The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, August 17, 1970 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.

Members present: Councilmen Soleim, Novak, Kane, Hallberg,
Christenson, Driscoll, Fischer, Mayer and
Mayor Rotty.
Members absent:
None.
Minutes of the last meeting were read and approved.
Councilman Driscoll introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING BID - WELL PUMP AND PUMPHOUSE
WHEREAS, pursuant to an advertisement for bids for the construc-
tion of a well pumphouse, and furnishing and installation of a natural gas
engine, pump drive, and deep well turbine pump for the City of Hastings,
bids were received, opened and tabulated according to law, and the follow-
ing bids were received complying with the advertisement:

AND WHEREAS, it appears that Ri~~~r~ Plumbing and Heating of
Stillwater, Minnesota is the lowest responsible bidder,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTINGS:
1. The Mayor and City Clerk are hereby authorized and directed to
enter into a contract with Richert Plumbing and Heating Co.
for the improvements as stated above according to the plans
and specifications therefore approved by the City Council and
on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids
except that the deposits of the successful bidder and the
next lowest bidder shall be retained until a contract has
been signed.

an ordinance entitled "AN ORDINANCE OF THE CITY OF HASTINGS MAKING ILLEGAL v
THE ISSUANCE OF WORTHLESS CHECKS, AND IMPOSING A PENALTY FOR VIOLATION
THEREOF" pass its third reading to finally read as follows: Ayes, all;
Nays, none.
The City Council of the City of Hastings does ordain:
Subdivision 1. Definition. "Credit" means an arrangement or
understanding with the drawee for the payment of the check or other order
for the payment of money to which this ordinance applies.

Subdivision 2. Acts constituting. Whoever issues any check or
other order for the payment of money which, at the time of issuance, he
intends shall not be paid may be sentenced to imprisonment for not more
than 90 days or to payment of a fine of not more than $300.00, or both.
.S~bdivision 3. Pro9f of intent. Any of the following is evi-
dence sufficient to sustain a finding that the person at the time he issued
the check or other order for the payment of money, intended it should not
be paid:
(1) Proof that, at the time of issuance, he did not have an
account with the drawee; or

(2) Proof that, at the time of issuance, he did not have
sufficient funds or credit with the drawee and that he
failed within five days after receiving notice of non-
payment or dishonor to pay the check or other order; or
(3) Proof that, when presentment was made within a reasonable
time, the issuer did not have sufficient funds or credit
with the drawee and that he failed within five days after
receiving notice of nonpayment or dishonor to pay the
check or other order.
Subdivision 4. Proof of lack of funds or credit. If the check
or other order for the payment of money has been protested, the notice of
protest thereof is admissible as proof of presentation, nonpayment, and
protest, and is evidence sufficient to sustain a finding that there was
a lack of funds or credit with the drawee.
Subdivision 5. Exception. This ordinance does not apply to a
post-dated check or to a check given for a past consideration, except a
payroll check.

In accordance with Air Pollution Control Regulations adopted by
the Minnesota Pollution Control Agency (MPCA) on July 3, 1969 and in accord-
ance with Minnesota Statutes 1967; Section ll6.07 the State of Minnesota
Air Pollution Control (APC) Regulations are herewith adopted by reference
as follows:

Fuel in the Minneapolis-St. Paul Metropolitan Area.
Every provision contained in the above sections and paragraphs
of said APC Regulations including amendments thereto, is hereby adopted
and made a part of this Ordinance as if fully set out herein.
Any violation of the standards hereby adopted, or any other
violation of this ordinance shall constitute a misdemeanor and any person
convicted of violating the same shall be subject to a fine of up to $300.
and imprisonment for up to 90 days, or both. Each day's violation shall
constitute a separate offense.
PARAGRAPH 2 - ENFORCEMENT OFFICIAL
the Enforcement Official shall be tbe Chief of Police for the
City of Hastings and/or his duly authorized representative.
PARAGRAPH 3 - DATE. OF ENFORCEMENT

All provisions of these regulations shall carry full force and
effect after passage and publication as required by law. All time re-
quirements as set forth in this ordinance shall begin to run as of July 3,
1969 and compliance dates shall be determined beginning with that date.
PARAGRAPH 4 - REPEAL
All Ordinances of this City, or any prOV1S1ons thereof, in con-
flict with this ordinance are hereby repealed.
PARAGRAPH 5 - SEPARABILITY
Every section, provision or part of this ordinance is declared
separable from every other section, provision or part thereof, and if any
part shall be declared invalid it shall not affect the validity of any
other section or part thereof.

