The City Council of the City of Hastings, Minnesota met in a
regular meeting on Tuesday, February 16, 1971 at 8:00 o'clock P.M. in
the Council Chambers of the City Hall.
Members present: Councilmen Novak, Kane, Collins, Hallberg,
O'Connor, Wilson, Driscoll and Christenson.

Minutes of the last meeting were read and approved.
Councilman Driscoll introduced the following resolution and
mbved its adoption:
BIDS FOR 2 SQUAD CARS
WHEREAS, pursuant to an advertisement for bids for furnishing
the City with two (2) Squad Cars for the Police Department, the following
bids were received complying with the advertisement: (Trade-in allowance
on one (1) 1970 Buick)

Police Squad Cars according to the specifications therefore approved
by the City Council and on file in the office of the City Clerk.
The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids, after a
contract has been signed.

WHEREAS, it appears that Air Comm is the lowest bidder, they
did not meet specifications in that a locking device would not be
provided to secure radio units to vehicular charger units.

WHEREAS, it appears that General Electric Company is the
lowest responsible bidder complying with all specifications,
NOW THEREFORE BE IT RESOVED by the City Council of the City
of.H~stings, Minnesota:
1. The Mayor and City Clerk are hereby authorized and directed
to enter into a contract with General Electric Supply Company for the
radios as specificed and therefore approved by the City Council and on
file in the Office of the City Clerk.

forthwith to all bidders the deposits made with their bids, after a

The Council heard all persons interested in said improvements.
All persons present were afforded an opportunity to present their views
and objections to the making of said improvements.

Minnesota:

1. Such plans and specifications, a copy of which is on file in the
City Clerk's Office are made a pa~t hereof are hereby approved.
2. The City Clerk shall prepare and cause to be inserted in the official
paper an advertisement for bids upon the making of such approved plans
and specifications. The advertisement shall be published for three (3)
weeks and shall specify the work to be done and shall state that the
bids will be opened and considered by the Council at 2:00 o'clock P.M.
on April 15, 1971 in the Council Chambers of the City Hall and awarded
on Monday, April 19, 1971 at 8:00 o'clock P.M. and that no bids will
be considered unless sealed and filed with the Clerk and accompanied r-~
by a cash depository, cashier's check, bid bond or certified check I'!.
payable to the Clerk for five (5) percent of the amount of such bids.

that an ordinance entitled "AN ORDINANCE FOR THE PURPOSE OF PROMOTING
HEALTH, SAFETY, ORDER, CONVENIENCE, AND GENERAL WELFARE BY REGULATING
THE USE OF LAND, THE LOCATION, SIZE, USE AND HEIGHT OF BUILDINGS,
THE ARRANGEMENT OF BUILDINGS ON LOTS, THE DENSITY OF POPULATION AND
DESIGNATING THE BOUNDARIES OF DISTRICTS FOR SAID PURPOSES WITHIN THE
CITY OF HASTINGS, MINNESOTA, ALL IN ACGORDANCE WITH A COMPREHENSIVE
PLAN, dated December 7, 1970 pass the second reading to be amended by

that the City Clerk and Mayor enter into the following agreement with
Washington County:
THIS AGREEMENT is made and entered into by ~nd between the
City of Hastings and the County of Washington, State of Minnesota,
this 16th day of February, 1971:
WHEREAS the City of Hastings wishes to abolish the office of

assessor for said City, under the prov~s~ons of Minnesota Statutes,
Section 273.072, and enter into an agreem~ntwith the County of Washington
to provide for the assessment of the property in said City by the county
assessor, and
WHEREAS, it is the wish of said county to cooperate with said
City to provide for a fair and equitable assessment of property;

NOW, THEREFORE, IN CONS IDERA TION OF THE MUTUAL CONVENANTS
HEREIN CONTAINED, IT IS AGREED AS FOLLOWS:
1. That the part of the City of Hastings which lies within
the County of Washington and constitutes a separate assessment district,
shall have its property assessed by the county assessor of Washington
County, peginning with the assessment of the year 1971, providing this
agreement is approved by the Commissioner of Taxation of the State of
Minnesota.
2. It is further agreed that the office of local assessor of
the part of the City of Hastings is hereby abolished, pursuant to this
agreement and the approval of the Commissioner of Taxation, and that
such office shall cease to exist for the duration of this agreement,
which shall be until notified by the Local Board.
3. In consideration for said assessment services, the City
of Hastings hereby agreed to pay the County of Washington the annual
sum of $125., such payment to made to the county treasurer on or
before October 31st of each year.
IN WITNESS WHEREOF, the parties have executed this agreement
this 16th day of February, 1971.

