The City Council of the City of Hastings, Minneso~a met in a
regular meeting on Monday, December 21, 1970 at 8:00 o'cJock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Soleim, Novak, Kane, Hallberg,
Christenson, Driscoll, Mayer and
Mayor Rotty.
Members absent: Councilman Fischer.

Moved by Councilman Christenson, seconded by Councilman Driscoll
to pass the second reading to amend an Ordinance entitled "AN ORDINANCE TO
ESTABLISH RULES GOVERNING THE FUNCTIONING OF THE CITY COUNCIL OF THE CITY
OF HASTINGS, MINNESOTA". Ayes, all; Nays, none.
Amendment to Rule 8: Committees
Moved by Councilman Christenson, seconded by Councilman Kane to
pass the first reading to amend an Ordinance entitled "AN ORDINANCE ESTAB-
LISHING A COMMISSION TO PLAN FOR THE ,DEVELOPMENT OF THE CITY OF HASTINGS".
Ayes, Councilman Soleim, Novak, Kane, Christenson, Driscoll and Mayer;
Nays, Councilman Hallberg.

its adoption:

on Highway #61 and 15th Street and Highways #55 and #61.

Councilman Christenson introduced the following resolution and
moved its adoption:
WHEREAS, the Commissioner of Highways has prepared plans, special
provisions and specifications for the improvement of part of Trunk Highway
Number 3 renumbered as Trunk Highway Number 61 w~thin the corporate limits
of the City of Hastings at Junction T .H. 61 amL15th Street; and
WHEREAS, said plans are on file in the office of the Department
of Highways, St. Paul, Minnesota, being marked, labeled, and identified as
S.P. 1913-24 (61-3); and
WHEREAS, said special provisions are on file in the office of
the Department of Highways, St. Paul, Minnesota, being marked, labeled and
identified as S.P. 1913-24 (61-3), which, together with. the Minnesota
Department of Highways SpecificatiorisforrHighway"Construction, dated
January 1, 1968, as amended by Supplemental Specifications, dated July 1,
1969, on file in the office of the Commissioner of Highways, constitute
the specifications for said improvement of Trunk Highway Number 3 re-
numbered as Trunk Highway Number 61; and
WHEREAS, copies of said plans and special prov1s10ns as so marked,
labeled and identitfied are also on file in the office of the City Clerk;
and

WHEREAS, the term "said plans and special provisions" as herein-
after used in the body of this resolution shall be deemed and intended to
mean, refer to, and incorporate the plans and special provisions in the
foregoing recitals particularly identiped and described. .
NOW, THEN, BE IT RESOLVED that said plans and special provisions
for the improvement of Trunk Highway Number 3 renumbered as Trunk Highway
Number 61 within the limits of the City of Hastings be and hereby are
approved.
BE IT FURTHER RESOLVED that the elevations and grades as shown
in said plans and special provisions be and they are hereby approved and

consent is hereby given to any and all changes in grade occasioned by the
construction of said Trunk Highway Number 61 in accordance with said plans
and provisions. Upon the call of the roll the following voted in favor
of the Resolution: Councilman Novak, Driscoll, Christenson, Mayer, Kane,
Soleim and Hallberg.
The following voted against its adoption: None
whereupon the Mayor and presiding officer declared the Resolution adopted.

Councilman Novak introduced the following resolution and moved
its adoption:
RESOLUTION REGARDING TRAFFIC SIGNAL
AT T.H. 6l - T.H. 55 S.P. 1910-16
(T .H. 55-53)
WHEREAS, The City was requested to approved plans and specifica-
tions for improvement of part of T.H. 53 renumbered as.T.H. 55 within the
corporate limits of the City of Hastings at Junction T.H. 61 and;
WHEREAS, said plans are on file in the Department of Highways,
St. Paul, Minnesota, being marked, labeled and identified as S.P. 1910-16
(55=53);
NOW THEREFORE, Be it resolved as follows:
1. That the City does not approve said proposed construction
and extension of center island as shown on said drawings
and specifications until and after the construction and
installation of the traffic signals at T.H. 61 and 15th
Street, S.P. 1913-24 (T.H. 61=3), is complete.

2. That following said installation, a study of secondary street
systems and traffic patterns complete with traffic counts
be completed.
3. That additional alternative solutions be studied to allow
free access to llth Street east of T.H. 6l (Vermillion
Street) at this intersection.

