The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, October 5, 1970 at 7:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Soleim, Novak, Hallberg, Christenson,
Mayer and Mayor Rotty.

Members absent: Councilmen Kane, Driscoll and Fischer.
Minutes of the last meeting were read and approve.
Councilman Soleim introduced the following resolution and moved
its adoption:
RESOLUTION ADOPTING ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by
law, the Council has met and heard and passed upon all objections to the
proposed assessments for the improvement of the following:
The construction of all or any part of the following: Grading,
Gravel Base, Surfacing and Curbing, Sanitary Sewer, Watermain and Storm
Sewer Extensions with appurtenances necessary thereto on the following
streets:
1969 IMPROVEMENTS
East 18th Street and LeDuc Drive from T.H. 61 to State Hospital
Complete grading, gravel base construction, concrete curb and
gutter, concrete sidewalks and necessary storm drainage.

Area assessments for part of the above construction are proposed
to be levied against all or part of the property located within the follow-
ing described area:

Beginning at the Northwest corner of Section 29, Tl15N, R17W,
thence Easterly along the North line of said Section 29, 2640 feet more
or less to the North 1/4 corner of said Section 29, thence northerly
along the north-south 1/4 section line of Section 20, Tl15N, R17W to the
north-west corner of Lot 1, Block 1, Lidd1es Riverda1e Addition, thence
southeasterly along the northeasterly line of Liddles Riverda1e Addition
which line is located 200 feet northeast of the centerline of C.S.A.H.
No. 42 and is parallel thereto; thence continuing southeasterly along the
aforementioned line 200 feet northeasterly of and parallel to the center-
line of C.S.A.H. No. 42 to the East line of Section 20, T1l5N, R17W;
thence southerly along the east line of said Section 20 to the northeast
corner of Section 29, Tl15N, R17W; thence continuing southerly along the
east line of said Section 29, 2640 feet more or less to the east 1/4
corner of said Section 29; thence westerly along the east-west 1/4 section
line of Section 29, said east-west line also being the north right-of-way
line of Trunk Highway 55, 5280 feet more or less, to the west 1/4 corner
of said Section 29; thence northerly along the west line of said Section 29,

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTIN:;S:
l. Such proposed assessments, a copy of which is attached hereto
and made a part hereof is hereby accepted and 8kall consitute the special
assessments against the lands therein, and each tract of land therein in-
cluded is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of lO years, the first of the installments to be
payable on or before the first Monday.oi'January, 1971. Any deferred in-
stallments shall bear interest at the rate of eight per cent (8%) per annum.
To the first installments shall be added interest on the entire assessment,
from the date of this assessment resolution, until December 3l, 1970. To
each subsequent installment when due shall be addedinteresc for one year
on all unpaid installments.
3. The owner of any property so assessed may, for 30 days after
notification from the City Treasurer, pay to the City Treasurer, the
whole of the assessment without interest, and he may at any time, prior 0
to certification of the assessment to the County Auditor, as herein provided, L.
pay the whole of the assessment against any parcel with interest accrued
to the date of payment to the City Treasurer, and he may at any time
thereafter pay the County Treasurer the entire amount of the assessment
remaining unpaid with interest accrued to December 3lst of the year in
which such payment is made.
4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the County Auditor to be extended on the proper tax

lists of the County and such assessment shall be collected and paid over
in the same manner as other municipal taxes.

RESOLUTION CALLING FOR AN ELECTION
ON $ 775,000. GENERAL OBLIGATION
ECONOMIC DEVELOPMENT BONDS OF 1970

WHEREAS:
A. Chapter X of the City Charter of the City of Hastings author-
izes the City of Hastings to issue general obligation bonds pursuant to
Minnesota Statutes Chapter 475 to finance the acquisition and development
of property for the purpose of promoting industry and providing employment
and in order to promote, attract and encourage and develop economically,
sound industry and commerce through governmental action, and for the purpose
of preventing so far as possible the emergence of blight and marginal
lands and areas of chronic unemployment.
B. The State Legislature has authorized the State of Minnesota
to sell certain public lands to the City of Hastings for said purpose.
C. The State Legislature has heretofore determined by adoption
of the Municipal Industrial Development Act (Minnesota Statutes Chapter 474) r~,,!
that the welfare of the State requires the active promotion, attraction,
encouragement, and development of economically sound industry and commerce L___J
through governmental action for the purpose of preventing, so far as
possible, the emergence of blight and marginal lands and areas of chronic
unemployment.
NOW THEREFORE, BE IT RESOLVED By the City Council of the City of
Hastings, Minnesota, as follows:
1. This Council has investigated the facts and does hereby find,
determine and declare as follows:
(a) It is necessary and expedient to acquire and improve the lands
authorized to be sold to the City by the State Legislature pursuant to
Chapter X of the City Charter for industrial and commercial purposes and
in order to promote, attract, encourage and develop economically sound
industry and ~ommerce and for the purpose of preventing, so far as possible
the emergence of blight and marginal lands and areas of chronic unemploy-
ment within the City of Hastings and the surrounding area and to prevent
the economic deterioration of this area to the point where the process
can be reversed only by total redevelopment through the use of local state
and federal funds.
(b) A primary factor necessitating such acquisition and develop-
ment is the technological change in agriculture and other traditional
industries of the State, the effect of which in the Hastings area has
been to shift to a significant degree the area of opportunity of educated
youth to processing, transporting, marketing, service and other commercial
and industrial enterprises.

