of Police 100 Sibley Street Hastings, Minnesota Dear Mr. Plath: LJ This is to infQrm you that the Hastings Board of Education, Independent School District 200, at their meeting held on Monday evening, February 22, 1971, passed a resolution prohibiting the use of snowmobiles on any of the real property owned by Independent School District 200, Hastings, Minnesota; and that school authorities shall take such action as may be necessary and appropriate to enforce the provisions of said resolution. . Will you be so kind as to see that the property of the school district be deleted from the City ordinance as regards to snowmobiles. Thank you for your kind cooperation. Yours very truly, s/ B. J. Ayes, all; Nays, none. Moved by Councilman Driscoll, seconded by Councilman Kane to advertise for bids for crushing 8,000 cubic yards of gravel from the Sanitary Landfill. Bids to be opened on Monday, March 15, 1971 at 8:00 o'clock P.M. Ayes, all; Nays, none. o Councilman Collins introduced the following resolution and moved its adoption: RESOLUTION: RESURFACING RY. 61 WHEREAS, the City Council of the City of Hastings is aware of the detrimental effects of freezing and thawing on highways; and WHEREAS, the heater-planer thin overlay placed upon T.H. 61=3 within the corporate limits of the City of Hastings in 1968 has proven to be ineffective; and WHEREAS, ths present condition of T.H. 61=3 is failing from apparent base failure at joints; and WHEREAS, normal maintenance procedures appear to be less than desirable for the convenience of the motoring public; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota at its regular meeting of March 1, 1971, does hereby urge the State of Minnesota, Department of Highways to proceed with complete maintenance reconstruction of T.H. 61=3 through the corporate limits of the City of Hastings, at a reasonable and early date. o Adopted by the City Council this 1st day of March, 1971. Moved by Councilman Collins, seconded by Councilman Kane that the present "No Parking" signs between llth Street and 14th Street on Pine Street be replaced by "Restricted Parking" signs. ,-- After further discussion Councilmen Collins and Kane with- drew their motion. A motion was then offered by Councilman Collins, seconded by Councilman Kane to remove the "No Parking" signs and directional striping between 11th Street and 14th Street on Pine Street during the non-school months. Moved by Councilman O'Connor, seconded by Councilman Hallberg to table the foregoing motion. Ayes, Councilmen Hallberg, O'Connor, Wilson, Driscoll and Christenson; Nays, Councilmen Novak, Kane and Collins. The Mayor declared the motion passed. Moved by Councilman Kane, seconded by Councilman Christenson that the bills as audited be approved and the City Clerk be instructed to issue warrants for the same.
