The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, May 18, 1970 at 8:00 o'clock P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Soleim, Novak, Kane, Hallberg,
Christenson, Driscoll, Fischer, Mayer and
Mayor Rotty.

Minutes of the last meeting were read and approved.
Moved by Councilman Hallberg, seconded by Councilman Christenson
to pass the second reading of an amendment to an Ordinance entitled "AN
ORDINANCE FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, ORDER, CONVENIENCE
AND GENERAL WELFARE BY REGULATING THE USE OF LAND, THE LOCATION, SIZE, USE
AND HEIGHT OF BUILDINGS, THE ARRANGEMENT OF BUILDINGS ON LOTS, THE DENSITY
OF POPULATION AND DESIGNATING THE BOUNDARIES OF DISTRICTS FOR SAID PURPOSES
WITHIN THE CITY OF HASTINGS, MINNESOTA, ALL IN ACCORDANCE WITH A COMPREHEN-
SIVE PLAN", dated August 6, 1956 rezoning the following described property
from Residential 1 to Residential 3: Ayes, all; Nays, none.

Moved by Councilman Fischer, seconded by Councilman Driscoll
that a hearing will be held in the Council Chambers of the City Hall on
Monday, June 15, 1970 at 7:00 o'clock P.M. for the purpose of discussion
of signal lights at the junction of Highway #55 and #61 and East 11th
Street. Ayes, all; Nays, none.

Moved by Councilman Christenson, seconded by Councilman Hallberg
that a proposed Ordinance entitled "AN ORDINANCE ESTABLISHING FIRE EMER-
GENCY LINES" pass its second reading. Ayes, all; Nays, none.
Councilman Christenson introduced the following resolution and
moved its adoption:
RESOLUTION
ESTABLISHING WORKING CONDITIONS, WAGES AND HOURS
FOR FIRE DEPAR'1MENT EMPLOYEES IN THE
CITY OF HASTINGS FOR 1970
WHEREAS, the City Council feels that it is for the best interest
of the City of Hastings, the Fire Department employees, and for their de-
signated bargaining representatives, Municipal Drivers, Helpers & Public
Employees Union, Local #664, for the purpose of establishing conditions of
employment of the employees of the Fire Department and to insure a friendly
spirit of cooperation between the City, its employees, and their designated
bargaining representatives, and to avoid disruption in the service and oper-
ation of said Fire Department, and to secure the benefits intended to be
derived by the City, its employees, and their designated bargaining repre-
sentatives, to adopt the hereinafter set out rules and regulations cover-
ing the employment and working conditions of the employees of the Fire
Department.

NOW THEREFORE, BE IT RESOLVED by the City Council that the follow-
ing rules and regulations covering the employment of the employees of the
Fire Department be adopted and placed in effect as follows, to wit;
ARTICLE I
Recognition
The City hereby agrees to recognize Municipal Drivers, Helpers & Public
Employees Union, Local #664, as the bargaining representative of all employees
employed in the Fire Department.
ARTICLE II
Seniority
The City hereby does recognize seniority rights and employees shall be pro-
moted, demoted, laid off, and returned to service according to their length
of service, providing, however, that such employees qualify to perf9rm the
work, and provided further, that such employees shall not establish seniority
rights until they have passed a probationary period of six months.

ARTICLE III
Vacations
The employees shall be granted the following vacation schedule:
1 year of service 5 days vacation
2 to 5 years of service 10 days vacation
6 years of service 11 days vacation
7 years of service 12 days vacation
8 years of service 13 days vacation
9 years of service 14 days vacation
10 years of service 15 days vacation
11 years of service 16 days vacation
12 years of service 17 days vacation

All vacation pay shall be accrued, and in the event an employee's employment
is terminated for any reason, the employee shall receive, upon his termina-
tion, the vacation pay which he has coming to him at that time on a pro-rata
basis. No more than four consecutive weeks vacation can be taken at one time.