pass the second reading to amend an ordinance entitled "AN ORDINANCE OF
THE CITY OF HAS~INGS, MIN~~Q~,~~tA~LISHING REGULATIONS GOVERNING USE OF
THE HASTINGS CITY DUMP AND PROVIDING A PENALTY FOR VIOLATION THEREOF"
dated November 4, 1968 by amending Section 3 as follows:
"All persons, firms, and corporations, who are residents of the
City of Hastings, or who have permission to use said dump shall observe
any and all reasonable regulations which may be prescribed from time to
time by the City Council, by resolution, including but not limited to fees
for use of said facilities, hours of use, and kinds and amounts of refuse
material which may be deposited in said dump. Regulations adopted by the
City Council, by resolution, from time to time, shall be available at the
office of the City Clerk."

to amend Section 35 of an Ordin~nce entitled "AN ORDINANCE REGULATING THE
OPERATION OF VEHICULAR AND PEDES TRIAL TRAFFIC WITHIN THE CITY OF HASTINGS"
as follows: Ayes, all; Nays, none
Section 35. Alleys.
No person shall park a vehicle within an alley in such a manner
or under such cpnditions as to leave available less than 10 feet of the
width of the alley traveling surface for free movement of vehicular
traffic, except that persons loading or unloading merchandise to stores
or other business establishments and iike facilities may, if necessary
to such loading or unloading, occupy a greater portion of. the alley so Il
long as the operator of the vehicle is in .the immediate presence of the ! .
vehicle to allow moving of the vehicle when necessary for passage of l~
other vehicles using the alley.
Moved by Councilman Fischer, seconded by, Councilman Driscoll
to approve the following bookkeeping transactions: Ayes, all; Nays,
none.
1. That on November 17, 1969 the Council deleted from the 1969
Assessment Rolls the assessment to James Tix, Lot 1, Block 1, Oak Park
Addition for Street Grading and Gravel Base Construction, in the amount
of $1,219.60, and that funds to cover this deletion will not have to be
provided for in the I.B. 1969 Sinking Fund, as there have been substantial
interest earnings in that fund that will adequately provide.
2. That the City share of $5,951.97 cost of sidewalk replace-
ment at 2nd & Ramsey and, 3rd & Sibley, completed under the 1969 Construc-
tion Program and paid for out of the I.B. 1969 Construction Fund, be
charged to the Sidewalk & Emergency Fund.
3.. That the following engineer,costs paid to Toltz, King, Duvall,
Anderson & Asso. out of the 1969 Construction Fund, for projects that were
dropped from the program, be charged to the City, Engineering Department:

struction Fund to the City Engineering Department for $33,339.73 and to
the General Fund for $926.90, to reconcile costs as charged on the 1969

5. That a liability be set against the Parks Sinking Fund of
$26,689.17 for the balance of the cost of the Todd Field drainage,
Comm. #54l5, that was completed and paid for under the I.B. 1969 Con-
struction Fund.

WHEREAS, pursuant to a written contract signed with the City of
Hastings on the 4th day of August, 1969, Peter lainetti Construction Co.
having satisfactorily completed their share of the 1970 Improvement
Program,
NOW THEREFORE BE IT RESOLVED, by the City Council of the City
of Hastings, Minnesota:
The work completed under said contract is hereby accepted and
approved, and

BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby
directed to issue a proper order for the final payment of $1~,990.05 on
such contract, taking the contractor's receipt in full.

to approve a Non-intoxicating 3.2 Off Sale Beer License for the Sisters

Moved by Councilman Fischer, seconded by Councilman Kane to
approve the holding of boxing shows in the City of Hastings, and that a
letter be sent to the State of Minnesota Athletic Commission to that
effect. Ayes, all; Nays, none.
Moved by Councilman Fischer, seconded by Councilman Hallberg
that the rezoning requested by Vernon Truax and Gordon Oehrlein of Lot 2,
Block 27, Addition #l3 to Commercial be in all respects denied based
upon objections raised at the Public Hearing held this date. Ayes, all;
Nays, none.
Councilman Mayer introduced the following resolution and moved
its adoption:

Moved by Councilman Christenson; seconded by Councilman
Kane that the City Engineer proceed to negotiate with the Minnesota
Highway'Department for the installation of traffic signals on 15th
Street and Highway 61; that the City Engineer take traffic counts
on Tyler Street, Ramsey Street, 11th Street and 15th Street prior to
the installation of these signals; and that the proposed signal'change
on Trunk Highways 55 and 61 and 11th Street be referred back to the
Safety Committee and the Minnesota Highway Department for further
study. Ayes, Councilmen Novak, Kane, Christenson,D~isc~l; Nays,
Councilmen Soleim, Hallberg, Fischer and Mayer. This resulted in a
tie vote and the Mayor was called upon to cast his vote. MayorRotty
voted aye. Motion carried.
Moved by Councilman Fischer, seconded by Councilman Novak
that the bills as audited be approve~ and the City Clerk be instructed
to issue warrants for the same. Ayes, all; Nays, none.
Moved by Councilman Novak, seconded by Councilman Fischer
that the next regular meeting of the City Council be held on Tuesday,
September 8, 1970. Ayes, all; Nays, none.