Councilman Christenson introduced the following resolution and
moved its adoption:
RESOLUTION TO MINNESOTA HIGHWAY DEPARTMENT
BE IT RESOLVED, That pursuant to statutory authority, that John L.
Davidson, City Engineer for and on behalf of the City of Hastings is hereby
authorized to request and obtain from the Minnesota Department of Highways
needed engineering and technical service during the year 1971; for which

payment will be made by the City of Hastings upon receipt of verified claims
from the Commissioner of Highways.
Adopted by the City Council this 21st day of December, 1970.

Councilman Driscoll seconded the motion to adopt said resolution

to pass the first reading of an amendment to an ordinance entitled "AN
ORDINANCE REGULATING THE PARKING OF CARS ON CERTAIN STREETS OF THE CITY OF V
HASTINGS FOR CERTAIN HOURS AND PROVIDING A PENALTY FOR THE VIOLATION
THEREOF" as follows: Ayes, all; Nays none.
that Section 1 of the above named ordinance be and hereby is amended by
adding thereto the following:
"It shall be illegal to park any vehicle in any block
between the hours of 2:30 A.M. and 5:30 A.M. of any day
of the week on the following streets in the City of
Hastings, to-wit:
East Second Street from T.H. 6l (Vermillion Street) to
Bailey Street (CMStP&P Railway right-of-way) except
marked taxi cab stands at 318 East Second Street and
except marked "limited parking" zone for Polka-Dot
Cafe, 118 E. Second Street.

that the following appointments be made to the Planning Commission:

of Orvin Moen, created by his resignation. (Expires 12/31/72)

The Mayor and City Council, on behalf of the citizens of the
City of Hastings, expresstheir thanks to Donald Fluegel and Orvin Moen
for the many hours of dedicated effort during their terms on the Planning
Commission. Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Christenson
to pass the third reading of an Ordinance entitled "AN ORDINANCE REGULATING V"
AND CONTROLLING THE USE OF SNOWMOBILES" to finally read as follows: Ayes,
all; Nays, none.
The City Council of the City of Hastings does ordain:
SECTION 1
Definitions.
Subdivision 1. For the purposes of this Ordinance the terms defined
herein shall have the meantmg ascribed to them.
Subdivision 2. "Person" includes an individual, partnership,
corporation, the state and its agencies and subdivisions, and any body of
persons, whether incorporated or not.

Subdivision 3. "Snowmobile" means a self-propelled vehicle de-
signed for travel on snow or ice or natural terrain steered by wheels, skis
or runners.
Subdivision 4. "Owner" means a person, other than a lien holder
having the property in or title to snowmobile entitled to the use or posses-
sion thereof.
Subdivision 5. "Operate" means to ride in or on al).d control the
operation of a snowmobile.
Subdivision 6. "Operator" mesas every person who operates or is
in actual physical control of a snowmobile.

SECTION 2 Except as herein specifically permitted and author-
ized, it is unlawful for any person to operate a snowmobile within the
limits of the City of Hastings:
1. .On the portion of any right of way of any public highway,
street, road, trail or alley used for motor vehicle travel, except the most
right hand lane (except in passing) which is used for vehicle traffic in
the same direction, other than on freeways, 'interstate, trunk, county,
state-aid, or county highways, Snowmobiles may also be operated upon the
ditch bottom 1,h8F8 l81,j~ll, 88 p88~8a or the outside bank of trunk, county
state-aid and county highways where such highways are so configured within
the corporate limits, in accordance with M.S. and this Ordinance.
2. On a public sidewalk provided for pedestrian travel.