In computing vacation pay, length of service shall be based upon the anniver-
sary date of the day an employee commences employment.
All employees are to be paid their vacation pay prior to their leaving for
vacation.
ARTICLE IV
Grievances
Should any grievance arise as to the interpretation of or adherence to the
terms and provisions of this resolution, the employees affected may, either
directly or through their designated bargaining representative, take the
matter up with the department head in an effort to effect a satisfactory
settlement. If the department head and the employee are unable, to agree,
then the matter shall be referred to the designated bargaining representa-
tive, who shall endeavor to effect, a satisfactory settlement with the City
Councilor its authorized representative.
ARTICLE V
Discrimination
No employee shall be discriminated against and no employee shall be dis-
charged for giving information regarding alleged violation of this resol-
ution.
ARTICLE VI
Sick Leave and
Other Leave of Absence
All emp1Qyees of the City shall be entitled to accumulate one day of sick
leave for each month of employment and allowed accumulation of sick leave
up to one hundred twenty (120) days. Employees shall bank an additional
one-half (1/2) day per month after the accumulation of the 120 days to be
used only in cases of very prolonged illnesses. Sick leave will be granted
for actual sickness, temporary physical disability, quarantine, and death
in the immediate family. The City may require a doctor's certificate on
sick leave claims of three days or more.
ARTICLE VII
Severance Pay
If an employee retires at age 65;!or as otherwise provided by law, or is
forced to retire due to physical condition not allowing him to continue
gainful employment, but not if discharged or resigns by the request of the
City, after ten (10) years of service, they will received 35% of the unused
sick leave, based on their then current hourly rate, as severance pay. The
one-half day per month accumulated after the 120 days, will not be considered
for severance pay purposes. '

ARTICLE VIII
Hours of Employment
The regular work day shall consist of 24 hours per day. The regular work
week shall consist of an average of fifty-seven (57) hours in one (1) week.
An employee called back to work after he has completed his regular work
day or called out on his day off sah11 receive $3.00 per hour.

Wages
Assistant Fire Chief
Firemen:

$772.50 per month
$625.00 per month

$3.00 per hour for stand-by, call-back and holiday time.
ARTICLE X
Holidays
All employees shall be paid for seven (7) holidays, based on eleven (11)
hours per day, in ~ash, on December 15th of the year, regardless of number
of holidays actually' wbrKe~~"Provided, however, that for the year 1970,
as this contract is effective as of April 16, 1970, said December 15th
payment shall be for four and one-half (4~) holidays.
'ARTICLE XI
Educational Instructional Time
A m1nLmum of four (4) hours and not to' exceed eight (8) hours per day on
regular days off be granted at the regular call back rate per hour for
educational instructional time.
ARTICLE XII
Leave of Absence
Employees subpoenaed as witnesses'or called and selected for jury duty
shall receive their regular compensation and other benefits for their em-
ployment less the amount received by them as jurors or witness fees.

The City agrees to grant the necessary time off without pay to any employee
designated to attend a labor convention or to serve in any capacity on
other official union business.
ARTICLE XII I
Job Classification
The City will forthwith undertake a job classification study of the Fire
Department. At the conclusion of the study, the Union will be advised of
City findings and recommendations., 'The Union will be given an opportunity
to be heard before implementation of any recommendations arising from the
study.
ARTICLE XIV
Insurance Benefits
All regular employees will continue to be .c:overed under the hospita1-medica1-
surgical insurance,p1an adopted by the City. Full cost of employee coverage
to be paid by the City. Cost of dependent coverage to be, pa(d by the employee.
All regular employees will also receive a $5,000 Life Insurance policy with
the full cost of the premiums to. be paid by the City.
ARTICLE XV

Amendments
Amendments may be made to this resolution at any tllne by the City Council,
with the approval of Municipal Drivers, Helpers & PUblic Employees Union,
Local 11664.
ARTICLE XVI
Effective Date
This resolution shall be considered to have been in full force and effective
as of April 16, 1970j

Moved by Councilman Hallberg, seconded by Councilman Christenson
that Arnold Endres, having satisfacorily passed the written examination
for Water Works Operator, Grade D, receives a monthly wage increase of
$35.00 effective May 1, 1970. Ayes, all; Nays, none.

Moved by Councilman Fischer, seconded by Councilman Christenson
that the City Engineer be authorized to do the necessary surveying, pre-
paration of plans and specifications for construction of sanitary sewer
along the north right-of-way of Trunk Highway #55 from Maple Street to
approximately 80 feet East of Walnut Street in Ninth Street. Mr. Leonard
Bauer will assume full responsibility for all costs incurred by such
work and reimburse the City for all engineering costs at the recommended
fee schedule. Ayes, all; Nays, none.
Moved by Councilman Fischer, seconded by Councilman Hallberg
that an addendum to the advertisement for bids for bulk gasoline be pub-
lished requesting bids for both bulk delivery and station pump delivery of
premium gasoline. Bids to be opened on June 1, 1970 at 8:00 o'clock P.M.
in the Council Chambers of the City Hall.