(c) Unless existing and related commercial and industrial enter-
prises are retained and ne.w ..i.~diu~tria1 and commercial enterprises are
developed to use the, available resources in the City of Hastings and
surrounding area and the State as a whole in educational and public
service facilities will be lost.

(d) The resulting movement of talented, educated personnel of
mature age to areas where their services may be effectively used and com-
pensated, and the lessening attraction of persons of businesses from other
areas for purposes of industry, commerce and tourist, has deprived the
City of Hastings and surrounding area and the State of the economic and
human resources needed as a base for providing governmental services and
facilities for the remaining population.

(e) As a result of this technological change and movement, the
area surrounding the City of Hastings has been adversely affected economi-
cally.
(f) Other factors necessitating such acquisition and development
are the increasing concentration of population in the City of Hastings,
the consequent increase in the amount and cost of governmental services
required in the City and the need for more intensive development and use
of land to provide an adequate tax base to finance these costs.
(g) Such acquisition and development is the first step toward
increasing the per capita income and benefiting the entire economy in
the Hastings area by eventually providing gainful employment of its people,
increasing their purchasing power, improving their living conditions and
relieving the demand for unemployment and welfare assistance.
(h) The eventual location of industry on said land will add
properties to the tax list, increase the tax base, measurable increase the
resources of the community, lighten the tax burden imposed on its property
taxpaymers, promote the economy of the State and therby contribute to the
welfare of its people.
(i) Private financing for said acquisition and development is
not feasible.

(j) Any benefits derived by private industry from the acquistion
and development of this property are only incidental to the accomplishment
of the primary purpose of acquisition and development, namely the encour-
agement and development of commerce and industry in order to prevent the
emergence of blight and marginal lands and areas of chronic unemployment.
2. The proposition of authorizing the issuance of $775,000
General Obligation Bonds for said purpose shall be submitted to the qualiti
fied electors of the City of Hastings at a special election to be held
on November 3, 1970. Said election shall be held between the hours of
7:00 o'clock A.M. and 8:00 o'clock P.M. The polling places in the City
shall be as follows:
1. Precinct No. 1 - Hastings High School
2. Precinct No. 2 - Fire Station
3. Precinct No. 3 - Cooper School
4. Precinct No. 4 - Howard's Garage
3. The Clerk is hereby authorized and directed to publish the
Notice of Election in the local official newspaper at least ten days
prior to the election, and to prepare separate blue colored ballots for
use at said election, which notice and ballot shall be in substantially
the following form:

4. The election judges for said election shall be the same as
the election judges for the general election taking place on the same
date.
5. Said election shall be held and conducted in accordance with
the City Charter and the statutes of the State of Minnesota applicable.
The ballots, when voted, shall be deposited in a separate ballot box,
painted blue, located in the polling place for each precinct. The Council
shall meet as required by law for the purpose of canvassing said election
and declaring the results thereof.
The motion for the adoption of the foregoing resolution was
duly seconded by Councilman Mayer and upon a vote being taken thereon,
the following voted in favor'thereof: All;

Moved by Councilman Hallberg, seconded by Councilman Mayer
that the recommendations as proposed by the Human Rights Commission be
approved. Ayes, all; Nays, none.
Councilman Driscoll and Councilman Fischer came in at this time.
The Chief of Police addressed the Council and advised that it
may be possible to obtain Federal funds to reimburse the City for certain
expenses heretofore expended by the City for Peace Officer Training
courses. Also, that further expenses to be expended by the City for
training of men and purchase of equipment may qualify for Federal funds.
That a person must be designated by the Council to make application for
these funds on behif of the City.
Whereupon, it was moved by Councilman Fischer, seconded by
Councilman Christenson that the Chief of Police, Daryl Plath, be and hereby
is designated as applicant for the City, to apply for federal funds to
reimburse the City or pay for costs incurred or to be incurred by the City
for these purposes. Ayes, all; Nays, none.

authorize expenses for Wallace Erickson and John Davidson to attend the
Minnesota Conference on Economic Development in Minneapolis on October
20 & 21 and to attend the Conference on Sanitary Landfill Principles in
Minneapolis on October 26 thru 29, 1970. Ayes, all; Nays, none.
Councilman Hallberg introduced the following resolution and moved
its adoption:
RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
HASTINGS AUTHORIZING TRANSFER OF REAL AND PERSONAL
PROPERTY TO THE METROPOLITAN SEWER BOARD, AUTHORIZING
CITY OFFICIALS TO ENTER CONTRACT, EXECUTE DEED AND BILL
OF SALE, AND RELATED MATTERS
WHEREAS, Laws of 1969, Chapter 449 has heretofore established
the Metropolitan Sewer Board and empowered it to acquire treatment works
from Municipalities in the Twin City Metropolitan area, including the City
of Hastings Treatment Works; and
WHEREAS, the Metropolitan Sewer Board has heretofore by resolution
determined to acquire the City of Hastings Treatment Works; and
WHEREAS, the terms of said transfer have been agreed upon and set
forth in Agreement form; and

WHEREAS, the transfer is to be effective as of October 15, 1970;
NOW THEREFORE, BE IT RESOLVED:
That the City Council of the City of Hastings hereby agrees to
enter into an Agreement with the Metropolitan Sewer Board effective
October 15, 1970, in words and figures as heretofore agreed upon by the two
bodies, and the Mayor and Clerk are authorized and instructed to execute
said Agreement as well as deeds, bills of sale, and assignments necessary
to complete said transfer, and the City Clerk is instructed to place a Copy
of said Agreement, as executed, on file in the City files.
