Members present: Councilmen Soleim, Novak, Kane, Hallberg, Christenson, Driscoll, Fischer and Mayor Rotty. Members absent: None. \,....--, I Minutes of the last meeting were read and approved. All persons present were given an opportunity to be heard in reference to the rezoning. When no one appeared, the Mayor declared the public hearing closed. Councilman Soleim introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC SALE OF $285,000 IMPROVEMENT BONDS OF 1970, SERIES B BE IT RESOLVED by the City Council of the City of Hastings, Minnesota, as follows: 1. It is hereby found, determined and declared that this City should issue $285,000 Improvement Bonds of 1970, Series B to finance various improvement projects throughout the City. 2. This Council shall meet at the time and place specified in the form of notice hereinafter contained for the purpose of opening and consid- ering sealed bids for, and awarding the sale of $285,000 Improvement Bonds of 1970, Series B of said City. o 3. The City Clerk is hereby authorized and directed to cause notice of the time, place and purpose of said meeting to be published in the official newspaper of the City and in the Commercial West, as provided by law, which notice shall be in substantially the following form: NOTICE OF BOND SALE $285,000 IMPROVMENT BONDS OF 1970, SERIES B CITY OF HASTINGS DAKOTA AND WASHINGTON COUNTIES MINNESOTA These bonds will be offered on Tuesday, June 16, 1970 at 5:00 P.M. CDST, at the City Hall, Hastings, Minnesota, Dated July 1" 1970, the bonds will mature on January 1, the the years and amounts as follows: $25,000 in 1972, $30,000 in 1973-79, $25,000.in 1980-81, without right of prior redemp- tion. No rate of any interest nor the net effective average rate of the issue may exceed 7% per annum. The proceeds will be used for various im- provement projects throughout the City. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Novak and upon a vote being taken thereon, the following voted in favor thereof: Christenson, Driscoll, Fischer, Hallberg, Kane, Novak and Soleim, and the following voted against the same: None. 497 Whereupon said resolution was declared duly passed and adopted. TYPE OF BID Sea~ed bids for not less than $279,420 and accrued interest on the principal sum of $285,000 from the date of the bonds to date of delivery must be filed with the undersigned prior to time of sale, together with a certified check or cashier's check in the amountof $5,700, payable to the order of the Treasurer of the Issuer, to be forfeited as liquidated damages if bidder fails to comply with the accepted bid. I RATES All rates must be in intergra1 multiples of 5/l00 of 1% and may not exceed 7% per annum. All bonds of the same maturity must bear a single rate from date of issue to maturity. No rate of any maturity may be more than 1% lower than the highest rate carred by any of the preceding maturities. Add- itional coupons may not be used. No limitation is placed upon the number of rates which may be specified. AWARD Award will be made on the basis of lowest dollar interest cost, determined by addition of any discout to and deduction of any premium from the total 498 interest on all bonds from their date to their stated ~aturity. Moved by Councilman Kane, seconded by Councilman Driscoll that the third reading of a proposed Ordinance entitled "AN ORDINANCE SPECIFY- ING TYPES OF LOCK ACCEPTABLE FOR USE ON APARTMENT, HOTEL AND MOTEL DOORS" be held over and referred to the Safety Committee. Councilman Fischer introduced the following resolution and moved its adoption: WHEREAS, there has been established and does exist, the City of Hastings a Charter Commission, created pursuant Minnesota States Anno- r-r tated, Chapter 410; and, LJ WHEREAS, said Charter Commission pursuant to Minnesota Statutes Annotated, 4l0.3l did on the 6th day of April, 1970, recommend to the City Council for passage as a Gharter A~endme~t by Ordinance, the following proposed amendments to the Hastings City Charter: CHAPTER X Section 1. In addition. to the powers otherwise granted by Minnesota Laws and this Charterl the City of Hastings shall have the power to acquire by purchase, gift or devise, and develop, on such terms as the City Council may in its sole discretion from time to time de~erm:ine, all necessary right, title and interest in and to land, including air rights, and any buildings and equipment thereon, necessary or desireab1e for the purpose of promo- ting industry and providing employment and in order to promote, attract, encourage and develop economically sound industry and commerce through governmental action for the purpose of preventing so far so far as possible, the emergence of blight and marginal lands and areas of chronic unemployment. Section 2. The City may pay for the acquisition and development of the property acquired for the purposes and pursuant to the provisions of Sec- tion 1 above out of such funds ~s may from time to time be available and C~i' appropriated by the City Council for such purposes, including but not limited to funds acquired through the issuance of general or special obligation bonds. If the acquisition and development of lands acquired pursuant to Section 1 is paid for from the proceeds of general obligation bonds, the development of such land may includ,e provision for utility services, including water, sanitary sewers" storm sewers or other drainage faci1itites, and transportation, power: and cOij\111l,mications facilities, which are necessary and incidental to the use of such lands for the fore- going purposes, but except with respect to such facilities may not include provisions for the construction of structures or buildings on the premises or the furnishing or equipping thereof. 501 If acquisition and development are paid for from the proceeds of general obligation bonds, such bonds shall be authorized, issued, sold and accounted for in the manner and upon the terms, conditions and pro- visions prescribed by Chapter 475 Minnesota Statutes and acts amendatory thereof and supp1imenta1 thereto. The general obligation bonds authorized by this section shall not be subject to any limitation contained in this City Charter prescribing or fixing any limit upon the bonded indebtedness of this City. ----I I Section 3. Notwithstanding any other prOV1S10n of this Charter to the contrary, any properties acquired or owned by the City and not required for municipal purposes may be sold or leased without approval of the electorate to achieve the purposes set forth in Section 1 above on such terms and conditions as the City Council in its sole discretion shall determine. When such property is sold or leased to non-governmental corporations or agencies, it shall not be exempt from taxation. Section 4. Nothing contained herein shall be construed to restrict the power and authority of the City to develop, lease and sell property acquired pursuant to this chapter in accordance with the further provi- sions of Chapter 474, Minnesota Statutes, as amended or supplemented, or such other laws as may from time to time be adopted, or to restrict in any way the powers granted to the City under Chapter 474, Minnesota Statutes, and acts amendatory and supplemental thereto, or such other laws as may from time to time be adopted. and; WHEREAS, the City Council has duly scheduled and held a public hearing on the matter April 27, 1970, which public hearing was preceeded by two weeks published notice of said hearing which notice contains the text of said proposed amendment, all as required by law; and, WHEREAS, the City Council has at two prior meetings unanimously passed said Charter Amendment by Ordinance for its first and second read- ings; and, WHEREAS, said amendment clearly appears to be in the best inter- ests of the City; NOW, THEREFORE, be it reroll1ed, that the hereinbefore se,t forth amendments to the Charter be and hereby is adopted as an Amendment to the City Charter, by Ordinance, and that said Ordinance so amending the charter hereby pass its third reading, and that the same become effective upon publication and elapse of time, all as set forth in Minnesota Statutes, Annotated ,410. 31.