Councilman Driscoll introduced the following resolution
and moved its adoption:
RESOLUTION: PROPOSED COUNTY ROAD 40-42
WHEREAS, the City Council of the City of Hastings recognizes
the need for a good quality roadway of express way design to connect
the City of Hastings with our neighbors to the West; and
WHEREAS, the proposed location of County Road 40-42 affords
a direct route from the City of Hastings to the West County line; and
WHEREAS, no cross-country continuous roadway now exists; and
WHEREAS, the County Court House is located within the City
of Hastings necessitating accessability,

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council
of the City of Hastings at its regular Council Meeting of February 16,
1971 does hereby urge the Dakota County Boara of Commissioners and
Engineering Staff to proceed with land acquisition and construction of
County Road 40-42 proposed.

to attend the University of Minnesota Clerks and Finance Officers school
in Minneapolis on March 11 and 12, 1971. Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Wilson
that the City of Hastings adopt the Resolution of Committment approved
by the Executive Committee of the League of Minnesota Municipalities
relative to national revenue sharing, which resolution is as follows:
A RESOLUTION OF COMMITMENT

We, the Executive Committee of the League of Minnesota Muni-
cipalities, hereby assert that the immediate establishment of an
adequate and fair national revenue sharing system iB the highest
priority issue confronting government here in Minnesota andthroughout
America;.~ National revenue sharing is essential to preserve our
federal system, vital to the ability of state and local governments
to set goals, make desicsions and be responsive to the need of their
citizens, and basic to the resolution of the principal domestic
problems confronting America. .
As evidence of the urgency and high priority we assign to
a national revenue sharing system, we hereby publicly commit ourselves
to actively support both a realignment of our national priorities and
a reallocation of our resources to provide funds for revenue sharing.
While we recognize the continued need to utilize categorical aid to
meet national objectives, we would support a moratorium on new grant
programs. 'And as rut%herevidence of our commitment, we would support,
if necessary, such increases in national taxes as are required to
supplement existing funds.

The City Attorney reported that the City had received a
petition by Mr. & Mrs. C. A. Wallin and Siewert Construction Company
petitioning the City to annex to the City 40 acres adjacent to the
City in Nininger Township.
Moved by Councilman Hallberg, seconded by Councilman Driscoll
that the above matter be referred to the Planning Commission. Ayes,
all; Nays, none.
Councilman Hallberg reported 'on proposed Housing Guidelines
being considered by the Metropolitan Council and offered the following
resolution relative thereto:
RESOLUTION ON HOUSING GUIDELINES
The Hastings City Council; having reviewed the several
policy statements presented for public hearing concerning housing to
be incorporated the Metropolitan Development Guide generally support
all except Policy No. 14. Policy No. 14 would in our opinion not
generate low-and-moderate income housing in the suburbs, but will
actually be a determent to all projects in the suburban municipalities
dependent on Federal financial assistance. It would not reduce the
cost of housing, but only reduce the quality.

Rather than using the refusal 'of Federal Funds as a threat,
the Metropolitan Council should appeal to the municipalities sense
of Metropolitan unity and social "r@spdns1bility'in uqing them to
participate in solving Metropolitan problems. The 'carrot and stick'
approach in initiating change in ~ttitudes is certainly not the
most effective~ '
The Metropolitan Council is urged to treat the causes of
the housing problem instead of the symptoms, to allow municipalities
the opportunity to be unique just as individual personalities are

unique. The Metro Council should move to attack the real causes for
housing deficiencies such as the high and still rising cost of finan-
cing, the dependence on property taxes to pay for municipal and
school costs, the competition for tax base, the existence of codes
that are not based on performance standards, the influence of slum
lords in preserving substandard housing, the permitting of the con-

It is our hope that the Metropolitan Council will return to its
previous practice of appealing for consensus on important issues.

Councilman Driscoll seconded the motion to adopt said
resolution and the same was passed by the following vote: Ayes, all;
Nays, none.
Moved by Councilman Christenson, seconded by Councilman
O'Connor to allow a Pleasant Drive entrance with a turn-around
included for Lot 7, Block 4, Townsview Estates Addition. The curb
opening permit will be issued upon approval by the City Engineer.
Ayes, Councilmen Novak, Collins, O'Connor, Driscoll and Christenson;
Nays, Councilmen Hallberg and Wilson. Motion carried.

Councilman Hallberg reported that the owners of property
at the southeast corner of 15th and Vermillion Streets have applied
for a Special Use Permit to construct a gasoline service station on
the property, and further that the applicant requests a variance
from Section 7.1.6 of the Zoning Ordinance requiring a 30 foot set-
back for gasoline island pumps.
Moved by Councilman Hallberg, seconded by Councilman
O'Connor that a Public Hearing be held March 15, 1971 at 8:00 o'clock
P.M. by the City Council and that the following notice be published,
mailed and posted as required by Ordinance: Ayes, all; Nays, none.
NOTICE OF PUBLIC HEARING ON APPLICATION
FOR SPECIAL USE PERMIT AND VARIANCE
Application has been made to the Hastings City Council,
sitting as a Board Adjustment, to grant a special use permit to allow
construction of a gasoline service station on the following described
property located in the City of Hastings, Dakota County, Minnesota:
Lots 15 & 16, Block 6
W.G. LeDuc's Addition
Notice is further given that the applicant requests a vari-
ance from the requirement that all gasoline pump _islands be located
not less than 30 feet inside exterior property lines.

A Public Hearing on the application for a special use
permit and variance will be held by the City Council sitting as a
Board of Adjustment at a regular meeting of the City Council
scheduled for March 15, 1971 at 8:00 o'clock P.M. in the Council