pass the third reading of an Ordinance entitled "AN ORDINANCE OF THE CITY
OF HASTINGS SPECIFYING TYPES OF LOCKS FOR MULTIPLE DWELLINGS, HOTELS AND (.//
MOTELS, PROHIBITING CERTAIN TYPES OF LOCKS; AND MAKING VIOLATION HEREOF A
MISDEMEANOR". Ayes, all; Nays, none.
The City Council of the City of Hastings, Minnesota does ordain:

Section 1. Purpose
The purpose of this Section is to require security devices in
multiple dwellings, hotels, and motels as a safety, burglary, and theft
prevention measure.
Section 2. Definition of dead bolt lock
For the purpose of this Section, a "dead bolt lock" is a locking
bolt which, when in the locked position, can only be moved positively by
turning a knob, sliding bolt, or mechanisem activated by working a combina-
tion, except that a lock bolt moved by a skeleton-type key is excluded
from this ordinance.
Section 3. Multiple dwellings, hotels, and motels - dead bolt lock required
All multiple dwellings, hotels, and motels approved for construc-
tion after the effective date of this ordinance shall provide dead bolt locks
on all entrance doors of each dwelling unit or room, at least one of which
must be capable of being locked from the exterior.

All multiple, dwellings" hotels, and motels existing before the effective
date of this ordinance shall provide dead bolt locks on all entrance doors
of each dwelling unit or room by January 1, 1972. Locks requiring keys to
unlock doors from the inside shall not be allowed.

Responsibility for security
The owner, operator, or agent in charge of buildings covered by
this section shall be responsible for compliance with the terms and provi-
sions of this section. Violation of this Ordinance shall be a misdemeanor.
Section 5. Security enforcement
The Building Inspector or his authorized agent is authorized
and directed to administer and enforce the provisions of this section.
The Chief of Police may disapprove locking devices that do not meet the
requirements of this section.

RESOLUTION RECEIVING FINAL PLANS AND SPECIFICATIONS AND
SETTING PUBLIC HEARING ON PROPOSED IMPROVJ:;MEN,TS
WHEREAS, final plans and specificat;ions have been prepared by the
Minnesota Highway Department.with respect to tqe improvements described in
the Notice of Hearing hereinafter set forth, and
wm:REAS, the Engineer h~s advised thiS'Council that the aforesaid
improvement is feasible and should be made as proposed in the Notice of
Hearing thereon, and
WHEREAS, the Council 'considers it expedient to make the following
listed improvements,

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota, as follows:
1. Said Plans and Specifications are hereby accepted and approved.
2. Said improvements are hereby combined and designated as part
of the 1970 Improvements and shall be undertaken pursuant to
to the provisions of Chapter 429, Minnesota Statutues 1961.
3. A Public Hear~ng relative to said improyements will be held
on July 6, 1970 at 7:30 P.M. inthe,Cou~cil Chambers of the
City Hall for the consideration of said improvements, the
nature of which, the estimated cost thereof, the area pro-
posed to be assessed therefore, are described in the Notice
of Hearing which shall be in substantially the following
form and is made a part thereof.
NOTICE OF HEARING
Notice is hereby given that the City Council of the City of
Hastings, Minnesota, will meet in the Council Chambers of the City Hall at 1-1
7:30 o'clock P.M. on Monday, July 6, 1970 to consider the following im-
provements designated as part of the 1970 Improvements: _~
East 18th Street (T.H. 291), T.H. 61 to the Vermillion River
Reconstruction including street grading and stabilization,
bituminous surfacing, concrete curb, gutteT and sidewalks,
and storm drainage.
The Council proposes to assess part of the cost for such improve-
ments against every lot, piece or parcel of land abutting upon said improve-
ments according to the special benefits received without regard to cash
valuation at the rate of $3.50 per front foot.

The City Share of the cost of said improvements is $56,951.61.
Persons desiring to be heard in reference to the proposed improve-
ments may be heardat said time and place.

The City Clerk is hereby authorized and directed to cause said
notice to be given two publications in the official newspaper and to give
mailed notice to every property owner whose property is benefited by said
improvements. Such publications shall be one week apart and at least
three days shall elapse between the last publications and the date of
hearing. Mailed notice shall be given not less than 10 days before the
hearing, pursuant to provisions of Section 429.031, Minnesota Statutes
1961.