3. On boulevards within any public right of way.
4. On private property of another without specific permission of
the owner, or person in control of said property.
5. On any other public place except as may 'be specifically
permitted by other provisions of the City Ordinances.
SECTION 3 A snowmobile ,may make a direct crossing of a street
or highway, except an interstate highway or freeway, provided:
1. The crossing is made at an angle of approximately 90 degrees
to the direction of the street or highway and at a place where no obstruc-
tion prevents a quick and safe crossing.
2. The snowmobile is brought to a complete stop before crossing
the shoulder or main traveled way. .
3. The driver yields the right of way to all on-coming traffic
which constitutes an immediate hazard.
4. In crossing a divided street or highway, the crossing is made r-l
only at an intersection of such street or highway with another public I
street or highway. l
5. if the crossing is made between the hours of one-half hour
after sunset to one-half hour befor sunrise or in conditions of reduced
visabi1ity, only if both front and rear lights are on.
SECTION 4 City traffic ordinances shall apply to the operation
of snowmobiles upon streets and highways, except for those relating to
required equipment, and except those which by their nature have no application.
SECTION 5 No snowmobile shall enter any intersection without
yielding the right of way to any vehicles or pedestrians. at the intersection,
or so close to the intersection as to constitute an immediate hazard.
SECTION 6 Persons under 18.
Subdivision 1. No person under 14 years of age shall operate
on streets or the roadway surface of highways or make a direct crossing of
a trunk, county state-aid, county highway or city street as the operator
of a snowmobile. A person 14 years of age or older, but less than 18 years
of age, may operate a snowmobile on street and highways as permitted under
this ordinance and make a direct crossing of such streets and highways only
if he has in his immediate possession a valid snowmobile safety certificate
issued by the commissioner, as provided by M.S.A. Section 84.872.

Subdivision 2. It is unlawful for the owner of a snowmobile to
permit the snowmobile to be operated contrary to the provisions of this
section.
SECTION 7 It is unlawful for any person to operate a snowmobile
within the limits of the City of Hastings:
1. At any place, while under the influence of alcohol or drugs
as defined in M.S. 169.121, which is hereby incorporated herein by refer-
ence.

2, At a rate of speed greater than reasonable or proper under all
surrounding circumstances.
3. At a speed greater than 10 miles per hour on any public street
or public right of way.
4. At any p1ac~ in a careless, reckless, or negligent manner or
heedlessly in 'disregard of the rights or safety of others, or in a manner
so as to endanger or be likely to endanger or cause injury or damage to
any person or property.

5. During the hours from 10:00 P.M. to 8:00 A.M. of any day,
except when returning to the operator's residence from outside the city,
when the most direct route shall be used.
6. So as to tow any person or thing in a public street or highway
except through use of a rigid tow bar attached to the rear of the snowmobile.
7. Within 100 feet of any fisherman, pedestrian, skating rink or
sliding area where the operation would conflict with use or endanger other
persons or property.
SECTION 8 It is unlawful for any person to operate a snowmobile
any place within the limits of the City of Hastings, unless it is equipped
with the following:
1. Standard mufflers which are properly attached and which reduce
the noise of operation of the motor to the minimum necessary for operation.
No person shall use a muffler cutout, by-pass, straight pipe or similar
device on a snowmobile motor.
2. Brakes adequate to control the movement of and to stop and
hold the snowmobile under any condition of operation.

3. A safety or so called "deadman" throttle in operating condition.
A safety or "deadman" throttle is defined as a device which, when pressure
is removed from the engine accelerator or throttle, causes the motor to be
disengaged from the driving track.
4. When operated between the hours of one-half hour after sunset
to one-half hour be for sunrise or at times of resuced visibility, at least
one clear lamp attached to the front, with sufficient intensity to reveal
persons and vehicles at a distance of at least 100 feet ahead during the
hours of darkness under normal atmospheric conditions. Such head lamp
shall be so aimed that glaring rays are not projected into the eyes of
an oncoming snowmobile operator. It shall also be equipped with at least
one red tail lamp having a minimum cand1epower sufficient intensity to
exhibit a red light plainly visible from a distance of 500 feet to the rear
during hours of darkness under normal atmospheric conditions.
5. Reflective material at least 16 square inches on each side,
forward of the handlebars, so as to re[ect light at a ninety degree angle.
SECTION 9 Every person leaving a snowmobile on a public place
shall lock the ignition, remove the key and take the same with him.
SECTION 10 Notwithstanding any prohibitions in this ordinance,
a snowmobile may be operated on a public thoroughfare in an emergency
during the period of time when, and at locations where, snow upon the road-
way renders travel by automobile impractical.

SECTION 11 It is unlawful to intentionally drive, chase, run
over or kill any animal with a snowmobile.
SECTION 12 Every person convicted of a violation of any of the
provisions of this ordinance shall be punished by a fine of not more than
three hundred dollars ($300.00) or by imprisonment for a period of not
more than ninety (90) days, or both, but in either case the costs of
prosecution may be added.
SECTION 13 Effect. This ordinance shall take effect and be in
force from and after to passage and publication.
