November 2, 1970
The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, November 2, 1970 at 8:00 o'clock P.M. in the Council Cham-
bers of the City Hall.
Members present: Councilmen Soleim, Novak, Christenson, Hallberg,
Driscoll, Fischer, Mayer, and Mayor Rotty.
Members absent: Councilman Kane.

Councilman Fischer introduced the following resolution and moved
its adoption:
BIDS FOR TWO (2) TWO AND ONE-HALF TON DUMP TRUCKS
WHEREAS, pursuant to an advertisement for bids for furnishing the
City with two (2) Dump Trucks for the Street Department, the following bids
were received complying with the advertisement:

Livingston Ford Sales, Inc. $19,495.30 $7,024.66 $12,470.64
Bahls Motor & Implement Co. $18,853.50 $5,233.60 $13,619.90
WHEREAS, it appears that Livingston Ford Sales, Inc. is the lowest
responsible bidder,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTINGS:

City Council
The Mayor and City Clerk are hereby authorized and directed to
contract with Livingston Ford Sales, Inc. for the purchase of
Trucks according to the specifications therefore approved by the
and on file in the office of the City Clerk.

2. The City Clerk is hereby authorized and directed to return
forewith to all bidders the deposits made with their bids, after a contract
has been signed.
Adopted by the City Council this 2nd day of November, 1970.

City with One (1) Used Crawler Tractor and Scraper for the Sanitary Landfill,
the following bids were received complying with the advertisement:

It was moved by Councilman Fischer, seconded by Councilman Driscoll
to hold over the award of this bid until November 16, 1970 to allow the
Street Department to check out both machines before awarding the bid. Ayes,
all; Nays, none.
Moved by Councilman Soleim, seconded by Councilman Novak that the
following amendment to the ordinance entitled "AN ORDINANCE PROVIDING FOR
SEWAGE SERVICE CHARGES AGAINST THE OWNERS OR OCCUPANTS OF PROPERTY NOW OR
HEREAFTER CONNECTED WITH THE SEWERAGE SYSTEM OF THE CITY OF HASTINGS" pass
its first reading amending Section C to read The minimum charge for every
sewer connection shall be $8.00 per quarter. Ayes, all; Nays, none.
Moved by Councilman Fischer, seconded by Councilman Mayer to appoint
Mrs. Clayton McNamara (2nd Ward) and Mrs. Glenda Schnirring (3rd Ward) as
election judges for the November 3rd General Elections. Ayes, all; Nays, none.

Moved by Councilman Soleim, seconded by Councilman Driscoll that
the following skating rink lease and agreement be approved: Ayes, all;
Nays, none.
AGREEMENT
THIS AGREEMENT, made and entered into this 2nd day of November,
1970, by and between Edwin Rother, party of the first part, Lessor, and
the City of Hastings, a Municipal Corporation, party of the second part,
Lessee:
WITNESSETH: That the party of the first part hereby leases to
the party of the second part, and the party of the second part hereby leases
from the party of the first part, the following described premises, situated
in the City of Hastings, County of Dakota, State of Minnesota, to-wit:

Lots #l3, 14, l5 - Block 9, Addition No 13
according to the plat thereof now on file
and of record in the office of the Register
of Deeds within and for the County of Dakota,
State of Minnesota.
The term of this lease shall be from the 2nd day of November,
1970 to the 2nd day of November 1971.
And the said City of Hastings agrees to hold the Lessor, Edwin
Rother, harmless from any and all damages of whatsoever, using said area
during the term of this lease.
Said premises are to be used by the party of the second part for
recreational purposes only and are to be under the full term of this lease.
In consideration for this lease, the party of the second part agrees
to pay the party of the first part the sum of One Dollar (1.00) for the full
term thereof. It is further stipulated and agreed by and between the parties
hereto that either party to this lease may terminate the same on giving
thirty (30) written notice to the other party hereto.

that Ted Riches be reappointed to the Police Civil Service Commission for
a three year term effective November 2, 1970. Ayes, all; Nays, none.
The Engineer read a letter from the Highway Department regarding
traffic signals on T.H. 61 and 15th Street. The Highway Department re-
quested agreement be approved by the City Council to allow the Highway
Department to proceed with final plans and specifications for opening of
bids the fourth week in January. The City would share 50% in the cost of
this installation at T.H. 61 and 15th St~eet only.

Councilman Fischer introduced the following resolution and moved
its adoption:
NOW, THEN, BE IT RESOLVED that the City enter into an agreement
with the State of Minnesota, Department of Highways for the following pur-
poses, to-wit,:
To provide a traffic control signal with street lights

within the corporate limits of the City on Trunk Highway
No. 6l at l5th Street in accordance with Agreement No.
56641, a copy of which was before the Council.
BE IT FURTHER RESOLVED that the proper City officers hereby are
authorized to execute such agreement, and thereby assume for and on behalf
of the City all of the contractual obligations contained therein.

Councilman Soleim seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, all; Nays, none.
The City Engineer furnished the City Council and Mr. Willis Olson
a report on the Mobile Home Court in South Hastings, It was moved by Council-
man Fischer, seconded by Councilman Soleim that Mr. Olson's plot plan be
referred to the Planning Commission and no further activity or construction
be undertaken on the property by the owner until such time as approved
legally by the City Council. This property described as follows:
Lots l5, 16, 17, 18, and 19; Blk 1, Vermillion
Addition, according to the plat thereof now on
file and of record in the office of the Register
of Deeds within and for the County of Dakota,
State of Minnesota.
Moved by Councilman Fischer, seconded by Councilman Soleim that
the bills as audited be approved and the City Clerk be instructed to issue
warrants for the same. Ayes, all; Nays, none.
